Executive Summary: The project Healing and Empowering marginalized communities in India started from 1st January, 2013. In a year the project contributed in empowering bottom up rights based approach with a top down advocacy and lobby strategy to cooperate, collaborate and coordinate; an opportunity to engage various government agencies including the national human rights Page 2 of 26

commission at the district and provincial levels; an opportunity to raise and represent the voices of the communities. So, in October, 2013 NHRC organized public hearing on SCs in which 123 cases were heard out of these 63 cases were reported from torture free model villages. The hearing ascertain the socio economic rights of the marginalized and article 21 of the constitution of India. It protection and provided assistance to marginalized families. 97 bonded labour received release certificate and case registered under Sc/St Act against the brick kiln owner. The total compensation 7760000 INR. The musahar of 30 villages of Varanasi district were benefited with a right to a job Job card under MNREGA, right to a home, right to water and identity as their dignity The psycho social support through testimonial therapy, folk school and capacity building workshop and various activities helped them speak without fear and without the threat of humiliation. First time most musahar felt honoured after being seriously heard by the members of the NHRC. The honor ceremonies and folk school established communal harmony, secularism and plural democracy. The observant of the community leaders and the activist prevented the happening the communal riot. The project had heightened its advocacy and had utilized the voices of the people in the pursuit of policy changes at varying levels to ascertain article 23 of the Indian constitution Prohibition of traffic in human beings and forced labour because in the previous project it was observed that contemporary form of slavery is flourishing and 243 cases of bonded labour were reported. The project organized public hearing to ensure human dignity against on bonded labour and children labour. In the hearing 40 cases were heard before the commission. Which result the inclusion of brick kiln owner in the MNREGA scheme. The issues related to the children and monitoring were also on precedence and 10 children were supported by the emergency fund of 1000 INR by the Government. Through various street movement like Satyagraha and meeting with interface meeting political parties and parliamentarian PVCHR advocate for the ratification of UNCAT and enactment of Prevention of Torture Bill and published book Respect Survivors & Abolish Torture torture law and police reform no real democratic & pluralistic democracy . The social media and media are used for the promotion of activities and the important issues and concerns that it brought to the attention of the greater public and it provide space in the print and electronic media for publishing of their self-suffering and broadcasting of their cultural activities in election media such as Karma. The news of the activities published in various daily Hindi and English newspaper. Such as quotation of Dr. Lenin published in Hindustan Times on The Freedom from torture is human rights but torture continue to trouble people who are gullible. PVCHR also

collaborated with Human Rights Watch on the issue of child sexual abuse in India Breaking the silence: Child Sexual Abuse in India. Due to which few survivors and activist were interviewed. In this year social media helped for the monitoring of cases of human rights violation 175 complained was filed across India on various issues and was successfully used for filling complaint against concerned authorities. The compensation of 7100000 INR were paid to the survivors and summons was issued to the various concerned authorities of the state. The complaint on the witch hunting contributed to state women commission, Assam for making law on witch hunting. The project had successfully used the media for social change through videos on various programme and issues. The project also concentrated on the condition of the prison, remand home and samwasini grih (women shelter home) and filed RTI to know the condition and filed PIL on three issues: Right of education of the children who are living in different prisons of Uttar Pradesh along with their mothers.i On that PIL Honble High Court gave Judgmentii. Right to education and recreational facilities to the children languishing in jails with their mother. To ensure the appointment of one doctor available to the women prisoners in Naini Central Jails on daily basis and one gynecologist and a child specialist to visit the womens wards of Naini Central Jail To implement the activities at the grass root level the staffs of the project were trained on the ToT workshop on testimonial therapy and incessant supervision workshop with focus on learning and sharing process. The project also contributed in making lobby and advocacy for the survivors of TOV at the sub regional and international level submitted report to Ms. Rashida Manjoo UN Special Rapporteur on violence against women and also intervened against the death penalty. The research paper on PVCHR-DIGNITY Danish Institute Against Torture joint initiative of testimonial therapy published in library of Inter-American Court of Human Rights (http://www.corteidh.or.cr/index.php/en/about-us). Many documents are uploaded on various sites. Make presence at various national and regional forums like meeting of South Asia Network Against Torture and Impunity (SANTI) and SDMA workshop. A. Women Convention: Savitri Bai Phule Women Forum (SWF) and PVCHR organized a women convention on 10 March as Indian Women Liberation Day in memory of Savitri Bai Phule. In the convention women took pledge against all type of exploitation, discrimination and injustice against women and child marriage. They affirm their commitment for education for girl against child marriage.iv 2. Base line data survey: The Base line data survey (BLD) filled in 72 villages of each individual family as comprehensive situation analysis involves three steps: (1) gathering information; (2) prioritization; and (3) analysis. The analysis of model village 3. Meri Pehchan (My identity is my dignity) campaign: After the analysis of baseline data survey first phase of campaign "Meri Pehchan" (My identity) flagged in 72 model villages of Badagaon, Pindra blocks of Varanasi, Tanda block of Ambedkar Nagar, Robertsganj block of Sonbhadra, Chaka block of Allahabad and Domchach block of Jharkhand state of India. The School Management Committee (SMC) had to formed under the Rights to Education Act, 2009 in entire Uttar Pradesh from 22nd July to 5th August, 2013. Page 6 of 26

The activists along with community leaders actively monitor the process of election of SMCs in each Government school of their respective blocks. 5. Malnutrition mapping of children: The health mapping of children continued in 20 villages of Badagaon and Pindra blocks of Varanasi. 6. Satyagrah: Satyagrah (Human rights street movement) for rule of law and human rights defenders from 15th August, 2013 and it continues for a months in various place of Uttar Pradesh and Jharkhand with the participation of thousands of people. The movement was to raise voices against drug Mafia, Sex mafia, police atrocity and apathy of cases against Human Rights defenders in various part of Uttar Pradesh. This satyagrah started on 15th August, 2013 and continues for four days in front of street of PVCHR office and after it continuous in various part of Uttar Pradesh. On 18th September, 2013 its first phase culminated in front of the Vidhan Sabha Bhawan, Lucknow. www.logsatyagraha.com To use activities in model block such as publication of pamphlets and posters to increase awareness for the prevention of torture, enactment of domestic law against torture in context of UNCAT and ratification of UNCAT. As an activist knowledge center PVCHR developed the pamphlets, posters and flax on the given below issues to developed understanding and increase awareness for the prevention of torture and ratification of UNCAT on the following Acts and guideline: 1. 8. Format for job card and asking for work under Mahatma Gandhi National Rural Employment Guarantee Act (MNREGA) was printed and distributed 9. 10 community leaders from Domchach village were trained on the using initial write complain and use of Right to Information Act. PVCHR organized fortnight celebration from 30th May 15th June, 2013 in Model blocks such as Robertsganj, Tanda, Pindra and Badagaon of Uttar Pradesh. The ceremonies were organized in various forms through discussion on women rights, cultural program, discussion on neo dalit, folk school and bringing solidarity and secularism. In the ceremony first time PVCHR honoured Mr. Shivam Gupta, Volunteer from Pindra block and Mr. Shiv Pratap Chaubey, Model Block Co-ordinator, Pindra with Neo-Dalit Award.

Objective 2: Promoting psychosocial support of the survivors, their families and communities. To identify survivors for the testimonial therapy through fact finding mission. To arrange interface (diverse group interact) with 40 different stakeholders i.e. Police department, lawyers, district legal service authority and psychologist and psychiatric, human rights institutions, policy makers and media

Peoples Vigilance Committee on Human Rights (PVCHR) jointly with the Danish Institute Against Torture (dignity) in collaboration with Voice of People and QICAC organised the public hearing against bonded labour and child labour to protest human dignity. In the hearing 40 cases were heard before Dr. Yogesh Dube, the member of the National Child Protection Commission and chairperson of the core committee for eradication of bonded labour in Uttar Pradesh along with Ms Shameena Shafiq, member National Womens Commission, and Assistant Registrar, National Human Rights Commission Mr. O.P Vyas. Former DGP Uttarakhand Mr. Jyotiswaroop Pandey and Ravindra Singh Dogra the secretary of the Panchayati raj and Rastravadi Granthalaya was special guest. During the program a report on the bonded labour The dark site of India was released. xii Outcome: The brick kiln was included in the MNRGA scheme and also one female worker will act as an ICDS worker in brick kiln to prevent malnutrition.xiii

To select cases for the direct immediate assistance such as legal, medical, transportation, meta legal intervention and other welfare assistance.

Meta Legal: 900 Meta-Legal intervention with various concerned authorities at different level. Open hearing: Varanasi: 1. National Human Rights Commission (NHRC) organized open hearing on the atrocities against Scheduled Castes and the problems being faced by them in seeking justice from the State Govt. agencies on 26-27 November, 2013 at Commissioner's Office Meeting Hall/Auditorium, Opposite Vikas Bhavan, Kacheri,

Varanasi (UP). The public hearing was headed by the Chairperson, Hon'ble Justice Shri K. G. Balakrishnan, Members Justice Shri D.Murugesan and Shri S.C. Sinha, Registrar (Law) Shri A.K.Garg and other senior officers of the Commission were the part of the delegation. The Commission had issued a public notice calling for complaints of atrocities by public servant or of negligence by a public servant in prevention of atrocities from the persons belonging to Scheduled Castes residing in the Varanasi Division comprising of Chandauli, Ghazipur, Jaunpur and Varanasi Districts of Uttar Pradesh. The Commission after due consideration, has decided to take up 123 cases during the Open Hearing and in which 63 cases were reported from Torture free model blocks of Badagaon and Pindra blocks of Varanasi.xiv Outcome of hearing: 97 bonded labours received the release certificate and on the direction of the NHRC case registered against Brick Kiln owner under SC/St Act and each of them will receive 80,000/- i.e. 7760000 Indian Rupeed.xv In 30 villages Birth Registration Certificate, Caste certificate, Ration Card, Job card under MNREGA scheme, Old age pension, handicapped card, distribution of blanket in four villages Anei , Hamirapur, Awrao and Ahirabeer villages. Lucknow: National Human Rights Commission organized "A Camp Sitting at Lucknow from 15th to 17th January, 2014. In the sitting two cases of the PVCHR heard before the commission.

Interventions: In many cases NHRC issued summon notice to various authorities such as Chief Secretary, SSP, Varanasi and Secretary, Department of Health, Government of Uttar Pradesh and also bailable warrant to the Chief Secretary of Madhya Pradeshxvi The Chief Secretary, Government of Uttar Pradesh, is asked to direct his officers to forward to the Commission all available information in the first instance in futurexvii NHRC asks the Delhi Govt. to pay rupees five lakhs as monetary relief to a victim of sexual harassment by a police constablexviii The fact-finding team of NHRC (Deputy Inspector) visited the Dumariya and Devduttpur village of Chandauli against the case registered.xix NHRC issues notices to the Chief Secretary, UP and DMs, Muzaffarnagar & Shamli on allegations of children's death due to cold in relief camps.xx Legal: 1. Objective 3: Mobilizing civil society and academia towards advocacy for justice and prevention of the survivors of torture and lobby and advocacy for the survivors of TOV at the Sub Regional and International Level To utilize print media and alternate media for the publication of stories in media (based on the testimonies and learning from the project especially model block and torture free village process in context of institutional reform). The right to information (RTI) was used to monitor the prison and used to collect the information of the facilities provided in the prison and Nari Niketan (shelter home for women) and Bal Sanrakshan Grih (Remand Home).

To increase the Meta Legal Intervention: accountability of 20 cases of detention and focus on prison reform. institutions about Shri Anil Parashar, Joint Registrar, National Human Rights Commission visited detention and prison. Varanasi prison 16 cases of detention were intervened with various concerned authorities. In case no. 11787/24/Crime u/s 3 (2) (v) of SC/ST (POA) was added against against the SHO of GRP, Jhansi. NHRC issued summon to various authorities such as Chief Secretary, SSP and District Magistrate.

Outcome After complain new prison constructed in Sonbhadra district of Uttar Pradesh and 15 new barrack constructed in Varanasi central prison. Received communication from H.E Governor office with direction to Chief Secretary, Uttar Pradesh for taking appropriate action. 13 lakhs compensation to survivors: first step of breaking of silence.xxxiv In the cases of detention NHRC directed for the compensation of 8, 00000 (8 lakhs rupees). 1. Legal: PIL on the following subjects: Right of education of the children who are living in different prisons of Uttar Pradesh along with their mothers.xxxv On that PIL Honble High Court gave Judgmentxxxvi. During the tribunal around 30 to 40 victims deposited before a six-member panel of prominent judges, academicians, former police officials with necessary testimonies about their problems. In the tribunal cases from communal riot in Tanda, police firing in Bazardiha and communal riots in Kudi was shared.lviii Met with Shri K.G Balakrishnan, Chairperson, NHRC, Sharad Chandra Saxena, Member, NHRC, A.K. Parashar, and C.K Tyagi On 26th June, 2013 at 2 pm the delegates of PVCHR in the leadership of Dr. Lenin met with Shri Akilesh Yadav, Chief Minister, U.P and Director General of Police Shri Deo Raj Nagar at CM house 5, Kali Das Marg, Lucknow.
