    January14,2014 To:MembersoftheU.S.Senate Thefollowing62organizationsarewritingtowarnthatSenatepassageofnewIransanctions wouldcriticallyendangerthepossibilityofadiplomaticresolutiontothenuclearstandoffwith Iran,increasingthelikelihoodofanucleararmedIranandanunnecessaryandcostlywar.We callonyoutonotcosponsorS.1881(theNuclearWeaponFreeIranActof2013)and stronglydiscourageSenateconsiderationofnewIransanctionswhilenegotiationsproceed. TheJointPlanofActionsignedbetweentheP5+1andIraninNovemberboostsAmericanand regionalsecuritybyfreezingandrollingbackIransnuclearprogramforthefirsttimeinnearlya decade.Theagreementalsoinstitutesunprecedentedtransparencyforinternationalinspectors, includingdailyinspectionofIransenrichmentfacilities. However,aspartoftheagreement,theU.S.hasagreedtorefrainfromimposingnew nuclearrelatedsanctionsonIran.EvenwiththedelaymechanismsincludedinS.1881,U.S. andIranianofficialswarnthatnewCongressionalsanctionswouldkillthedeal.

    TheWhite HousehasaddedthatnewCongressionalsanctionswouldbeperceivedasasignofbadfaith byalliescriticaltotheenforcementofthesanctionsregime,includingtheotherpermanent membersoftheUNSecurityCouncil.Asaresult,newsanctionswilleroderatherthan strengthenourleveragefornegotiations.Further,anunclassifiedU.S.intelligenceassessment warnsthat,newsanctionswouldunderminetheprospectsforasuccessfulcomprehensive nuclearagreementwithIran. S.1881alsosetsinsurmountabledemandsforacomprehensivenucleardealbyinsistingthat Irandismantleitsentirenuclearinfrastructure,includingenrichmentandreprocessing capabilitiesandfacilities.Suchademandisapoisonpillfornegotiationsandisnotnecessary topreventanucleararmedIran. Further,anycomprehensivedealwillrequiretradinginexistingsanctionsforIraniannuclear concessions.ButthesanctionsprovisionsincludedinS.1881couldonlybewaivedbythe PresidentforafinalnucleardealifIranagreestothezeroenrichmentdemand,effectively eliminatingthePresidentsabilitytooffersanctionsrelief.RatherthanattackPresidentialwaiver authority,CongressshouldensurethatthePresidenthasfullauthoritytoliftsanctionsaspartof acomprehensivedeal. Byforeclosingdiplomaticprospects,newsanctionswouldsetusonapathtowar.The AmericanpeoplehavemadeitclearthattheydonotwantanotherwarintheMiddleEastand stronglysupportpursuingdiplomaticprospectsuntiltheyareexhausted.Itwouldbetheheight ofirresponsibilitytostepinandundercutdiplomaticnegotiationsbeforethisopportunityhasthe chancetobearfruit. WestronglyurgeyoutowithholdcosponsorshipofS.1881anddelayconsiderationofnew Iransanctionswhilenegotiationsareongoing.
