Name: Thomas Tullis Student ID: 951378892 ASUO Election Rules 9.

8 lists "harassment, intimidation, bribery or fraud with the intent of affecting the outcome of the election" as a severe campaign violation. I feel as though I have been victim of severe intimidation from the Mighty Oregon slate and specifically the people
working for, slated for, and supporting Presidential candidate Ben Bowman. I was also the subject of attempted bribery to influence the election.

Describe the situation and present the facts in the order in which they occurred. Include names, titles, and describe any affiliation to the 201409 ASUO Elections. Fall Term 2013: Alex Titus requested a meeting with myself at the EMU Fishbowl. I agreed, and met with Alex Titus and Marshall KoslovKosloff where they notified me that they were planning on running Marshall for ASUO President and requested my help on the campaign. I agreed to help. Evening of 3/5/14: I learned that Marshall was no longer planning an ASUO President bid, but and that Ben Bowman would be taking that seat place on the slate. Early Morning of 3/8/14: I notified Freshman Coordinator for the Mighty Oregonthe slate that I would no longer be supporting the campaign because I disagreed with Bowman's stance on important issues. [FIG 1] On Tuesday 3/11/14: I filed to run for ASUO Presidential candidate. Late that evening, Alex Titus and Marshall KoslovKosloff met me in the main lobby of my Residential Residence Hall, Riley. Alex and Marshall talked to me for about an hour trying to convince me to work on Ben Bowman's campaign for ASUO Mighty OregonPresident. I told them I had filed as a candidate myself and that I had big issues with supporting Ben Bowman. They laughed at my candidacy, and told me to reconsider and that I stood no chance. I told them if Ben wanted my support he would need to speak to me myselfhimself. On Wednesday 3/12/14: Ben Bowman, Alex Titus, and Marshall KoslovKosloff met with me again, at my residencetial hall at approximately 9 p.m. [FIG 2]. The conversation took place in my dorm room where only KoslovKosloff, Titus, Bowman, myself, and my roommate (Aran Schwoebel) where present. The conversation lasted about an hour and a half. I started off saying that I wanted to be upfront with the conversation and that I didn't want things to get personal. The men from Mighty Oregon agreedthree of them. The conversation quickly turned hostile with these menthem yelling and swearing at me. I was told thatThey told me that it was impossible for me to win, that my stance on issues didn't matter, that my campaign was "literally fucking hundreds of people" and that it was "the most selfish thing I have ever heard in my life". KoslovKosloff said that I was running "for no other reason than my own personal masturbation to myself". I Theywas called me a pawn and a puppet and told me that . I was told I'm being used. I was toldThey said that I'm "living in the clouds" for believing in voter choice. I was toldThey added that my voter ceiling is 500 votes max. I was told thatThey emphasized that if I run this year no one will want to work with me in the future and that my future in the ASUO will die. I was told that I'mThey also called me "the joke candidate" and that after the election, when I lose, "they're gonna

publish Emerald articles about you, and I swear to god they will publish an Emerald Article about you how you personally fucked us over and they will because there's fucking people on the Emerald who are fucking on our side". Notably, Ben Bowman is currently on leave from his role as Opinion Editor of the Emerald. I was told thatThey told me I need to "play how the game works". I was told that I'm They called me "a freshman who knows shit about student government,". I was told that Iand told me that I don't care about student government and that said that I "don't give a shit." I was told that I don't know how the ASUO works, I dont know what I'm doing, and that I "literally know nothing." I was toldThey said that I'm not involved and that I should have to demonstrate understanding of how things work before filing to run. I was toldThey added that I don't have a voice, and that my platform is too ambitious and that my policies are impossible to put into place. I was told that I'm not thinking about my future. Ben Bowman tried to intimidate me by saying that: "Titus is applying for a Truman scholarship to get his graduate school fully funded. wWhat do you think the difference between being student body president and not being influences that?" I was toldThey said that I'm "fucking my friends" and that this is personal and that it can't not be. Perhaps most importantly, Ben said that "policy is very important but I care more about these two [Titus and Marshall], I care more about my team, I care more about Evan fucking Roth, than I care about those policy outcomes. And guess what happens if fucking Beau wins? Do you think they're gonna hire Alex Titus. Do you think Alex Titus can run for President next year?" Multiple times during this conversation I had to tell my guests to be quieter to prevent being written up. My roommate Aran Schwoebel stayed out of the conversation but was present for the entirety and can witness to what I've recollected.

On Thursday 3/13/14: I scheduled a meeting with my fraternity president. I am a member of a newly forming fraternity at University of Oregon, Delta Upsilon (DU). The meeting occurred around 8 p.m. in the main lobby of the Lillis Business center. Before even being able to tell my fraternity members brothers that I was now running for ASUO Ppresident, the president of my fraternity, Grayson McCormick, told me that he had been approached by Emily Wu, the current ASUO Ffreshman ASUO senatoRepresentative,r and Senate Sseat 12 candidate for Mighty Oregon. Wu approached McCormick at his place of work to misinform him that I was running a "smear" campaign against Ben Bowman and that it would have great implications on Delta Upsilon's reputation as a whole. Due to this misinformation, McCormick told me that my candidacy would greatly impact harm Delta Upsilon's standing within the Greek community. Grayson said that because the individuals making up Mighty Oregon'sBen Bowmans leadership team were also members and leaders of the FIJI colony, my run for President would create a bad relationship between Delta Upsilon and the greater Greek community. Grayson was under the impression that my candidacy would also affect Delta Upsilon's ability to charter as a fraternity. The meeting concluded with Grayson telling me that because our fraternity was being intimidated by the otherBen Bowmans campaign, my best course of action would be to withdraw my candidacy or else to separate myself from Delta Upsilon. Some of the witnesses of this meeting include DU members: Aran Schwoebel, Matthew Gonzalez, Fintan Doyle, Kyle Crair, Kory Christoffersen, and Brendan Collins-Bride.

Comment [BR4]: Do you want to implicate Emily Wu? If yes, this is good. If not, change it to a member of Ben Bowmans campaign Formatted: Font: 12 pt

After my meeting with Delta Upsilon, Grayson McCormick and other DU members had a private meeting with Marshall KoslovKosloff, Alex Titus, Ben Bowman, and Evan Roth to discuss the implications of my candidacy. On Friday 3/14/14: I found my girlfriend, Emily Doyen, very upset because she had been crying after she received a call from Kendall Cheever, a sister at Gamma Phi Beta, saying that she heard "through the grapevine" that Gamma Phi Beta would not allow her to rush in the spring if my candidacy continued [Fig 3]. Kendall is very good friends with Emily Wu. My girlfriend was previously signed up to rush Gamma Phi Beta and had been in contact with the VP of Membership [FIG 4] . A few minutes after the call, Kendall retradacted her statements in a text message to my girlfriend, writing in part "Let's pretend it didn't.[happen]" [FIG 5] On this samLater thate day, I met with DU president Grayson McCormick again and he said that after consulting with the DU national leadership team (currently on campus to help with the formation of our chapter) he was confident that FIJI did not have the power to prevent our chapter from chartering. He said that Delta Upsilon did feel like my run was a threat to our chapter's social standing with the UO Greek Community. After this meeting I received a text from Grayson [FIG 6], that said?.

Comment [BR5]: Do you know for a fact that Emily had something to do with this? If not, leave it out. Formatted: Font: 12 pt

On Saturday 3/15/14: I sent Grayson an email resigning from DU. I met with Grayson later that night to formally separate myself from the fraternity. I did this as a direct result of the intimidation that my fraternity felt was a real concern as a newly forming chapter. I did not want my candidacy to implicate my fraternity brothers or their social standing within Greek life. On this same day atAt 3:53 pmp.m., I called Alex Titus and spoke with him and Marshall KoslovKosloff for about 20 minutes. In the conversation, I asked what real implications my candidacy would cause. Marshall told me that I would be "black listed" from ASUO and from all of UO Greek Life. He told me that if I remained in DU, there would be a serious chance that our chapter would not charter and would be shunned from the greater community. He also said that my girlfriend would be black listed from Greek Life and would not be allowed to rush Spring term. Marshall was clear that I would be given an executive appointment to a finance committee if I withdrew from the race. Marshall said: "We will put you on the finance committee you want to be on. That's what's important, dude. It's not a bribe, it's a direct offer of what we originally wanted." Because he was saying that, if I withdraw, I will get appointed to a finance committee, but if I stay in, I will not, I believe this is a rather direct bribe. Fortunately, I recorded the entire conversation and the transcription and audio recording are attached. Are you aware of any laws, rules, etc. that you believe have been violated? If so, please list them. ASUO Election Rules 9.8 lists "harassment, intimidation, bribery or fraud with the intent of affecting the outcome of the election" as a severe campaign violation. I have been victim of severe intimidation from the Mighty Oregon slate and specifically the people

working for, slated for, and supporting Presidential candidate Ben Bowman. All this is done with the intent to have me withdraw from the race, which they think would influence the outcome more likely in their favor. I was also the subject of attempted bribery to influence the outcome of the election when I was offered an appointment if I withdraw. 9.8.1 Consequences may include, but are not limited to, loss of all campaigning privileges including presence on the ballot, and, should sanctions be applied after election, removal from any office other than the ASUO Presidency. ASUO Elections Rule 6.1 states Campaigns shall be held responsible for all electionrelated activities undertaken by their affiliates, including but not limited to volunteers, employees, and representatives. Campaigns have a positive duty to ensure that all such persons do not violate these Rules; this duty increases with the degree of affiliation between an individual and the campaign. These acts have been committed by Presidential candidate Ben Bowman, and two people from his inner circle, including in his presence. This is sufficient to implicate Presidential candidate Ben Bowman. What is your desired outcome of the grievance/complaint? Because Ben Bowman and his subordinates, both within his presence and without his presence, have committed severe violations, both intimidation and bribery with an intent to affect the outcome of the election, my desired outcome is that Ben Bowman and his executive ticket lose the privilege to appear on the ballot for the Spring 2014 ASUO Elections. I would like to specifically note that the intimidation they have committed was not just aimed at me, but aimed at my girlfriend and fraternity brothers, attempting to hold them hostage to influence my decisions. Because their actions go beyond threatening just myself, removal from the ballot is especially justified in this case. I do not desire any sanctions be levied against the other candidates on Mighty Oregon, because I do not believe they had any idea about this, and they should not be punished for actions by their superiors that they had no control or knowledge.
