2.7.4Culturalimpactassessment
Whenanassessmentisrequired 1. Aculturalimpactassessmentwillberequiredforallapplicationsrequiringaresourceconsentunder: a. theSitesandPlacesofSignificancetoManaWhenuaoverlay b. 2. theSitesandPlacesofValuetoManaWhenuaoverlay.

Aculturalimpactassessmentwillberequiredforallapplicationsrequiringaresourceconsentwithin: a. areassubjecttocustomarymarinetitleandprotectedcustomaryrightsareasundertheMarine andCoastalArea(TakutaiMoana)Act2011 b. areasorresourcessubjecttocustomaryusesorculturalactivitiesasidentifiedwithinareserve managementplanorculturalactivitiesmanagementplanthatisheldbythecouncil aplaceofsignificancetoMaoriidentifiedinthescheduleofsignificanthistoricheritageplaces sites,places,areasorresourcesofsignificanceidentifiedinfinalDeedsofSettlementandTreaty Settlementlegislationincluding: i. landreturnedoridentifiedforthepurposesofculturalredressorcommercialredress ii. areassubjecttostatutoryacknowledgementandotherstatutoryinstrumentsforcultural redress

Informationrequirements 4. Aculturalimpactassessmentmust: a. identifythenatureoftheactualorpotentialeffectsoftheproposalonManaWhenuavalues,and b. 5. appropriatelyaddresstheactualorpotentialeffectsoftheproposalonManaWhenuavalues.

Aculturalimpactassessmentshouldbepreparedbyaniwiauthorityorapersonorentitynominated bytheiwiauthoritywithconfirmationofthisnominationprovidedinwritingbytherelevantiwiauthority representative(orrepresentativeswherethereismorethanonepotentiallyaffectediwiorhap). Aculturalimpactassessmentisnotrequirediftherepresentativeoftheiwiauthorityfromtherelevant ManaWhenuagroup(orgroupswherethereismorethanonepotentiallyaffectediwiorhap)confirm inwritingthataculturalimpactassessmentisnotnecessary. Whereaculturalimpactassessmentisrequiredthefollowinginformationshouldbeincluded(insuch detailascorrespondswiththescaleandsignificanceoftheeffectsthattheactivitymayhaveonMana Whenuavalues): a. adescriptionoftheproposedactivity b. recognitionoftheManaWhenuawithintheareasubjecttotheapplicationandadescriptionof theirrelationshipwiththeareaandculturallandscape astatementoftheManaWhenuavaluesassociatedwithanyparticularresources,sitesorplaces affectedbytheactivity.Thesevaluesmaybeidentifiedthrough: i. referencedocuments ii. iii. iv. v. vi. vii. viii. ix. d. engagementwithManaWhenua recommendationsprovidedbyManaWhenuaorapersonnominatedbyManaWhenua hapuoriwiplanningdocuments culturalvaluesassessmentspreparedbyManaWhenua TreatySettlementdocumentsandrelatedlegislation MoriLandCourtrecords vhistoricalpublications anyotherrelevantinformation

Informationmanagementprotocols 8. Wheresensitiveinformationisincludedinaculturalimpactassessment,thisinformationshouldbe crossreferencedandcontainedwithinanappendixtothereport.Protocolsshouldbeincludedwithin theappendixforhowtheinformationcanbeusedforthepurposesofs.42oftheRMAintermsof notification,hearingsandinresponsetoofficialinformationrequests. 9. WhereinformationwithinaculturalimpactassessmenthasbeenidentifiedbyManaWhenuaas sensitiveinformation,theprotocolsfortheuseoftheinformationcontainedwithinthereportmustbe followed.

Requestforadditionalinformation 10. WhereManaWhenuavaluesmaybeadverselyaffectedandaculturalimpactassessmenthasnot beenprovided,thecouncilmay: a. takeintoaccountthefailuretoprovideaculturalimpactassessmentinconsideringwhetherto accepttheapplicationunders.88oftheRMA b. requesttheapplicanttoprovide,orcommissionaculturalimpactassessmentaspartofany furtherinformationinaccordancewiths.92oftheRMA takeintoaccountthefailuretoprovideaculturalimpactassessmentinconsideringwhetherornot tonotifytheapplication.

TreatySettlementnoticerequirements 11. Acopyofresourceconsentapplicationsforactivitieswithin,adjacentto,orimpactingonstatutory acknowledgementareaswillbeprovidedtopostsettlementgovernanceentitiesasdirectedbyrelevant TreatySettlementlegislation. 12. AcurrentlistoffinalDeedsofSettlement,TreatySettlementlegislationandstatutory acknowledgementswithinAucklandisincludedinAppendix4.2.Therequirementsofthelegislation mustbeconsideredinallresourcemanagementprocesses.
