Upon consideration of the motion of plaintiffs for injunctive relief, the response of the defendant, this Court has found and concluded, for thespecificreasonsrequiredunderFederal Rule ofCivilProcedure65(d)thatplaintiffshaveshown(1)alikelihoodofsuccessonthemerits on at least some of their claims, (2) that they will suffer irreparable harm if an injunction is not issued, and (3) that the balance of harms and the public interest weigh in favor of granting the preliminary injunction. Specifically, the Court finds, that as appliedtothePlaintiffsandtheclass they represent, Texas Family Code Title 1 Subtitle A Chapter 2SubchapterASection 2.001 (b) and Article 1, Sec. 32 ofthe TexasConstitution,violate rightssecuredbytheFirst and Fourteenth Amendments to the United States Constitution in that each restricts the otherwise legally eligible plaintiffs from participatinginthestateregulatedinstitution ofmarriage, solely on the basis of their respective sexes, thereby treating them differently than oppositesex couples seeking to exercise their fundamental right to participate in the same sateregulated

institution. There is insufficient state interest tojustify thissinglingoutofsamesexcouples,given thesevereharmitimposesontheplaintiffsandothersintheclass. THEREFORE, it is hereby ORDERED that the MOTION FOR TEMPORARY RESTRAINING ORDER AND PRELIMINARY INJUNCTION is GRANTED and defendants Texas Governor Rick Perry, Texas Attorney GeneralGregAbbott,TarrantCounty Clerk Mary Louise Garcia, and their officers, agents, servants, employees, and attorneys, and those persons inactiveconcertorparticipationwithdefendantswhoreceiveactualnoticeofthis Order, are PRELIMINARILY ENJOINED from enforcing Texas Family Code Title 1 Subtitle A Chapter 2SubchapterASection2.001(b) andArticle1,Sec.32oftheTexas Constitution as applied to samesex couples seeking license to participate in the institution of marriageassanctionedbythegovernmentoftheStateofTexas. PlaintiffsshallpostBondof$1.00 ITISSOORDERED.
