I refer to your Application for Extension of Time to lodge the Association's Annual summary of
financial affairs submitted on 16/08/2013. NSW Fair Trading has approved the Association's request
for an extension of time.
The association is required to have its accounts audited as required by the Act and to call another
general meeting to present those audited accounts to the members. Following this meeting the
committee is required to lodge a new Form A12 relating to this meeting and attach a copy of the
audit accounts.
The Annual summary of financial affairs for the financial year ending 31/12/2012 will need to be
lodged no later than 15/11/2013.
As the association has lodged 2 previous extensions of time applications for prior years, no further
extensions will be granted.
It is also noted that the association has not lodged an Annual summary of financial affairs and
audited accounts for the financial year ending 3111212011.

the Association's annual summary of financial affairs for financial year ended 30 December
2011. Please arrange for the correspondence to be provided to the committee at the earliest
opportunity.

properly executed and returned to Fair Trading before 21 August 2013.
Additionally, I take this opportunity to remind the committee the annual general meeting in

Thank you for your email to me on 1 July 2013 attaching the front page of the Associations
annual summary of financial affairs for the financial period 30 December 2011 and the last
page with the credit card details.
Emails from Registry Services have been sent to you in the past week and telephone
messages have been left advising that the second page of the A 12 has not been received
and therefore the document cannot be accepted for lodgement. I have enclosed a copy of
the documents that were scanned and attached to your email being the first page and fourth
pages of an A12.
The second page must be completed including the declaration by the person lodging the
document and returned to Registry Services. I have enclosed a blank A 12 for your
assistance,
I also note the Association would now have held its AGM for the financial year ended 31
December 2012 and the annual summary is due for lodgement. Could you please arrange for
the Association to submit this document as soon as possible if this has not already occurred.

NSW Fair Trading is currently undertaking a review of all incorporated associations required
to report as Tier 1 associations under the Associations Incorporation Act 2009 that are in
breach of the financial reporting requirements under the Act.
This review indicates you are the current recorded public officer of this association. The
review also indicates that this association has failed to lodge the required Annual summary of
This is a breach of section 45 of the Act, which provides for penalties for each breach, of up
to a maximum of 5 penalty paints or $550, where prosecution is successful.
Further, section 76 of the Act also provides that Fair Trading can take action to cancel the
registration of an association on a number of grounds, including where during the last 3
financial years an association has not lodged an Annual summary of financial affairs.
Action required: The Association is required to lodge the outstanding Annual summaries of
financial affairs for the Association (Form A12 - available on the Fair Trading website) by no
later than 17 July 2013 together with the prescribed fees of $84.00 for each year, which
includes the requisite late fees. Failure to do so will result in further compliance action being
initiated.
If you have lodged prior to receiving this letter or have an approved extension of time in
which to lodge no further action is required from you.

NSW Fair Trading's original determination and the internal review decision provide
reasons as to why the Association's current name Is unacceptable. These include:
• its message Is anti-vaccination;
• Its name does not reflect the antl-vaccinatlon message or its true nature, objects or
functions; and
• its name Is likely to mislead the public.
The Association has requested that I review a list of names and advise as to which names
Applications for reservation of name and Applications for approval for ohange of name as
Information in relation to lodging an Application for rssG/vat/on of name (Form A1) and an
Application for approval of ohange of name (Form A7) following approval by members by
special resolution Is available on the Fair Trading website (www.falrtrading.nsw.gov.au).
Importantly however, any name change being considered by the Association (including
those listed in your letter) should take Into consideration the reasons why the change Is
required, and avoid misleading the public as to the message, true nature, objects or
functions of the Association,
In this regard, you are reminded the Association was advised on 14 January 2013 In the
direction to change its name that if an Application for approval of change of name is not
