He employs Strong Contractor to carry out and complete the construction of the project. In the course of the construction, Clever Architect charges Strong Contractor for all drawings and plans supplied to the contractor for the purpose of the construction. Strong Contractor concedes to the demand so as not to delay his progress and serves a protest notice to Smart Developer. Clever Architect contends that it is a custom in construction industry that contractors should pay for all drawings and plans supplied to them. Smart Developer is unhappy with Clever Architects performance and serves a notice terminating his engagement after thirty days from the date of the notice. However, Clever Architect argues that the thirty day notice is not valid. He asserts that it is the custom in the architectural services that the notice should be minimum sixty days. When Strong Contractor completes the construction and is leaving the site, he dismantles and removes the site office. Smart Developer objects the contractors action and insists that the site office be reinstalled. You are required to identify the issues in the above case and advise the three parties accordingly. Maxis sends out letters to contractors inviting them to submit quotations for the construction of his bungalow. The letters indicate that the job will awarded to the contractor that submits the lowest quotation. All quotations should be submitted to Maxis office on or before 4.00 pm 30 July 2012. Celcom Builder submits two quotations: one, based on fixed price lump sum and the other on cost plus basis. On the last submission date Maxis instructs the chief consultant to close the biddings at 12.00 pm. Digi Contractor submits his tender at 3.00 pm. The tender analysis report reveals that Celcom Builder quotations are the first lowest (the fixed price) and the third lowest (the cost plus). However, Maxis awards the contract to his sister-in-law, Gigy Enterprise, the second lowest bidder. It appears that Gigy Enterprise makes a mistake in her bid: instead of RM643,500.00, the quotation is RM436,500.00. As soon as she realises her mistake, she instantly dispatches a notice to Maxis, revoking the quotation. However, immediately thereafter, she receives a facsimile from Maxis awarding the work to her. You are required to: 1) Identify the issues that arise in the above case; 2) Discuss the legal positions of those issues; and 3) Advise the parties accordingly. En. Question
Discuss the application of the principles of indefeasibility of title in Malaysia. Ali and David are registered proprietors of Land Office title lands. Ali, owner servient land grants an easement to David, the dominant land owner, allowing him access to his land from the main road. Subsequently, David sells his land to Daud. The new owner executes Form 16A and submits it to Maya Bank to create a charge as security for a loan. In February 2004 Ali grants tenancy of his house to Ahmad for as long as he wishes. Ahmad then lodges a caveat on the land and blocks the access lane to Dauds land. In August 2004 Ali sells his land to Arman who subsequently notifies Ahmad to move out of the house within one month from the date of the notice. At the same time Ali sends a claim to Ahmad for expenses that he incurs in payment of the quit rent to the State Authority as well as the assessment rate to the Local Authority for the duration of the tenancy period. The Registrar of Titles notifies Arman that the application for transfer of title could not be executed because of the caveat lodges by Ahmad. Daud fails to pay the bank loan and the Bank serves Form 16E notice to and applies to the High Court for permission to sell off the land. Daud objects the service of the Form 16E and informs the bank that he prefers that it takes possession of the land. When Daud examine the RDT he discovers that the charge is never registered. You notice that Daud, Ahmad and Arman and Maya Bank are very confused about the law and the procedures for the transactions that they have executed. Advise Ahmad, Daud and Arman and Maya Bank on the legal positions of the issues that they are facing.
