Indications are that Indian &uslim can no longer turn to 'udiciary for 'ustice under rising *iolent anti &uslim )indut*a forces. This is hat one could conclude at the .hmadabad magistrate courts shocking, shameful and frightening *erdict on Thursday /0 1ecember /234 stating that there no e*idence to prosecute 5u'arat #hief &inister Narendra &odi in a case relating to the anti &uslim pogrom in /22/. The *erdict has gi*en a clean chit to Narendra &odi and 67 others. It is a political than a 'udicial *erdict as an ad*erse court *erdict could expose &odi of his role in the genocide of &uslims and seriously affect !,8s massi*e and aggressi*e $&odi-for-8&$ campaign and its chances of ousting #ongress at the #entre in /239 polls. #ommenting on the *erdict acti*ist &allika Sarabhai said that it as :silly to ha*e expected anything else but a clean chit for Narendra &odi from a 5u'arat court. The courts may not find e*idence, but let Narendra &odi ask his conscience.: She said she has :great optimism in India$s good 'udges: and is hence :not gi*ing up this long battle.: The *erdict sent shock a*es among Indias beleaguered and often brutali;ed &uslim community.

The <uestion is ho carnage of such huge proportion could happen ithout the kno ledge of Narendra &odi ho as #hief &inister of 5u'arat especially hen the entire state machinery, under &odis control, as fully utili;ed to execute this barbarity hich no normal human being could perpetrate. Thousands of &uslims ere massacred , some of them electrocuted hile others being chopped , children together ith their family members ere roasted in burning fire, &uslim o ned residential, commercial, industrial properties ere set abla;e, thousands of &uslim omen ere raped and in one of the most inhuman atrocities &uslim girls pri*ate parts ere mutilated ith s ords supplied by &odis &inister &ayaben =odnani, those dri*en out still languish in refugee camps in appalling condition hile their properties being grabbed. The list of crime continues. Though all fingers pointed at Narendra &odi, he as ne*er tried. Instead, indicating Indias fast declining moral *alues under rising (SS led )indu fascism, &odi is the prime ministerial candidate supported by the )indu corporate conglomerates hich flourished under him, and !rahmin controlled media and external forces such as +ionist ,e s besides financial support from Indian expatriates from oil rich 5ulf countries and the est. Narendra &odi, (SS front !,8s prime ministerial candidate, is an insult to this ancient country here peaceful )induism of %edas flourished. &ore than 362 million &uslims li*e in fear today at the thought of &odi becoming prime minister in *ie of his crime records. The <uestion is ho come India could not find a decent crime free person to contest the prime ministerial elections. +akia ,affrey, ife of the former #ongress &8, -hsan ,afffrey ho filed the case, broke do n in the court as she narrated ho her husband as dragged by the mob, stripped and chopped off his limbs before burning him ali*e. She described the horror she and other members of the society under ent hen they ere under attack by the mob of more than 4,222 on "ebruary /7, /22/, the *ery next day of train burning at 5odhra. :>e are not satisfied ith the order and ill file an appeal in a month,: said +akia$s counsel, adding, there as enough e*idence to prosecute the Narendra &odi

in a larger conspiracy case. The ad*ocate claimed they had produced enough e*idence to pro*e that chief minister Narendra &odi as in*ol*ed. -xplaining the carnage +akia stated that ?on the day of the massacre, hearing the mob, many of the residents took refuge in the home of former #ongress &8 -hsan ,afri, also a resident. !y noon, the mob turned *iolent, breached the boundary all and set fire to the houses .!y e*ening, 0@ people, including former #ongress &8 -hsan ,afrey ere charred to death. ,affreys frantic phone calls for help to the police and politicians ere ignored during the massacre.Anly after the police arri*ed in the e*eningB +akia came do n from the first floor and sa on the *eranda the mutilated bodies of her neighbour =asambhai$s ife and his pregnant daughter-in-la , ho had been stabbed in the abdomen ith a s ord. The foetus had come out. She also sa fi*e or six bodies lying in the backyard. +akia accused the Special In*estigation Team, SIT, appointed by the Supreme #ourt, of shielding &odi and others by not belie*ing statements gi*en by police officers and neglecting the a*ailable e*idence. She has also accused the SIT of playing the role of a court by ad'udging the truth of the a*ailable e*idence. )er la yers contended that the in*estigation as incomplete and the probe agency had not e*en done it seriously. +akia ,affrey alleged that &odi colluded ith senior ministers, bureaucrats and the police to fan the communal *iolence that tore through the state. In /220, +akia filed a complaint about the role played by &odi and 0/ others during the /22/ riots. >hen 5u'arat police refused to register her complaint, she mo*ed the 5u'arat high court hich asked her to approach a magisterial court. She chose to mo*e the apex court. +akia furnished mobile phone records to claim that &odi along ith his six close aides *isited their neighborhood, &eghaninagar, 'ust a day before the murderous mob attacked their house. She told a metropolitan magistrate in .hmedabad that &odi himself *isited the area ith his aides on "ebruary /C, /22/, before going to 5odhra here 6@ kar se*aks ere killed. 1uring that *isit, +akia alleged, he conspired ith rioters to carry out the next day$s D"ebruary /7E attack on her apartment. )ere are some details of the 5ulberg massacre caseB -hsan ,affrey, then #ongress &8 and husband of +akia , the main petitioner in the case, as among 07 others ho ere burnt ali*e during the /22/ riots in 5u'arat.

,affreys frantic phone calls for help to the police and politicians ere ignored at the time of incident. +akia accused that &odi colluded ith senior ministers, bureaucrats and the police to fan the communal *iolence that tore through the state. +akias allegations ere in*estigated by a Special In*estigating Team or SIT appointed by the Supreme #ourt in &arch /227. &odi as interrogated in /232 by the SIT for o*er nine hours. In /233, the Supreme #ourt refused to hear the case and said it ould be handled by an .hmadabad court. In .pril /233, San'i* !hatt, ho as a senior police officer in /22/, said that at a meeting, &odi told him and other cops to allo )indus in the state to exact re*enge for the killing of 6@ karse*aks on the Sabarmati -xpress near 5odhra. )o e*er, the SIT concluded that San'i* !hatt$s testimony as not reliable because he as nursing a grudge against the go*ernment as he as sidelined by the &odi administration. The SIT also alleged that the petition as a moti*ated one and as filed at the instance of anti-&odi acti*ist Teesta Setal*ad. .fter four years, the SIT said in "ebruary /23/ to the shock of the entire country that there as no prosecutable e*idence against &odi and the others and filed a closure report indicating its in<uiry has ended. +akia contested that decision and challenged the SIT$s closure report and the clean-chit gi*en to &odi.

.rguments got o*er in September /234. SIT counsel (S ,amuar argued before the court that no direct or circumstantial e*idence supporting +akias allegations as found, hile her la yers argued that SIT ignored the rele*ant e*idence and shielded the main culprits. "inally on Thursday /0 1ecember /234 court issued the *erdict exonerating &odi of all charges Fa *erdict hich ill him a great deal in his prime ministerial campaign. The SIT head, retired #!I director, (= (agha*an told N1T% that he stands by his report and is ready for it :to be scrutini;ed by anyone.: The unans ered <uestion is if Narendra &odi did not commit this barbarity ho did itG (agha*an should prick his conscious, if he has something like that, before selling his soul to protect &odi. This is emerging India and god sa*e )indus, &uslims and other alike from )indut*a fascism . The affected speak out (upa &odyH The decision is not only about 5ulbarg Society, it$s about all *ictims of the /22/ riots. +akia did all she could to tell the 'udiciary that someone must be held responsible for that day.

Saira SindhiH >e ere hoping that hile nobody listened to our pleas, the 'udiciary ill be the last hope. The 'udgment has affected our spirit but e ill continue seeking 'ustice till our last breath. Salim SindhiH There$s abundant e*idence ... .ll I ant is for the 'udiciary to see the case as a chance to set an example so no po er hungry people use it for their gains. =asam &ansuriH The 'udgment came in less than a minute and left us all stunned. I ha*e lost 32 members of my family in riots. >e are ready to go up to the Supreme #ourt to seek 'ustice.
