Tract Description: The Pine Saw-Timber on the George Van Williams tract, adjacent to Dry Creek, has caught the eye of every timber man who has used NC HWY 24/27 for the last 30 plus years. Centered North of NC HWY 24/27, between Gurney W and Alex Roads, this timber stand comes with great logging access and a profound variety of both Hardwood and Pine. Newly surveyed property lines are flagged in high visibility pink flagging; a freshly surveyed property division line is also flagged in pink and painted Teal; SMZs or Streamside Management Zones are flagged in Blue and out areas are flagged and/or painted in Red (extreme caution should be used when logging near the abandoned talc quarry that is painted in red in the Northwest quadrant of the property); an aesthetic buffer adjacent the Tara Williams Sheffield Property has been flagged in high visibility orange flagging and an aesthetic buffer adjacent NC HWY 24/27 has been painted Red. The harvest area has been mapped using GPS and is made up of 70+- acres with an additional 2.8+- acres of adjoining timber that has been 100% tallied and painted for removal. Great Access Points have been secured via NC HWY 24/27 and Gurney W. Road. See attached maps **Note** Please use all supplied maps (Aerial and New Survey Map) when performing and making your own cruise and assessment of the available timber. As youll see property lines supplied by the Moore County GIS department vary drastically from the new survey, with the adjoining James T. Emery Property shifted to the West and so forth. Please see attached Volume Sheets. Type of Harvest: Clear-Cut Harvest of all Merchantable Forest Products, with the following exceptions: NO teal painted trees along the newly surveyed property division line; NO red painted trees; NO trees located within the two designated aesthetic areas and the Dry Creek Buffer (The Dry Creek NO HARVEST Buffer runs North from NC HWY 24/27 to a point due East of an Old Home Place atop a Hill). And, within other SMZs NO pine trees less than 12 DBH & NO hardwood trees less than 16 DBH are to be harvested. Sale Type: Lump Sum Sealed Bid. A 5% earnest money deposit may be required of the successful high bidder. A $1,000.00 performance bond is required along with a pre-harvest meeting to discuss logging and harvest requirements. Performance Bond will be held by American Timber Services, LLC in an escrow account. The landowners reserve the right to reject any and all bids. Date of Sale:
Thursday, April 24th at 12:00 PM - Sealed bids will be opened on the tract at the logging access point off

Time Limit of Cutting Contract: 24 months from the date of sale will be allowed to harvest said trees and timber. American Timber Services, LLC reserves the right to halt all logging activities due to wet weather with high soil rutting, which will be determined by the Seller(s) and/or American Timber Services, LLC. An extension of the contract would be granted under these restrictions. CONDITIONS OF THE SALE: A. The Buyer Agrees to the Following: 1. Maintain all logging activities within the sale boundaries. Property lines, out areas, streamside management zones, and other areas of significance throughout the forest have been flagged with high visibility flagging and/or painted. 2. Forestry Best Management Practices (BMPs) and Forest Practices Guidelines (FPGs) must be implemented while logging. Road construction must be approved by the Seller(s) and/or its American Timber Services, LLC. Amassed soil from road construction or wet weather skimming must be returned to roads when harvest process is complete. Buyer is responsible for all construction, gravel, erosion control, water bars, and straw and grass application on SMZ crossings and erodible areas within the tract. 3. SMZ crossing must be approved by Seller(s) and/or American Timber Services, LLC and must be debris free, grassed and covered with straw at harvest completion. Again, buyer is responsible for all state compliance under BMPs and FPGs. 4. Trucks Entering Highway signs are required in both directions from the tract access point(s). NO EXCEPTIONS! 5. All timber and cutting rights will revert back to the landowners when timber harvesting is complete regardless of Timber Deed contract period. 6. Any reserved tree cut or severely damaged will be charged to Buyer at triple the stumpage value, but not less than $100.00 per tree. 7. All trash and litter must be kept within containment holders and removed on a weekly basis with all materials removed at end of harvest. B. The Seller Agrees to the Following: 1. Guaranteed title to the forest products covered within this notice and to warrant the title against all claims at their expense. 2. To grant ingress and egress to said lands for the Buyer and their agents or assigns. C. Published Volumes are meant as a guide only and are not guaranteed in any fashion. Bidders are responsible for their own cruises and bid volumes. Again, the sellers reserve the right to reject any and all bids.
