Chief Law Officer of the Executive Council (s. 5(a))


The role of chief la! officer might be referred to as the Attorney 'eneralLs o"erall responsibility as the independent legal ad"isor to the Cabinet - and some ha"e e"en suggested that the role possibly extends to the $egislature as !ell& The importance of the independence of the role is fundamental to the position and !ell established in common la!1 statutes and tradition& As chief la! officer1 the Attorney 'eneral has a special responsibility to be the guardian of that most elusi"e concept - the rule of la!& The rule of la! is a !ell established legal principle1 but hard to easily define& %t is the rule of la! that protects indi"iduals1 and society as a !hole1 from arbitrary measures and safeguards personal liberties& The Attorney 'eneral has a special role to play in ad"ising Cabinet to ensure the rule of la! is maintained and that Cabinet actions are legally and constitutionally "alid& %n pro"iding such ad"ice it is important to -eep in mind the distinction bet!een the Attorney 'eneralLs policy ad"ice and preference and the legal ad"ice being presented to Cabinet& The Attorney 'eneralLs legal ad"ice or constitutional ad"ice should not be lightly disregarded& The Attorney 'eneralLs policy ad"ice has the same !eight as that of other ministers&

Criminal prosecutions (s.5(d))


Tne of the most publicly scrutini?ed aspects of the Attorney 'eneralLs role is the responsibility for criminal prosecutions encompassed in section = 7d9 and s& 4< of the Constitution Act1 (3AC& Section 4< gi"es the pro"inces authority to legislate in matters related to the administration of criminal :ustice and thereby gi"es the pro"incial Attorney 'eneral authority to prosecute offences under the Criminal Code& The Attorney 'eneral does not1 ho!e"er1 direct or cause charges to be laid& While the Attorney 'eneral and the Attorney 'eneralLs agents may pro"ide legal ad"ice to the police1 the ultimate decision !hether or not to lay charges is for the police& Tnce the charge is laid the decision as to !hether the prosecution should proceed1 and in !hat manner1 is for the Attorney 'eneral and the Cro!n Attorney& %t is no! an accepted and important constitutional principle that the Attorney 'eneral must carry out the @inisterLs criminal prosecution responsibilities independent of Cabinet and of any partisan political pressures& The Attorney 'eneralLs responsibility for indi"idual criminal prosecutions must be underta-en - and seen to be underta-en - on strictly ob:ecti"e and legal criteria1 free of any political considerations& Whether to initiate or stay a criminal proceeding is not an issue of go"ernment policy& This responsibility has been characteri?ed as a matter of the Attorney 'eneral acting as the VueenLs Attorney - not as a @inister of the go"ernment of the day& )5

This is not to suggest that decisions regarding criminal prosecutions are made in a complete "acuum& A !ide range of policy considerations may be !eighed in executing this responsibility1 and the Attorney 'eneral may choose to consult the Cabinet on some of these considerations& Do!e"er any decisions relating to the conduct of indi"idual prosecutions must be the Attorney 'eneralLs alone and independent of the traditional Cabinet decision ma-ing process& %n practice1 in the "ast ma:ority of cases1 these decisions are made by the Attorney 'eneralLs agents1 the Cro!n Attorneys& An important part of the Cro!nLs - and thus the Attorney 'eneralLs - responsibility in conducting criminal prosecutions is associated !ith the responsibility to represent the public interest - !hich includes not only the community as a !hole and the "ictim1 but also the accused& The Cro!n has a distinct responsibility to the court to present all the credible e"idence a"ailable&

Legislative Responsibilities (s. 5(e) and (f))


The Attorney 'eneral has broad responsibilities associated !ith 'o"ernment legislation& These responsibilities ha"e been described as t!ofold& Tne is to o"ersee that all legislati"e enactments are in accordance !ith principles of natural :ustice and ci"il rights 7see also s& =7b9 abo"e9& This is ob"iously an important and broad area of responsibility& The second aspect of this responsibility is to ad"ise on the constitutionality and legality of legislation& The Attorney 'eneralLs legislati"e responsibilities are played out in a "ariety roles& The Tffice of $egislati"e Counsel reports to the Attorney 'eneral& $egislati"e Counsel plays a -ey role in ensuring the legal integrity of 'o"ernment legislation& Although the $egislati"e CounselLs reporting relationship to the Attorney 'eneral does allo! the Attorney 'eneral to pro"ide guidance and set standards1 indi"idual pieces of legislation are drafted on instructions from client ministries and are not !ithin the sole control of $egislati"e Counsel or the Attorney 'eneral& %t should also be noted that $egislati"e Counsel also has a direct responsibility to the $egislature as the Tffice also drafts all pri"ate memberLs bills& )=

Civil Litigation (s.5(h) and (d))


%n addition to the specific responsibilities to conduct ci"il litigation on behalf of the 'o"ernment and its agencies 7s& =7h991 the Attorney 'eneral has broader litigation responsibilities flo!ing from the historical po!ers of the Attorney 'eneral referred to in s& =7d9 of the Act& These po!ers are based on the Cro!nLs parens patriae 7parental9 authority& The Attorney 'eneralLs authority1 therefore1 is not only to conduct litigation in cases directly affecting the go"ernment or its agencies but also to litigate cases !here there is a clear matter of public interest or public rights at sta-e& This has been characteri?ed as a constitutional responsibility to ensure that the public interest is !ell and independently represented& %t may in"ol"e inter"entions in pri"ate litigation or Charter challenges to legislation1 e"en if the arguments conclude that the legislation does contra"ene constitutionally protected rights&
