Cybercrimes under Philippine Law JJ Disini


The new Cybercrime Law expanded the definition of cybercrimes and refined the extent of liability. The Law incorporates not only existing cybercrimes under the E-Commerce Act but also those under all other special laws. This session is designed to explain the different types of cybercrimes and provide insight as to how liability can be determined under the new structure of Philippine Cybercrime law.

Cybercrime investigation and prosecution will be greatly strengthened if the Philippines accedes to the Cybercrime Treaty or the Budapest Convention. This session will discuss the details of the treaty and the means by which it will aid in combating cybercrime in the Philippines.

Privacy under Philippine Law JJ Disini


Privacy is a concept that exists in the Constitution, the Civil Code and even the Penal Code. But it is an elusive concept that covers the right to use contraceptives, the resistance of State intrusions into ones home, and the limitations upon State surveillance of its own citizens. This session traces the history and boundaries of Philippine privacy law as it relates to physical spaces, personal choices, and control of information.

The Data Privacy Act is an all-encompassing law that affects more businesses than generally believed. All customer information, 201 files, marketing materials, computer logs and other forms of personal information are all covered and regulated. And it also covers information processed and collected by all government agencies. This means the use, disclosure and processing of these information fall within the ambit of the new law. Although not widely known, the Data Privacy Act imposes obligations upon most businesses and violations will result in criminal liability. This session will attempt to unravel the complex provisions of the law and provide guidance in ensuring compliance with the Data Privacy Act.
