of Deeds RE: Integrity of our land records and fraudulent foreclosures Dear Register, On June 28, 2011 - Registers, registrars and recorders from across the country gathered in Atlantic City for the Annual Conference of The International Association of Clerks, Recorders, Election Officials and Treasurers (IACREOT). It is my understanding that Register John OBrien of the South Essex Registry of Deeds educated professionals like you regarding the current condition of land record integrity in his Land Registry, as well as in the Commonwealth of Massachusetts. Register OBrien declared his Registry a literal crime scene. A crime scene resulting from the vast number of mortgage documents that were filed in the Southern Essex County Land Recording System by financial institutions/banks and Servicers; documents riddled with error, misrepresentations of fact, and illegal property claims. My question to you is it appears little, or nothing has been done to effect change in our County since that national conference. However, both national and local media have featured countless stories of Lender and Service Provider greed, documented their complete disregard of the real property laws in this country, and the legal due process taken from US property owners. Although banks have incurred heavy fines, they are a mere pittance compared to the magnitude of the damage incurred, but the malfeasance continues, although slightly diminished. Registers of Deeds, in other counties, and around the United States have begun to demonstrate courage, and to protect homeowner rights, the integrity of the land records in their charge, and to perform the fiduciary responsibilities they have sworn to uphold However you not taken a stand on these issues? Why? You have not demonstrated leadership around these critical matters, nor demonstrated any capacity to be an agent of change. My question to you is why? We now know that tens of thousands of documents were recorded in our county, which are complete misrepresentations of the truth and literally millions around the country have experienced the same. These Assignments, particularly processed through the banking industrys Mortgage Electronic Registration System (MERS), have been used to pollute our Land Recording System. These same documents have been used to perpetuate foreclosure activities, particularly since the 2008 Wall Street collapse foreclosures that should be voided because these Assignments and the actions behind them are illegal. Homes were literally ripped from defenseless homeowners. Soon Main Street Americans will come to understand their rights have

been violated too they just witnessed the largest land grab in their lifetimes, albeit unknowingly, and they will be knocking on every Registers and Attorney Generals Office doors! Main Street Americans dont yet understand that these same illegal documents and acts have been actuated on their properties, and this by-product impacts the very sanctity of their own real property records, not just those experiencing foreclosure. Almost every US citizen today has had their real property transferred into securitized Trusts unknowingly, and behind the scenes. These activities now affect hundreds of thousands of properties throughout the Commonwealth, and created a situation whereby homeowners now have unmarketable Titles. Unmarketable titles mean that at some point in time, property rights can be challenged, and will require expensive legal and/or surveying engagements to repair. How? By creating clouded Chains-of-Title. Clouded Chains-of -Title Property records, both foreclosed or not, are riddled with mortgage transactions that misrepresent, and are inaccurate these transgressions put a cloud over every subsequent property record, and complicate our rights to readily sell our homes - legally unencumbered, to refinance our mortgage, or to extract equity from the most significant investment of our lifetimes our homes and property. Much of this misrepresentation presents itself in the form of illegal Assignments of Mortgage, used to fuel fraudulent foreclosures, and to take property rights. Frequently, these acts declare the sale of a mortgage loan via MERS by a ghost Lender. The fact is MERS obscures from the public view the financial entity that is the legal holder of our Promissory Note, or has the right to foreclose on a property owner, or to collect our monthly mortgage payments in the name of some unheard of securitized Trust, with nameless investors. Fraudulent Foreclosures There are estimates as high as 91% showing ALL foreclosures done over the past decade are factually void, and this issue deserves your immediate attention. Cleaning up our polluted Land Registry has become a social and economic problem that is not going to disappear. In fact, as we become more educated, homeowners will demand the repair to the integrity of our Land Recording Systems, since it has become increasingly clear, the average citizen will be left to bear the burden of the debacle created by the banks. Like the mining companies that strip-mine the earth, our financial institutions, their malfeasant acts completely unregulated by the way, have been allowed to literally extract the wealth from our real property system, and to park these profits in off-shore accounts, amounting to trillions of dollars. Also, each fraudulent foreclosure, especially via MERS means that our counties have been cheated of millions of dollars of county revenue normally required from land recordings revenue not collected on land recording transactions hidden in the unregulated execution of the MERS System. When will you investigate this matter in our county Registry? Our land records are damaged, and our County has been stripped of much needed revenues. When will you act on behalf of your constituents, and do to the right thing?

Land Registry Repair As one of your constituents, I call on you to execute your authority and to honor your job commitment to maintain a Land Recording System with integrity, and to meet your County fiduciary responsibilities. To that end, it is time for you to engage a professional Land Record Audit. WE THE PEOPLE demand from you, similar efforts, and nothing less than those of Register John OBrien, and First Assistant Register Kevin Harvey. You can no longer sit idly because your inaction is tantamount to the same thing. I demand a written response from you, outlining your intentions to repair our Land Registry. It is your job to protect our land records, and to perform the very job you were elected to do. Inaction means that you should be removed from your job, and WE THE PEOPLE will work to see that you are if you choose to do nothing. I am sending this letter by USPS certified mail, so there can be no question that you have been notified of this travesty. Make no mistake this is a call-toaction. Your lack of response will leave me and many of your constituents with no other conclusion than you have no intention of righting the wrongs that have, and continue to be perpetrated on your watch. It is time for you to do your job, or WE THE PEOPLE will find a new Register by exercising our voting rights in the next election.
