TERMS AND CONDITIONS
1. Allotment shall be made on the basis of highest bid received in sealed bid auction. n case of tie between
two or more parties, allotment shall be made through Drawof Lots.
2. Only permanent residents of J&KState shall be eligible to participate in the auction.
3. The site shall be leased out on "As is where is basis". However site plan of the site can be seen
from the office of the Chief Town Planner, JDAon all working day during office hours.
4. Each bid must be accompanied with an earnest money amounting to 10% of the minimum
reserve price in the shape of DDduly pledged to Vice Chairman, JDA. n case the bidder backs out t h e e a r n e s t
money shall be forfeited.
5. The bids shall be received in sealed cover by Speed Post/Regd. Post only, so as to reach the
office of the Vice Chairman, JDAon or before 10th. of Sept. 2013 upto 2 p.m. Bids sent by hand or courier wiII
not be accepted.
6. The highest bidder shall be required to deposit 50% of the premium within 30 days from the d a t e o f i s s u e o f
allotment letter and balance payment within 60 days thereafter. Earnest money shall be adjusted towards the last
installment. Failure in the payment of 1st installment shall result in cancellation of allotment and forfeiture of earnest
money. Maximum grace period of 3 months can be allowed for payment of 2nd. installment, subject to
the payment of penalty @ 18% p.a. of balance amount. f default goes beyond grace period, allotment shall be
cancelled and earnest money forfeited at the sole discretion of VC, JDA.
7. The highest bidder if deposits full premium within 30 days from the date of date of issue of Lo, he/she will
be given rebate of 1% of the total premium.
8. f the bid is less than the minimum reserve price, the earnest money deposited by the bidder will be
forfeited.
9. Lease deed shall be executed with the allottee for a period of 40 years to begin with.
10. The possession of the shop site shall be handed over only after payment of full premium. Beside premium ground
rent @ Rs. 3/- per s ft. p.m. shall also be charged from the allottee from the date of handing over the possession of
the site or 60 days from the date of execution of lease deed which ever is earlier. Rent shall be subject to an upward
revision of 10% after every 3 years.
11. The shop site shall be utilised for commercial purposes only.
12. VC, JDAreserves the right to extend/postpone or cancell the auction without assigning any reason thereof. n case
of any dispute before or after issue of Lo/ allotment letter, decision of JDAwill be final and JDA will refund the bid
amount along with simple interest.
13. Cost of stamp duty, registration of lease deed or any other incidental charges whatsoever levied by the
Govt./Local Bodies shall be paid by the lessee.
14. The lessee shall not further sub-let or dispose of allotted space without the permission of the Authority and
on payment of transfer charges as JDAmay decide.
15. Applicants are requested to give complete postal address and contact number. Any communication sent
at the given address shall be deemed to have been received.
