Dear Judge Berman: I write to follow up the letter that Barbara Jones sent to the Court on behalf of the District Council on December 3, 2013(Doc. 1441) and the parties' discussions with Your Honor during the December 4, 2013 conference related to the District Council's Technology Committee and IT Modernization plan. A subcommittee of the District Council's Technology Committee, assisted by Charles Jackson, the Information Technology Director of the District Council Benefit Funds, interviewed representatives from five consulting companies that submitted responses to the District Council's request for proposals ("RFP"). The subcommittee recommended the Segal Co. At the interview, the Segal Co. agreed to cap its fees at a total of $165,000. A copy of the Segal Co. response to the RFP is enclosed as Exhibit 1. The District Council's Executive Committee reviewed the responses to the RFP and the subcommittees recommendation. The Executive Committee then recommended to the Delegate Body that the Segal Co. be retained. At its regularly scheduled monthly meeting yesterday evening, the Delegate Body reviewed the RFP responses from the five consulting companies and the Executive Committee's recommendation. After a lengthy and thoughtful discussion, the Delegate Body voted without dissent to retain the Segal Co. as the District Council's IT consulting company. A copy of the District Council's notice to the Review Officer under the 2010 Stipulation and Order memorializing the above recommendations, decision, and $165,000 cap on fees is enclosed as Exhibit 2.
