5/24/2013 4:37 PM SITE VISIT REVISC ** VISIT LOCATION TODAY AND BUSINESS WAS OPEN. THERE WAS SIGNS ALONG THE ROADSIDE STATING CHINA MASSAGE WITH THE TELEPHONE NUMBER. TALK TO OWNER (EMILY) LAN FEN ZHOU REGARDING ONE OF THE EMPLOYEE WITH A STATE MASSAGE LICENSE BUT NO NCDMV ID OR DRIVERS LICENSE. EXPLAIN SHE WILL NOT BE EMPLOYED UNITIL SHE IS PROPERLY CREDENTIALED. OWNER STATED THAT THE EMPLOYEE IS GOING TO DMV TODAY AND SHE UNDERSTANDS. ALSO NOTICE SEVERAL OTHER NC STATE MASSAGE CERTIFICATION UP ON THE WALL WHILE AT THE LOCATION. ** CONTACTED EMILY REGARDING GPD APPROVED AND UNAPPROVED EMPLOYEE. MS CAME IN PAID LICENSE FEES FOR 2012-2013 & 2013-2014. ** Carolyn Revis visit location 8/8/2013 with Tom from Vice Narcotics. Business was open and operating, with a valid city Privilege License. One employee fled out the back of business and was escorted back inside by two uniformed officers. At that time Tom asked if he could search the business and was told yes. Search found four employees were present at the location (3 giving massages at the time) but did not have a North Carolina Board of Massage and Bodywork Therapy License or a NCDMV identification. These employees were not on the original list of employees given to the Privilege License department. Carolyn issued a Notice of Violation for not having proper licensing or proper state identification. Per the Notice of Violation, the business has 3 business days to correct the violations. Carolyn was able to contact the owner, Lan Fen Zhou (Emily) by phone at the location regarding the employees not properly licensed. She was informed that the 4 employees at the location cannot perform massages until the proper licenses and identification is presented to our office. ** Emily and Jie Li came into the office 8/9/13 and Carolyn explained that no one can provide massages unless they have a NC State Massage License and NCDMV identification. Jie Li is now the new employee working at this location and she provided her active NC State Massage License and NCDL. Emily provided a written statement saying she would not employee anyone else that does not have a NC State Massage License and NCDMV identification. Carolyn also explained that if found in violation again they would be fined and have to close for 6 months.

NOTICE OF VIOLATION FOLLOW UP SITE VISIT

** *Carolyn Revis & Richard Hawk & Tom from Vice Narcotics visit locaton 8/16/2013 in follow-up to a Notice of Violation for not having proper licensing or proper state identification issued on Thursday, 8-8-13, Collection staff accompanied by 1 member of the Vice unit performed a site visit to Foot Care, 4401 W. Wendover Ave, Ste. 106. The purpose of the follow-up visit was to verify compliance of the employees state massage license and NC driver or ID information. The Vice unit officer that accompanied Collections did not enter the building and was stationed in back of the office suite in preparation for someone to possibly exit the back door, like the previous site visit. Carolyn and Richard were able to enter the business, and speak with Lan Fen Zhou(Emily), Jie Li, and Hong Ling Zhou. These were the only employees on site, and all 3 were able to provide proof of proper NC state identification that matched what was on file currently with our privilege license office. These 3 employees also had their current NCLMBT license posted on the wall in a conspicuous area near the entrance of the business. Therefore the violations issued on 8-8-13, are now in compliance. ** As stated on 8-22-13, regarding identificaton verified during 8-16-13 site visit, let it be known that HongLing Zhou came into our office on 8-15-13 and presented her active NC LMBT license(we verified her license is in good standing), as well as her USA Permanent resident picture ID, and a NC DMV offical receipt for purchase of NC ID. Her hard copy NC ID will be mailed 7-10 days after purchase date(8-15-13), HongLing Zhou, and "emily" were informed that immediately when her hard copy NC ID shows up, she needs to bring that into our office to copy for our records.

** Business was open and operating, with a valid city Privilege License displayed. Upon entry of the business, Hong Ling Zhou greeted us (a licensed massage therapist with this location). Only Hong Ling Zhou and Charlotte Koh were working at this location today, both with active and prominently displayed North Carolina Board of Massage and Bodywork Therapy licenses. All additional licenses displayed on the wall were active and on the employee list the Privilege License department currently has. Business was found compliant.

** Teresa Childress visit location 8/8/13 with Joe and Caption Culler from Vie Narcotics. Business was open and Teresa spoke to Qian Lin, one of the massage therapists, and asked for an updated list of employees. Three NC state massage licenses were displayed, Qian Lin, Qiaoyun Zhang and Han Wang

and all are in an active status. Qiaoyun Zhang and Han Wang were not at the location. During the visit Xiaoyi Long exited one of the rooms with a male and when we asked Qian Lin if Xiaoyi Long also does massages she stated no and that she only answers phones for the business. Vice was able to take a photo of both Qian Lin NCDL and Xiaoyi Longs Tennessee drivers license. Another female was in the back of the business knitting and Qian Lin explained she was her friend and did not work there. Teresa explained to Qian Lin that we needed to get a copy of Han Wangs NCDL since we were able to verify active massage state license status. Han Wang called the Privilege License Office and spoke to Suzanna. Han stated she did not have a NCDL but would get one before she starts working, which would not be for at least 2 more weeks. Suzanna explained she could not start working until she provides our office with proper identification.

** Business was open and operating, with a valid city Privilege License displayed. Upon entry of the business, Qian Lin was at the front desk (a licensed massage therapist at this location). The two (2) North Carolina Board of Massage and Bodywork Therapy licenses displayed on the wall of the business matched up with the two we had on our employee checklist and were shown in a prominent manner. There was another female on site, Jia Hai Ying, who was in the process of performing a massage with a client, and was leaving a massage room when we entered the business. She was unable to provide NC DMV identification, or a NC massage license. Jia Hai Ying stated that she was performing a foot massage for the client, but when asked, the massage client stated he actually received a back massage, from Jia Hai Ying. The act of a massage by an unlicensed employee resulted in us moving forward and issuing a notice of violation. Privilege License attempted to reach the business owner, Feng Li by telephone during this visit, but was unsuccessful. A Notice of Violation was issued to May Spa for having an employee perform massages who does not have a current North Carolina Board of Massage and Bodywork Therapy license. Per the Notice of Violation, the business has 3 business days to correct the violations. It was explained to employee Qian Lin that Jia Hai Ying, or anyone else that is unlicensed is not allowed to perform massages at this business, and that a 2nd Notice of Violation within a 12 month rolling period would result in a revocation of the business license. She said she would attempt to contact Feng Li that day.

OWNER CAME TO OFFICE; REFERENCE NOV

** Today, Feng Li (owner) and his niece, Melody, stopped in our office to discuss the NOV issued on Friday to May Spa. Melody came to translate for Feng Li since he does not speak good English. They stated they want to be in compliance and did not realize that the unlicensed employee was giving a massage; they have given written statement that she nor any other unlicensed person would give massages at their location. They were also notified that a 2nd NOV within a 12 month rolling period results in a revocation, and to make sure anyone they employ is licensed as well as has the proper NC identification.
