FOREWORD
From1,700peoplein1900,theHindupopulationinAmericagrewtoapproximately387,000by1980and1.1 millionin1997.1Asof2008,theestimatedU.S.populationofHindusofIndianoriginwasapproximately 2.29million(basedonextrapolationsfromstatisticsonresidentsofIndianandIndoCaribbeandescent).2 Estimatesvary,buttheremayalsobeasmanyas1millionpracticingHinduAmericans,notofIndianorigin, intheU.S.

AsagenerationofHinduAmericanscameofageinthe1980sand1990s,Hindutemplesbegantochange suburbanlandscapes,andreligioculturalorganizationsformedorganicallywithincommunities.3Shapedin thecrucibleofgeneralizedignoranceaboutHinduism,itsbeliefs,andethos,agroupofprimarilyAmerican bornandraisedHindusestablishedtheHinduAmericanFoundation(HAF)in2003,asthefirstadvocacy organizationseekingtoestablishacredible,articulate,andprofessionalvoiceforagrowingcommunity.

WhilenoadvocacyorganizationcouldclaimtorepresenttheentiretyofaninherentlydiverseAmerican Hindudiaspora,HAFwasthefirsttocreateaprofessionalizedmodel,andgainedrecognitionasthefirst majornationaladvocacygrouplookingatHinduidentity,asProf.DianaEck,professorofcomparative religionandFounderofthePluralismProjectatHarvardUniversity,toldtheNewYorkTimesin2010.4

A Decade of Hindu American Advocacy

Since2003,HAFestablisheditselfasarespected,actionoriented,andresultsdriveninstitution.5Withthe supportofanationalmembership,HAFopenedapermanentofficeinWashington,DCandsupportsa fulltimeprofessionalstaff.ItsBoard,staff,ExecutiveCouncil,localchapters,andmembershiprepresent Hindusofeveryrace,nationality,ethnicity,race,caste,gender,andsexualorientation.HAFsadvocacy effortsareguidedbythefollowingstatedobjectives:1)promotepluralismandmutualrespectamongst
peoples2)ensureanaccurateunderstandingofHinduismasalivingtradition3)highlightandsecurethehuman rightsofHindusaroundtheglobe4)representtheHinduAmericancommunitysneedsandintereststo institutionsinfluencingandmakingpolicy5)solvecontemporaryproblemsbyapplyingHinduphilosophyand6) buildasustainableinstitutionthatwillremainapreeminentadvocateforDharmacommunitiesforfuture

TheFoundationstrackrecordasanestablishedcivilandhumanrightsorganizationismanifestinthe respectandtrustithasearnedfromleadersinpublicpolicy,themedia,academiaandwithintherealmof interfaithcircles.IthasroutinelybeenquotedbytheU.S.CommissiononInternationalFreedom(USCIRF) initsannualreports,7 andhasspearheadedaswellassupportedreligiousfreedominitiativesthroughthe InternationalReligiousFreedomRoundtableinWashington,D.C.HAFhasalsobeenaleadingvoiceon internationalanddomesticcivilrightsissues,includingadvocatingonbehalfofminoritywomensrightsin countriessuchasPakistan8andBangladesh,supportingMuslimandSikhemploymentrightsintheU.S. throughCAAssemblyBill19649 ,speakingoutagainsttheunconstitutionalsurveillanceofmosquesinNew York,10 pushingforimmigrationreform11andguncontrol,12andadvocatingfortheinclusionofhatecrime reportingagainstSikhs,Arabs,andHindus.13Recently,HAFmadeinternationalheadlineswhenit expresseddisappointmentwiththeIndianSupremeCourtsdecisionnottoupholdthedecriminalizationof consensualhomosexualconduct.14

HAFplaysaleadingroleineducatingAmericansatlargeandcourtsacrosstheU.S.aboutvariousaspects ofHindubeliefandpracticeinthecontextofreligiousliberty,eitherasapartytothecaseoranamici(friend ofthecourt).15PriortotheestablishmentofHAF,aHinduvoicewasmissingamongstthoseofJews, Christians,Buddhists,andatheists,whohadalonghistoryofactivelyparticipatingindefendingreligious libertyintheU.S.HAFhasalsocreatedlegalresourcesfortheHinduAmericancommunity,including HAF'sKnowYourRightsguideandR1ReligiousWorkerVisaguides.16HAFsadvocacyhasfilledthis void,providingaHinduAmericanvoiceandresourcewherepreviouslytherewasnone.

HAFhasalsotakenonmanypublicpositionstoaddresssensitiveissueswithintheHinducommunity, includingseekinganendtocastebaseddiscrimination17andendingviolenceanddiscriminationagainst women. 18AsoneleaderattheFoundationsaid,HinduAmericanFoundationclearlyhasastrongtrack

recordoftakingindependentpositionsleftistandradicalsthrowthelabelHindutvaatHAF,andrightwing HinduscallHAFkneejerkliberals!YettherealityisthatHAFisneither.TheteamatHAFthinksthrough positionsthathavenothingtodowiththeusualleftrightparadigmpresentinIndiaortheU.S.,andtherefore HAFrejectsanylabels.

Attacks Against HAF by CAG and CAG Members

Indeedprincipledoppositionisexpectedwhenlitigatingissuesinthepublicsquare,andHAFhas,attimes, facedstiffoppositionfromtherightandleftoftheideologicalspectruminresponsetovariouspositions, reports,andstatementsreleasedbytheFoundation.Butasanindependentandnonpartisaninstitution, HAFworkswithawidespectrumoforganizationsrepresentingAmericasdiversereligionsandpolitical ideologies.TheCoalitionAgainstGenocide(CAG),isoneentitythathasconsistentlyopposedHAF initiativespublicly,andgoesfurtherinattemptingtoessentializeHAFasbutonemanifestationofseveral IndiabasedsocioreligiousorganizationswithexistentiallinkstotheSanghParivar.

CAGisalooselyknitcoalitionofapproximatelyfiftyorganizations,manyofwhich,arenonexistententities, anditmaintainsnoofficialstatusasalegalentity.Manyofitsleadersandspokespersonsespouse antiAmerican,antiIsrael,andantiIndia(andantiHindu)views.

TherepeatedeffortsofCAGtodeconstructHAFintoapurportedbranchofanimaginedmonolithicfamily,is oftenpredicatedonfamilysummercampssomeleadersofHAFattendedasteenagerswhichwere organizedbysocioreligiousorganizationssuchastheVishwaHinduParishadAmerica(VHPA) devotionalgatherings,scripturalstudygroupsorcollegestudentmeetingsorganizedasapartoftheHindu StudentsCouncilorparticipationandleadershipincreatingthelargestnetworkofHindutempleexecutives intheUnitedStatesasapartoftheHinduMandir(temple)ExecutiveCouncil(HMEC).

Indeed,inthe1970sand1980s,therewasapaucityoforganizedforaforHindureligioculturalexpression intheUnitedStatesandmanyyouthsparticipatedinVHPAactivitieswithnecessarilynoknowledgeor ideologicalallegiancetosociopoliticalactivitiesinIndia.TheHinduStudentsCouncilwasthefirst,andfor overadecade,theonlynationallyorganizedinstitutionfocusedonmeetingthespiritualneedsofHindu studentsoncollegecampuses.AndHMECistodayoneofthemostrespectedforaofHindutemple executivesfromthroughoutthenationaddressingurgentissuesconcerningtheserelativelynewinstitutions ontheAmericanlandscape.

RepresentingHAF,anAmericanorganizationledbymostlyAmericanbornHinduAmericans,notaffiliated

withanyreligiousorpoliticalorganizationsorentities,HAFleadersconsistentlyandcategoricallyrejectany

insinuationthatHAFisanideologicalbedfellowofanyorganizationwithexistentialtiestothepolitical landscapeinIndia.CAGmemberorganizationsandtheirleadersseektorepresentHAFassomehow supportiveatbestandcondoningatworstthehorrificriotsinGujaratthatleftover1000MuslimsandHindus dead,followingthetrainburningofHindupilgrimsbyaMuslimmobinFebruary2002.Infact,HAFhas repeatedlyandpubliclydenouncedandcondemnedtheriotsasaheinoustragedy.19,20

AsaninitialventureintoHinduphobicactivism,CAGleaders,underanavatarentitledCampaigntoStop FundingHatelaunchedanattempttodelegitimizeanddestroytheIndiaDevelopmentandReliefFund (IDRF). 21IDRF,anAmericantaxexemptcharitythatpromotessustainabledevelopmentinIndiawith donationscollectedintheUnitedStates,survivedtheattack,whiletheHinduAmericancommunitywasput onnoticeastotheextentCAGwouldgotomalignordestroyorganizationsthatitideologicallyopposed.

ConstituentsofCAGthenpubliclyopposedtheeffortsofHAFwhentheFoundationwasalitigantagainsttheCalifornia StateBoardofEducationtoreverseanunfair,closeddoorprocesswhichdisenfranchisedHindugroupsseekingto offereditstodeeplyflawedsixthgradetextbooks.22HAFprevailedinthelawsuit,andultimately,anestimated75%of editssuggestedbyHindugroupswereaccepted.23Lattersectionsinthisreportrevisitthehistoryofthetextbook adoptionprocessandHAFshistoricrole.

Recently, this same coalition announced its support of H. Res. 417, a congressional resolution introduced by Congressmen Joseph Pitts (RPA) and Keith Ellison (DMN) attacking India's record on religious freedom, targeting only Hindus as instigators of violence, and ignoring the impact of Islamist and Maoist terrorism in the country. Amongst otherbroadsweeping misstatementsoffact, the resolutiondemands the establishment of religious minoritycourts to conducttrials andhearappeals, undermining thesecular nature of the Indias judicial system. When HAF launched its counter efforts to educate legislators about the inaccuracies, misrepresentations, and omissions in H. Res. 417, a resolution CAG member Indian American Muslim Council (IAMC) hired lobbying firm Fidelis Government Relations to push, CAG began publiclycriticizingHAF,tryingtolinkit,onceagain,totheSanghParivar.24

California Textbook Controversy: A Review

In2005,HinduparentsandgroupspubliclyjoinedthetextbookadoptionprocessinthestateofCalifornia. TheHinduAmericanFoundationbecameapartytotheprocessandresortedtoahistoriclawsuitagainst theCaliforniaStateBoardofEducationprevailingonthemeritsofthecaseandbeingawardedallofitslegal fees.

TheHinduAmericancommunitywasshockedwhenCAGmembersincludingFOSA(describedabove)and otherCAGgroupsinsinuatedthemselvesintotheprocessinoppositiontoHinduorganizations.FOSAfiled anamicusbrief,notonthemeritsofthelawsuit,butoutliningadhominemattacksagainstHAFandother Hindugroupsparticipatinginthepublicprocessoftextbookadoptionastheyhavedonewithothergroupsin thepast.Thebriefwasrejectedoutrightbythejudgeasitlackedmeritandrelevance.96

Conclusion
SubjectedtoscrutinybytheHinduAmericanFoundation(HAF),CAGstandsexposedinthisreportas nothingmorethananinternetbasedportal,thatdespiterepeatedclaimstothecontrary,isprimarily comprisedofdefunct,nonincorporatedorshellgroupswhosesolepurposeistoprojectabroadcoalition. MarlettealsoruledthatthereliefdemandedbyHAFthatistorejectthetextbooksadoptedunderan illegalprocesswouldbedisruptivenotonlytothoseaffectedsixthgraders,butpotentiallyevery CaliforniapublicschoolstudentusinganyandeverytextbooksadoptedundertheSBEsunlawful policies.JudgeMarlettewrote,TheCourtthereforedeterminesthatrespondent[SBE]shouldbe permittedareasonableopportunitytocorrectthedeficienciesinitsregulatoryframeworkgoverningthe textbookapprovalprocesswhilemaintainingthecurrentsystemintheinterim. Accordingtosomecounts,70%oftheeditsandcorrectionssubmittedbytheHindugroupswere incorporatedintothetextbookspublishedandadoptedinthe20052006adoptioncycle.
