07. Thetendersreceivedafterduedateandtimeshallnotbeacceptedunderanycircumstances,whatsoeverit
maybe.Theenvelopeof'EMD&TenderFee'shallbeopenedfirst.TenderswithoutEMD&Tenderfeewillnot
beconsidered.TheTechnicalBidshallbeopenedforthosetendersonlywhohavesubmittedEMD&Tender

Director,M.P.StateElectronicsDevelopmentCorporationLtd,forthispurpose.
08. TheFinancialBidshallbeopenedonlyfortheBidderswhofoundsuccessfulintheirtechnicalbidevaluation.
Dateandtimeforopeningofthefinancialbidshallbecommunicatedtoallsuchbidderlateron.
09. MPSEDCdonotbindhimselftoacceptthelowestoranyothertenderandreservestherighttoacceptor
rejectanyorallthetenderseitherinfullorinpartwithoutassigninganyreason.
10. Beforebidding,theTendererisadvisedtovisitthesite,itssurroundingstoassessandsatisfythemselves
about the local conditions such as the working and other constraints at site, approach roads to the site,
availabilityofwater&powersupply,applicationoftaxes,dutiesandleviesasapplicable,accommodations
they may require etc. and any other relevant information required by them to execute complete scope of
work.TheTenderermayobtainallnecessaryinformationastorisks,weatherconditions,contingencies&
othercircumstances(insurgenciesetc.)whichmayinfluenceoraffecttheirtenderprices.Tenderershallbe
deemedtohaveconsideredsiteconditionswhetherhehasinspecteditornotandtohavesatisfiedhimself
in all respect before quoting his rates and no claim or extra charges whatsoever in this regard shall be
entertained/payablebytheMPSEDCatalaterdate.

11. TheTenderermustattestallerasuresandalterationsmadewhilefillingthetenderDocumentbyputting
hisinitials.Over-writingoffiguresisnotpermitted.

12. ftheTendererfailstocomplywithanyoftheabovestatedconditions,thetendershallbeconsideredasinvalid.

13. All inclusiveprices should be quoted in the original B.O.Q of financial bidgiven in thetender document. The
ratesquotedbytheTenderershallbefirmandfixedfortheentireperiodofcompletionandtillhanding
overofthework.
Thecontractorshallberesponsibleforthepayment,whereverpayable,athisowncostofalltaxessuchas
exciseduty,customduty,salestax,includingtheServicetax,purchasetax,consignmenttax,work
contracttax,oranyothersimilartaxinthestateconcerned,turnovertax,tolltax,octroi charges, royalty,
cess, levy and other tax(es) or duty(ies) which may be specified by local/state/central government
fromtimetotimeonallmaterials,articleswhichmaybeusedforthiswork.Theratesquotedbyhim
in the tender in bill of quantities shall be inclusive of all suchtaxes,dutiesetc.Theimpositionofanynew
and/ or increase in the aforesaid taxes, duties, levies (including fresh imposition of Work Contract Tax,
TurnoverTax,SalesTaxonWorkContractoranyothersimilarTax)etc.duringthecurrencyofthecontract
shallbebornebycontractorandshallnotbepaidorreimbursedtothecontractorbyMPSEDC..ntheevent
ofnon-payment/defaultinpaymentofanyoctroi,royalty,cess,turnovertax,salestax,includingthepurchase
tax,consignmenttax, work contract tax or any other similar tax in the state concerned, customs, excise or
anyotherlevy/taxincludinglaborduesetc.bycontractor/supplier,MPSEDCreservestherighttowith-hold
the dues/ payments of contractor and make payment to local/state/ Central Government authorities or to
laborersasmaybeapplicable.ThecontractorshouldsubmitalongwiththetenderRegistrationCertificates
withSalesTaxonworkscontractauthorityetc.otherwiseappropriaterecoveryshallbemadefromhisbills.

14. Following procedures shall be adapted in case of difference in quoted rates in figures and words and
extensions.
a) Wherethereisdifferencebetweenratesinfiguresandinwords,theratesquotedinwordsshallbe
consideredascorrect.

b) Wheretheamountofanitemisnotworkedoutoritdoesnotcorrespondtotherateeitherinfigureorin
words,theratesquotedinwordsshallbeconsideredascorrectandnecessaryconsiderationmade.

c) WheretheratesquotedbytheTendererinfiguresandinwordstally,buttheamountisnotworkedout
correctly,theratesquotedbytheTenderershallbeconsideredascorrectandamountshallbecorrected
accordingly.

15. AllTaxesasapplicablefromtimetotimeshallbedeductedfromeachrunningbillofthecontractor.

ELGBLTY/EVALUATONCRTERAOFTECHNCALBD:
TheEvaluationofBidder'stechnicalProposalshallbeasgivenhereunder:
a) Bidder(s) must have successfully completed at least one similar work of value not less than Rs.150.00
Lacs (Rupees One hundred Fifty Lacs) for State/Central Govt., PSUs/Corporate or any other reputed
institutioninthelastfiveyears.

OR

Must have successfully completed two similar works of value not less than Rs. 75.00 Lacs (Rupees
SeventyFiveLacs)each,forState/CentralGovt.,PSUs/Corporateoranyotherreputedinstitutioninthe
lastfiveyears
BiddermustsubmittheproofofexperiencebyprovidingtheattestedcopiesofWorkOrder/Agreementand
workCompletionCertificateshowingtheexecutedvalueofthejob.

b) Aspertheauditedfinancialresults,theAverageAnnualTurnoveroftheprecedingthreefinancialyears
(FYs)i.e.,2011-12,2010-11&2009-10ofthebiddershouldbenotlessthanRs.200.00Lacs.ncase,
BalanceSheetandProfit&Lossaccountstatement(B/S&P/L)forFY2011-12isstillnotaudited,then
bidderhasanoptiontosubmittheB/S&P/LaccountstatementforFY2008-09alsoinsupportofmeeting
theminimumturnovercriteria.Biddersmustsubmittheattestedcopyofncometaxreturnsandaudited
B/S&P/LaccountsstatementforrelevantFYsalongwiththetechnicalbid.

1.0 GENERALNFORMATON:

2.0 Handingover&Clearingofsite:
2.1 TheContractorshouldnotethatareaforproposednteriorworkmaybemadeavailableinphasesas
peravailabilityandinconjunctionwithpaceofactualprogressofworkatsite.Theworkmayberequired
tobecarriedoutinconstrainedsituations.Theworkistobecarriedoutinsuchawaythatthetraffic,
peoplemovement,ifany,iskeptoperativeandnothingextrashallbepayabletothecontractordueto
thisphasing/sequencingofthework.Thecontractorisrequiredtoarrangetheresourcestocomplete
theentireprojectwithintotalstipulatedtime.Thecontractorshallnotbeentitledforanyextrapayment,
whatsoever,inthisregard.tshouldbeclearlyunderstoodthattheMPSEDCshallnotconsiderany
revisionincontractpriceoranyothercompensationwhatsoeverviz.towardsidlenessofContractor's
labour,equipmentetc.
2.2 Spaceforsiteofficeshallbedecidedatsite.Thestoreformaterial,toolsandlaboraccommodation
shallbearrangedbythecontractorathisowncost.Thesiteshouldbewellmaintainedandkeptclean
bytheContractorthroughouttheprojectexecution.
2.3 Afterthecompletionoftheproject,theContractorshallremovealltheTemporarystructures(ifany)
constructedbyhimandclearthesiteasperthenstructionsoftheMPSEDC.ncase,iftheContractor
failstodoso,theConsultant/Ownershallhaverighttoremovethetemporarystructuresandclearthe
site.TheexpensesincurredshallberecoveredfromtheContractorfromthepaymentsduetohim.
2.4 ThecontractorshallmakehisownarrangementforWater&Electricalpowerfortheexecutionofworkof
theirscopeandotherpurposesathisowncostandpayrequisiteelectricityandwatercharges.The
contractorshallalsomakestandbyarrangementforwater&electricitytoensureun-interruptedsupply.

3.0 Scopeofwork:
Thescopeofworkenvisagedinthistenderbroadlyincludesbutnotlimitedtothenteriorsworksonly.Thescope
ofworkcoveredinthistendershallbeaspertheBillofQuantities,specifications,drawings,instructions,
orders issued to the contractor from time to time during the pendency of work. The drawings for this
work, which may be referred for tendering, provide general idea only about the work to be performed
underthescopeofthiscontract.Thesemaynotbethefinaldrawingsandmaynotindicatethefullrange
oftheworkunderthescopeofthiscontract.Theworkwillbeexecutedaccordingtothedrawingstobe
released as "GOOD FOR CONSTRUCTON" from time to time by the Consultant/ MPSEDC and
according to any additions/modifications/alterations/ deletions made from time to time, as required by
anyotherdrawingsthatwouldbeissuedtothecontractorprogressivelyduringexecutionofwork.tshall
be the responsibility of the contractor to incorporate the changes that may be in this scope of work,
envisagedatthetimeoftenderingandasactuallyrequiredtobeexecuted.

3.1 The quantities of various items as entered in the "BLL OF QUANTTES" are indicative only
andmayvarydependingupontheactualrequirement.Thecontractorshallbeboundtocarry
outandcompletethestipulatedworkirrespectiveofthevariationinindividualitemsspecifiedin
the bill of quantities. The variation of quantities will be governed as per stipulated terms &
conditionofcontract.
3.2 Fixednterior&Loosefurnitureworks:
Theaboveisindicativeofthebroadscopeofwork.However,dependinguponsiteconditions
andsituations,itispossiblethatcertainotherworksnotincludedabovemayberequiredtobe
executed.Suchadditions/deletions/alterationsshallnotbethegroundforanyclaimsor
extraswhatsoeveritmaybe.
3.3 Samples&ShopDrawings:
Aftertheawardofthecontract,thecontractorshallfurnishtheshopdrawingsandsamplesofmaterials
tobeincorporated,fortheapprovalofcompetentauthority.

4.0 COMMTMENTOFCONTRACTOR:
4.1 nterpretationofContractdocuments:
4.1.1 Allthedocumentsformingpartofthecontractaretobetakenasmutuallyexplanatory,supplementary
andcomplementarytoeachother,ifthereisanyerror,omissionordiscrepancyinanyofthem,itshall
bebroughttothenoticeoftheConsultant/Ownerwellintime.ThedecisionoftheConsultant/Owner
shallbefinalandbinding.TheContractorshallexecutetheworkonlyaftertheclarificationinwritingfrom
Consultant/Owner.

4.1.2 TheContractorshallexamineallthecontractdocumentsthoroughlyincludingthescope,natureand
magnitudeofworkshehastoexecuteinaccordancewiththecontractdocuments

4.1.3 TheContractorshallvisittheprojectsitetostudythesiteconditions,meansofaccesstothesite,in
additiontootherfactorsgoverningtheworks.

4.1.4 Theremaybechangeintheinteriorlayoutaspertechnicalrequirementsandthetenderershallnotbe
entitledforanyclaimduetosuchchanges.

4.2 Performance Security/ Retention Money: The Successful Tenderer will furnish within 7 days after the
issueofLetterofntent(LO),anamountequalto10%oftheacceptedcontractvalueasPerformance
Security by way of crossed Demand draft or an unconditional Bank Guarantee of any ndian
NationalizedBank/ScheduledBank)validfortheperiodof90daysaftertheendofthedefectliability
period.TheperformancesecurityshallbereleasedaftersuccessfulcompletionofDefectliabilityperiod
of12months,providedthecontractorhassatisfactorilycarriedoutalltheworksandattendedtoallthe
defectsinaccordancetoallstipulatedterm&conditionsofthecontract.

4.3 TimeofCompletion:
Theworkshallbecompletedinallrespectswithin50days+7daysformobilization.

4.4 WorkSchedule:
Thesuccessfultenderershallsubmittheworkscheduleintheformofprogrammechartswithinfive
daysfromthedateofcommencingofworkandshallexecutetheworkstrictlyaspertheschedule
submittedbyhim.

4.5 Compensationfordelay(Liquidateddamages):
Timeisessenceofcontract.ftheContractorfailstocompletetheworkandclearthesiteonorbefore
thedatesfixedforcompletion,heshallwithoutprejudicetoanyotherrightorremedyonaccountofsuch
breachbeliabletopaycompensationviz.0.5%(halfpercent)ofthetotalcontractvalueofthework
ordered,foreveryweekdelay,eventhoughapartremainsincomplete.Forthepurposeofthis
condition,thecontractvalueshallbe,thevalueofworkactuallyordered,plusalgebraicsumof
subsequentworkorderedprovidedalwaysthatthetotalamountofcompensationtobepaidunderthis
conditionshallnotexceed10%(Tenpercent)ofthetotalcontractvalue.
4.6.A Forcemajeure:
TheeventslikeWar,revolution,riots,floods,earthquakeandepidemicoranyothersuchreasonwhich
isbeyondthecontrolofmanagementshallcomeunderthecategoryofforcemajeure
.
ftheexecutionofworkisdelayedduetoanyoftheaboveevents,thenthetimeperiodshallbe
extendedaspertheaffectedperiod.

4.6.B ncaseworkisdelayedduetoanyotherreasonswhichisbeyondtheContractor'scontrol,the
Contractorshallthenuponthehappeningofanysucheventcausingdelayshallimmediatelybut
notlaterthan10daysofhappeningofsuchevent,givenoticethereofinwritingtotheOwner/
Consultant,andshallusehisbestendeavortopreventormakegoodthedelay.Theacceptingofficer
mayinhisdiscretiongrantsuchextensionoftimeasmayappearreasonabletohimandthesameshall
becommunicatedtotheContractorinwritingandshallbefinalandbinding.TheContractorshallbe
boundtocompletetheworkwithinsuchextendedtime.

4.7 Cancellation/Determinationofcontractinfullorpart:
SubjecttootherprovisionscontainedinthisclausetheConsultantmay,withoutprejudicetohisany
otherrightsorremedyagainstthecontractorinrespectofanydelay,inferiorworkmanship,anyclaims
fordamagesand/oranyotherprovisionsofthiscontractorotherwise,andwhetherthedateof
completionhasorhasnotelapsed,bynoticeinwritingabsolutelydeterminethecontractinanyofthe
followingcases:
i) fthecontractorhavingbeengivenbytheConsultantanoticeinwritingtorectify,reconstructor
replaceanydefectiveworkorthattheworkisbeingperformedinaninefficientorotherwise
improperorun-workmanlikemannershallomittocomplywiththerequirementofsuchnoticefora
periodofsevendaysthereafter;or
ii) fthecontractorhas,withoutreasonablecause,suspendedtheprogressoftheworkorhasfailed
toproceedwiththeworkwithduediligencesothatintheopinionoftheConsultant(whichshallbe
finalandbinding)hewillbeunabletosecurecompletionoftheworkbythedateforcompletion
andcontinuestodosoafteranoticeinwritingofsevendaysfromtheConsultant;or
iii) fthecontractorfailstocompletetheworkwithinthestipulateddateoritemsofworkwithindividual
dateofcompletion,ifanystipulated,onorbeforesuchdate(s)ofcompletionanddoesnot
completethemwithintheperiodspecifiedinanoticegiveninwritinginthatbehalfbythe
Consultant;or
iv) fthecontractorpersistentlyneglectstocarryouthisobligationsunderthecontractand/or
commitsdefaultincomplyingwithanyofthetermsandconditionsofthecontractanddoesnot

remedyitortakeeffectivestepstoremedyitwithin7daysafteranoticeinwritingisgiventohimin
thatbehalfbytheConsultant;or
v) fthecontractorshallofferorgiveoragreetogivetoanypersoninMPSEDC/Consultantortoany
otherpersononhisbehalfanygiftorconsiderationofanykindasaninducementorrewardfor
doingorforbearingtodoorforhavingdoneorforbornetodoanyactionrelationtotheobtainingor
executionofthisoranyothercontractforMPSEDC;or
vi) fthecontractorshallenterintoacontractwithMPSEDCinconnectionwithwhichcommissionhas
beenpaidoragreedtobepaidbyhimortohisknowledge,unlesstheparticularsofanysuch
commissionandthetermsofpaymentthereofhavebeenpreviouslydisclosedinwritingtothe
Consultant;or
vii) fthecontractorshallobtainacontractwithMPSEDCasaresultofwrongtenderingorothernon-
bona-fidemethodsofcompetitivetendering;or
viii) fthecontractorbeinganindividual,orifafirm,anypartnerthereofshallatanytimebeadjudged
insolventorhaveareceivingorderororderforadministrativeofhisestatemadeagainsthimor
shalltakeanyproceedingsforliquidationorcomposition(otherthanavoluntaryliquidationforthe
purposeofamalgamationorreconstruction)underanynsolvencyActforthetimebeinginforceor
makeanyconveyanceorassignmentofhiseffectsorcompositionorarrangementforthebenefit
ofhiscreditorsorpurportsotodo,orifanyapplicationbemadeunderanynsolvencyActforthe
timebeinginforceforthesequestrationofhisestateorifatrustdeedbeexecutedbyhimfor
benefitofhiscreditors;or
ix) fthecontractorbeingacompany,shallpassaresolutionortheCourtshallmakeanorderforthe
windingupofthecompany,orareceiverormanager,or
x) fthecontractorshallsufferanexecutionbeingleviedonhisgoodsandallowittobecontinuedfor
aperiodof21days;or
xi) fthecontractorassigns,transfers,sublets(engagementoflabouronapiece-workbasisorofthe
labourwithmaterialsnottobeincorporatedinthework,shallnotbedeemedtobesubletting)or
otherwisepartswithorattemptstoassign,transfersubletorotherwisepartswiththeentireworks
oranyportionthereofwithoutandpriorwrittenapprovaloftheConsultant/MSEDC.

Whenthecontractorhasmadehimselfliableforactionunderanyofthecasesaforesaid,theConsultant
withthepriorapprovalofMPSEDCmaywithoutprejudicetoanyotherrightorremedywhichshallhave
accruedorshallaccruehereaftertoMPSEDC,byanoticeinwritingtocancelthecontractasawholeor
onlysuchitemsofworkindefaultfromtheContract.

TheConsultantshallonsuchcancellationbytheMPSEDChavepowersto:

a)Takepossessionofsiteandanymaterials,constructionalplant,implements,stores,etc.
thereon;and/or
b)Carryouttheincompleteworkbyanymeansattheriskandcostofthecontractor;and/or
c)Todetermineorrescindthecontractasaforesaid(ofwhichterminationorrescissionnoticein
writingtothecontractorunderthehandoftheConsultantshallbeconclusiveevidence).Upon
suchdeterminationorrescissionthefullsecuritydepositrecoverableunderthecontractshallbe
liabletobeforfeitedandun-usedmaterials,constructionplants,implements,temporary
buildings,etc.shallbetakenoverandshallbeabsolutelyatthedisposaloftheMPSEDC.fany
portionoftheSecurityDeposithasnotbeenpaidorreceiveditwouldbecalledforandforfeited;
and/or
d)ToemploylabourpaidbyMPSEDCandtosupplymaterialstocarryouttheworkoranypartof
theworkdebitingthecontractorwiththecostofthelabourandthepriceofthematerials(ofthe
amountofwhichcostandpricecertifiedbytheConsultantshallbefinalandconclusive)against
thecontractorandcreditinghimwiththevalueoftheworkdoneinallrespectsinthesame
mannerandatthesameratesasifithadbeencarriedoutbythecontractorunderthetermsof
hiscontract.ThecertificateoftheConsultantastothevalueoftheworkdoneshallbefinaland

conclusiveagainstthecontractorprovidedalwaysthatactionunderthesub-clauseshallonlybe
takenaftergivingnoticeinwritingtothecontractor.Providedalsothatiftheexpensesincurred
bythedepartmentarelessthantheamountpayabletothecontractorathisagreementrates,
thedifferenceshallnotbepaidtothecontractor;and/or
e)Aftergivingnoticetothecontractortomeasureuptheworkofthecontractorandtotakesuch
whole,orthebalanceorpartthereofasshallbeunexecutedordelayedwithreferencetothe
GeneralConditionsofContractclauseno.4.5and/orrelevantclauseofSpecialConditionsof
Contract,outofhishandsandtogiveittoanothercontractortocompleteinwhichcaseany
expenseswhichmaybeincurredinexcessofthesumwhichwouldhavebeenpaidtothe
originalcontractorifthewholeworkhadbeenexecuted
byhim(oftheamountofwhichexcessthecertificateinwritingoftheConsultantshallbefinal
andconclusive)shallbeborneandpaidbytheoriginalcontractorandmaybedeductedfrom
anymoneyduetohimbyMPSEDCunderhiscontractoronanyotheraccountwhatsoeveror
fromhissecuritydepositortheproceedsofsalesofunusedmaterials,constructionplants,
implementstemporarybuildingsetc.thereoforasufficientpartthereofasthecasemaybe.f
theexpensesincurredbytheMPSEDCarelessthantheamountpayabletothecontractorat
hisagreementrates,thedifferenceshallnotbepaidtothecontractor;and/or
f)Byanoticeinwritingtowithdrawfromthecontractoranyitemsoritemsofworkasthe
Consultantmaydetermineinhisabsolutediscretionandgetthesameexecutedattheriskand
costofthecontractor.

AnyexcessexpenditureincurredortobeincurredbyMPSEDCincompletingtheworksorpartof
theworksortheexcesslossordamagessufferedormaybesufferedbyMPSEDCasaforesaid
afterallowingsuchcreditshallwithoutprejudicetoanyotherrightorremedyavailabletoMPSEDC
inlawberecoveredfromanymoneysduetothecontractoronanyaccount,andifsuchmoneys
arenotsufficientthecontractorshallbecalleduponinwritingandshallbeliabletopaythesame
within30days.

fthecontractorshallfailtopaytherequiredsumwithintheaforesaidperiodof30days,the
MPSEDCshallhavetherighttosellanyorallofthecontractor'sunusedmaterials,constructional
plant,implements,temporarybuildings,etc.andapplytheproceedsofsalethereoftowardsthe
satisfactionofanysumsduefromthecontractorunderthecontractandifthereaftertherebeany
balanceoutstandingfromthecontractor,itshallberecoveredinaccordancewiththeprovisionsof
thecontractandlaw.

AnysumsinexcessoftheamountsduetoMPSEDCandunsoldmaterials,constructionalplant
etc.shallbereturnedtothecontractor,providedalwaysthatifcostoranticipatedcostof
completionbyMPSEDCoftheworksorpartoftheworksislessthantheamountwhichthe
contractorwouldhavebeenpaidhadhecompletedtheworksorpartoftheworks,suchbenefit
shallnotaccruetothecontractor.

ntheeventofanyoneormoreoftheabovecoursesbeingadoptedbytheConsultant/MPSEDC
thecontractorshallhavenoclaimtocompensationforanylosssustainedbyhimbyreasonsofhis
havingpurchasedorprocuredanymaterialsorenteredintoanyengagementsormadeany
advancesonaccountorwithaviewtotheexecutionoftheworkortheperformanceofthe
contract.Andincaseactionistakenunderanyoftheprovisionaforesaidthecontractorshallnot
beentitledtorecoverorbepaidanysumforanyworkthereoforactuallyperformedunderthis
contractunlessanduntiltheConsultanthascertifiedinwritingtheperformanceofsuchworkand
thevaluepayableinrespectthereofandheshallonlybeentitledtobepaidthevaluesocertified.

Providedfurtherthatifanyoftherecoveriestobemade,whiletakingactionasper(d)and/or(e)
above,areinexcessofthesecuritydepositforfeited,theseshallbelimitedtotheamountbywhich
theexcesscostincurredbyMPSEDCexceedsthesecuritydepositsoforfeited.

4.8 Contractorliabletopaycompensationevenactionnottaken:
nanycaseinwhichanyofthepowersconferredupontheConsultantbyrelevantclausethereof,
shallhavebecomeexercisableandthesamearenotexercised,thenon-exercisethereofshallnot
constitute a waiver of any of the conditions hereof and such powers shall notwithstanding be
exercisable in the event of any future case of default by the contractor and the liability of the
contractorforcompensationshallremainunaffected.ntheeventoftheConsultantputtinginforce
all or any of the powers vested in him under the preceding clause he may, if he so desires after
giving a notice in writing to the contractor, take possession of (or at the sole discretion of the
Consultant which shall be final and binding on the contractor) use as on hire (the amount of the
hiremoneybeingalsointhefinaldeterminationoftheConsultant)alloranytools,plant,materials
andstores,inorupontheworks,orthesitethereofbelongingtothecontractor,orprocuredbythe
contractor and intended to the used for the execution of the work/or any part thereof, paying or
allowingforthesameinaccountatthecontractrates,orinthecaseofthesenotbeingapplicable,
at current market rates to be certified by the Consultant, whose certificate thereof shall be final,
and binding on the contractor and/or direct the contractor, clerk of the works, foreman or other
authorizedagenttoremovesuchtools,plant,materials,orstoresfromthepremises(withinatime
to be specified in such notice) in the event of the contractor failing to comply with any such
requisition,theConsultantmayremovethematthecontractor'sexpenseorsellthembyauctionor
private sale on account of the contractor and his risk in all respects and the certificate of the
Consultantstotheexpensesofanysuchremovalandtheamountoftheproceedsandexpenses
ofanysuchsaleshallbefinalandconclusiveagainstthecontractor.

4.9 ApprovedEqual:
"ApprovedEqualshallmeananalternativeproduct/serviceapprovedbytheMPSEDCas
equivalenttothatspecifiedinthecontractdocuments.

4.10 temsofworkforcompletion:
Thetendererisboundtocarryoutanyitemsofworknecessaryforthecompletionofthejob,even
though such items are not included in the BOQ, in the stipulated period of time, unless an
extensionoftimeisdulyauthorized.TheMPSEDCwillissueinstructionsforsuchadditionalitems
andtheirquantitiesinwriting.

4.11 Scheduleofquantities:
Thequantitiesgiveninthescheduleofquantitiesareprovisionalandareonlymeanttoindicatethe
intent of the work and to provide bases for tendering. The contractor shall be paid for the actual
quantity of work executed by him actually at site as per the instructions. The MPSEDC will have
the right to increase or decrease any of the quantities or totally omit any items of work and the
contractorshallnotclaimanyextraordamagesonthesegroundssubjecttotheconditionthatthe
overallcontractamountisnotvariedbymorethan+or-10%ofoverallcontractamount,however
for the purpose of this variation, the escalation in cost of materials, labour etc shall not be taken
into account. Any error in description or in quantity or omission of item in the schedule of
quantities shall not violate this contract but shall be deemed to be a variation required for
completionoftheproject.

4.12 Terminationofcontractondeath:
ftheContractorisanindividualoraproprietaryfirmandtheindividualorproprietordiesandif
theContractorisapartnershipfirmandoneofthepartnersdies,thentheConsultant/Owner
hastherighttoterminatethecontractunlessanduntiltheConsultant/Ownerissatisfied

thatthesurvivingpartnersarecapableofexecutingandcompletingtheremainingcontract.n
caseofterminationofcontract,thelegalrepresentativesofthedeceasedContractorarenot
entitledforanycompensationorclaim.nadditionMPSEDCshallnotlevyanypenaltyagainstthe
damagecausedbyincompletework.

4.13 Contractor'ssubordinatestaff:
The Contractor shall depute qualified engineers for execution of the project. The technical staff
employed by the Contractor shall be responsible for the quality and workmanship of the work as
perthesatisfactionofMPSEDC.TheContractor'ssupervisorystaffshouldfollowtheinstructions
given by MPSEDC or his authorized representative. f any of the Contractor's staff members is
incapable or inexperienced, in the opinion of consultant/owner, then he should be removed
immediatelyandtheContractorshoulddosuitablesubstitution.TheTechnicalstafftobeemployed
should be degree holder from a government recognized institution with at least 3 years practical
experience of work, in addition to Diploma holder and other experienced supervisory staff to be
deployedatsite..

4.14 Sublettingofcontract:
TheContractorshallnotappointanysub-contractorsforexecutionofanypartoftheworks,without
thewrittenapprovaloftheMPSEDC.

4.15 Co-operationwithotheragenciesatsite:
TheContractororhisauthorizedrepresentativesmustworkincloseco-operationwiththeagencies
executingotherworksformingthepartoftheprojectandalsowiththeotheragenciesemployedbythe
Consultant/Ownerfortheexecutionoftheworks/incidentalworks.Contractorshallpermitfreeaccess
andgenerallyaffordreasonablefacilitiestootheragenciesordepartmentalworkmenetc.The
Contractor'squotedamount/ratesshallbedeemedtocaterforalltheabovecontingenciesandnothing
extrashallbeadmissibleonthisaccount.

4.16 Safetyofadjoiningproperties:
TheContractororhisauthorizedrepresentativesshouldconductalltheoperationsnecessaryforthe
executionofworksinsuchamannerthatnoinconvenience/damagesarecausedtothepropertiesof
otherpersons/agencies.

4.17 TaxesandDuties:
4.17.1 Thecontractorshallberesponsibleforthepayment,whereverpayable,athisowncostofalltaxessuch
asexciseduty,customduty,salestax,includingtheservicetax,purchasetax,consignmenttax,work
contracttax,oranyothersimilartaxinthestateconcerned,turnovertax,tolltax,octroicharges,royalty,
cess,levyandothertax(es)orduty(ies)whichmaybespecifiedbylocal/state/centralgovernmentfrom
timetotimeonallmaterials,articleswhichmaybeusedforthiswork.Theratesquotedbyhiminthe
tenderinbillofquantitiesshallbeinclusiveofallsuchtaxes,dutiesetc.Theimpositionofanynewand/
orincreaseintheaforesaidtaxes,duties,levies(includingfreshimpositionofWorkContractTax,
TurnoverTax,SalesTaxonWorkContractoranyothersimilarTax)etc.duringthecurrencyofthe
contractshallbebornebycontractorandshallnotbepaidorreimbursedtothecontractorbyMPSEDC.
.ntheeventofnon-payment/defaultinpaymentofanyoctroi,royalty,cess,turnovertax,salestax,
includingtheservicetax,purchasetax,consignmenttax,workcontracttaxoranyothersimilartaxinthe
stateconcerned,customs,exciseoranyotherlevy/taxincludinglaborduesetc.bycontractor/supplier,
MPSEDCreservestherighttowith-holdthedues/paymentsofcontractorandmakepaymentto
local/state/CentralGovernmentauthoritiesortolaborersasmaybeapplicable.Thecontractorshould
submitalongwiththetenderRegistrationCertificateswithSalesTaxonworkscontractauthorityetc.
otherwiseappropriaterecoveryshallbemadefromhisbills.

4.17.2 Theratequotedbythecontractorshallbedeemedtobeinclusiveofservicetax,SalesTax,Turnover
TaxonworkscontractoranysimilartaxaspertheActapplicableintheStateanditshallnotbe
reimbursedbyMPSEDC.TaxdeductionsatsourceshallbemadeasperlawsprevalentintheState.

4.17.3 Thestampdutyandregistrationcharges,ifany,onthecontractagreementleviedbytheGovernmentor
anyotherstatutorybody,shallbepaidbythecontractor.

4.17.4 twillbeincumbentupontheContractortoobtainaregistrationcertificateasadealerundertheLocal
SalesTaxActandtheCentralSalesTaxActandnecessaryevidencetothiseffectshallbefurnishedby
the Contractor to MPSEDC. Sales Tax on the transactions between the Contractor and his
Subcontractor/Vendorsetc.shallnotbereimbursedbyMPSEDC.TheContractorshallberesponsible
foranytaxesthatmaybeleviedhereunderonthetransactionbetweenContractorandMPSEDC.

4.17.5 ThebiddershallquotehisratesinclusiveofServicetax,TurnoverTax/SalesTaxonWorksContract
payabletoState/CentralGovt.along-withothertaxes,duties,leviesetc.inconjunctionwithotherterms
andconditions.ncase,theServicetax,TurnoverTax/SalesTaxonWorksContractonexecutionof
worksiswaivedoffbytheState/CentralGovt.atlaterstageforthisproject,theequivalentamountfrom
thedateofwaiverofsuchtax(asperprevailingrateasonthedateofwaiverofServicetax,Turnover
Tax/SalesTaxonWorksContract)shallbedeductedfromtheamountpayabletothecontractorfrom
subsequentRABills.

4.17.6 ValueAddedTax(VAT)
"The consideration agreed for the execution of said contract shall includes the tax, duties, cess, etc.
suchasexciseduty,VAT,whichareapplicableormaybeleviedinfutureunderanyStateLaworthe
CentralLawonexecutionofsaidcontract,suchtaxesshallbebornebythecontractorandshallnotbe
reimbursed by MPSEDC. Further, if due to any variance in such tax, duties, cess etc. there is any
increaseinthetaxes,thesameshallalsobebornebythecontractor.WhereunderanyoftheStateor
theCentralLaw,thereisrequirementofdeductionoftaxatsource,thesameshallbedeductedfromthe
amount paid or payable to the contractor pursuant to this contract and shall be deposited to the
Government authorities by MPSEDC. The MPSEDC shall issue the documents/forms/ certificate as
prescribed under the relevant law, in respect of the amount so deducted from the amount paid or
payable to the contractor. MPSEDC shall have full rights to withhold the amount payable to the
contractor in pursuant to this contract, if contractor does not fulfill his obligation under any State or
CentralLawrelatingtoexecutionofsaidcontract,incasetheamounthasalreadybeenpaid,MPSEDC
hastherighttorecoversuchpaymentsfromthecontractor.

4.17.7 RoyaltyonMaterials:
Thecontractorshalldepositroyaltyandobtainnecessarypermitfordisposingoffsurplusexcavated
rocksandforsupplyofbajri,stone,kankar,sand,bricksetc.fromthelocalauthoritiesandquotedrates
shallbeinclusiveofroyalty

4.18 Arbitration:
Exceptasotherwiseprovidedinthiscontractallquestionanddisputesrelatingtothemeaningofthe
specifications,designs,drawingsandinstructionshereinbeforementionedandastothingwhatsoever,
inanyway,arisingoutoforrelatingtothecontract,designs,drawings,specifications,estimates,
concerningtheworks,ortheexecutionorfailuretoexecutethesame,whetherarisingduringthe
progressoftheworkorafterthecompletionorabandonmentthereofshallbereferredtotheAdditional
ChiefGeneralManager,MPSEDCwhoshallgivehiswritteninstructionsand/ordecisionswithina
periodof30daysofsuchrequest.Thisperiodcanbeextendedbymutualconsentoftheparties.
Uponreceiptofwritteninstructionsordecisions,thepartyshallpromptlyproceedwithoutdelayto
complysuchinstructionsorinstructions.fanypartyisnotsatisfiedwiththedecisionoftheAdditional

ChiefGeneralManager,MPSEDC,hecanrefersuchdisputetoMD,MPSEDCforarbitrationgoverned
asper"TheMadhyaPradeshMadhyasthaAbhikaranAdhiniyam1983".

4.19 Escalation:
TheratesquotedbytheContractorinthiscontractdocumentsshallbefinalandshallnotbesubjected
toanychangeduetotheincreaseinlabourwagesorinflationinthecostofmaterialsoranyotherprice
variationsduetoanyreasonduringthetenureofthecontractorduringtheextendedtimeofcompletion.

4.20 nsurance:
TheContractorshallathisownexpensecarryandmaintaininsurancewithreputedinsurance
companiestothesatisfactionoftheownerasunder:

i) nsuranceofworks:TheContractorshalltakefullresponsibilityforloss,damageandcareofthe
areaandtheworksuntilitis,constructed,andhandedovertotheOwner.TheContractorshallin
theinterestoftheworkinsuretheplantandtheworkfortheirfullvalue(contractvalue)plus
10.00%(tenpercent)untiltheworkshavebeentakenover.Suchinsuranceshallcoverthe
equipmentsandworksagainstloss,damageordestructionbyfire,earthquake,theftoranyother
cause,throughoutthedurationofthecontractperiodorextendedcontractperiod.ftheContractor
failstoundertaketheinsurance,theownerwillinsureanddebitthepremiumexpendituretothe
Contractor'saccount.

ii) nsuranceofemployees:TheContractorshallacceptfullandexclusiveLiabilityforthecompliance
withallobligationsimposedbytheEmployeesStatensuranceAct,1948andanyliabilityor
penaltywhichmaybeimposedbytheCentral,StateorLocalAuthoritiesduetothereasonof
violationbytheContractororsub-contractoroftheEmployeesStatensuranceAct,1948,theshall
berecoveredfromanyofthepaymentduetoContractor.TheContractorshallagreetofulfillthe
requirementsofEmployeesStatensuranceCorporation,thedeclarationformsandallforms
whichmayberequiredinrespectoftheContractor's,sub-contractor'semployeeswhoare
employedintheworkprovidedfororthosecoveredbyE.S.l.C.fromtimetotimeunderthe
agreement.TheOwnershallretainsuchsumasmaybenecessaryfromthetotalcontractvalue
untiltheContractorshallfurnishsatisfactoryproofthatallcontributionsasrequiredbythe
EmployeesStatensuranceAct,1948havebeenpaid.

iii) Workmen'sCompensation:nsuranceshallbeeffectedforalltheContractor'semployees
engagedforthiscontract,ifanyoftheworkissub-let,theContractorshallrequirethesub-
contractortoprovideworkmen'scompensationandemployersliabilityinsuranceforthelatter's
employees,ifsuchemployeesarenotcoveredundertheContractor'sinsurance.TheContractor
shallalsocarryandmaintainallotherinsurance,whichmayberequiredunderanylawor
regulationsfromtimetotime.Heshouldalsocarryandmaintainanyotherinsurance,whichmay
berequiredbytheOwner.

iv) Transitnsurance:Thecostoftransitinsurancerelatingtotheitemstobetransportedbythe
ContractortothesiteofworkshallbebornebytheContractorandthequotedpriceshallbe
inclusiveofthiscost.

v) LossordamageandndemnityAgreement:TheContractorshallberesponsibleduringthe
progressofworkaswellasmaintenanceperiodforanyliabilityimposedbylawforanydamageto
workoranypartthereofortoanyofthematerialsorotherthingsincludingthoseofownerusedin
performingtheworkorforinjurytoanypersonorpersonsorforanypropertydamagedinor
outsidetheSite.TheContractorshallindemnifyandholdtheownerandtheengineerHarmless
againstallliability,claims,lossorinjury,includingcosts,expensesandattorneys,feesincurredin
thedefenseofsame,arisingfromanyAllegationwhethergroundlessornot,ofdamageorinjuryto

anypersonorPropertyresultingfromtheperformanceoftheworkorfromanymaterialusedin
theworkorfromanyconditionoftheworkorworkssiteorfromanycausewhatsoeverduringthe
progressandmaintenanceofthework.

vi) Thirdpartyinsurance:Beforecommencingtheexecutionoftheworks,theContractor,butwithout
limitinghisobligationsandresponsibilitiesshallinsureagainsthisliabilityforanymaterialor
physicaldamage,lossorinjurywhichmayoccurtoanyproperty,includingthatoftheOwner,orto
anyperson,includinganyrepresentativeoftheOwner,byorarisingoutoftheexecutionofworks
orintheworkbeingcarriedoutbytheowner,byorarisingoutofthereferredtointheprovisionto
clause4.20(v)hereof.Suchinsuranceshallbeeffectedwithaninsurer,intermsapprovedbythe
Owner,andforatleasttheamountstatedintheAppendixoftheTender.TheContractorshall
depositwiththeEngineerortheEngineer'srepresentativethepoliciesofinsuranceandthe
receiptsforpaymentofthecurrentpremiums.Thetermshallincludeaprovisionwhereby,inthe
eventofanyclaiminrespectofwhichtheownerwouldbeentitledtoreceiveindemnityunderthe
policybeingthroughormadeagainsttheContractor,theinsurerwillindemnifytheOwneragainst
suchclaimsandanycosts,chargesandexpensesinrespectthereof.
vii) TheContractorisrequiredtodepositcopiesofallinsurancepolicieswiththeMPSEDC.

5.0 EXECUTONOFWORK

5.1 General:
Alltheworksshallbeexecutedinaccordancewiththedetaileddrawings,SSpecificationsand
instructionsgivenbytheOwner/Consultantorasmentionedinthecontractdocument.

5.2 Drawings:
Thedrawingsgiveninthetenderdocumentareindicativeonly.Theyareonlymeantforgivingideaof
thetypeandquantumofworktobeexecuted.Allworkingdrawingsshallbemarked"Releasedfor
Execution"anddulysignedbytheConsultant.Alltheolddrawingsshallbediscardedandmarkedwith
"Supersededbydrawingno....."fduringtheexecutionoftheworkanydiscrepancyoccursinthe
drawingsorbetweenthedrawingsandspecification,thenthesameshouldbeclarifiedfromthe
Consultant/Ownerpriortotheexecutionofwork.ThedecisiongivenbytheConsultant/Ownerwould
befinal.

5.3 MaterialandSamples:

5.3.1 Thematerials/productsusedontheworksshallbeoneoftheapprovedmake/brandsoutoflistof
manufacturers/brands/makesgiveninthetenderdocuments.Thecontractorshallsubmitsamples/
specimensoutofapprovedmakesofmaterials/productstotheConsultantforpriorapproval.n
exceptionalcircumstancesConsultantmayallowalternateequivalentmakes/brandsofproducts/
materialsaftergettingapprovalfromMPSEDC.Thefinalchoiceofbrand/makeshallremainwiththe
Consultant,whosedecisioninthismattershallbefinalandbindingandnothingextraonthisaccount
shallbepayabletotheContractor.

ncasesinglebrand/makeismentioned,otherequivalentmakes/brandsmaybeconsideredbythe
ConsultantafterpriorapprovalofMPSEDC.ncaseofvarianceinCPWD/S/BSSpecificationsfrom
approvedproducts/makesspecification,thespecificationofapprovedproduct/makeshallprevailfor
whichnothingshallbepaidextratotheContractor.

ncasenomakeorbrandofanymaterials,articles,fittingsandaccessoriesetc.isspecified,thesame
shallcomplywiththerelevantndianStandardSpecificationsandshallbeartheS/BSmark.The
Consultant/MPSEDCshallhavethediscretiontocheckqualityofmaterialsandequipmentstobe

incorporatedinthework,atsourceofsupplyorsiteofworkandevenafterincorporationinthework.
Theyshallalsohavethediscretiontochecktheworkmanshipofvariousitemsofworktobeexecutedin
thiswork.Thecontractorshallprovidethenecessaryfacilitiesandassistanceforthispurpose.

5.3.2 Theaboveprovisionsshallnotabsolvethecontractorfromthequalityoffinalproductandingettingthe
materialandworkmanshipqualitycheckedandapprovedfromtheMPSEDC.
5.3.3 Thecontractorshallwellinadvance,producesamplesofallmaterials,articles,fittings,accessoriesetc.
thatheproposestouseandgetthemapprovedinwritingbyConsultant.Thematerialsarticlesetc.as
approvedshallbelabeledassuchandshallbesignedbyConsultantandtheContractor's
representative.

5.3.4 TheapprovedsamplesshallbekeptinthecustodyoftheConsultanttillcompletionofthework.
Thereafterthesamplesexceptthosedestroyedduringtestingshallbereturnedtothecontractor.No
paymentwillbemadetothecontractorforthesamplesorsamplesdestroyedintesting.

5.3.5 Thebrandsofallmaterials,articlesfittingsetcapprovedtogetherwiththenamesofthemanufacturers
andfirmsfromwhichsupplieshavebeenarrangedshallberecordedinthesiteorderbook.

5.4 Testandnspectionofworks:
5.4.1 Thecontractorshallcarryoutthevariousmandatorytestsfromauthorizedlaboratory,asper
specificationsandthetechnicaldocumentsthatwillbefurnishedtohimduringtheperformanceofthe
work.

5.4.2 Allthetestsonmaterials,asrecommendedbyCPWD,MOSTandrelevantndianStandardCodesor
otherstandardspecifications(includingallamendmentscurrentatthelastdateofsubmissionoftender
documents)shallbegotcarriedoutbythecontractoratthefieldtestinglaboratoryoranyother
recognizedinstitution/laboratory,atthedirectionoftheMPSEDC.

5.4.3 Alltestingcharges,expensesetc.shallbebornebythecontractor.Allcoststowardssamples,materials,
collection,transport,manpower,testingetc.shallbebornebytheContractorandaredeemedtobe
includedintheratesquotedbyhiminthebillofquantities.

5.4.4 Workstobeopentonspection:Allworksexecutedorunderthecourseofexecutioninpursuanceof
thiscontractshallatalltimesbeopentoinspectionandsupervisionoftheConsultant/MPSEDC.The
workduringitsprogressorafteritscompletionmayalsobeinspected,byChiefTechnicalExaminerof
GovernmentofMadhyaPradesh(CTE)and/oraninspectingauthorityofStateGovernmentand/orby
thirdpartychecksbyMPSEDC.Thecomplianceofobservations/improvementsassuggestedbythe
inspectingofficersofMPSEDC/CTE/StateauthoritiesshallbeobligatoryonthepartoftheContractorat
thecostofcontractor

5.5 nadequateworksandmaterials:
i) fanymaterialbroughtbytheContractorisfoundunsuitableorofsub-standardqualityaftertesting,
thentheContractorshallremovethatfaultymaterialsimmediatelyfromthesiteasperthe
instructionsoftheMPSEDC.
ii) fanyworkexecutedbytheContractorisfoundtobeofbadworkmanshipornotasperthe
drawings,thenthesameistobedismantledandre-executedbytheContractorwithoutclaiming
anyextrapayment.

5.6 Discrepanciesbetweeninstructions:

fanydiscrepancyoccursbetweenthevariousinstructionsconveyedtoContractororhisauthorized
representativeorifanymisunderstandingarisesbetweentheContractor'sstaffandowner'sstaff,the
ContractorshallreportthematterimmediatelytoMPSEDC,whosedecisionsshallbefinalandbinding.
Moreover,noclaimsforlossesduetodiscrepanciesbetweeninstructions,doubtsor
misunderstandingsshallbeadmissible.

5.7 Changeinspecificationsandextraitems:
fthereisanyvariationinspecificationforanychangeinmakeofitemthenithasgottobe
approvedfromtheConsultant/Ownerinwritingpriortoinstallationorexecutionandthefinancial
effect,plusorminus,orimpactshallbeincorporatedaccordinglybytheConsultant/Owner.fany
oftheitemstobeexecutedisnotincludedinthescheduleofquantities,thentheContractorshall
submittherateanalysisoftheitemspecifyingtheactualcostofprevailingratesofmaterialandlabour
andallowing15%tocoveroverheadandprofit.

5.8 Worknotspecifiedinthespecification:
fforanywork,nospecificationhasbeengiveninthetenderdocument,thentheworkwillbe
executedaspertheSspecifications,andiftheworkisnotcoveredbySspecificationsthenitshould
beexecutedasperstandardengineeringpractice,subjecttotheapprovaloftheConsultant/Ownerin
writing.

5.9 ProgressReport:
Duringexecutionofthecontract,theContractorshallfurnishfortnightlyprogressreportstoMPSEDC
andintheformatasspecifiedbytheConsultant/Ownerindicatingtheprogressachievedduringthe
fortnightandthetotalprogressuptothefortnightasagainstscheduledandanticipatedcompletion
datesinrespectofkeyphasesoftheworksuchas,releaseofdrawingsforfabrication,procurement
ofmaterials,fabrication,inspection,testingatworks,transportation,installation,erection,testingat
site,commissioningetc.TheContractorshallalsofurnishanyotherinformationinordertoascertain
progress,ifcalledforbytheConsultant/Owner.

5.10 Liabilitiesfordefectsandrectification:
fitshallappeartotheConsultant/Ownerinchargethatanyworkhasbeenexecutedwithimperfector
unskilledworkmanshiporwithmaterialsofanyinferiordescription,orofqualityinferiortothatcontracted
for,orotherwisenotinaccordancewiththecontract,theContractorshallondemandinwritingfromthe
Consultant/Ownerorhisrepresentativespecifyingthework,materialsorarticlescomplainedof
notwithstandingthatthesamemayhavebeeninadvertentlypaidfor,forthwithrectify,removeand
reconstructthatworksospecifiedandprovideotherproperandsuitablematerialsorarticlesathisown
chargesandcost,andintheeventoffailuretodosowithinaperiodtobespecifiedbytheConsultant/
Ownerorhisdemandaforesaid,theConsultant/Ownermayonexpiryofnoticeperiodrectifyor
remove,re-executetheworkattheriskofContractorandthecostshallberecoveredfromthe
Contractor.ThedecisionoftheConsultant/Ownerastoanyquestionarisingunderthisclauseshallbe
finalandconclusive.

5.11 Suspensionofwork:

TheContractorshallsuspendtheprogressofworkonreceiptofthewrittenorderfromtheConsultant/
Ownerforanyofthefollowingreasons:
a) OnaccountofanydefaultonthepartoftheContractor.
b) Forexecutionoftheworkforreasonsotherthanthedefaultofthecontractor.
c) Forsafetyoftheworks.

5.11.1 TheContractorshallduringsuchsuspension,properlyprotectandsecuretheworksandcarryout
theinstructionsoftheConsultant/Owner.
5.11.2 fthesuspensionisorderedforthereasons5.11(b)and(c)asstatedabove,theContractorshallbe
entitledforextensionoftimeequaltotheperiodofeverysuchsuspensionbutnocompensationfor
damagesetc.shallbeadmissibleonaccountofsuspensionofwork.
5.11.3 ftheprogressoftheworkissuspendedforthereasonstatedin5.11(a)thenthe
Contractorshallnotbeentitledfortheextensionoftimeandalso,theContractorshallhavenoclaim
forpaymentofcompensationforre-executionoffaultyworks.

6.0 Possessionpriortocompletion:
TheConsultant/Ownershallhavetheauthoritytotakepossessionofanycompletedorpartially
completedworks.Suchpossessionshallnotbedeemedtobeacceptanceofanyworkcompleted
inaccordancewiththecontract;ifsuchpriorpossessiondelaystheprogressofworksthenthe
adjustmentinthetimeofcompletionshallbedoneaccordingly.ThedecisionoftheMPSEDCregarding
theextentofdelayshallbefinalandbinding.

7.0 Defectliabilityperiod:Thecontractorshallberesponsiblefortherectificationofdefectsintheworks
foraperiodtwelvemonthsfromthedateoftakingoveroftheworksbytheMPSEDC.Anydefects
discoveredandbroughttothenoticeofthecontractorforthwithshallbeattendedtoandrectified
byhimathisowncostandexpense.ncasethecontractorfailstocarryouttheserectifications,the
samemaywithoutprejudicetoanyotherrightorremedyavailable,begotrectifiedbyMPSEDCat
thecostandexpenseofthecontractor.

8.0 CareofWorks:
Fromthecommencementtothecompletionofworks,theContractorshalltakefullresponsibilityforthe
careofallworksincludingalltemporaryworksandincaseanydamageorlossoccursthenthe
Contractorshallathisowncostrepairandmakegoodthesamesothatoncompletionofthework,the
sameshallbeingoodorder,inallrespect,inaccordancewiththecontractandtothefullest
satisfactionoftheMPSEDC.

9.0 WorkonSunday,HolidaysandduringNight:
ForcarryingoutworkonSundayandHolidaysorduringnight,thecontractorwillapproachthe
Consultantorhisrepresentativeatleasttwodaysinadvanceandobtainhispermission.TheConsultant
athisdiscretioncanrefusesuchpermission.Thecontractorshallhavenoclaimonthisaccount
whatsoever.fworkdemand,thecontractorshallmakearrangementstocarryouttheworkonSundays,
Holidaysandintwo,threeshiftswiththewrittenapprovalofConsultantatnoextracosttoMPSEDC

10.0 NodleChargestowardsLabourorP&Metc.:
Noidlechargesorcompensationshallbepaidforidlingofthecontractor'slabour,stafforP&Metc.on
anygroundorduetoanyreasonwhatsoever.MPSEDCwillnotentertainanyclaiminthisrespect.

11.0 CERTFCATEANDPAYMENT
11.1 ScheduleofRates:
i) ThepaymentstobemadetotheContractorforvariousitemsofworksshallbeaspertheallinclusive
ratesquotedbytheContractorinthetenderdocument.
ii) TheratesquotedbytheContractorinthetenderdocumentshallremainfirmtillthecompletionofthe
work.

iii) Thescheduleofratesshalldeemtoincludethecostofalltaxesandtestingfeesforthearticlesandno
extrapaymentforthesameshallbegiventotheContractor.
iv) Thescheduleofratesshallbedeemedtoincludeandcovertherisksofallpossibilitiesofdelayandno
extrapaymentshallbegiventotheContractorfortheworkexecutedintheextendedtimeperiod.
v) ThepaymentshallbemadebytheMPSEDCafterduescrutinybytheconsultant.

11.2 MeasurementofWorks:

11.2.1 UnlessotherwisementionedinthebillofquantitiesandasspecifiedinTechnicalSpecificationofthe
TenderthemeasurementsofworksshallbedoneasperCPWDspecificationsandifthesameisnot
givenintheCPWDSpecifications,thesameshallbemeasuredasperlatestrelevantBScodesin
force.

11.2.2 TheMeasurementsofvariousitemsoftheworkshallbetakenjointlybythecontractor'sauthorized
representativewiththeConsultant/MPSEDC'sauthorizedrepresentativeformaintainingtherecord.

11.2.3 npresenceoftheContractorauthorizedrepresentativetheConsultantorhissubordinatestaffshall
recordthesemeasurementsinthemeasurementbookssuppliedbytheMPSEDC.

11.2.4 npresenceoftheContractorauthorizedrepresentativetheConsultantorhissubordinatestaffif
deemedfitmayalsorecordthesemeasurementsintheLaptop(Computer)insteadofmeasurement
bookssuppliedbytheMPSEDC.nsuchcasesthedulyboundedPrintedhardcopiesshallalsobe
treatedastheMeasurementBook.

11.2.5 Allmeasurementssorecordedinthemeasurementbookshallbecrosscheckedandverifiedbythe
Consultant.ntheofficeoftheConsultanttheContractor'sauthorizedrepresentativeshallalsocross
examinethesemeasurementsfromtheirownrecordofjointmeasurementandatthefootof
Measurements,shallgivetheiracceptanceasfollows:

andallthesemeasurementsareacceptabletous.

11.3.1 TherunningaccountbillstobesubmittedbytheContractorshouldamounttominimumRs.30.00Lacs
(ThirtyLacs)onthebasisofdetailedmeasurementsofvariousitemsofWorksexecutedandjointly
recorded.Thecontractorshallpreparecomputerizedbillusingtheprogrammeasapprovedbythe
Consultant/MPSEDCasperprescribedformat/proforma.TheContractorshallsubmit4Nos.ofhard
copiesandonesoftcopyoffloppy/CDforallbills.

11.3.2 Allrunningpayments/interimpaymentsshallberegardedaspaymentsbywayofadvanceagainstthe
finalpaymentonlyandnotaspaymentsforworkactuallydoneandcompletedand/oracceptedby
Consultant/MPSEDCandshallnotprecludetherecoveryforbad,unsoundandimperfectorunskilled
worktoberemovedandtakenawayandreconstructedorre-erectedorbeconsideredasanadmission
ofthedueperformanceoftheContract,oranypartthereof,inthisrespect,ortheaccruingofanyclaim,
norshallitconclude,determineoraffectinanywaythepowersoftheConsultant/MPSEDCunder
theseconditionsoranyofthemastothefinalsettlementandadjustmentsoftheaccountsorotherwise,
orinanyotherwayvary/affectthecontract.Thefinalbillshallbesubmittedbythecontractorwithin
threemonthsofthecompletionofwork;otherwiseConsultant/MPSEDC'scertificateofthe
measurementandofthetotalamountpayablefortheworkaccordinglyshallbefinalandbindingon
contractor.
EachRunningBillsshouldbeaccompaniedbytwosetsofat-least20(twenty)photographsasper
directionofConsultant/MPSEDCtakenfromvariouspointsdepictingstatusofworkasonReport/Bill
datealongwithMonthlyProgressReportfortheconcernedmonthinthepro-formatobegiven/
approvedbyConsultant/MPSEDC.ntermittentprogressPhotographsasandwhenrequiredshallalso
beprovidedbytheContractorathisowncostasperdirectionofConsultant/MPSEDC.Nopaymentof
runningaccountbillshallbereleasedunlessitisaccompaniedbyprogressphotographsandMonthly
ProgressReportasabove.

11.3.3 AllrunningbillssopreparedbythecontractorshallbesubmittedtotheConsultantwhowilldulycheck
andforwardthesamewithin15daystotheM.P.S.E.D.Cforpayments.MPSEDCshallreleasethe
paymentswithinnext15daysfromthedateofreceivedofrunningbillsintheirofficefromConsultant,by
AccountPayee'sChequefromitsofficesdirectlyattheaddressnotifiedbytheContractor(Postage
chargesshallbechargedtothecontractor'saccount).ncaseofPaymentsismadebyDemandDraftat
therequestoftheContractor,BankCommissionchargesshallalsobedebitedtotheaccountof
contractor.

12.0 NoCompensationforCancellation/ReductionofWorks:
fatanytimeafterthecommencementoftheworktheConsultant/MPSEDCshallforanyreason
whatsoeverisrequiredtoabandontheworkorisnotrequiredthewholeworkthereofasspecifiedinthe
tendertobecarriedout,theConsultant/MPSEDCshallgivenoticeinwritingofthefacttothecontractor,
whoshallhavenoclaimtoanypaymentofcompensationwhatsoeveronaccountofanyprofitor
advantagewhichhemighthavederivedfromtheexecutionoftheworkinfull,butwhichhedidnot
deriveinconsequenceofthefullamountoftheworknothavingbeencarriedoutorfore-closure,neither
shallhehaveanyclaimforcompensationbyreasonofanyalterationshavingbeenmadeintheoriginal
specifications,drawings,designsandinstructionswhichshallinvolveanycurtailmentoftheworkas
originallycontemplated.
Providedthatthecontractorshallbepaidthechargesonthecartageonlyofmaterialsactuallyand
bonafidebroughttothesiteoftheworkbythecontractorandrenderedsurplusasaresultofthe
abandonmentorcurtailmentoftheworkoranyportionthereofandthentakenbackbythecontractor.

13.0 Set-offofContractor'sLiabilities:
Consultant/MPSEDCshallhavetherighttodeductorsetofftheexpensesincurredorlikelytobe
incurredbyitinrectifyingthedefectsand/oranyclaimunderthisagreementagainsttheContractorfrom
anyoragainstanyamountpayabletothecontractorunderthisagreementincludingsecuritydeposit
andproceedsofperformanceguarantee.

14.0 Jurisdiction:
TheagreementshallbeexecutedatBhopalonnon-judicialstamppaperpurchasedinBhopalandthe
courtsinBhopalalonewillhavejurisdictiontodealwithmattersarisingtherefrom,totheexclusionofall
othercourts.

15.0 FinalPaymentCertificate:
Within45daysafterreceiptoftheFinalStatement,andthewrittendischarge,theConsultantafterdue
consultationwithMPSEDC'sRepresentative,shallissuetotheMPSEDC(withacopytotheContractor)
aFinalPaymentCertificatestating,(a)theamountwhich,intheopinionoftheConsultant,isfinallydue
undertheContract;and,(b)aftergivingcredittotheMPSEDCforallamountspreviouslypaidbythe
MPSEDCandforallsumstowhichtheMPSEDCisentitledundertheContract,thebalance,ifany,due
fromtheMPSEDCtotheContractorfromtheContractortotheMPSEDCasthecasemaybe.

16.0 TakingOver/VirtualCompletionCertificate:
Whenthewholeoftheworkshavebeencompletedasperthecontract,theContractorshallbeeligible
toapplyforprovisional/Virtualcompletioncertificateinrespectoftheworks.TheConsultantin
consultationwiththeMPSEDCshallissuetotheContractortheprovisional/Virtualcompletioncertificate
afterverifyingfromthecompletiondocumentsandsatisfyinghimselfthattheworkhasbeencompleted
inaccordancewiththeconstructiondrawings,specificationsandasperthecontractconditions.The
Contractor,afterobtainingtheprovisional/Virtualcompletioncertificateshallbeeligibletopresentthe
finalbillfortheworkexecutedbyhimunderthetermsofthecontract.Theworkwillnotbeconsideredas
completeandtakenoverbytheMPSEDCuntiltheentiretemporaryworks,laborhutmentetc.are
removedandtheworksiteclearedtothesatisfactionoftheConsultant/MPSEDC
ftheContractorfailstocomplywiththerequirementsoftheaboveonorbeforethedateforthe
completionoftheworks,theConsultant/MPSEDCattheexpenseoftheContractor,mayremovethe
toolsandplantsandsurplusmaterialsanddisposeoffthesameashedeemedfit.TheContractorshall
bearallsuchamountsofexpensesincurredbytheConsultant/MPSEDC.

17.0 FinalCertificate:
ThisshallmeanthecertificateissuedbytheMPSEDCafterthedefectliabilityperiodisover.

LABOURSAFETYPROVSONS

1.0 Suitable scaffolds should be provided for workmen for all works that cannot safely be done from the
ground,orfromsolidconstructionexceptsuchshortperiodworkascanbedonesafelyfromladders.
When a ladder is usedan extra mazdoor shall be engaged for holding the ladder and if theladder is
usedforcarryingmaterialsaswell,suitablefootholdsandhandholdsshallbeprovidedontheladder
andtheladdershallbegivenaninclinationnotsteeperthan1/4to1(1/4horizontaland1vertical).
2.0 Scaffoldingorstagingmorethan3.6m(12feet)abovethegroundorfloor,swungorsuspendedfroman
overheadsupportorerectedwithstationerysupportshallhaveaguardrailproperlyattachedorbolted,
braced and otherwise secured at least 90 cm. (3 feet) high above the floor or platform of such
scaffoldingor stagingand extendingalongthe entire length of the outsideand ends thereof with only
suchopeningasmaybenecessaryforthedeliveryofmaterials.Suchscaffoldingorstagingshallbeso
fastenedastopreventitfromswayingfromthebuildingorstructure.
3.0 Workingplatforms,gangways,andstairwaysshouldbesoconstructedthattheyshouldnotsagunduly
orunequally,andiftheheightoftheplatformorthegangwayorthestairwayismorethan3.6m(12feet)
abovegroundlevelorfloorlevel,theyshouldbecloselyboarded,shouldhaveadequatewidth&should
besuitablefastenedasdescribedin(2.0)above.
4.0 Everyopeninginthefloorofabuildingorinaworkingplatformshallbeprovidedwithsuitablemeansto
prevent thefall of persons or materials by providing suitable fencing or railing whose minimum height
shallbe90cm(3feet).
5.0 Safemeansofaccessshallbeprovidedtoallworkingplatformsandotherworkingplaces.Everyladder
shallbesecurelyfixed.Noportablesingleladder shallbe over9m.(30feet)inlengthwhilethewidth
betweensiderailsinrungladdershallinnocasebelessthan29cm.forladderuptoandincluding3m
(10feet)inlength.Forlongerladdersthiswidthshouldbeincreasedatleast1/4"foreachadditional30
cm(1ft.)oflength.Uniformstepspacingshallnotexceed30cm(12").Adequateprecautionsshallbe

takentopreventdangerfromelectricalequipment.Nomaterialsonanyofthesitesoftheworkshallbe
sostackedorplacedastocausedangerorinconveniencetoanypersonorthepublic.Thecontractor
shallprovideallnecessaryfencingandlightstoprotectthepublicfromaccident,andshallbeboundto
beartheexpensesofdefenseofeverysuit,actionorotherproceedingatlawthatmaybebroughtbyan
personforinjurysustainedowingtoneglectoftheaboveprecautionsandtopayanydamagesandcost
whichmaybeawardedinanysuchsuit,actionorproceedingstoanysuchpersonorwhichmay,with
theconsentoftheContractor,bepaidtocompensateanyclaimbyanysuchperson.
6.0 EXCAVATONANDTRENCHNG
Alltrenches,1.2mts.(fourfeet)ormoreindepth,shallatalltimesbesuppliedwithatleastoneladderfor
each30m.(100feet)inlengthorfractionthereof,Laddershallbeextendedfrombottomofthetrenchto
atleast90cm(3feet)abovethesurfaceoftheground.Thesideofthetrenches,hitchare1.5m.(5feet)
ormoreindepthshallbesteppedbacktogivesuitableslopeorsecurelyheldbytimberbracing,soas
toavoidthedangerorsidestocollapsing.Theexcavatedmaterialsshallnotbeplacedwithin1.5m(5
feet)of theedges ofthe trench or half of the depth of the trench whichever is more.Cutting shall be
donefromtoptobottom.Undernocircumstancesunderminingorundercuttingshallbedone.

7.0 DEMOLTON:Beforeanydemolitionworkiscommencedandalsoduringtheprogressofthework:
7.1 Allroadsandopenareasadjacenttotheworksiteshalleitherbeclosedorsuitablyprotected.
7.2 Noelectriccableorapparatuswhichislikelytobeasourceofdangeroracableorapparatususedby
theoperatorshallremainelectricallycharged.
7.3 Allpracticalstepsshallbetakentopreventdangertopersonsemployedfromriskorfireorexplosionor
flooding. No floor, roof or other part of the building shall be overloaded with debris or materials as to
renderitunsafe.

8.0 AllnecessarypersonalsafetyequipmentsasconsideredadequatebytheEngineer-in-chargeshould
bekeptavailablefortheuseofpersonsemployedonthesiteandmaintainedinaconditionsuitablefor
immediate use, and the contractor shouldtakeadequate step to ensureproper use of equipmentby
thoseconcerned-Thefollowingsafetyequipmentshallbeinvariablyprovided.
8.1 Workers employed on mixing asphaltic materials, cement and lime mortars shall be provided with
protectivefootwearandprotectivegoggles.
8.2 Those engaged in white washing and mixing or stacking of cement bags or any materials which are
injurioustotheeyeshallbeprovidedwithprotectivegoggles.
8.3 Thoseengagedinweldingworksshallbeprovidedwithweldersprotectiveeyeshields.
8.4 Stone breakers shall be provided with protective goggles and protective clothing and seated at
sufficientlysafeinterval.
8.5 When workers are employed in sewers and manholes, which are in active use, the Contractors shall
ensurethatthemanholecoversareopenedandventilatedat-leastforanhourbeforetheworkersare
allowedtogetintothemanholes,andthemanholessoopenedshallbecordonedoffwithsuitablerailing
andprovidedwithwarningsignalsorboardstopreventaccidentthepublic.naddition,thecontractor
shallensurethatthefollowingsafetymeasuresareadheredto:
a) Entry for workers into the line shall not be allowed except under supervision of the JE or any
otherhigherofficer.
b) Atleast5to6manholesupstreamanddownstreamshouldbekeptopenforatleast2to3hours
beforeanymanisallowedtoenterintothemanholesforworkinginside.
c) Before entry, presence of Toxic gases should be tested by inserting wet lead acetate paper
whichchangescolourinthepresenceofsuchgasesandgivesindicationoftheirpresence.
d) PresenceofOxygenshouldbeverifiedbyloweringadetectorlampintothemanhole.ncase,
noOxygenisfoundinsidethesewerline,workersshouldbesentonlywithOxygenkit.
e) Safety belt with rope should be provided to the workers. While working inside the manholes
suchropeshouldbehandledbytwomenstandingoutsidetoenablehimtobepulledoutduring
emergency.

f) Theareashouldbebarricadedorcordonedofbysuitablemeanstoavoidmishapsofanykind.
Properwarningsignsshouldbedisplayedforthesafetyofthepublicwhenevercleaningworks
areundertakenduringnightorday.
g) Nosmokingoropenflamesshallbeallowedneartheblockedmanholebeingcleaned.
h) The malba obtained on account of cleaning of blocked manholes and sewer lines should be
immediatelyremovedtoavoidaccidentsonaccountofslipperynatureofthemalba.
i) Workers should not be allowed to work inside the manhole continuously. He should be given
rest intermittently. The Engineer n-charge may decide the time up to which a worker may be
allowedtoworkcontinuouslyinsidethemanhole.
j) GasmaskswithOxygenCylindershouldbekeptatsiteforuseinemergency.
k) Air-blowers should be used for flow of fresh air through the manholes. Whenever called for,
portableair-blowersarerecommendedforventilatingthemanholes.TheMotorsfortheseshall
bevapourproofandoftotallyenclosedtype.Nonsparkinggasenginesalsocouldbeusedbut
they should be placed at-least2 meters away from the opening and on the leeward side
protected from wind so that they will not be a source of friction on any inflammable gas that
mightbepresent.
l) The workers engaged for cleaning the manholes/ sewers should be properly trained before
allowingworkinginthemanhole.
m) TheworkersshallbeprovidedwithGumbootsornonsparkingshoes,bumphelmetsandgloves
non sparking tools, safety lights and gas masks and portable air blowers (when necessary).
They must be supplied with barrier cream for anointing the limbs before working inside the
sewerlines.
n) Workmendescendingamanholeshalltryeachladdersteporrungcarefullybeforeputtinghis
fullweightonittoguardagainstinsecurefasteningduetocorrosionoftherungfixedtomanhole
well.
o) famanhasreceivedaphysicalinjury,heshouldbebroughtoutofthesewerimmediatelyand
adequatemedicalaidshouldbeprovidedtohim.
p) Theextentstowhichtheseprecautionsaretobetakendependonindividualsituationbutthe
decisionoftheEngineerin-chargeregardingthestepstobetakeninthisregardinanindividual
casewillbefinal.

8.6. TheContractorshallnotemploymenandwomenbelowtheageof18yearsontheworkofpainting
withproductscontainingleadinanyformwherever menabovetheageof18areemployedonthe
workofleadpaintingthefollowingprecautionsshouldbetaken.
8.6.1 No paint containing lead or lead products shall be used except in the form of paste or readymade
paint.
8.6.2 Suitablefacemasksshouldbesuppliedforusebytheworkerswhenpaintisappliedintheformof
sprayorasurfacehavingleadpaintisdryrubbedandscrapped.
8.6..3 OverallsshallbesuppliedbytheContractortotheworkmenandadequatefacilitiesshallbeprovided
toenabletheworkingpainterstowashduringthecessationofwork.

8.6.4.1 a White lead, sulphate or lead work products containing those pigments shall not be used in
paintingoperationexceptintheformofpasteorofpaintsreadyforuse.
b. Measures shall be taken whenever required in order to prevent danger arising from the
applicationofpaintintheformofspray.
c. Measuresshallbetaken,wheneverpracticabletopreventdangerarisingoutofdustcausedby
dryrubbingdownandscrapping.
8.6.4.2 a Adequatefacilitiesshallbeprovidedtoenableworkingpaintertowashduringandoncessation
ofwork.
b. Suitable arrangements shall be made to prevent clothing put off during working hours being
spoiledbypaintingmaterials.

8.6.4.3 a) Cases of lead poisoning and of suspected lead poisoning shall be notified and shall be
subsequently verified by a medical man appointed by the competent authorities of the
Consultant.
b) TheMPSEDCmayrequirewhennecessaryamedicalexaminationofworkers.
c) nstructionswithregardtothespecialhygienicprecautionstobetakeninthepaintingtradeshall
bedistributedtoworkingpainters.

9.0 When the work is done near any place where there is risk of drowning, all necessary equipments
shouldbeprovidedandkeptreadyforuseandallnecessarystepstakenforpromptrescueofany
personindangerandadequateprovisionsshouldbemadeforpromptfirstaidtreatmentofallinjuries
likelytobeobtainedduringthecourseofthework.

10.0 Use of hoisting machines and tackle including their attachment encourage and supports shall
conformtothefollowingstandardofconditions.
10.1 a) Theseshallbeofgoodmechanicalconstruction,soundmaterialandadequatestrengthandfree
frompatent,defectsandshallbekeptrequiredingoodworkingorder.

b)Everyropeusedinhoistingorloweringmaterialsorasameansofsuspensionshallbeofdurable
qualityandadequatestrength,andfreefrompatentdefects.

10.2 Everycranedriverorhoistingapplianceoperatorshallbeproperlyqualifiedandnopersonunderthe
age of 21 years should be in-charge of any hoisting machine including any scaffolding, winch or
givingsignalstooperator.
10.3 ncaseofeveryhoistingmachineandofeverychainringhook,shackleswivelandpulleyblockused
in hoisting or as means of suspension the safe working load shall be ascertained by adequate
means.Everyhoistingmachineandallgearreferredtoaboveshallbeplainlymarkedwiththesafe
workingload.ncaseofahoistingmachinehavingavariablesafeworkingload,eachsafeworking
loadandtheconditionsunderwhichitisapplicableshallbeclearlyindicated.Nopartofanymachine
oranygearreferredtoaboveinthisparagraphshallbeloadedbeyondthesafeworkingloadexcept
forthepurposeoftesting.
10.4 ncaseofMPSEDCmachines,thesafeworkingloadshallbenotifiedbytheEngineer-in-Charge.As
regardsContractor'smachinestheContractorshallnotifythesafeworkingloadofthemachineto
the Engineer-in-charge whenever he brings any machinery to site of work and get verified by the
Engineer-in-Charge.

11.0 Motorsgearing,transmissionelectricwiringandotherdangerouspartsofhoistingappliancesshould
beprovidedwithefficientsafeguard,hostingappliancesshouldbeprovidedwithsuchmeansaswill
reduce to the minimum the risk of accidental descent of the load. Adequate precautionsshouldbe
taken to reduce the minimum the risk of any part of a suspended load becoming accidentally
displaced. When workers are employed on electrical installations, which are already energized,
insulating mats, wearing apparel, such as gloves sleeves and boots as may be necessary be
provided.Theworkershouldnotwearanyrings,watchesandcarrykeysorothermaterials,which
aregoodconductorsofelectricity.

12.0 Allscaffold,ladders,andothersafetydevicesmentionedordescribedhereinshallbemaintainedin
safe condition and no scaffold ladder or equipment shall be altered or removed while it is in use.
Adequatewashingfacilitiesshouldbeprovidedatornearplacesofwork.
13.0 Thesesafetyprovisionsshouldbebroughttothenoticeofallconcernedbydisplayonanoticeboard
ataprominentplaceofworkspot.Thepersonresponsibleforcomplianceofthesafetycodesshall
benamedthereinbythecontractor.

14.0 To ensure effective enforcement of the rules and regulations relating to safety precautions the
arrangementsmadebytheContractorshallbeopentoinspectionbytheortheirrepresentatives.

15.0 Notwithstanding the above Clauses & sub clauses from (1.0) to (14.0) there is nothing in these to
exemptthecontractorfromtheoperationsofanyotherActorRuleinforceintheRepublicofndia.

MODELRULESFORTHEPROTECTONOFHEALTHANDSANTARY
ARRANGEMENTSFORWORKERS

1.0 APPLCATON
Theserulesshallapplytoallbuildingandconstructionworksinwhich20(twenty)ormoreworkers
areordinarilyemployedorareproposedtobeemployedinanydayduringtheperiodduringwhich
thecontractorworkisinprogress.

2.0 DEFNTON
Workplacemeansaplacewheretwentyormoreworkersareordinarilyemployedorareproposedto
be employed in connection with construction work on any day during the period during which the
contractorworkisinprogress.

3.0 FRST-ADFACLTES
3.1 Ateveryworkplacefirstaidfacilitiesshallbeprovidedandmaintained,soastobeeasilyaccessible
duringworkinghours,First-Aidboxesattherateofnotlessthanoneboxper150contractlabouror
partthereofordinarilyemployed.

3.2 The First-Aid box shall be distinctly marked with a red cross on white ground and shall contain the
followingequipments:-

3.2.1a)Forworkplacesinwhichnumberofcontractlabouremployeddoesnotexceed50,
EachFirst-Aidboxshallcontainthefollowingequipments:

i) 6smallsterilizeddressings.
ii) 3mediumsizesterilizeddressings.

viii) 1(30gms)bottleofpotassiumpermanganatecrystals.
ix) 1pairofscissors.
x) 1copyoftheFirst-Aidleaf-letissuedbytheDirectorGeneral,FactoryAdviseService&

xi) 1bottlecontaining100tablets(eachof5grams)ofaspirin.

3.2.2 For work places in which thenumber of contractlabour exceed 50. Each First-Aid box shall

3.3 Adequate arrangements shall be made for immediate recumbent of the equipment when
necessary.
3.4 NothingexcepttheprescribedcontentsshallbekeptintheFirstAidbox.
3.5 TheFirstAidboxshallbekeptinchargeofaresponsiblepersonwhoshallalwaysbereadily
availableduringtheworkinghoursoftheworkplace.
3.6 ApersoninchargeoftheFirst-AidboxshallbeapersontrainedinFirst-Aidtreatment,inwork
placeswherethenumberoflabouremployedis150ormore.

3.7 nworkplaceswherethenumberoflabouremployedis500ormoreandhospitalfacilitiesare
notavailablewithineasydistanceoftheworks,first-AidPostsshallbeestablishedandrunbya
trained Compounded. The Compounded shall be on duty and shall be available at all hours
whentheworkersareatwork.
3.8 Where work places are situated in places, which are not towns of cities, a suitable motor
transportshallbekeptreadilyavailabletocarryinjuredpersonorpersonssuddenlytakenillto
thenearesthospital.

4.0 DRNKNGWATER
4.1 neveryworkplace,thereshallbeprovidedandmaintainedatsuitableplaces,easilyaccessible
tolabour,asufficientsupplyofcoldwaterfitfordrinking.
4.2 Wheredrinkingwaterisobtainedfromanintermittentpublicwatersupply,eachworkplaceshall
beprovidedwithstoragewheresuchdrinkingwatershallbestored.
4.3 Everywatersupplyofstorageshallbeatadistanceofnotlessthan50feetfromanylatrines
drainorothersourceofpollution,Wherewaterhastobedrawnfromanexistingwellwhichis
withinsuchproximityoflatrine,drainoranyothersourceofpollution,thewellshallbeproperly
chlorinated before water is drawn from it for drinking. All such wells shallbe entirely closed in
andbeprovidedwithatrap-doorwhichshallbedustandwater-proof.
4.4 Areliablepumpshallbefittedtoeachcoveredwell,trap-doorshallbekeptlockedandopened
onlyforcleaningorinspectionwhichshallbedoneatleastonceamonth.

5.0 WASHNGFACLTES

5.1 neveryworkplaceadequateandsuitablefacilitiesforwashingshallbeprovidedandmaintained
fortheuseoflabouremployedherein.
5.2 Separate and adequate screening facilities shall be provided for the use of male and female
workers.
5.3 SuchfacilitiesshallbeconvenientlyaccessibleandshallbekeptcleanandhygienicCondition.

6.0 LATRNESANDURNALS
6.1 Latrinesshallbeprovidedineveryworkplaceonthefollowingscale,namely:

a) Wherefemalesareemployedthereshallbeatleastonelatrineforevery25females.
b) Wheremalesareemployed,thereshallbeatleastonelatrineforevery25males.
Providedthat where the numberofmales or femalesexceeds 100, it shall besufficientif
thereisonelatrinefor25malesorfemales,asthecasemaybe,uptothefirst100,andone
forevery50thereafter.

6.2 Everylatrineshallbeundercoverandsopartitionedoffastosecureprivacy,andshallhavea
properdoorandfastenings.
6.3 ConstructionofLatrines:Theinsidewallsshallbeconstructedofmasonryorsomesuitableheat
resistingnon-absorbentmaterialsandshallbecementwashedinsideandoutsideatleastonce
ayear.Latrineshallnotbeastandardlowerthanbore-holesystem.
6.4 (a)Whereworkersofbothsexesareemployed,thereshallbedisplayedoutsideeachblockof
latrineandurinal,anoticeinthelanguageunderstoodbythe majorityoftheworkers"ForMen
only"or"ForWomenonly"asthecasemaybe.

(b)Thenoticeshallalsobearthefigureofmenorofwomen,asthecasemaybe.
6.5 Thereshallbeatleastoneurinalformaleworkersupto50andoneforfemaleworkersupto50
employedatatime.Providedthatwherethenumberofmaleorfemaleworkmen,asthecase
maybe,exceeds500,itshallbesufficientifthereisoneurinalforevery50malesorfemales
uptothefirst500andoneforevery100orpartthereof,thereafter.
6.6 a) Thelatrinesandurinalsshallbeadequatelylightedandshallbemaintainedinacleanand
sanitaryconditionatalltimes.

b) Latrines and urinals other than those connected with a flush sewerage system shall
complywiththerequirementsofthePublicHealthAuthorities.
6.7 Watershallbeprovidedbymeansofataporotherwisesoastobeconvenientlyaccessibleinor
nearthelatrinesandurinals.
6.8 DSPOSALOFEXCRETA
Unlessotherwisearrangedforbythelocalsanitaryauthorityarrangementsforproperdisposal
ofexcretabyincinerationattheworkplaceshall bemadebymeansofasuitableincinerator.
Alternativelyexcretamaybedisposedoffbyputtingalayerofnightsoilatthebottomofapucca
tankpreparedforthepurposeandcoveringitwitha15cmlayerofwasteorforrefuseandthen
coveringitwithalayerofearthforfortnight(whenitwillturnintomanure).
6.9 TheContractorshall,athisownexpense,carryoutallinstructionissuedtohimbytheEngineer-
in-Charge to effect proper disposal of night soil and other conservancy work in respect of the
Contractor's workmen or employees on the site. The Contractor shall be responsible for
payment of any charges which may be levied by Municipal or Cantonment Authority for
executionofsuchworkonhisbehalf.

7.0 PROVSONOFSHELTERDURNGREST
Ateveryplacethereshallbeprovided,freeofcostfoursuitablesheds,twoformalesandthe
othertwoforrestseparatelyfortheuseofmanandwomenlabour.Theheightofeachshelter

shallnotbelessthan3metersfromthefloorleveltothelowestpartoftheroof.Theseshallbe
keptcleanandthespaceprovidedshallbeonthebasisof0.6sqm.Perhead

Provided that the Engineer-in-Charges may permit, subject to his satisfaction, a portion of the
buildingunderconstructionorotheralternativeaccommodationtobeusedforthepurpose.

8.0 CRECHES
8.1 Aeveryworkplace,atwhich20ormorewomenworkersareordinarilyemployed,thereshallbe
providedtworoomsofreasonabledimensionsfortheuseoftheirchildrenundertheageofsix
years.Oneroomshallbeusedasaplayroomforthechildrenandtheotherastheirbedrooms.

Theroomsshallbeconstructedonstandardnotlowerthanthefollowing:
i)Thatchedroof
ii)Mudfloorandwalls.
iii)Planksspreadoverthemudfloorandcoveredwithmatting

8.2 Theroomsshallbeprovidedwithsuitableandsufficientopeningsforlightandventilation.There
shallbeadequateprovisionofsweeperstokeeptheplacesclean.
8.3 TheContractorshallsupplyadequatenumberoftoysandgamesintheplayroomandsufficient
numberofcotsandbeddingsinthebed-room.
8.4 TheContractorshallprovideoneAyaatolookafterthechildreninthecrchewhenthenumber
ofwomenworkersdoesnotexceed50andtwowhenthenumberofwomenworkersexceeds
50.
8.5 The use of the rooms/earmarked as ealize shall be restricted to children, their attendant and
motherofthechildren.

9.0 CANTEENS
9.1 neveryworkplacewheretheworkregardingtheemploymentofcontractlabourislikelyto
continue forsix months and whereincontract labour numbering one hundred or more are
ordinarily employed, an adequate canteen shall be provided by the Contractor for the use of
suchlabour.
9.2 ThecanteenshallbemaintainedbytheContractorinanefficientmanner.
9.3 The canteen shall consist of at least a dining hall, kitchen, store room, pantry and washing
placesseparatelyforworkersandutensils.
9.4 Thecanteenshallbesufficientlylightedatalltimeswhenanypersonhasaccesstoit.
9.5 The floor shall be made of smooth and impervious material and inside walls shall be lime
washedorcolourwashedatleastonceineachyear.
Providedthattheinsidewallsofthekitchenshallbelime-washedeveryfourmonths.

9.6 Thepremisesofthecanteenshallbemaintainedinacleanandsanitarycondition.
9.7 Waste Water shall be carried away in suitable covered drains and shall not be allowed to
accumulatesoastocauseanuisance.
9.8 Suitablearrangementsshallbemadeforthecollectionanddisposalofgarbage.
9.9 Thedinninghallshallaccommodateatatime30personsofthelabourworkingattime.
9.10 Thefloorareaofthedinninghall,excludingtheareaoccupiedbytheservicecounterandany
furniture except tables and chair shall not be less than one square meter per dinner to be
accommodated.
9.11 a) Aportionofthedinninghall,andservicecountershallbepartitionedoffandreservedfor
womenworkersinproportiontotheirnumber.

b) Washingplacesforwomenshallbeseparateandscreenedtosecureprivacy.

9.12 Sufficient tables, stool, chairs or benches shall be available for the number of dinners to be
accommodated.
9.13.1 a)Thereshallbeprovidedandmaintainedsufficientutensils,crockery,furnitureandanyother
Equipmentnecessaryfortheefficientrunningofthecanteen.
b) Thefurniture,utensilsandotherequipmentshallbemaintainedinaclean and
hygieniccondition.

9.13.2 a) Suitable clean clothes for the employees serving in the canteen shall be provided and
maintained.
b) Aservicecounter,ifprovided,shallhavetopofsmoothandimperviousmaterial.
c)Suitablefacilitiesincludinganadequatesupplyofhotwatershallbeprovidedforthe
cleaningofutensilsandequipment.

9.14 The food stuffs and other items to be served in the canteen shall be in conformity with the
normalhabitsofthelabour.

9.15 Thechargeforfoodstuffs,beveragesandanyotheritemsservedinthecanteenshallbebased
on'NoprofitNoloss'andshallbeconspicuouslydisplayedinthecanteen.

9.16 n arriving at price of food stuffs, and other articles served in the canteen, the following items
shallnotbetakenintoconsiderationasexpenditure,namely:
a) Therentoflandbuilding.

theEngineer-in-Chargeincludingthefillingupofanyborrowspitswhichmayhavebeendugby
him.

11.0 AMENDMENTS
MPSEDCmayfromtimetotime,addtooramendtheserulesandissuesuchdirectionsasit
may consider necessary for the purpose of removing any difficulty which may arise in the
administrationhereof.

CONTRACTOR'SLABOURREGULATONS

1.0 SHORTTTLE
TheseregulationsmaybecalledtheContractor"LabourRegulations.

2.0 DEFNTONS
2.1 "Workman means any person employed by the MPSEDC, or its Contractor directly or indirectly
throughasub-contractor,withorwithouttheknowledge,oftheMPSEDC,todoanyskilled,semi-skilled,
un-skilled, manual, supervisory, technical or clerical work for hire or reward, whether, the terms of
employmentareexpressedorimpliedbutdoes notincludeanyperson-
a) Whoisemployedmainlyinamanagerialor administrative capacity;or
b) WhobeingemployedinasupervisorycapacitydrawswagesexceedingRupeesTwothousand
Fivehundredperpersonorexerciseseitherbythenatureofthedutiesattachedtotheofficeor
byreasonofpowersvestedtohim,functionsmainlyofmanagerialnature.
c) Whoisanoutworker,thatistosay,apersontowhomanyarticlesormaterialsaregivenoutby
or on behalf of the principal employer to be made up cleaned, washed, altered, ornamental
finished,repaired,adoptedorotherwiseprocessedforsale forthepurpose of the trade or
businessoftheprincipalemployerandtheprocessistobecarriedouteitherinthehomeofthe
outworkerorinsomeotherpremises,notbeingpremisesunderthe control and management
oftheprincipalemployer.
2.2 "FairWagesmeanswageswhetherfortime orpieceworkfixedandnotifiedunder the provisions of
theminimumWagesActfrom timeto time.
2.3 "Contractorshallincludeeverypersonwho undertaketoproduceagiven result other than a mere
supply of goods or articles of manufacture through labour or who supplies labour for any work and
includesasub-contractor.
2.4 "Wagesshall havethesamemeaningasdefinedin thePaymentofWagesAct.
2.4.1 Normallyworkinghoursofanadultemployeeshouldnotexceed9hoursaday.Theworkingdayshall
besoarrangedthat inclusiveofintervalforrest, ifany, itshall notspread overmorethan12
hoursonanyday.
2.4.2 When anadultworkerismadetoworkformorethan9hoursonanydayorformorethan48hoursin
anyweekhe shall be paid overtime for the extra hours put in by him at double the ordinary rate of
wages.
2.4.3.1 Every worker shallbegiven aweeklyholidayonaSunday,inaccordancewiththeprovisionsofthe
Minimum Wages (Central) Rules 1960 as amended from time to time, irrespective of whether such
workerisgovernedbytheMinimumWagesAct ornot.
2.4.3.2 Whether the Minimum Wages prescribed by the Government under the Minimum Wages Act are not
inclusiveofthewagesfortheweeklydayofrest,theworkershallbeentitledtorestdaywagesatthe
rateapplicableto thenextprecedingday,providedhehasworkedunderthesamecontractorfora
continuousperiodofnotlessthandays.
2.4.3.3 HereacontractorispermittedbytheEngineer-in-Chargetoallowaworkertoworkonanormalweekly
holiday,heshallgrantasubstituteholidaytohimforthewholedayonone of the five days
immediately before or after the normal weekly holidays and pay wages to such worker for the work
performedonthenormalweeklyholidayatovertimerate.

3.0 DSPLAYOFNOTCEREGARDNG-WAGES,ETC.
Thecontractor shall before he commences his work on contract, display and correctly maintain and
continuetodisplayandcorrectlymaintainina cleanandlegibleconditioninconspicuousplacesonthe
work,noticesinEnglishandinthelocalndianlanguagesspokenbythemajorityoftheworkers,giving
theminimumratesofwagesfixedunderthe Minimum Wages Act, the actual wages being paid, the
hours of work for which such wages are earned, wage period, dates of payment of wages and other
relevantinformationasperAppendix'A'.

4.0 PAYMENTOFWAGES
4.1 Thecontractor shallfixwageperiodsinrespectofwhichwagesshallbepayable.
4.2 Nowageperiodshallexceed onemonth.
4.3 Thewagesofeverypersonemployedaslabourinanestablishmentorbyacontractorwherelessthan
one thousand, such persons are employed shall be paid before the expiry of the seventh day and in
othercasesbeforetheexpiryoftenthdayafterthelastdayofthewageperiodinrespectofwhichthe
wagesarepayable.
4.4 Where theemploymentofanyworkeristerminated by or on behalf of the contractor the wages
earnedbyhimshallbepaidbefore theexpiryofthesecondworkingdayfromthedateonwhichhis
employmentisterminated.
4.5 Allpaymentsofwagesshallbemade onaworkingdayattheworkpremisesandduring the
workingtimeandonadatenotifiedinadvanceandincasetheworkiscompletedbeforetheexpiryof
thewageperiod,finalpaymentshall bemadewithin48hoursofthelastworkingday.
4.6 Wagesdue to every worker shall be paid to him direct or to other person authorized by him in this
behalf.
4.7Allwagesshallbepaidincurrentcoinorcurrencyorinboth.
4.8 Wagesshall be paid without any deductions of any kind except those specified by the Central
Governmentbygeneralorspecialorderinthisbehalforpermissibleunder the payment of Wages
Act1956.
4.9 Anoticeshowingthewageperiodandtheplaceand timeof disbursement of wages shall be
displayedattheplace of work and a copy sent by the contractor to the Engineer-in-Charge under
acknowledgment.
4.10 tshall bethedutyofthecontractortoensurethedisbursementofwagesinthepresenceofthe
Engineeroranyother authorizedrepresentativesoftheEngineer-in-Chargewhowillberequiredtobe
presentattheplaceandtimeofdisbursementofwagesbythecontractortoworkmen.
4.11 ThecontractorshallobtainfromtheEngineeroranyotherauthorizedrepresentativeoftheEngineer-in-
Chargeasthecasemaybe,acertificateunderhissignatureattheendoftheentriesinthe"Registerof
Wagesor the"Wage-cum-MusterRollasthecasemaybeinthefollowingform:
"CertifiedthattheamountshownincolumnNo..........hasbeenpaidtotheworkmenconcernedinmy

5.0FNESANDDEDUCTONS,WHCHMAYBEMADEFROMWAGES
5.1 Thewagesof aworkershallbepaidtohimwithout anydeduction ofanykindexceptthefollowing
a) Fines
b) Deductionsforabsencefrom dutyi.e.fromtheplaceorthe places where by the terms of his
employment he is required to work. The amount of deduction shall be in proportion to the period for
whichhewasabsent.
c) Deductionfor damagetoorlossofgoodsexpresslyentrustedtotheemployedpersonsforcustody,or
fromlossofmoneyor anyotherdeductionwhichhe is required to account where such
damageorlossisdirectlyattributabletohisneglectordefault.
d) Deduction for recovery of advances or for adjustment of over payment of wages, advances granted
shallbeenteredinaregister.
e) Anyotherdeduction,whichtheCentralGovernmentmayfromtimetotimeallow.

5.2 Nofinesshouldbeimposedonanyworkersaveinrespectofsuchactsandomissionsonhispartas
havebeenapprovedbytheChiefLabourCommissioner.
NOTE:AnapprovedlistofActsand Omissionsforwhichfinescanbeimposedisenclosedat
Appendix-.
5.3 Nofineshallbeimposedona worker andnodeduction for damage or loss shall be made from his
wagesuntiltheworkerhasbeengivenanopportunityofshowingcauseagainstsuchfinesor
deductions.
5.4 Thetotalamountoffinewhichmaybeimposedinanyonewageperiodonaworkershallnotexceedan

amount equal to three paise in a Rupees of the total wages, payable to him in respect of that wage
period.
5.5 Nofineimposedonanyworkershall berecoveredfromhimin installment,oraftertheexpiryofsixty
daysfromthedateonwhichitwasimposed.
5.6 Everyfineshallbedeemedto havebeenimposedonthedayoftheactoromissioninrespectofwhich
itwasimposed.

6.0 LABOURRECORDS
6.1 Thecontractor shallmaintaina"Registerof personsemployedonworkoncontractinformXofthe
CL(R&A)CentralRules1971(Appendix-B).
6.2 Thecontractorshallmaintaina"MusterRollregisterinrespectofallworkmenemployedbyhimonthe
workundercontractinfromXVoftheCL(R&A)Rules1971(Appendix-C).
6.3 Thecontractorshallmaintaina"WageRegisterinrespectofallworkmen employed by him on the
workinform(Appendix-D).
6.4 Register of accidents The contractor shall maintain a register of accidents in such form as may be
convenientattheworkplacebutthesameshallincludethefollowingparticulars:
a) Fullparticularsofthelabourerswhometwithaccident.
b) Rateofwages
c) Sex
d) Age
e) Nature ofaccidentandcauseofaccident.
f) Timeanddateofaccident.

6.5 RegisterofFinesThecontractorshallmaintaina"RegisterofFinesintheform(Appendix-H).
Thecontractorshalldisplayinagoodconditionandinaconspicuousplaceofworktheapprovedlistof
ActsandOmissionforwhichfinescanbeimposed(Appendix-).
6.6 RegisterofDeductions-Thecontractorshallmaintaina"RegisterofDeductionsfordamageorlossin
form(Appendix-J).
6.7 RegisterofAdvances-Thecontractorshallmaintain a"RegisterofAdvancesinform(Appendix-K).
6.8 RegisterofOvertime-Thecontractorshallmaintaina"RegisterofOvertimeinform(Appendix-L).

7.0 ATTENDANCECARD-CUMWAGESLP:
7.1 Thecontractorshallissueanattendancecard-cum-wagesliptoeachworkmanemployedbyhiminthe
specimenformat(Appendix-E).
7.2Thecardshallbevalidforeachwageperiod.
7.3 The contractor shall mark the attendance of each workman on the card twice each day, once at the
commencementof thedayandagainaftertherestinterval,beforeheactuallystartswork.
7.4 Thecardshallremaininpossessionoftheworkerduringthewageperiodunderreference.
7.5 Thecontractorshallcompletethewageslipportiononthereverseofthecardatleastadaypriortothe
disbursementofwagesinrespectofthewageperiodunderreference.
7.6 Thecontractorshallobtainthesignatureorthumpimpressionofthe worker on the wage slip at the
timeofdisbursementofwagesandretainthecardwithhimself.

8.0 EMPLOYMENTCARD
The contractor shall issue an Employment Card in form to each worker within three days of the
employmentoftheworker(Appendix-F).

9.0 SERVCECERTFCATE
On termination of employment for any reason whatsoever the contractor shall issue to the workman
whoseserviceshavebeenterminated,aservicecertificateinfromAppendix-G.

10.0 PRESERVATONOFLABOURRECORDS
AllrecordsrequiredtobemaintainedunderRegulationsNos.6and7shallbepreservedinoriginalfora
period of three years from the date of last entries made in them and shall be made available for
inspectionbytheEngineer-in-Charge,LabourOfficer.

11.0 POWEROFLABOUROFFCERSTOMAKENVESTGATONSNQURY
TheLabourOfficeroranyotherpersonauthorizedbyMPSEDC,onitsbehalfshallhavepowertomake
inquireswithaviewtoascertainingandenforcingdueandproperobservanceoftheFairWageClauses
andtheProvisionsofRegulations.Heshallinvestigateintoanycomplaintregardingthedefaultmadeby
thecontractororsub-contractorinregardtosuchprovision.

12.0 NSPECTONOFBOOKANDSLPS
Thecontractorshallallowinspectionofalltheprescribedlabourrecordstoanyof his workers or to
hisagentataconvenienttimeandplaceafterduenoticeisreceivedortotheLabourofficeroranyother
person,authorizedbytheCentralGovernmentonhisbehalf.

13.0 SUBMSSONOFRETURNS
Thecontractorshallsubmitperiodicalreturnsasmaybespecifiedfromtimetotime.

14.0 AMENDMENTS
The MPSEDC, may from to time, add or amend the regulations and on any question as to the
application, interpretation or effect of these regulations the decision of the Chief Engineer concerned
shallbefinal.

6.0 LABOURLAWSANDSAFETYREGULATONS
6.1 LaborLaws
i) Laborbelowtheageof18yearsshouldnotbeemployedonthework.
ii) TheContractorshallnotpaylessthanwhatisspecifiedinthelawtoLaborersengagedbyhimonthe
work.
iii) TheContractorshall,athisownexpenses,complywithalllaborlaws
naddition,theownershallnotberesponsibleforanyrecovery/penaltyimposedbytherespective
authoritiesforviolatingthelaborlaws.
iv) ftheContractoriscoveredundertheContractLabor(RegulationandAbolition)Act,heshallobtaina
licensefromthelicensingauthority(i.e.theofficeofLaborCommissioner),bypaymentofthenecessary
prescribedfeeanddeposit,ifany,beforestartingthework.
v) TheContractorshallfurnishtotheownerthedetailsoftheworkersemployedontheworks.

vi) TheContractorshallcomplywiththeprovisionsoftheexistingrulesandregulationsrelatingtolabor
laws.
vii) TheownershallonareporthavingbeenmadebyaninspectingofficerasdefinedinContractLabor
(RegulationandAbolition)Act,1980,havethepowertodeductfromtheamountduetotheContractor
anysumrequiredorestimatedtoberequiredformakinggoodthelossessufferedbyaworkeror
workersbyreasonofnon-fulfillmentoftheconditionsofthecontractorthebenefitoftheworkers,orif
deductionsmadefromhisortheirwageswhicharenotjustifiedbythetermsofcontractornon-
observanceofthesaidregulations.

7.0 SAFETYCODE
7.1 SafetyandProtection
TheContractorshalladheretosafeengineeringpracticeandguardagainsthazardousandunsafe
workingconditions.Whilecarryingoutthework,theContractorshouldprovidefor:
i) Safetyofpersonnelengagedintheelectrificationanderection
ii) Protectionandsafetyofworksandmaterialsduringtheirprogress.
iii) Cleanandhygienicconditionsofworkingandlivingforhisworkers,asrequiredbyMPSEDC.
7.2 FirstAid
TheContractorshallprovideregularfirstaidfacilitiesforhisemployeesandthoseofhissub-contractors.

7.3 Contractor'sBarricades/safetyanddangerboards
TheContractorshallerectandmaintainbarricades,safety,anddangerboardsrequiredabouthis
operationstoguardorprotect
i) Excavations
ii) Chargedelectricalpanelsandsystemareas
iii) AreasadjudgedhazardousbytheContractororConsultant'srepresentatives.

7.4 Preservationofpeace
TheContractorshalltakeprecautionstopreventanyriotousorunlawfulbehaviorbyhisworkers,forthe
preservationofpeaceandprotectionofinhabitantsandthesecurityofpropertyintheneighborhoodof
thework.

TheconditionsofcontractandthedrawingshallbereadinconjunctionswiththeSpecificationsandmattersreferredto,
shownordescribedinonearenotnecessarilyrepeatedintheother.Thesespecificationsarecomprehensiveandmay
exceedtherequirementsofthisproject.AnyambiguitybetweentheGeneralspecifications,theBillofquantitiesand
contractdrawings,shallbereferredtotheconsultantforclarificationnotlaterthan10daysbeforethedateFixedfordelivery

throughouttheperiodofcontract.Theseshallbethelatesteditionsandshallincludeallrevisions/addendumthereof.

Approvedmanufacturers:Namesofapprovedmanufacturersshallbeconstructedasestablishingastandardofqualityand
notaslimitingcompetition.

Thecontractorshallincludeinhispricesforsupplyingtheitemormaterialsfromtheapprovedmanufacturerslistedorequal
andapproval.

Allitemsormaterialsshallbedeliveredtothesiteinthemanufacturersoriginalunopenedcontainerswiththemanufacturers
brandandnameclearlymarkedon.

Allitemsormaterialsshallbeassembled,mixed,fixed,appliedorotherwiseincorporatedintheworksinaccordancewith

1 GENERAL

1.1 Scope

Thisspecificationappliestotheinteriordecorationworkstobeexecutedbythecontractor.tistobereadinconjunctionwith
andsubjecttothegeneralconditionsofcontractandinconjunctionwiththedrawings,thescheduleofratesandsuchother
documentsasmayfromtimetotimebeagreeduponascomprisingpartofthiscontract.Wherethesespecificationsarenot
clear,consultationwiththearchitectsistobeobtainedbythecontractor.

1.2 Settingoutthework

Thecontractorshallsetouttheworksandduringtheprogressoftheworkshallamendatisowncostanyerrorsarising
frominaccuratesettingout.Duringtheexecutionoftheworkcontractormustcrosscheckhisworkwiththedrawings.The
contractorshallberesponsibleforalltheerrorsinthisconnectionandshallhavetorectifyalldetectsand/orerrorsathis
owncost,failingwhichthearchitect/ownerreservestherighttogetthesamerectifiedattheriskandcostofthecontractor.

1.3 Cleaningupandhandingover

Uponcompletionoftheworkalltheareasshouldbecleaned.Allfloors,doors,windows,Surface,etc.shallbecleaned
downinamannerwhichwillrendertheworkacceptabletothearchitectandowner.Allrubbishduetoanyreason,shallbe
removeddailyfromthesiteandanareaofuptotenmetersontheouterboundariesofthepremiseswillbecleanedbythe
contractorasapartofthecontract.Uponcompletionoftheproject,thecontractorshallturnovertotheownerforthe
following:-

a) Writtenguaranteeandcertificates.

b) Maintenancemanuals,ifany.

1.4 Samples

ThecontractorshallsubmittotheArchitectsamplesofallmaterialsforapprovalandnoworkshallcommencebeforesuch
samplesaredulyapproved.Samplesofprecastconcretepanels,masonryunits,buildinginsulation,finishedhardware,floor
tiles,stones,wood,finishing&carpentryitemsaslaminates,veneers,etc.ply,blockboards,upholsterycloth,andevery
otherworkrequiringsamplesintheopinionofthearchitectsshallbesuppliedtothearchitects,andthesesampleswillbe
retainedasstandardsofmaterialsandworkmanship.Thecostofsamplesshallbebornebythecontractor.

Throughoutthisspecification,typesofmaterialmaybespecifiedbymanufacturer'snameinordertoestablishstandardof
quality,priceandperformanceandnotforthepurposeoflimitingcompetition.Unlessspecificallystatedotherwise,the
Biddersmayassesthepriceofapprovedequivalentexceptthattheburdenisuponthecontractortoprovesuchequalityin
writing.

Thecontractorforthematerialapprovals,withinoneweeksoftheArchitect'sordertocommenceshallsubmitadetailed
program.Thedetailedprogramshallincludebutnotlimitedto:

Date/sofsubmittingthevariousmaterialssamples.

Date/sbywhichtheArchitect'sapprovalisrequired.

Date/sofplacingordersontheManufacturers/Suppliers.

Date/sofarrivaloftheapprovedmaterial/sontothesite.

Date/softhecompletionofthe'Mock-ups',wheneverrequired,andtheDate/sbywhichtheArchitects'inspectionofsuch
'Mock-ups'shouldbecompletedandtheDate/sbywhichtheArchitectshouldfullyapprovethesaidMock-ups.

1.5 Tests

Allmaterialsandmethodsoftestsshallconformtothelatestrules,regulationand/orspecificationsofthefollowing
authoritieswherespecified(BS),BritishStandardsCodecfPractice(BS)incasenoequivalentBSisavailable.The
Architectswillhavetheoptiontohaveanyofthematerialstestedandifthetestresultsshowthatthematerialsdonot
conformtothenumberofrepresentativetestswillbedeemedtobeincludedintheratestendered.

1.6 Rates

Theallinclusiveitemratesquotedinscheduleofquantitiesaredeemedtobeincludedtoexecutetheworksinstrict
accordancewiththerelevantspecificationsreadinconjunctionwiththeappropriatestandardspecifications.

1.7 ModeofMeasurement

Theitemquotedinscheduleofquantitiesaredeemedtobeincludedtoexecutetheworksinstrictaccordancewiththe

1.8 SafetyCode

(1) Allnecessarypersonalsafetyequipmentasconsideredadequatebythearchitectshouldbe-lavailablefortheuse
ofthepersonemployedonthesiteandmaintainedinconditionsuitableforimmediateuse,andthecontractorshouldtake

iii) ThecontractorstotheworkmenshallsupplyoverallsandadequateFacilitiesshallbeprovidedtoenablethe

(2) Allscaffoldsladdersandothersafetydevicesmentionedordescribedhereinshallbemaintainedinsafecondition
andnoscaffold,ladderorequipmentshallbealteredorremovedwhileitisinuse.Adequatewashingfacilitiesshouldbe
providedatornearplacesofwork.

(3) Thesafetyprovisionsshouldbebroughttothenoticeofallconcernedonanoticeboardataprominentplaceat
workspot.Thepersonresponsibleforcomplianceofthesafetycodeshallbenamedthereinbythecontractor.

(4) Toensureeffectiveenforcementoftherulesandregulationsrelatingtosafetyprecautions.(Thearrangements

2.0 MASONRYWORKS

2.1 Brickworks

i) ThebricksshallconformtotheS.

ii) Thebuildingbricksaretobethebestqualitytablemoldedkilnburnt,patentbricks,hardsound,squarewithsharp
arises,evenanduniforminshapeandcolorfreefromcracks,stones,flawsandotherdefects.Samplesofbricksaretobe
submittedtotheArchitectforapprovalbeforefullquantityisordered.Allsupplyofbricktoconformtothesampleapproved.

iv) EverybrickshallbethoroughlysoakedinwaterbeforeuseBrokenbricksshallnotbeusedexceptasclosers.The
coursesshallbetrulyhorizontalandtheworkstrictlyplumb,jointsshallbebrokenverticallyandtheyshallnotexceed1/2"in
thickness.AlljointsinbrickworkaretobewellFilledwithmortar.Allbrickworkshallbekeptconstantlymoistonallthe
facesforatleast8days.

v) Thebrickworkshallnotberaisedmorethat12singlecoursesperdayandshallbebuiltinEnglishbond,except

3.0 CARPENTERYANDJONERY

3.1 Timber

Alltimbershallbeofthekindandoffirstclassqualityasdescribedandindicatedondrawingsandschedules.tshallbe
uniformintexture,freefromlarge,looseheadorclusterknots,veneer,injuriousopenshakes,boreholes,rot,decay
discoloration,softorspongyspots,hollowpockets,putandallotherdefectsandblemishes.Thesizesshownordescribed
aretobetakenasnotsizeswhenfinished.

3.2 Seasoning

Alltimbershallbefullyseasoned,ifnecessary,inkilns,chemicallyimpregnatedifrequiredandthecontractorshallproduce
satisfactoryproofofthesame.

ThemoisturecontentintheTimber,shallnotexceed12%forinternalworkand16%forexternalwork.Thetimbershall
remainstable,freefromexpansionorcontractionsoranyothermovements,whenfixedinposition.Thetimbershallbetree
fromdryingdetectsandshrinkage.

3.3 Roughcarpentry

Material

Allframingandotherconcealedwoodmembersshallbeofsoundwoodorapprovedspecialsandshallbeseasoned.All
surfacesincontactwithmasonryorconcrete,andingeneral,allsurfaceshiddenfromview,shallbetreatedwithtwocoats
ofapprovedwoodpreservativepaint.

Workmanship

Allcarpentersworkshallbedonebyskilledworkmen,withthelongestnailsthatmaybeusedwithoutsplittingthewood.n
generaltopnailingandcrossnailingshallbeused.Whereveritisnecessary,oranadequatejointcannotbeformedby
nailing,themembersshallbelappedorjointedbyGlstrapsorextrawoodblocks.Alljointingandnailingshallbedonewith
neatness,especiallyinexposedposition.Jointsandnailingshallbeapprovedbythearchitectanddoneaccordingtohis
directionswhenrequired.Grossbracing,solidblockingandbracingshallbeprovidedaccordingtobestpractice.

3.4 Joinery

Materials

Finishedwoodworkandjoineryincludingdoors,shallbewithstraightgrainedndianTeakofapprovedquality,unlessnoted
otherwise.Woodshallbefreefromknots,andotherblemishesandimperfections.AllFinishedwoodforjoineryshallbe
seasonedasprescribedbefore.Alljoineryworkshallbesecurelymortisedandtenonedandgluedwithbestquality
syntheticwaterproofglueequivalentofFEVCOLorVEMCOL.Allsectionsanddimensionsshallbeasshownondrawings.
Foralljoinerywork,nailsshallnotbepermitted,andonlywoodscrewsofappropriatesizesshallbeused.Wherever
practicable,meansoffasteningthevariouspartstogethershallbeconcealed.

nstallation

Doors,andcabinetworkshallbeinstalledinpositionsonlyaftertheplasterinthesectionforwhichitisintended,is
sufficientlydry.

Allinteriorandexteriordoors,cabinetworkandotherFixedwoodenequipmentshallbefixedplumbandtrue.Wherever
possible,thejointsshallbebeveled.Allexterioranglesshallbemitred.Adjoininginteriorwoodmembersshallmatchand
harmonize.Allwoodworkincontactwithmasonryshallbepaintedwithapprovedbitumenpaintorsolignumbeforeplacing
inpositions.Allconcealedwoodmembersshallbeused.Whereverpracticable,meansoffasteningthevariousparts
togethershallbeconcealed.

3.5 MEASUREMENTS

TheContractorshallbefullyresponsibleforaccuracyofallmeasurementsandshallverifyalldimensionsgivenonthe
drawings,andshallmakesuchsitemeasurementsasarenecessarytocompletetheworkproperly.

3.6 DoorsandWindows

DoorsandwindowsandventilatorframesshallbemadeofFirstqualityseasonedtimberspecifiedundertheheadoftimber
fordoorsandwindowframes,andasshownonthedrawingorasdirectedbytheArchitect/Client.Theseshallbeproperly
framedmortisedtogether,andsetsolidlyinthemasonrywithMSholdfasts.Holdfastswillbe30x4cmsand5mmflatfixed
tothejambandembeddedinmasonrywithPCC1:2:4.Windowsmtr.1-iighwillhaveminimumof6numberholdfasts.
Eachholdfastwillbefixedtotheframewith3Nos.of5cm.longgalvanizedironscrews.ncasetheframesaretobefixed

3.7 FlushDoors

Sapprovedmanufacturers.Thefinishedthicknessoftheshuttershallbeasmentionedintheitems.Faceveneersshallbe
ofthepatternandcolourapprovedbytheArchitectandanapprovedsampleshallbedepositedwiththeArchitectsfor
reference.Thesolidcoreshallbewoodlaminatepreparedfrombattensofwell-seasonedandtreatedgoodqualitywood
havingstraightgrains.Battensshallbeofuniformsizeofabout2.5cm.widthproperlygluedandmachinehotpressed
togetherwithgrainsofeachpiecereversedfromthatofadjoiningone.Theadhesiveusedforbendingshallbephenol
formaldehydesyntheticresinconformingtoBWPtypespecifiedinS.Visionpanels,if.myshallhefactoryFinishedandno
deductionshallbemadeforsuchopenings.Alsonothingextrashallbepaidforglassinsuchopenings.

3.8 Plywood

Plywoodshallbebestqualityclosedgrainedsuitableforveneering,paintingorbondedwithplasticlaminate.tshallberesin
bondedandofwaterproofandboilproof(WBP)brand.Exposededgesshallbefinishedwithanedgestripofsolid
teakwood.

3.10 GlassandGlazing

Thecontractorshallfurnishalllabor,materialandequipmentrequiredtocompletetheinstallationofallglassandrelated
items.Aglassshallbeofthetype,quality,andsubstancespecifiedinthescheduleofquantities.Thecontractorshallout
glasssizesbyfieldmeasurementsordimensionsoftheapprovedshopdrawings.Theresponsibilityforcorrectglasssizes
shallrestwiththecontractor.Nocracked,chippedordisfiguredglassshallaccepted,andthecontractorshallreplaceall
breakage'sorfaultyinstallationwithoutcosttotheEmployer.

Theglassshallbesetinwoodormetalglazingstrapsandmetalsashwithelasticglazingandcompound.Theglassshall
bebeadedFirstandsoinstalledastoachieveacompletelywatertightresult.Theopaqueglass,wherecalledfor,shallbe
setwiththesmoothsurfaceoutside.Atthecompletionoftheworkallglassshallbethoroughlycleanedofpaintandother
marksremoved.Anycracked,scratched,chippedorotherwisedefectiveglassshallberemovedandreplacedwithoutextra

3.11 Hardware

Thecontractorshallprocureallthehardwareasspecifiedintheschedule.Therateshallincludeformakingchasesto
receivethehardware,andalsothecostofapprovedscrews,nails,clampsetc.TheFixingshallbedoneinthebest
workmanshiplikemannerandinaccordancewiththatemployedforFixinghardware.Anydamagetothejoineryorthe
hardwareshallbemadegoodatnotextracosttotheemployer.

3.12 Partitions/FalseCeiling

GRolledSections/TimberframingtorpartitionsandceilingshallbefixedbyapprovedMSclamps.Blotsorotherequal
andapprovedslottedanglesuspendersandshallbetreatedwithwoodpreservativeusingsolignumorotherequaland
approved.SteelworkwithinfalseceilingshallbepaintedwithtwocoatsofprimingRedleadpaint.MSclamps,suspenders
shallbeweldedtotheMSholddownplateswhereprovidedinthestructuralsoffit,orfixedintotheRCCworkbycutting
holesinapprovedmannerandgroutedwithstiffmixof(1:1'/2:3)cementconcrete.

4.0 METALWORKS

4.1 MetalCasements

Framesofcasementsshallbeofhotrolledsections.Bothfixedandopenableframesshallbeconstructedofsectionswhich
havebeencuttolength,mitredandelectricallyflushbutweldedatcorners.Subdividingbarunitsshallbetennonedand
rivetedintotheframes.Allframesshallhavethecornersweldedtoutruerightangleandweldsshallneatlygrounddown
smooth-Couplings,mullions,transom,andweatherbarshallbeprovided,asdirectedbytheArchitects.Outerframesshall
beprovidedwithfixingscrewsandlugsshallbeusedforfixingtheframetothemasonry.Masticcementsshallbeusedfor
makingthejointswatertight.

Hingesshallbeofthestrongprojectingtype.fdirected,frictiontypehingesshallbeusedinwhichcasewindowsshallnot
befittedwithpegstays.Projectingtypehingedshuttershallbefittedwithbronze,orbrasspegstays,30cmslongwithpeg
andbracketswelded/rivetedtotheframe.Allwindowsshallbeprovidedwithhandlesofbrassorbronze,fixedwitha

Thedrawingsmustindicateconstructiondetails,material.Fixingclampsetc.Thecontractorshallhowevermakehisown
measurementtoascertaintheactualopeningonsiteandtheywillberesponsibleforthecorrectnessofthesizesofthe
windows,louversetc.

ProtectionagainstWindandWeather

Contractorshallensurethatthememberofthedoors/windows/walling,shallwithstand150Kg/Sqm.windpressure,without
deformation.Theoperablewindowsmustnotwarpintheextremeclimaticconditions.Allcalculationsforthesizingofthe
membersmustbelodgedwiththeArchitects.Thecontractorishowever,responsibletoreplaceanydamagedmemberat
theircost,ifthesameisfoundtobeinadequateforextremeweather.Thecontractormustguaranteethatthewindowsare
completelywaterproof.

Thecontractorshallsubmitonesampleofeachitemforinspectionandscrutinyandgetthesameapprovedbythe
Architect,priortofabricatingtheremainingitems.

Allextrudedaluminumsectionsshallbeobtainedfromapprovedandestablished
ManufacturersorapprovedequivalentandshallbeofaluminumalloyconformingtoS:733.Thesectionsshallgenerally

Puttyshallbeappliedfirstbetweenglasspanelandglazingbarsandthenonglasspanelswhichshallstop2-3mmfromthe

5.0 EdgeSupportRigidGridSystem(Falseflooring)

Thesystemshallcompriseofthefollowings:

AccessFloorpanelofsize600x600mmshallbeallsteelweldedconstruction,withanenclosedbottompanof56

6.0 PLASTERNGANDPANTNG

6.1 General

6.1.1 Allplasterworkshallbeofthebestworkmanshipandinstrictaccordancewiththedimensionsofthedrawings.All
plasteringshallbefinishedtotruelevelsincludingplumbs,withoutimperfections,andsquarewithadjoiningwork.tshall
formproperfoundationsforfinishingmaterialssuchaspaintetc.Masonryandconcretesurfacetowhichplasteristobe
appliedshallbeclean,freefromefflorescence,sufficientlyroughandkeyedtoensureproperbond.

6.1.2 Allchiseling,installationofconduits,boxes,etc.shallbecompletedbeforeanyplasteringiscommencedona
surface.Chiselingorcuttingofplasterwillnotbepermitted.Brokencomersshallbecutbacklessthan150mmbothsides
andpatchedwithplasterofParisasdirected.Allcornersshallberoundedtoaradius.Contractorshallgetsamplesofeach
typeofplasterworkapprovedbytheArchitect.

6.2 Plasterwork

beforeplastering.

6.4 Distempering

Oilbondeddistemper(OBD)ofrequiredcolourandSapprovedbrandandmanufactureshallbeused.Theshadeshallbe
gotapprovedfromtheArchitectbeforeapplicationofthedistemper.Thedistempercolourasrequiredshallbestirredslowly
incleanwaterusing6decilitres(0.6litre)ofwaterperKg.ofdistemperorasspecifiedbythemakers.Warmwatershall
preferablybeused.tshallbeallowedtostandforatleast30minutes(orifpracticableovernight)beforeuse.Themixture
shallbewellstirredbeforeandduringusetomaintainanevenconsistency.Distempershallnotbemixedinlargerquantity
thanisactuallyforonedayswork.

Preparationofsurface

Beforenewworkisdistempered,thesurfaceshallbethoroughlybrushedfreefrommortardroppingandotherforeign
matterandsandpaperedsmooth.PittinginplastershallbemadegoodwithplasterofPairsmixedwiththecolourtobe
used.Thesurfaceshallthenberubbeddownagainwithafinegradesandpaperandmadesmooth.Acoatofdistemper
shallbeappliedoverthepatches.Thepatchedsurfaceshallbeallowedtodrythoroughlybeforetheregularcoatof
distemperisapplied.

Aprimingcoatofwhitingshallbeappliedoverthepreparedsurface.Nowhitewashingcoatshallbeusedasaprimingcoat
fordistemper.

Application

Thetreatmentshallconsistofaprimingcoatofwhitingfollowedbytheapplicationoftwoormorecoatsofdistempertillthe
surfaceshowsanevencolours.

6.5 Oilemulsion(Oilbound)distempering

Material:Oilemulsion(oilbound)distemper(S:428-1929)ofapprovedbrandandmanufactureshallbeused.Theprimer
usedshallbecementprimerordistemperprimer.Thisshallbeofsamemanufactureasdistemper.Thedistempershallbe
dilutedwithwateroranyotherprescribedthinnerinamannerrecommendedbythemanufacturer.Onlysufficientquantityof
distemperrequiredfordaysworkshallbeprepared.Thedistemperandprimershallbebroughtbythecontractorinsealed
tinesinsufficientquantities,atatimeiosufficetorafortnightswork.Theemptytinsshallnotberemovedfromthesiteof
work.tillthisitemofworkhasbeencompletedandpassedbytheArchitect.

Preparationofsurface

Beforenewworkisdistempered,thesurfaceshallbethoroughlybrushedfreefrommortardroppingsandotherforeign
matterandsandpaperedsmooth.Pittinginplastershallbemade;goodwithplasterofParismixedwiththecolourtobe
used.Thesurfaceshallthenberubbeddownagainwithfinegradesandpaperandmadesmooth.Acoatofdistempershall
beappliedoverthepatches.Thepatchedsurfaceshallbeallowedtodrythoroughlybeforetheregularofdistemperis
applied.

Aprimingcoatofwhitingshallbeappliedoverthepreparedsurface.Nowhitewashingcoatshallbeusedasaprimingcoat
fordistemper.

Application

Theprimingcoatshallbewithdistemperorcementprimer,asrequiredinthedescriptionoftheitemandasrecommended
bythemanufacturer.

Note:

ifthewallsurfaceplasterhasnotdriedcompletelycementprimershallbeappliedbeforedistemperingthewalls.Butif
distemperingisdoneafterthewallsurfaceisdriedcompletely,distemperprimershallbeapplied.

Aftertheprimercoathasdriedforatleast48hours,thesurfaceshallbelightlysandpaperedtomakeitsmoothforreceiving
thedistemper,takingcarenottoruleouttheprimingcoat.Alllooseparticlesshallbedustedoffafterrubbing.Onecoatof
distemperproperlydilutedwiththinner(Waterorotherliquidasstipulatedbythemanufacture)shallbeappliedwithbrushes
inhorizontalstrokesfollowedimmediatelybyverticaloneswhichtogetherconstituteonecoat.Thesubsequentcoatsshall
beappliedinthesameway.

Fordistemper15cmdoublebristledbrushesshallbeused.Aftereachdayswork,brushesshallbethoroughlywashedin
hotwaterwithsoapsolutionandhungdowntodry.

Thespecificationsinrespectofscaffoldingprotectivemeasuresandrouteshallbeasdescribed.

6.6 Painting

i) Paintingprimingcoatofwoodsurface

Primerforwoodworkshallbeasspecifiedinthedescriptionoftheitem.Surfacetobeprimedshallbedryandthoroughly
cleaned.Allunevennessshallberubbeddownsmoothwithsandpaperandshallbewelldusted,knots,ifany,shallbe
coveredwithpreparationofredleadmadebygrindingredleadinwaterandmixingwithstronggluesizedandusedhot.
Appropriatewoodfillermaterialwithsameshadeaspaintshallbeusedwheresospecified.

Thesurfacetreatedforknottingshallbedrybeforeprimerisapplied.Aftertheprimerisappliedtheholesandidentification
onthesurfaceshallbestoppedwithglazier'sputtyorwoodputty,stoppingshallnotbedonebeforetheprimingcoat.

ii) Paintingprimingcoatonron&Steelsurfaces.

Allrustandscalesshallberemovedbyscrappingorbybrushingwithsteelwirebrushes.Hardskinofoxideformedonthe
surfaceofwroughtironduringrankingwhichbecomesloosebyrushingshallberemoved.Alldustanddirtshallbe
thoroughlywipedawayfromthesurface.

iii) Paintingprimingcoatonplasteredsurface

Thesurfaceshallordinarilynotbepaintedshallbeappliedtogetcorrectfinishuntilithasdriedcompletely/Beforeprimeris
applied,holesandundulationsshallbefilledupwithplasterofParisandrubbedsmooth.

Theprimershallbeappliedwithbrushes,workedwellintothesurfaceandspreadevenandsmooth.Paintingshallbedone
bycrossingandlayingoff.Thecrossingandlayingoffconsistsofcoveringtheareaoverwithpaint,brushingthesurface
hardfortheFirsttimeoverandthenbrushingalternatelyinoppositedirection,twoorthreetimesandthenfinallybrushing
lightlyinadirectionatrightanglestothesame.nthisprocess,nobrushmarksshallbeleftthelayingoffisfinished.Thefull
processofcrossingandlayingoffwillconstituteonecoat.

Rate

Rateshallincludecostofalllabour,materialandallapplicablerates&taxesinvolvedtheoperationsdescribedabove
includingscaffoldingetc.

Paintingwithenamelpaint(conformingtoS:2933-1975)andwithsyntheticenamelpaint(conformingtoS:1932-
1964).

b)TopCoat

Topcoatsofspecifiedpaintofdesiredshadeshallbeapplied.Eachcoatshallbeallowedtodryfornotlessthan24hours
andlightlyrubbeddownsmoothwithFinestwetabrasionpapertogetanevenglossysurface.f,however,thesurfaceis
notsatisfactoryadditionalcoatsasrequired.

6.7 Spectrumtexturedwallfinish

SpectrumtexturedfinishshallbeofcolourandFinishspecifiedintheBOQ,orasapprovedbytheConsultant.Finishshall
beappliedonplainsmoothplaster/woodsurface.Thesurfaceshouldbecompletelydry.

Thenoteshallincludecostofallmaterialandlabourinvolvedinalloperationsincludingpreparationsofsurface,scaffolding

6.8 Theratesofpaintingshallinclude.

workandforinspection,

7.2MATERALSANDWORKMANSHP:-

1. Allmaterials,whicharetobeusedintheworks,shallbeoftheirbestrespectivekindsandtotheapprovalofthe
Architect.TheArchitectorhisrepresentativewillacceptthatthematerialsarereallythebestoftheirkinds,whenitis
approvedbeyonddoubtthatnobettermaterialsoftheparticularkindinquestionareavailableinthemarket.

2. TheArchitectinconsultationwithOwnershallhavethepowertocausethecontractortopurchaseandusesuch
materialsfromanyparticularsource.Asmayinhisopinionbenecessaryforthepurposeofproperexecutionofthe
work.Providedsuchsourceisanauthorizeddealer/stockiestofthesaidmaterials.

3. Allsteelworktobespotandlineweldedandshallbepaintedtwocoatsorenamelpaint.

4. Thecontractorshallallowforapairorballandsocketlatchandadrawerlockandset
oftwokeysandforeverydrawerandtobefixedasperArchitect'sinstructions,inconsultationwithOwner.

5. AllshutterstobelungedwithhingesasspecifiedbyArchitectandtobefittedwithmaterialsandscrews.

6. Thecontractorshallprovidesamplesofallmaterialsormock-upsoffinishesandvariousitemsoffurnituresuchasthe

7.3 CARPENTRYANDJONERYWORK

1. TimberusedforthejoineryshallbeoftheapprovedqualityseasonedWood.andshallbewellseasonedoutsquare,
freefromexcesssap,fromsapwooddeadknotsofotherdefectsandshallhavefinelightveinswithuniformstraight
flowoflines.

2. AllPlywoodtobeusedontheworkshallbeofapprovedmanufacturer.

3. TeakveneeringonplywoodshallbeofspecialteakqualitywiththincloseveinsoflightcolourandshallrunstraightNo
veneerwithboardblacklines,knotsandwavyveinsshallbeapproved.

4. AlledgesandcomersoftheplywoodwhereverexposedshallbelippedwithRubberWoodCoveringbeadsmitered
andgluedasmaydirectedbytheArchitect.

5. Theworkmanshipshallbeofthebestquality.Boardsandscantlingsshallbeaccuratelysawnandshallbeofuniform
widthandthicknessthrough.Workshallbeaccuratelysetoutinaccordancewiththedrawingsandshallbeframed

LAMINATED ACCESS FLOOR PANEL: nos 118.00
Floor panel of size 600x600 mm shall be all steel welded construction,
with an enclosed bottom pan of 56 hemto bepherical and 8 oval cones
with 25 reverse cones and top plain sheet which are fuse welded at 152
locations to form a panel of an overall depth of 37 mm. The panel after
cleaning, degreasing, phosphating by 11 tank process to be coated with
40-60 micron epoxy coat and to be heated to achieve maximum
adhesion to the panel surface and corrosion resto betance. The inner
empty core of the panel to be injected with a light weight fire retardant,
non combustible cementitious compound at high pressure to fill in all the
crevices of the panel and ensures support of not less than 90% of the
top surface area of the panel.
The panel to be then laminated with 2.0 mm thick fire retardant floor
grade Antto betatic Laminate / ESD Laminate on a semi -automated
lamination line to ensure maximum bonding to the steel surface. The
edges of the laminate are protected with black Conductive PVC edge
trim 5mm wide on all sides. Thto be edge trim to be mechanically locked
and sealed in place to avoid detachment.
SUB STRUCTURE -PEDESTAL ASSEMBLY:
Sub structure installed to support the panel shall be suitable to achieve
a minimum finished floor height of 65mm to a maximum of 300 mm from
the exto beting floor level. Pedestal design shall confirm speedy
assembly and removal for relocation and maintenance. The assembly
shall provide easy adjustment of leveling and accurately align panels for
a maximum 25 mm in the vertical direction. Pedestals shall support an
axial load without permanent deflection and an ultimate load as laid out
in System Performance requirement.
The Pedestal head assembly shall consist of a 75 x 75 mm x 3.5 mm
embossed head mechanically riveted to a 100mm long 19 mm Dia rolled
formed stud and 2 check nuts for level adjustment and arresting vertical
movement. The pedestal head shall consist of an anti-vibrational PVC
cap, for Panel and stringer location.
The Pedestal Base assembly shall consist of 22.20 mm OD pipe of
thickness 1.6mm mechanically locked on a press for perpendicularity
and then welded to a base plate of 100 x 100 x 2mm thick with stiffening
folds.
The sub structure assembly shall be suitably anchored to the floor with
suitable adhesive or fastener as recommended by the manufacturer. All
steel components shall be zinc electro plated.
STRINGERS:
The stringer to be hot dipped galvanized steel cold rolled construction
specially designed with ribs embossed on 3 sides for strength, lateral
stability, and rolling loads and to support the panels on all four sides for
alignment. The stringer to have a counter sunk holes at both ends to
accommodate bolting of M6 machine screws to the pedestal head
assembly. The stringers shall be 21 x 32 x .8mm x 570 mm length.

FRAMES- Partition thickness to be of 80mm for required stability and
with the inside gap between two tile to be 64mm for higher wire carrying
capacity. The inside frame to be made out of 1.6mm thick CRCA sheets
and the thickness of 56mm.All the Frames to be duly powder coated in
specified color to a thickness of 50-60 microns.The horizontals and
verticals of the frames to be welded together at different heights so as to
facilitate the wire management system running within the frame. The
frame to have various slots at different heights for fixing of tabletop
brackets, tiles, storages and shelves. All the frames to be joined
together by means of screws and nuts. They shall be attached to form a
2-way, 3-way or a 4-way configuration. Possibility to join the frames at
120 degrees can also be required within the system.All frames are to be

TABLE TOPS AND GABLE ENDS - All table tops and Gable ends to
be either out of 25mm Pre-laminated particleboard with PVC edge
banding or 25mm Plain particleboard with post forming of 0.8mm
laminate on top and balancing laminate at bottom.Specially designed
powder coated M.S. brackets fixed to the partition frame support the
tabletops and gable ends.
MAGNETIC PANEL-the magnetic board has an underlay of 28g G
sheet covered with appropriate fabric. Each magnetic board to be
provided with magnets to hold paper/documents in any position.
TABLE TOP- the work tops to be made of 25 mm thk particle board. The
surface to be post formed by 0.8mm thk laminate to provide rounded
edges. The bottom surface will also be laminated. MS brackets that will
be powder coated to 50-60 microns will support the work tops. The
tables will be lipped PVC edge bend of minimum 2mm thickness. The
work surfaces can also be offered in single piece without any joints,
profiled by spatial CNC machines. The CNC machine provides high
level consistency in dimension and curvilinear profiles.
GABLE END-gable end to be made of 25 mm thk pre laminated particle
board with 2mm edge lipping.
CPU Trolley - CPU trolley to be made from 1mm thick CRCA steel
sheet. The width of the trolley can be varied for accommodating various
widths of CPUs; The trolley to be mounted on lockable castors of ebco.
Keyboard Drawer - Keyboard tray of ABS Plastic to be mounted on
metal slides for easy movement. The slides are from reputed companies
from ndia.
Storage Unit - Storage body to be made of 18mm thick pre laminated
partical Board conforming to S : 12823, The back of the unit to be made
from 9mm prelaminated board. All the exposed edges are sealed with
0.8mm thick PVC mported edge banding on sides and bottom. The top
and hinged shutters are sealed with 2mm thick PVC edge banding.
The units are assembled by knock down fittings such as Minifix and
Dowels. All the hardware and Hinges are from Mepla/Hafele/Hettich of
or Ebco, PVC edge banding to be of Rehau.

which shall display date, time, actual & set values, operating conditions,
signal faults, collective faults, limiting values and PAC wellness
alarm/service alarm to reduce the down time and unit memory shall hold
the 400 most recent events with D number, time and date stamp for
each event.

Designed system should have for PAC units controller for


synchronising the Multiple No. of units to work as single system for all
installed units: (i) Load sharing mode feature, (ii) Cascading Effect and
(iii) Sequencing of all installed Units.

The unit should be installed so that one unit is working and one unit is in
