2.7.4Culturalimpactassessment
Whenanassessmentisrequired 1. Aculturalimpactassessmentwillberequiredforallapplicationsrequiringaresourceconsentunder: a. theSitesandPlacesofSignificancetoManaWhenuaoverlay b. 2. theSitesandPlacesofValuetoManaWhenuaoverlay.

Aculturalimpactassessmentshouldbepreparedbyaniwiauthorityorapersonorentitynominated bytheiwiauthoritywithconfirmationofthisnominationprovidedinwritingbytherelevantiwiauthority representative(orrepresentativeswherethereismorethanonepotentiallyaffectediwiorhap). Aculturalimpactassessmentisnotrequirediftherepresentativeoftheiwiauthorityfromtherelevant ManaWhenuagroup(orgroupswherethereismorethanonepotentiallyaffectediwiorhap)confirm inwritingthataculturalimpactassessmentisnotnecessary. Wheresensitiveinformationisincludedinaculturalimpactassessment,thisinformationshouldbe crossreferencedandcontainedwithinanappendixtothereport.Protocolsshouldbeincludedwithin theappendixforhowtheinformationcanbeusedforthepurposesofs.42oftheRMAintermsof notification,hearingsandinresponsetoofficialinformationrequests. 9. WhereinformationwithinaculturalimpactassessmenthasbeenidentifiedbyManaWhenuaas sensitiveinformation,theprotocolsfortheuseoftheinformationcontainedwithinthereportmustbe followed.

Requestforadditionalinformation 10. WhereManaWhenuavaluesmaybeadverselyaffectedandaculturalimpactassessmenthasnot beenprovided,thecouncilmay: a. takeintoaccountthefailuretoprovideaculturalimpactassessmentinconsideringwhetherto accepttheapplicationunders.88oftheRMA b. requesttheapplicanttoprovide,orcommissionaculturalimpactassessmentaspartofany furtherinformationinaccordancewiths.92oftheRMA takeintoaccountthefailuretoprovideaculturalimpactassessmentinconsideringwhetherornot tonotifytheapplication.

Acopyofresourceconsentapplicationsforactivitieswithin,adjacentto,orimpactingonstatutory acknowledgementareaswillbeprovidedtopostsettlementgovernanceentitiesasdirectedbyrelevant TreatySettlementlegislation. 12. AcurrentlistoffinalDeedsofSettlement,TreatySettlementlegislationandstatutory acknowledgementswithinAucklandisincludedinAppendix4.2.Therequirementsofthelegislation mustbeconsideredinallresourcemanagementprocesses.
