Review on Research Paper : Court Management- To reduce Backlog of old pending cases and Increase rate of disposal in subordinate

Research paper shows that, Effective management controls are clearly essential to the success and well-being of Government organizations like court management. It also shows that, building effective management control procedures for such faculty it is somewhat difficult . But the author did not discuss for ADR mechanism and Juvenile Justice system though the excellent results are achieved by both systems . However, it can not be deny that, it is a good example for improving in disposal of cases and and distribution efficiency. The author did not consider hypothesis but has designed target towards selected courts. His primary object was to show effective result by introducing executive mentoring. During the Mentor sessions the author considered keys to achieve goals . He studied for making target, need of stakeholder and promote the mentees to find out a solution to their problem. His problem solving method by executive mentoring is an extraordinary method. The entire project study shows effective communication and motivation were the intangible tools to achieve goals . Review : Use of Research Study in Marketing Management The author has discussed many concepts in management but I studied Research Paper & project report in the light of Marketing Management. I found the similar concepts useful in marketing management studies, as: [1] Research Study :- The object of the judiciary is to impart justice as early. Need of speedy justice and minimize the delay in delivering justice is challenge as discussed in the project.

Marketing Management :- In marketing management also, the main objective of marketing is to produce products and services for the society as per their needs and tastes. It should be in minimum costs. [2] Research Study:- The project focused on the micro level of service operations, and on what to measure rather than on how to measure. In the project, the author gave attention to reduce backlog. Marketing Management : In the marking concept such system can be used to draw attention to service productivity and its connection to service quality and eventually to profits. [3] Research Study :- A main purpose was to implant the strategy of continuous improvements. Marketing Management : Such strategy is also useful in marketing management. [4] Research Study :- The conducted mentoring session by the author and its results as defined in tables shows the individual capital of the author. Thus it shows good example to gain the trust and confidence of the stake holders. Marketing Management : In marking management the manager has to gain customer's confidence quickly. [5] Research Study :- The author has separated courts in Pilot and Non-piloting to find out effects of the executive mentoring. Then he analysed cases qualitative and quantitative. It is a study as per the object of the project. Marketing Management : In marketing management also , the manager has to analyse market opportunities, plan for activities, implement marketing plans and setting control mechanism. [6] Research Study : On study of entire project it shows that, the author has indirectly considered study for SWOT. Marketing Management : In marketing management SWOT has to be carried out whenever it needs. [7] Research Study : The author has verified cases, boards etc. which is nothing but scanning the environment. Marketing Management : In marketing , it is necessary to analyze, gather and forecasting information related to the environment. [8] Research Study : In study, the author has followed sequential steps in his research to reduce backlog. Marketing Management : In marketing management, the manager has to carry out research study. He has to make segment, target the market.

Evaluation --- in the light of marketing management Assuming that the mentor/author is a service provider. Executive mentoring was his service. He planed, framed policy and program to determine what actually demanded to reduce the backlog. He identified the potential stakeholders. He developed strategy to get maximum rate of disposal and also gave ways to satisfy the stakeholder that, such method is beneficial for drawing performance in a systematic manner. He developed his method (service) at each mentoring session, for a certain cases, he monitor the used method . The change in the sessions shows that, the author identified the need of changes so that entire process is highly integrated effort to increase disposal rate that satisfies to reduce the backlog of old cases. He held sessions like teacher at right places, right time with right communication and promoted to the stakeholder to reduce backlog. The preliminary study and data shows that, the author compared the previous data and by showing said data, he influenced to dispose cases in legal form with provisions of law. Though there may be a ways to decide the cases by regular mode , but by conducting sessions in such fashion , the stakeholders satisfied to decide matters through the executive mentoring method. The survey for balance sheet checking shows that, the author divided the courts in to piloting and non-piloting. He divided it to measure, to access and to represent the ability of each court. He evaluated each court and finally selected courts to make entry in the planned manner. For each court working and disposal , he made attempt to increase disposal to get more result in all sectors for his applied method and created positive image in the mind of stakeholders. The entire process shows that, it is within framework as per the strategy for micro level. During the sessions the author has studied the response from the stakeholders when the process was going on and rate of disposal was increasing he concentrated towards it . The observations also shows that, two stakeholder perceived differently. Overall, it shows that, due to regular interactions with the stakeholder directly or indirectly, the backlog was reduced in an unimaginable manner . While deciding matter, the author did not suggest, how to decide particular cases . His overall monitoring was for regular court and A.D.R. By mediation and Lok Nayalaya . As I observe above that, there is no discussion for Juvenile or ADR cases disposal but it can be seen that, it is a careful plan and coordination with all stakeholders. More particularly the court of juvenile shows that, it has high level of awareness with the new method. The effective communication by author, at planning stage and execution stage shows that he continuously motivated and kept involved to the stakeholders to deep discipline. It is nothing but

due to two ways communication between them. For the assessment stage, he again communicated with them at each stage, modified the plan in some respect for next session and thus the method of author is nothing but a good example for maintenance relationship between stakeholders. In the entire project, the effect of computerized system and software for court is not discussed. The limitation clause speaks the reason. If author could get opportunity on computerization, then definitely he could study for separate desktop for each line functioning and staff functioning servants. Such continuous and close monitoring might be useful to alert the litigants through Internet media ( like private companies are using to alert customers by way of sms, email and other electronic mode). Evaluation --- in the light of court management The Research Study speaks that, judge has to also deals with administrative role. He has to schedule the cases for hearing, time management, controlling adjournments. In short he has to more concentrate over judicial management. Research Study speaks that, if there is no proper cause list so due to overloaded cases, the work can not be carried out smoothly. In fact the work of judge is judicial work. He should not be engaged in work that can be performed by court staff or by other officers. This duty has to be performed by manager by his management task/skill. The study focused on the courts' personnel management, including structural arrangements, staffing, selection and appointment, performance evaluation, training and promotion procedures, status of court employees. Research findings have observed need of development in the major areas of court administration. Efficient court management become a need in judicial system to reduce backlog and delay in justice. Discussed National Court Management System Policy and Action plan , Maharashtra Court managers rules, shows that, the core functions are are necessary. In the research report the author studied for Case flow management, Case Load management, Line functioning and staff functioning, management of records and information systems, personal management. The work of court manager is also like any other manager which involves planning and organizing activities, providing staff support, help in recruitment transfer and promotion of the staff, giving directions and monitoring performance. For doing all these task the manager must possess technical , interpersonal and conceptual skill. Though it is not discussed but it also shows that there is need of in housekeeping such as, security, cleaning premises, building maintenance supervision ( including court buildings and residential quarters). In fact, court management is a complex subject. The court administration and administration of other fields is somewhat different. Internal administration of court management is not simple. So

it is to learn this aspect it will be necessary to attain formal formal class room instructions and study in the courts including study of judicial system. Manager should be aware about court environment like kinds of cases, documents, works of staff (duty lists), all returns, civil and criminal manual, other manuals, staffing pattern, compendium. They will have to visit courts, attend meetings, Legal aid work, computer room (e-court-project) knowledge. They should know other administrative agencies related to court like Police machinery, collector, public work department, government hospital, government Treasury. Thus it shows that, court manager should possess good leadership style to enhance interpersonal skills to understand the judicial system. The project shows that, those who wants to be court manager, has to study all aspects and prepare study report , then join seminars where the exchange of experience of other court management scholar's study report is available. Conclusion For Court Management :- Entire process shows that, by ethical way author suggested to see alternative /additional way ( like execute mentoring ) to reduce backlog of old cases by regular court and by way of ADR system. The research report was was combined with personal observations and consultations with stakeholders. As a result, discrepancies were identified. If used regularly by courts, this survey can potentially serve as a tool to measure the performance of courts and identify measures to be taken for administrative improvements such as enhancing the court management. The court system needs to function as a unified administrative and management system, especially in the subordinate courts . For Marketing Management : It gives way to think , what tasks necessary for successful

marketing management. It gives clear understanding for process, Marketers, what is being marketed, target market. The logic is useful for Attracting , developing, retaining customers and to achieve goals to maximize consumption, maximize consumer satisfaction. The Research Study may be contributions in the field of Marketing Management study and court management.
