I, Ana Nazer Y. Gracia of legal age, single and a resident of 121 Mabini Street, Biasong, Dipolog City, under oath, depose and say: Q1. What is you purpose in executing this affidavit? A. To file a criminal complaint for RECKLESS IMPRUDENCE RESULTING TO DAMAGE OF PROPERTY against Julius Adorabeh, whose address is at Gampis, Sicayab, Dipolog City. Q2. Why? A. He was responsible for the considerable damage to my car, a BLACK FERRARI bearing plate number LMA 213, by colliding it with his car, red MITSHUBISHI, he was driving in a very fast and in reckless manner, without taking into consideration the condition of the road, that in spite of a heavy traffic the road was at that time, and that I was giving signal beforehand that I was about to turn left. Q3. When did this happen? A. Last May 1, 2011 at around 5:30 in the afternoon. Q4. Do you have any companion? A. Yes, my friends namely Felina Comoy and Ricca Basas, both of legal ages, singles and residents of Polanco, Zamboanga del Norte and Biasong, Dipolog City respectively, were on board with me. Q4. Where did the accident happen? A. At the national highway along Gen. Luna Street, Estaka, Dipolog City. Q5. While driving said vehicle, what happen along the way? A. While driving my car with my friends heading to the direction of the City Rotonda, in cautious and prudent manner and in lawful speed, when it was about for us to turn left at the intersection going Lapu-Lapu Street, a red Mitsubishi car came ramming into my car, colliding the right-hand side of my car. The red Mitsubishi was driven by a person named Julius Adorabeh, of legal age who is residing at Gampis, Sicayab Dipolog City which darted at said intersection heading south direction going to City Boulevard. Q6. Did you take any effort to avoid the collision? A. Yes, in fact, I stopped my car with the signal lights were blinking on when I was about to turn left to enter Lapu-Lapu street. And I can fully remember that I was blowing my cars horn at that time. Despite the facts that the road is slippery because of the bad weather condition, his car was at full speed causing to collide and bump my car. Q7. How much is the damaged caused to your vehicle? A. The repair will cost me Php 125, 000.00 sir. Q8. Do you have anything more to say? A. No more unless further asked.
