Rental Contract

1. CHECK-IN/CHECK-OUT TIME: Check-in begins at 4:00 PM CST. Checkout is no later than 10:00 AM CST. Any deviation from this policy will be subject to an automatic fee of $150.00 charged to credit card on file. Refunds will not be given for late arrivals or early departures. If an early check-in or late checkout is available the cost is $75.00. Please check with property manager for availability. 2. SMOKING POLICY: Smoking is not permitted in any Barefoot Vacations properties. Any violation of this policy will result in immediate eviction and the guest will be charged $250.00 plus cost to remove odor. 3. PET POLICY: With the exception of our pet friendly properties, pets are not permitted in any Barefoot Vacations properties. Guests who violate this policy will be charged a fee of $250.00, plus the expense of any necessary cleaning. Violations may also result in immediate eviction of the property. For those properties, which are pet friendly, guests must have their pet approved, pay $150.00 nonrefundable pet fee and abide by the pet guidelines provided. 4. MINIMUM AGE POLICY: Our properties will not be rented to anyone under 25 years of age unless accompanied by an adult guardian or parent. The ratio of adult guardian or parent must be five (5) children to one (1) adult. A parent or guardian must be staying at the property at all times. The parent or guardian must check in and must not leave overnight during the length of the stay. Guests who violate this policy are subject to immediate eviction and forfeiture of all rental payments. In accordance with Florida State Statute 509.41, reservations made under false pretense are null and void and check-in will not be allowed or guests will be asked to vacate the property. 5. RESERVATION PAYMENT: A payment equal to 50% of the total rental amount is due immediately at time of booking and will be applied toward the total rental amount. Payment should be in the form of credit card or e-check. If paying via e-check, a credit card must be on file to hold the reservation. Credit cards are accepted, but require an additional processing fee of 3.5% for Visa, MasterCard and Discover. A 4.25% processing fee is required for American Express. 6. FINAL PAYMENT: The balance of the rental fee will be automatically processed using your original method of payment approximately thirty (30) days before your arrival date. Upon receipt of final payment you will receive, by email, our rental confirmation letter with check-in/check-out procedures, entry code and other important information. 7. MAXIMUM OCCUPANCY: The maximum number of guests allowed at each property is listed on our website. If the maximum occupancy is exceeded, you may be asked to vacate the property and forfeit any rental payments.

8. DAMAGE/SECURITY DEPOSIT: A credit card is required for all rentals to be held for Damage/Security Deposit. Guests are responsible for the property, its contents, and themselves during occupancy. Please remember that you are staying in someones home; treat it with the care that you would your own home. Guests must lock windows and doors securely when not at the property. Rearranging furniture or removing items from the property is absolutely prohibited. After checkout, the Property Manager will inspect the home for damage, missing items, lost or damaged linens; lost keys/amenity passes or abnormally dirty appearance. If the Property Manager determines that damage is present, items missing, towels/linens lost or damaged, keys and/or amenity passes are missing, or the unit is found abnormally dirty at checkout, additional charges will be charged to your credit card to assist in performing a deep cleaning of the property. Renter authorizes Barefoot Vacations to charge the credit card on file to reimburse Barefoot Vacations for any such expense. If something were to happen during your stay, please contact us immediately. If ALL checkout procedures are not followed, you will incur an automatic fee of $150.00. 9. CANCELLATION AND CHANGES POLICY: A sixty (60) day notice is required for cancellation and/or changes to a reservation. With the exception of a $75.00 Cancellation fee and the propertys associated Reservation fee, deposits are fully refundable if cancellations are given 60 days prior to the arrival date. Cancellations or changes that result in a shortened stay, that are made less than 60 days of arrival date, forfeit the full reservation payment. Early departure does not warrant any refund. 10. HOUSEKEEPING: Properties of Barefoot Vacations are cleaned to quality standards prior to your arrival. Daily maid service is not included, but may be added for an additional fee. You are responsible for leaving the property in good condition at check out. Damage charges will be applied to your credit card in the event that excessive cleaning is needed following your departure. Your property should have an initial startup supply of trash bags, toilet paper, bath soap, laundry detergent, dishwasher detergent, dishwashing liquid, and a kitchen sponge. This initial supply is not intended to last the length of your stay and you should plan to bring or purchase additional supplies for your stay. Any concerns regarding housekeeping should be reported immediately to the property manager. 11. BEACH & POOL TOWELS: You should bring beach and/or pool towels. We do not permit towels or linens to be removed from the property. 12. MAINTENANCE: Promptly report any maintenance problems to Barefoot Vacations so we may address. No refund or rate adjustment will be made for unforeseen failures/outage such as the supply of electricity, water, pool filtration systems, air conditioning, telephone, television or cable service, internet, appliances, etc. 13. RATES: We accept reservations up to one year in advance. Barefoot Vacations reserves the right to correct or adjust rates to the published rates at the time of the reservation in the event that they have been misquoted due to human and/or computer error.

14. FALSIFIED RESERVATIONS: In accordance with Florida State Statute 509.41, any reservation made under false pretense are null and void and check in will not be allowed or guests will be asked to vacate the property and forfeit security deposit and/or rental money. 15. PARKING: Please use only the parking spaces designated for the particular property. 16. PROPERTY RULES AND REGULATIONS: Please observe all rules and regulations governing the use of the property and residing community. Failure to comply may result in eviction. 17. SECURITY OF PERSONAL PROPERTY: Barefoot Vacations is not responsible for any acts of theft or vandalism, or other damages to any personal property or for personal items left by guest in the property at departure. We are not responsible for items left behind but will make every attempt to them if notified within 7 days of your departure. Cost to ship plus a $15 handling fee will be charged to your credit card on file. 18. TRANSFER OF RESERVATION: The rental property may not be sublet or transferred to any other party. 19. SWIMMING POOLS: In-ground swimming pools may cause an inherent risk to renters and guests. As the renter, you accept the risk of the pool and specifically agree that no minor children will be in the pool area without continuous adult supervision. The renter assumes full control and full responsibility for the use of the inground swimming pool during confirmed rental period. It is against the law to disarm pool alarms installed for the safety of your family and guests. Seasonal pool heat is available at some rental properties at an additional charge. Pool temperatures will not be adjusted higher than 90 degrees. Adjusting and/or tampering with pool heaters or pool equipment will result in an additional damage charge to your credit card. 19. HURRICANE POLICY: Refunds will be only given when the National Weather Service advises of a mandatory storm evacuation in the area. The day that the National Weather Service advises that you are in a Tropical Storm/ Hurricane Warning, we will refund any unused portion of rent from a guest currently registered. 20. INDEMNIFICATION & HOLD HARMLESS: By agreeing to this contract, renters, guests and any occupants agree to indemnify, defend, and hold harmless the owner, landlord and rental manager for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with renters, guests or occupants use and occupancy of the rental property, including, but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by renters, guests or occupants.
