AGGREMENT FOR SUB-CONTRACT

To Mr. Bapi Chakrobortoy S/o Sunil Chakrobortoy South Rathkhola Naxalbari Sub:- Contract of the work Constriction of Aaginwadi center in Phansidewa Block for 6 center at Khataldangi, Factory line, Girja line, Gota line, Hatkhola, Raikota. Sir, With reference to above mention sub contractual work is pleased to place the letter of award for Constriction of Aaginwadi Center in Phansidewa Block, for 6 centers at Khataldangi, Factory line, Girja line, Gota line, Hatkhola, Raikota. Amounting to Rs. 1,80,000/- (one lakh eighty thousand only) per building. As per enclosed Schedule and Centre and terms and Conditions mentioned hereunder:-

1. Condition of the contract in case of any discrepancies confect or inconsistency the provisions of the condition of this order will prevail. 2. The work should be start within 7 days from the signing of the agreement; else the agreement will be void/cancel. 3. Cost: - The total cost of the work is Rs.1,80,000/- * 6 = 10,80,000/- (ten lakh eighty thousand only) for total 6 centers. The rates are firm and final in all respect and shall allow no variation on his account. 4. Completion of works: - The entire work covered under the scope of work shall be completed with in 2 (two) months. 5. Technical Specification: - The work shall be carried our as per the enclosed annexure-1 & under overall direction of the Engineer-in-charge/Department schedule (Office of the District Magistrate). 6. Terms of payment:- Payment shall be made after completion of 3 (three) center, as 1st R.A. Bill, after 10days on submission of R.A. Bill and rest will be paid along with final bill. 7. Security Deposit: - 5% will be deducted from each bill & will be release after completion of total centre. 8. Materials: - The sub-contractor at their own cost shall arrange all materials required for due completion of the work. 9. T&P/Machinery/Equipment: - The sub-contract himself at their own will arrange all the T&P, Machinery and Equipments for the work. Water &electricity required for the work shall be arranged by the sub-contractor at his own cost. 10. Penalty: - If the work is not competed within stipulated completion period. Compensation for delay in compaction of work will be charged @1/2% per week subject to maximum of 5% of the total value of this work order. 11. Defect & Liability Period: - The work shall be covered for defect liabilities 6(six) months from the date of completion of the entire work under the contract. 12. Security Deposit: - Security deposit @05% form each final Account bills shall be deducted and the same would be released on expiry of defect liability period. 13. Arbitration: - In case of any dispute between the contractor and the sub-contractor during the execution of the works the same shall be referred to the Sole Arbitrator by the Main Contractor (Sumit Sarkar) Siliguri whose decision in all such matter will be binding and final on both the parties. 14. The work should be carried out very carefully and during the execution of work it shall be ensured that there should not be any damage/ theft/ dismantling/ accident/ misshappening of any man, materials, structure, building and installations. In case of any damage, theft, dismantling, discoloring, accident, miss-happening of any man, materials, structure, building and installations and surrounding areas, the sub-contractor shall be fully responsible and make the same good tied of cost.
