ORDER

This matter comes on for trial pursuant to written notice. Each of the parties appear pro se and each testified. Plaintiff offered into evidence his exhibits 1-9 and defendant offered into evidence her exhibits 101-106, all of which were received without objection. Based on the record the court finds that plaintiff performed work on defendant's steps on a time and materials basis. The job required that the plaintiff tear out the old steps, dispose of the materials, dig out the footings, install a rock base and concrete pad and then the brick that had been purchased by defendant. It finds that the charges for materials are his actual charges and his charges for time are fair and reasonable. Defendant has concern about the safety of the steps because on two separate occasions bricks on the edge have come loose, one of which was re-glued by the plaintiff with no additional charge for his time. He also obtained another type of sand when the regular concrete sand did not stay in place and left the excess with the defendant. There is no evidence in the record that the materials were not installed contrary to ordinary accepted procedure. Plaintiff allowed defendant to pay in installments over several months with no service fees or interest charges. In light of all of the foregoing the court finds that the plaintiff is entitled to recover judgment for the balance due on the account in the amount of $98.00 plus interest at the rate of 2.13% per annum from January 7, 2014 and the costs of this action. It is so ORDERED.
