On December 17th, Britain's highest court, the Law Lord's of the House of Lords,
ruled there is no legal bar to the extradition of Khaled Al Fawwaz, Ibrahim Eidarous
and Adel Abdel Bary from England to the United States to face murder and
conspiracy charges relating to their roles in the 1998 bombings of the United States
Embassies in Kenya and Tanzania. The near simultaneous bombings killed 224
people and wounded over 5,000 others. The three men have also been named, along
with 14 others, in a federal indictment filed in the United States District Court for the
Southern District in Manhattan with being members of Usama Bin Laden's Al Qaeda
terrorist network and for their roles in supporting his terror network in England. The
charges could result in the death penalty for the three men. Among the ev.dence
presented in the latest extradition proceeding was a fax sent to London from an Al
Oaeda official before the bombings, explaining how Al Qaeda should claim
responsibility for the attacks after they occur. The fax was addressed to Al Fawwaz
and the fingerprints of both Eidarous and Abdel Bary were found on the document.
The three men were arrested in England in 1999 and have been fighting an American
extradition request in the British legal system for the last three years. The next step in
the process is for British Home Secretary David Blunkett to draft a formal extradition
order Then Al Fawwaz and his two associates can go back to court and challenge
that order, setting off another round of appeals through the British courts. After this
ast attempt to avoid extradition is exhausted, the three men can still challenge the
^tradition in the European Court of Human Rights in Strasbourg Austria. These
appeals could delay the extradition another year or more. The member nations of the
European Union consider the death penalty a violation of fundamental human rights
and could demand the United States agree not to seek the death penahy for the three
men before allowing extradition. The specter of secret military trials for suspected
^onsts has also been a source of friction between the United States and the
European Union. The European Parliament, speaking-for the 15 member nations of
the European Union, issued a resolution saying no extraditions will be allowed from
any member country unless the United States agrees the suspect will not be subject to
fe feath Penalty or to secret military trials. The three men will most likely be tried
^New York City at the United States District Court for the Southern District. Four
other defendants from the Embassy bombings were convicted in May of this year and
sentenced to life in prison on October 18 .
