USA vs. GUINTO, 182 SCRA 644 Case Digest These are cases that have been consolidated because they all involve the doctrine of state immunity. The United States of America was not impleaded in the case at bar but has moved to dismiss on the ground that they are in effect suits against it to which it has not consented. FACTS: 1. USA vs GUINTO (GR No. 76607) The private respondents are suing several officers of the US Air Force in Clark Air Base in connection with the bidding conducted by them for contracts for barber services in the said base, which was won by Dizon. The respondents wanted to cancel the award because they claimed that Dizon had included in his bid an area not included in the invitation to bid, and also, to conduct a rebidding. USA vs RODRIGO (GR No. 79470) Genove filed a complaint for damages for his dismissal as cook in the US Air Force Recreation Center at Camp John Hay Air Station. It had been ascertained after investigation that Genove had poured urine into the soup stock used in cooking the vegetables served to the club customers. The club manager suspended him and thereafter referred the case to a board of arbitrators, which unanimously found him guilty and recommended his dismissal. USA vs CEBALLOS (GR No. 80018) Bautista, a barracks boy in Camp O Donnell, was arrested following a buy-bust operation conducted by petitioners, who were USAF officers and special agents of the Air Force Office. An information was filed against Bautista and at the trial, petitioners testified against him. As a result of the charge, Bautista was dismissed from his employment. He then filed for damages against petitioners claiming that it was because of the latters acts that he lost his job. USA vs VERGARA (GR No. 80258) A complaint for damages was filed by private respondents against petitioners (US military officers) for injuries allegedly sustained by the former when defendants beat them up, handcuffed them and unleashed dogs on them. The petitioners deny this and claim that respondents were arrested for theft but resisted arrest, thus incurring the injuries. ISSUE:

Whether or not the defendants were immune from suit under the RP-US Bases Treaty for acts done by them in the performance of their official duties. RULING: The rule that a State may not be sued without its consent is one of the generally accepted principles of international law that were have adopted as part of the law of our land. Even without such affirmation, we would still be bound by the generally accepted principles of international law under the doctrine of incorporation. Under this doctrine, as accepted by the majority of the states, such principles are deemed incorporated in the law of every civilized state as a condition and consequence of its membership in the society of nations. All states are sovereign equals and cannot assert jurisdiction over one another. While the doctrine appears to prohibit only suits against the state without its consent, it is also applicable to complaints filed against officials of the states for acts allegedly performed by them in the discharge of their duties. The rule is that if the judgment against such officials will require the state itself to perform an affirmative act to satisfy the same, the suit must be regarded as against the state although it has not been formally impleaded. When the government enters into a contract, it is deemed to have descended to the level of the other contracting party and divested of its sovereign immunity from suit with its implied consent. It bears stressing at this point that the aforesaid principle do not confer on the USA a blanket immunity for all acts done by it or its agents in the Philippines. Neither may the other petitioners claim that they are also insulated from suit in this country merely because they have acted as agents of the United States in the discharge of their official functions. There is no question that the USA, like any other state, will be deemed to have impliedly waived its non-suability if it has entered into a contract in its proprietary or private capacity (commercial acts/jure gestionis). It is only when the contract involves its sovereign or governmental capacity (governmental acts/jure imperii) that no such waiver may be implied. In US vs GUINTO, the court finds the barbershops subject to the concessions granted by the US government to be commercial enterprises operated by private persons. The Court would have directly resolved the claims against the defendants as in USA vs RODRIGO, except for the paucity of the record as the evidence of the alleged irregularity in the grant of the barbershop concessions were not available. Accordingly, this case was remanded to the court below for further proceedings.

In US vs RODRIGO, the restaurant services offered at the John Hay Air Station partake of the nature of a business enterprise undertaken by the US government in its proprietary capacity, as they were operated for profit, as a commercial and not a governmental activity. Not even the US government can claim such immunity because by entering into the employment contract with Genove in the discharge of its proprietary functions, it impliedly divested itself of its sovereign immunity from suit. But, the court still dismissed the complaint against petitioners on the ground that there was nothing arbitrary about the proceedings in the dismissal of Genove, as the petitioners acted quite properly in terminating Genoves employment for his unbelievably nauseating act. In US vs CEBALLOS, it was clear that the petitioners were acting in the exercise of their official functions when they conducted the buy-bust operation and thereafter testified against the complainant. For discharging their duties as agents of the United States, they cannot be directly impleaded for acts imputable to their principal, which has not given its consent to be sued.

THE REPUBLIC OF INDONESIA, HIS EXCELLENCY AMBASSADOR SOERATMIN, and MINISTER COUNSELLOR AZHARI KASIM, petitioners, vs. JAMES VINZON FACTS: Petitioner, Republic of Indonesia, represented by its Counsellor, Siti Partinah, entered into a Maintenance Agreement in August 1995 with respondent James Vinzon, sole proprietor of Vinzon Trade and Services. The equipment covered by the Maintenance Agreement are air conditioning units and was to take effect in a period of four years. When Indonesian Minister Counsellor Kasim assumed the position of Chief of Administration in March 2000, he allegedly found respondents work and services unsatisfactory and not in compliance with the standards set in the Maintenance Agreement. Hence, the Indonesian Embassy terminated the agreement in a letter dated August 31, 2000. Respondent filed a complaint claiming that the aforesaid termination was arbitrary and unlawful. Petitioners filed a Motion to Dismiss assailing that Republic of Indonesia, as a foreign sovereign State, has sovereign immunity from suit and cannot be sued as a party-defendant in the Philippines. ISSUE: whether or not the Court of Appeals erred in sustaining the trial courts decision that petitioners have waived their immunity from suit by using as its basis the abovementioned provision in the Maintenance Agreement. RULING: The SC GRANTED the petition. The rule that a State may not be sued without its consent is a necessary consequence of the principles of independence and equality of States. The mere entering into a contract by a foreign State with a private party cannot be construed as the ultimate test of whether or not it is an act jure imperii or jure gestionis. Such act is only the start of the inquiry. A sovereign State does not merely establish a diplomatic mission and leave it at that; the establishment of a diplomatic mission encompasses its maintenance and upkeep. Hence, the State may enter into contracts with private entities to maintain the premises, furnishings and equipment of the embassy and the living quarters of its agents and officials. It is therefore clear that petitioner Republic of Indonesia was acting in pursuit of a sovereign activity when it entered into a contract with respondent for the upkeep or maintenance of the air conditioning units, generator sets, electrical facilities, water heaters, and water motor pumps of the Indonesian Embassy and the official residence of the Indonesian ambassador.

In US vs VERGARA, the contradictory factual allegations in this case need a closer study of what actually happened. The record was too meager to indicate if the defendants were really discharging their official duties or had actually exceeded their authority when the incident occurred. The needed inquiry must first be made by the lower court so it may assess and resolve the conflicting claims of the parties. NOTE: 1. A STATE MAY BE SAID TO HAVE DESCENDED TO THE LEVEL OF AN INDIVIDUAL AND CAN THUS BE DEEMED TO HAVE TACITLY GIVEN ITS CONSENT TO BE SUED ONLY WHEN IT ENTERS INTO BUSINESS CONTRACTS. 2. Jure Gestionis by right of economic or business relations, may be sued. (US vs Guinto) Jure Imperii by right of sovereign power, in the exercise of sovereign functions. No implied consent. (US v. Ruiz, 136 SCRA 487)

KHOSROW MINUCHER, petitioner, vs. HON. COURT OF APPEALS and ARTHUR SCALZO, respondents FACTS: Khosrow Minucher, an Iranian national and a Labor Attach for the Iranian Embassies in Tokyo, Japan and Manila came to the country to study in 1974 and continued to stay as head of the Iranian National Resistance Movement. In May 1986, Minucher was charged with an Information for violation of Republic Act No. 6425, Dangerous Drugs Act of 1972. The criminal charge followed a buy-bust operation conducted by the Philippine police narcotic agents in his house where a quantity of heroin was said to have been seized. The narcotic agents were accompanied by private respondent Arthur Scalzo who became one of the principal witnesses for the prosecution. In August 1988, Minucher filed Civil Case before the Regional Trial Court (RTC) for damages on the trumped-up charges of drug trafficking made by Arthur Scalzo ISSUE: WON private respondent Arthur Scalzo can be sued provided his alleged diplomatic immunity conformably with the Vienna Convention on Diplomatic Relations RULING: The SC DENIED the petition. Conformably with the Vienna Convention, the functions of the diplomatic mission involve, the representation of the interests of the sending state and promoting friendly relations with the receiving state. Only diplomatic agents, are vested with blanket diplomatic immunity from civil and criminal suits. Indeed, the main yardstick in ascertaining whether a person is a diplomat entitled to immunity is the determination of whether or not he performs duties of diplomatic nature. Being an Attache, Scalzos main function is to observe, analyze and interpret trends and developments in their respective fields in the host country and submit reports to their own ministries or departments in the home government. He is not generally regarded as a member of the diplomatic mission. On the basis of an

erroneous assumption that simply because of the diplomatic note, divesting the trial court of jurisdiction over his person, his diplomatic immunity is contentious. Under the related doctrine of State Immunity from Suit, the precept that a State cannot be sued in the courts of a foreign state is a long-standing rule of customary international law. If the acts giving rise to a suit are those of a foreign government done by its foreign agent, although not necessarily a diplomatic personage, but acting in his official capacity, the complaint could be barred by the immunity of the foreign sovereign from suit without its consent. Suing a representative of a state is believed to be, in effect, suing the state itself. The proscription is not accorded for the benefit of an individual but for the State, in whose service he is, under the maxim par in parem, non habet imperium that all states are sovereign equals and cannot assert jurisdiction over one another. The implication is that if the judgment against an official would require the state itself to perform an affirmative act to satisfy the award, such as the appropriation of the amount needed to pay the damages decreed against him, the suit must be regarded as being against the state itself, although it has not been formally impleaded A foreign agent, operating within a territory, can be cloaked with immunity from suit but only as long as it can be established that he is acting within the directives of the sending state. The consent of the host state is an indispensable requirement of basic courtesy between the two sovereigns. The buy-bust operation and other such acts are indication that the Philippine government has given its imprimatur, if not consent, to the activities within Philippine territory of agent Scalzo of the United States Drug Enforcement Agency. In conducting surveillance activities on Minucher, later acting as the poseur-buyer during the buy-bust operation, and then becoming a principal witness in the criminal case against Minucher, Scalzo hardly can be said to have acted beyond the scope of his official function or duties. NICOLAS vs. ROMULO FACTS: Herein respondent, Lance Corporal Daniel Smith, is a member of the United States Armed Forces. He was charged with the crime of rape committed against a Filipina, Suzette S. Nicolas.

Pursuant to the Visiting Forces Agreement (VFA) between the Republic of the Philippines and the United States, the United States, at its request, was granted custody of defendant Smith pending the proceedings. During the trial, the US Government faithfully complied with its undertaking to bring defendant Smith to the trial court every time his presence was required. Eventually, the Regional Trial Court rendered its Decision, finding defendant Smith guilty. He shall serve his sentence in the facilities that shall be agreed upon by appropriate Philippine and United States pursuant to the VFA. Pending agreement on such facilities, accused is hereby temporarily committed to the Makati City Jail. However, defendant was taken out of the Makati jail by a contingent of Philippine law enforcement agents, and brought to a facility for detention under the control of the United States government, provided for under new agreements between the Philippines and the United States, referred to as the Romulo-Kenney Agreement. This agreement provides that in accordance with the Visiting Forces Agreement signed, Smith, United States Marine Corps, be returned to United States military custody at the U.S. Embassy in Manila. Petitioners contend that the Philippines should have custody of Smith because if they would allow such transfer of custody of an accused to a foreign power is to provide for a different rule of procedure for that accused. The equal protection clause of the Constitution is also violated. ISSUE: Whether or Not there is a violation of the equal protection clause. HELD: The equal protection clause is not violated, because there is a substantial basis for a different treatment of a member of a foreign military armed forces allowed to enter our territory and all other accused. The rule in international law is that a foreign armed forces allowed to enter ones territory is immune from local jurisdiction, except to the extent agreed upon. The Status of Forces Agreements involving foreign military units around the world vary in terms and conditions, according to the situation of the parties involved, and reflect their bargaining power. But the principle remains, i.e., the receiving State can exercise jurisdiction over the forces of the sending State only to the extent agreed upon by the parties.

As a result, the situation involved is not one in which the power of this Court to adopt rules of procedure is curtailed or violated, but rather one in which, as is normally encountered around the world, the laws (including rules of procedure) of one State do not extend or apply except to the extent agreed upon to subjects of another State due to the recognition of extraterritorial immunity given to such bodies as visiting foreign armed forces. Applying, however, the provisions of VFA, the Court finds that there is a different treatment when it comes to detention as against custody. It is clear that the parties to the VFA recognized the difference between custody during the trial and detention after conviction, because they provided for a specific arrangement to cover detention. And this specific arrangement clearly states not only that the detention shall be carried out in facilities agreed on by authorities of both parties, but also that the detention shall be "by Philippine authorities." Therefore, the Romulo-Kenney Agreements of December 19 and 22, 2006, which are agreements on the detention of the accused in the United States Embassy, are not in accord with the VFA itself because such detention is not "by Philippine authorities." Respondents should therefore comply with the VFA and negotiate with representatives of the United States towards an agreement on detention facilities under Philippine authorities as mandated by Art. V, Sec. 10 of the VFA. The Visiting Forces Agreement (VFA) between the Republic of the Philippines and the United States, is UPHELD as constitutional, but the Romulo-Kenney Agreements are DECLARED not in accordance with the VFA.

MARCOS V. MANGLAPUS FACTS: February 1986, Ferdinand E. Marcos was deposed from the presidency via the non-violent people power revolution and forced into exile. In his stead, Corazon C. Aquino was declared President of the Republic under a revolutionary government. Now, Mr. Marcos, in his deathbed, has signified his wish to return to the Philipppines to die. But Mrs. Aquino, considering the dire consequences to the nation of his return at a time when the stability of government is threatened from various directions and the economy is just beginning to rise and move forward, has stood firmly on the decision to bar the return of Mr. Marcos and his family. Petitioners assert that the right of the Marcoses to return to the Philippines is guaranteed under the following provisions of the Bill of Rights, to wit: Section 1. No person shall be deprived of life, liberty, or property without due process of law, nor shall any person be denied the equal protection of the laws. Section 6. The liberty of abode and of changing the same within the limits prescribed by law shall not be impaired except upon lawful order of the court. Neither shall the right to travel be impaired except in the interest of national security, public safety, or public health, as may be provided by law. Furthermore, they contend that the President is without power to impair the liberty of abode of the Marcoses because only a court may do s o within the limits prescribed by law. Nor may the President impair their right to travel because no law has authorized her to do so. They advance the view that before the right to travel may be impaired by any authority or agency of the government, there must be legislation to that effect. The petitioners further assert that under international law, the right of Mr. Marcos and his family to return to the Philippines is guaranteed. The Universal Declaration of Human Rights provides:

Article 13. (1) Everyone has the right to freedom of movement and residence within the borders of each state. (2) Everyone has the right to leave any country, including his own, and to return to his country. Likewise, the International Covenant on Civil and Political Rights, which had been ratified by the Philippines, provides: Article 12 1) Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence. 2) Everyone shall be free to leave any country, including his own. 3) The above-mentioned rights shall not be subject to any restrictions except those which are provided by law, are necessary to protect national security, public order (order public), public health or morals or the rights and freedoms of others, and are consistent with the other rights recognized in the present Covenant. 4) No one shall be arbitrarily deprived of the right to enter his own country. ISSUES: Whether or not the President has the power under the Constitution, to bar the Marcoses from returning to the Philippines. Whether or not the President acted arbitrarily or with grave abuse of discretion amounting to lack or excess of jurisdiction when she determined that the return of the Marcoses to the Philippines pos es a serious threat to national interest and welfare and decided to bar their return. HELD: SC well-considered opinion that the President has a residual power which justifies her act of banning the return of the Marcoses and she did not act arbitrarily or with grave abuse of discretion in determining that the return of former President Marcos and his family at the present time and under present circumstances poses a serious threat to national interest and welfare and in prohibiting their return to the Philippines. It must be emphasized that the individual right involved is not the right to travel from the Philippines to other countries or within the Philippines. These are what the right to travel would normally connote. Essentially, the right involved is the right to return to ones country, a totally distinct right under international law, independent from although related to the right to travel. Thus, the Universal Declaration of Humans Rights and the International Covenant on Civil and Political Rights treat the right to freedom of movement and abode within the territory of a state, the right to leave a country, and the

right to enter ones country as separate and distinct rights. The Declaration speaks of the right to freedom of movement and residence wit hin the borders of each state [Art. 13(l)] separately from the right to leave any country, including his own, and to return to his country. [Art. 13(2).] On the other hand, the Covenant guarantees the right to liberty of movement and freedom to choose his residence [Art. 12(l)] and the right to be free to leave any country, including his own. [Art. 12(2)] which rights may be restricted by such laws as are necessary to protect national security, public order, public health or morals or enter qqqs own country of which one cannot be arbitrarily deprived. [Art. 12(4).] It would therefore be inappropriate to construe the limitations to the right to return to ones country in the same context as those pertaining to the liberty of abode and the right to travel. The right to return to ones country is not among the rights specifically guaranteed in the Bill of Rights, which treats only of the liberty of abode and the right to travel, but it is our well-considered view that the right to return may be considered, as a generally accepted principle of international law and, under our Constitution, is part of the law of the land [Art. II, Sec. 2 of the Constitution.] However, it is distinct and separate from the right to travel and enjoys a different protection under the International Covenant of Civil and Political Rights, i.e., against being arbitrarily deprived thereof [Art. 12 (4).] Although the 1987 Constitution imposes limitations on the exercise of specific powers of the President, it maintains intact what is traditionally considered as within the scope of executive power. Corollarily, the powers of the President cannot be said to be limited only to the specific powers enumerated in the Constitution. In other words, executive power is more than the sum of specific powers so enumerated. To the President, the problem is one of balancing the general welfare and the common good against the exercise of rights of certain individuals. The power involved is the Presidents residual power to protect the general welfare of the people. It is founded on the duty of the President, as steward of the people. The Constitution declares among the guiding principles that [t]he prime duty of the Government is to serve and protect the people and that [t]he maintenance of peace and order, the protection of life, liberty, and property, and the promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy. [Art. II, Secs. 4 and 5.] More particularly, this case calls for the e xercise of the Presidents powers as protector of the peace. The power of the President to keep the peace is

not limited merely to exercising the commander-in-chief powers in times of emergency or to leading the State against external and internal threats to its existence. The President is not only clothed with extraordinary powers in times of emergency, but is also tasked with attending to the day-to-day problems of maintaining peace and order and ensuring domestic tranquility in times when no foreign foe appears on the horizon. Wide discretion, within the bounds of law, in fulfilling presidential duties in times of peace is not in any way diminished by the relative want of an emergency specified in the commander-in-chief provision. For in making the President commander-inchief the enumeration of powers that follow cannot be said to exclude the Presidents exercising as Commander-in- Chief powers short of the calling of the armed forces, or suspending the privilege of the writ of habeas corpus or declaring martial law, in order to keep the peace, and maintain public order and security. The Court cannot close its eyes to present realities and pretend that the country is not besieged from within by a well-organized communist insurgency, a separatist movement in Mindanao, rightist conspiracies to grab power, urban terrorism, the murder with impunity of military men, police officers and civilian officials, to mention only a few. The documented history of the efforts of the Marcoses and their followers to destabi lize the country, as earlier narrated in this ponencia bolsters the conclusion that the return of the Marcoses at this time would only exacerbate and intensify the violence directed against the State and instigate more chaos. The State, acting through the Government, is not precluded from taking preemptive action against threats to its existence if, though still nascent they are perceived as apt to become serious and direct. Protection of the people is the essence of the duty of government. The preservation of the State the fruition of the peoples sovereignty is an obligation in the highest order. The President, sworn to preserve and defend the Constitution and to see the faithful execution the laws, cannot shirk from that responsibility. We cannot also lose sight of the fact that the country is only now beginning to recover from the hardships brought about by the plunder of the economy attributed to the Marcoses and their close associates and relatives, many of whom are still here in the Philippines in a position to destabilize the country, while the Government has barely scratched the surface, so to speak, in its efforts to recover the enormous wealth stashed away by the Marcoses in foreign jurisdictions. Then, We cannot ignore the continually increasing burden imposed on the economy by the excessive foreign borrowing during the Marcos regime, which stifles and stagnates development and is one of the root causes of widespread poverty and all its attendant ills. The resulting

precarious state of our economy is of common knowledge and is easily within the ambit of judicial notice INTERNATIONAL SCHOOL V. QUISUMBING FACTS: Private respondent International School, Inc. (School), pursuant to PD 732, is a domestic educational institution established primarily for dependents of foreign diplomatic personnel and other temporary residents. The decree authorizes the School to employ its own teaching and management personnel selected by it either locally or abroad, from Philippine or other nationalities, such personnel being exempt from otherwise applicable laws and regulations attending their employment, except laws that have been or will be enacted for the protection of employees. School hires both foreign and local teachers as members of its faculty, classifying the same into two: (1) foreign-hires and (2) local-hires. The School grants foreign-hires certain benefits not accorded local-hires. Foreign-hires are also paid a salary rate 25% more than local-hires. When negotiations for a new CBA were held on June 1995, petitioner ISAE, a legitimate labor union and the collective bargaining representative of all faculty members of the School, contested the difference in salary rates between foreign and local-hires. This issue, as well as the question of whether foreign-hires should be included in the appropriate bargaining unit, eventually caused a deadlock between the parties. ISAE filed a notice of strike. Due to the failure to reach a compromise in the NCMB, the matter reached the DOLE which favored the School. Hence this petition. ISSUE: Whether the foreign-hires should be included in bargaining unit of local- hires. RULING: NO. The Constitution, Article XIII, Section 3, specifically provides that labor is entitled to humane conditions of work. These conditions are not restricted to the physical workplace the factory, the office or the field but include as well the manner by which employers treat their employees.

Discrimination, particularly in terms of wages, is frowned upon by the Labor Code. Article 248 declares it an unfair labor practice for an employer to discriminate in regard to wages in order to encourage or discourage membership in any labor organization. The Constitution enjoins the State to protect the rights of workers and promote their welfare, In Section 18, Article II of the constitution mandates to afford labor full protection. The State has the right and duty to regulate the relations between labor and capital. These relations are not merely contractual but are so impressed with public interest that labor contracts, collective bargaining agreements included, must yield to the common good. However, foreign-hires do not belong to the same bargaining unit as the local-hires. A bargaining unit is a group of employees of a given employer, comprised of all or less than all of the entire body of employees, consistent with equity to the employer indicate to be the best suited to serve the reciprocal rights and duties of the parties under the collective bargaining provisions of the law . The factors in determining the appropriate collective bargaining unit are (1) the will of the employees (Globe Doctrine); (2) affinity and unity of the employees interest, such as substantial similarity of work and duties, or similarity of compensation and working conditions (Substantial Mutual Interests Rule); (3) prior collective bargaining history; and (4) similarity of employment status. The basic test of an asserted bargaining units acceptability is whether or not it is fundamentally the combination which will best assure to all employees the exercise of their collective bargaining rights. In the case at bar, it does not appear that foreign-hires have indicated their intention to be grouped together with local-hires for purposes of collective bargaining. The collective bargaining history in the School also shows that these groups were always treated separately. Foreign-hires have limited tenure; local-hires enjoy security of tenure. Although foreign-hires perform similar functions under the same working conditions as the local-hires, foreign-hires are accorded certain benefits not granted to local-hires such as housing, transportation, shipping costs, taxes and home leave travel allowances. These benefits are reasonably related to their status as foreignhires, and justify the exclusion of the former from the latter. To include foreign-hires in a bargaining unit with local-hires would not assure either group the exercise of their respective collective bargaining rights.

WHEREFORE, the petition is GIVEN DUE COURSE. The petition is hereby GRANTED IN PART.
