TITLE III: CRIMES AGAINST PUBLIC ORDER

Chapter I. Rebellion, Coup detat, Sedition, and Disloyalty Article 134: Rebellion/ Insurrection 1. Actual clash of arms is not necessary when the accused is in conspiracy with those actually taking arms against the government. 2. Not necessary that purpose is accomplished provided that the Purpose or Intent to overthrow government must be proved. 3. Levying war against government during peace time--- Rebellion not Treason 4. Act of giving comfort or moral aid is not a crime in the case of Rebellion Article 134-A: Coup detat 1. Committed by: persons belonging to the military or police or holding any public office or employment a. May be committed by private individual if in conspiracy with the perpetrators 2. Means: Swift attack accompanied by violence, intimidation, threat strategy or stealth 3. Directed: Duly constituted authorities or any military camp or installation, communication networks, public utilities or other facilities needed for the exercise and continued possession of POWER 4. PURPOSE: Seize or Diminish state power Article 135 Penalty for Rebellion, Insurrection or Coup detat Who are liable: A. Leaders- PROMAHE; LEDICO B. Participants- PAREX; GS-PAREX, NGS-PASAF Deemed Leaders: Directed Spoke for them Signed Acts on behalf of the rebels

Article 136: Conspiracy and Proposal to commit coup detat, rebellion or insurrection

Article 137: Disloyalty of Public Officer or Employees Acts of Disloyalty: 1. By failing to resist a rebellion by ALL MEANS in their power 2. By continuing to discharge the duties of their offices under the CONTROL of REBELS 3. By ACCEPTING APPOINTMENT to office under them

Article 138: Inciting to rebellion or insurrection Elements: 1. Offender does not take arms or is not in open hostility against Govt 2. INCITES other to execute any acts of rebellion 3. By means of speeches, proclamations, writings, emblem, banners or other representation tending to the same end. Must not have committed rebellion otherwise: Principal by inducement

Article 139: Sedition 1. Social and Political Ends 2. At least 4 armed; creates public disturbances/ commotions for any of the 5 purposes. Article 140: Penalty for Sedition Article 141: Conspiracy to Commit Sedition 1. No proposal to commit sedition Article 142: Inciting to Sedition -Utterances that may endanger public order Elements: 1. Does not take direct part in the crime of sedition (otherwise liable for Sedition) 2. Incites others to the accomplishment of any acts which constitute sedition: a. Means of speeches, proclamations, writings, emblem b. Uttering seditious words or speeches which tend to disturb public peace.

c. Writings, publishing or circulating scurrilous libels- govt, which tend to disturb the public peace (low, vulgar, mean or foul i. Tend to disturb, obstruct lawful officer in executing its functions ii. Tend to instigate others to cabal and meet together for unlawful purposes iii. Suggest or incite rebellious conspiracies or riots iv. Lead or tend to stir up people against lawful authorities or to disturb the peace of community, the safety and order of the government EX.
