EMPLOYMENT CONTRACT
Name : PULUNG Rank : BOSUN Vessel : SYMPHONY 5 Date of : 09.04.2013 Commencement We are pleased to confirm your appointment as BOSUN on board the Tug SYMPHONY 5 or any of Companys vessels as the management may deem fit. Salary : USD 1,000 pm *Salary (100%) - To commence on signing onboard vessel *Salary (50%) - To commence from the day the crew departs home port. *Salary The last day salary is the day the crew disembarks from the ship. ------------------------------------------------------------------------------------------------------------------------------------------------TERMS AND CONDITIONS OF SERVICE 1. 1.1 PARTIES AND APPLICATION OF AGREEMENT The provisions of this Employment Agreement shall regulate the terms and conditions of Employment of the Seafarer serving on any Vessel nominated by the Company. Company means REGULUS SHIP SERVICES PTE LTD or the Managers of the vessel on which the Seaman will serve pursuant to this Agreement and who employs the Seaman. Seaman means the named crew. Vessel(s) means any vessel(s) managed, operated or chartered by which the Seaman may serve.

The employment is valid for trading worldwide. DURATION OF EMPLOYMENT You are engaged for a period of (6) SIX Months (+1 month), which may be extended with the approval from Company. The employment shall automatically terminate upon the seafarer being relieved onboard. The Seaman who wish to be relieved, must give 30 (thirty) days written notice to enable his relief to be appointed and join the vessel. The Owners/Managers reserve the right to terminate the employment up to 30 days in advance or later of the contract period for the convenience of repatriation, at the Owners/Managers option. PROBATIONARY PERIOD For all new recruits to the Company, the first 2 months in the Letter of Employment shall be considered a Probationary period. During the Probationary period: a) b) If not satisfied with Seaman performances, the Company may terminate the employment of the New Entrants without notice and paying accrued wages on the date of signing off. The Seaman may terminate his employment by giving 30(thirty) days written notice to enable his relief to be appointed and join the vessel at its next convenient port of call. The Seaman shall be liable for and pay his own repatriation expenses, plus cost of his replacement.

4.

WORKING HOURS Normal working time will be 10 hours per day including Saturday & Sunday. However, if at the discretion of the Master, and for Operational reasons, overtime work is required, you will perform any such work without any additional payment over and above the salary.

TERMINATION If the Seaman decides to terminate his Employment contract prior to expiration of the service period the seaman must give to the Master a written and signed resignation letter 30 days in advance countersigned by head of the department, stating the reason for resignation and his agreement to allow his repatriation expenses including air fares and agents expenses and fees, and substitutes joining expenses to be deducted from the balance due to him. In case the seamans balance of wages is not sufficient to pay the above expenses, then the Company has right to reject his resignation until the seamans credit balance becomes sufficient to cover fully the expenses. If, due to circumstances involving no fault of your own (E.g. ship has been wrecked, sold, laid up or crew management changed), it becomes necessary to terminate your employment before the date contemplated in the agreement, you will be given one months notice in writing or one months basic wages in lieu thereof, and free repatriation to point of hire. However no severance pay would be payable if relieved after serving on board for three months. However, where there are arrangements for the seaman to be transferred as per clause 9 no severance pay shall be payable. Should the seaman refuse to continue his service when offered employment on another ship of the same management at the same rating and wages, for the remaining contract, he shall be liable to pay his own repatriation expenses and air fares as well as the agents fees and expenses and substitutes joinin g expenses. The Company may terminate a Seamans employment without notice and without further liability on its part and Seaman to pay for his repatriation costs, if any Seafarer endangers the safety of the vessel or himself or his colleagues, or exhibit a lack of competence which is inconsistent with his qualifications or is found to have presented fraudulent certificates/documents, or is in breach of the Companys drug and alcohol policy or in case of gross negligence or gross misconduct, or is guilty of any serious or persistent breach of Contract, unwillingness to work, refusal and/or failure to follow instructions of superiors, staging a strike or stoppage of work, causing trouble, being found in possession of dangerous weapons, inefficiency in his rank, desertion, and insubordination. You will receive wages only up to and including the day of termination of your service and you will liable for all the expenses towards your repatriation and relief expenses and for all costs and/or losses incurred. REPATRIATION The Seaman shall be entitled to be repatriated at the Companys expense, either to his home country or to the place of his original engagement as indicated in Letter of Employment: a) b) c) After the number of months of continuous service onboard as stated in the Letter of Employment. COMPENSATION The company will arrange necessary P & I cover to provide for medical expenses of the Seaman during actual service, not including your leave, provided any sickness or injury involved was contracted while upon Companys business and was not self -influenced nor due to your own fault or negligence, or under the influence of alcohol, drugs etc.

7.1 (a) The Company shall not bear any of the following :- cost of Dental or Optical appliances - expenses arising out of any illness or disease caused by misconduct - expenses for blood test for Venereal Disease

The seaman is entitled to receive compensation benefits according to the laws of the seamans own country for any injury, illness or death attributed to his engagement on board the vessel unless such injury, illness or death occurred due to the negligence of the seaman, in which case, no compensation benefits whatsoever are payable to the seaman. Transportation of the seamans remains and property, in case of death, to the point of hire at the expense of the Owner, or if not possible under the circumstances, the proper disposition thereof upon previous arrangements with the seamans next of kin or disposition of remains in accordance with the international procedures of burial at sea are guaranteed.

SALARY & PAYROLL You will be paid in US Dollars. Payment of cash on board is generally discouraged and will only be considered for emergency. A Portage Bill will be provided to the vessel where you are serving at the beginning of every month. This will be showing crew earnings for the previous. This must be signed as acknowledgement of acceptance and returned to the office. An Account of Wages will be provided to you when you are signing off from the vessel. Account of Wages is a consolidation of your earnings as shown in previous Portage Bills. USD 500 will be given during Sign Off as cash advance and will be deducted from your balance wages. Your final Accounts of Wages will be remitted to your Bank account.

Allotment Advise On joining vessel, you must give your allotment instructions. Cost of telex transfer and bank charges are to the employees account. On every 25th of the month, EXCEPT for FILIPINO CREW, all other crew MUST inform to the Master the amount that you required to be remitted. All Filipino crew are required to make arrangements to remit at least 80% of your wages every month to your nominated bank according to POEA Rules.

Retention US$ 500.00 (Five Hundred) for Ratings will be retained from your 1st month salary US$ 750.00 (Seven Hundred Fifty) for Officers will be retained from your 1st month salary The retention is to cover administrative costs should you resign or be terminated before completion of your Contract Term. The retention will be held in reserve until you have completed your Contract Term with the Company and will be settled with the final Account of Wages.

Cash Advance Cash advance can be made to crew once per month subject to a maximum of 20% of your monthly wages when the vessel is in port where crew can utilize the money for their personal requirements. You will be advised the amount that can be made available towards it after deductions such as home allotment, etc.

8.7

Joining Expenses On travel to duty, you are required to travel by the most economical means of transport between your home town and the vessel, if you expect your expenses to be reimbursed by the Company. Expenses must be claimed within 45 days and be supported by original verifiable receipts.

You will be responsible for all personal taxation whether of an income or capital nature, which may be from time to time levied upon you by your resident country of origin. In the event that the company pays such taxes on your behalf, you agree to indemnify the company against all such payments it may make in respect thereof. It will be your own responsibility to ensure, if required by any Government or recognized authority of your resident country, to remit any portion of your earnings to the State/Authority in question. 9. SICK PAY If the Seaman is declared medically unfit and signs off due to sickness or injury sustained onboard during his Contract, his wages shall continue until he has been repatriated at the Companys expense and has arrived at his home or place of original engagement or he declines repatriation. Transfer The Owners/Managers have the right to transfer the seaman to other vessel or vessels under the same management provided that this agreement will continue to be in force in the new ship without any revisions. All travelling expenses for such transfer will be for the account of the vessel/ship owner. In case the seaman disagrees, the agreement is automatically terminated at his own risk and the seaman agrees to pay his own repatriation cost including air fares and agents fees and expenses and substitutes joining expenses. 10. You are required to comply with all the rules of the company and all safety precautions have to be taken on board the vessel as per the company rules. You are strictly instructed to follow Companys Alcohol and Drug Policy, whereby possessing, consumption, trading on board the vessel, any alcohol and/ or drugs is a very serious offence and liable to instant termination of contract and dismissal from Vessel. The seaman agrees that he shall pay transportation fare for excess weight in his luggage over and beyond that normally allowed by the carrier. You will be required to wear the companys Coveralls & PPE while on board the vessel during the period of this contract. The Company will supply 2 Coveralls, a pair of Safety Shoes & PPE as applicable. You will be required to obtain at your own expenses, the necessary documents (like Licenses and Seaman Identification Books, Passport, STCW95, Certificates etc) required for your rank depending upon the flag of the ship. The company may apply and obtain the required documents in compliance with the flag administration requirement. The cost for the documents shall be deducted from your salary. The original document shall be handed to the crew onboard. Signing of this Contract binds you to sign the appropriate Articles of Agreement of the ship to which you may be appointed from time to time by the Company. HSE DECLARATION

I am personally responsible for all consequences (all cost, fines, charges claims for damages etc) as the Owners of the vessel may have to face as a result of my committing a drug crime. My contract of employment is immediately cancelled & repatriation costs, fines etc, will be borne by me if I have committed a drug crime.
