PURCHASER customer who places the order for GOODS KODA POWER a.s. THE SELLER guarantees the PURCHASER that the GOODS delivered will meet the below stated parameters:

1.1 PERFORMANCE RELIABILITY GUARANTEE


The performance reliability is defined by the following formula:

where: Tf overall duration of forced outages of the delivered equipment within a guarantee period in hours

Tp total number of planned operation hours of the delivered equipment within a guarantee period

The total number of the planned operation hours will always be less or equal to duration of a guarantee period in hours.

The reliability of the delivered equipment will be higher or equal to 99.5 %.


The performance reliability guarantee applies to operation of the delivered equipment within a guarantee period. The evaluation of the performance reliability will be processed each time when functionality loss of the delivered equipment causes its forced outage.

1.2.1 GUARANTEE CONDITIONS OF PERFORMANCE RELIABILITY DEFINITION OF FORCED OUTAGE Beginning of the outage: moment of functionality loss of the delivered equipment caused by its failure End of the outage: moment of required functionality recovery of the delivered equipment

FOLLOWING OUTAGES WILL NOT BE CONSIDERED AS RELEVANT outage of the delivered equipment caused by external influences or Force majeure outage of the delivered equipment caused by incorrect attendance (infringement of operating instructions) extension of repair time of the delivered equipment due to external influences, Act of Providence or repair of components not included in SELLERS scope, but preventing from its required functionality recovery time of repair of the delivered equipment performed within a reserve shutdown period of a turboset or its outage caused by a failure of equipment out of SELLERS scope. However, if a request to starting-up the turboset is made and the repair has not been finished yet, the time from the request to repair completion and subsequent required functionality recovery of the delivered equipment will be taken into account. time of repair that takes place within a scheduled outage of a turboset

PURCHASER OBLIGATIONS operate the delivered equipment in accordance with operating instructions PURCHASER is obliged to file available records about equipment operation within a guarantee period SELLERS authorized personnel will be granted access to the delivered equipment and will have at disposal available operation records and information PURCHASER will inform the SELLER about failures of the delivered equipment If a repair is performed by the PURCHASER, the repair will start in the shortest possible time since failure announcement. The repair will only be performed by personnel with corresponding qualifications.

2 GUARANTEE TEST CONDITIONS


The stated guaranteed values are meant without tolerance limits. For the evaluation of the guaranteed values that are to be proved by the guarantee measurements, only tolerance given by measurement uncertainty will be applied. The operation during the guarantee measurement shall be adjusted in accordance with the Reference heat balance diagram and conditions according to the guarantee measurement project. If the conditions differ from the defined ones, the resultant values measured will be corrected according to correction curves. The resultant values can also be corrected according to other operating conditions that possibly occurred and that differ from the calculated ones provided it is discussed and approved by both contracting parties. The guarantee measurement will be performed in accordance with the standard for steam turbine measurement IEC 953-2 . According to this standard, the measurement tolerance will be determined as well. For evaluation, water and water steam tables for industrial purposes IAPWS-IF 97 will be used. The guarantee measurements will start by drawing up an initial report about measurement conditions and methods and its evaluation and will conclude by drawing up a final report about the tests performed.
