CONTRACT ACT 1. X beats Y and compels him to sell his house for Rs 100000.

Y agrees to sell his house to Y. Y signs the necessary documents for the sale of house and receives the payment. Later on, Y wants to avoid the contract? Will he succeed? 2. X, a poor Hindu widow, was in great need of money to establish her right to maintenance. She took a loan of Rs 1500 bearing a rate of interest of 100% p.a. Is this transaction an unconscionable? DISCHARGE OF CONTRACT Q1. The unloading of a ship was delayed beyond the date agreed with the shipowners owing to a strike of dock labourers. On a suit by the ship-owners for damages, the plea of impossibility of performance was raised. Advise the shipowners.

Q2. A contract to marry B in two years time. Shortly afterwards he breaks off the engagement without Bs consent. B writes repeatedly begging him to adhere to the contract. Just before the expiry of two years, a change in law makes it illegal for A to marry B. On the expiry of two years, B sues A for the breach of the contract. Will she succeed? Q3. A wine merchant contracts to sell to a customer 5 dozen bottles of a particular brand of champagne. At the time of the contract the wine merchants whole stock of wine had been destroyed by fire, but he was not aware of this fact. What is the effect on the legal rights of parties? Q4. A agrees to sell his scooter to B a month after the date of the contract. But just after 10 days of the contract he sells the scooter to C. There upon B sues A for the breach of contract. 15th June, X informs that he could not supply those goods. The rates of timber per cubic feet on various dates were on 15th June Rs 1200, On 1st July Rs 1300, on 30 Sept Rs 1400. State the legal position in each of the following cases; Case (a): If Y filed a suit for breach of contract on 15th June. Case (b): If Y filed a suit for breach of contract on 30th Sept. Case (c): If on 29th Sept the import of such goods was banned & Y filed a suit for breach of contract on 30th Sept Q9. X of Delhi agreed to sell 100 bales of cotton @ Rs 1000 per bale and to deliver within a fortnight at buyers godown at Lahore. X failed to supply these goods. State the legal position in each of the following cases: Case (a): If, unknown to both the parties, the goods were destroyed by fire at the time of agreement. Case (g): If these goods could not be delivered because of strike of transport operators. CONSUMER PROTECTION ACT Q1. I have instituted a complaint before the Consumer Court against a Medical Practitioner. My complaint has been challenge on the ground that a Medical Practitioner cannot be sued under the Consumer Act. What does law provide? Q2. I had purchased seeds from a party. The seeds did not germinate. The other party took the plea that I was not a consumer. Whether purchase of seeds for the purpose of agriculture is purchase for commercial purpose?
