ORACLE DATABASE 10g EXPRESS EDITION LICENSE AGREEMENT

am I listed on the %nited tates *epartment of Commerce Table of *enial +rders'
I will not download or otherwise e&port or re(e&port the )rograms, directly or indirectly, to
persons on the above mentioned lists'
I will not use the )rograms for, and will not allow the )rograms to be used for, any purposes
prohibited by %nited tates law, including, without limitation, for the development, design,
manufacture or production of nuclear, chemical or biological weapons of mass destruction'

entity that has ac!uired the programs ,)rograms, refers to the software product which you have
ac!uired and program documentation' ,"icense, refers to your right to use the programs under
the terms of this .greement' The substantive and procedural laws of California govern this
.greement' /ou and +racle agree to submit to the e&clusive 0urisdiction of, and venue in, the
courts of California in any dispute relating to this .greement'
-e are willing to license the programs to you only upon the condition that you accept all of the
terms contained in this .greement' 1ead the terms carefully and indicate your acceptance by
either selecting the ,.ccept, button at the bottom of the page to confirm your acceptance, if you
are licensing via our online system, or continuing to install the program if you have received this
license agreement during the installation process' If you are not willing to be bound by these

purposes of developing, prototyping and running your applications for your own internal data

may use the programs to provide third party demonstrations and training2 and d) you may copy
and distribute the programs to your licensees provided that each such licensee agrees to the terms
of this .greement' /ou are not permitted to use the programs for any purpose other than as
permitted under this .greement' )rogram documentation is either shipped with the programs, or

6' 4&press 4dition may be installed on a multiple C)% server, but may only be e&ecuted on one
processor in any server2
7' 4&press 4dition may only be used to support up to 89: of user data (not including 4&press
4dition system data)2
8' 4&press 4dition may use up to 5 9: 1.; of available memory'
Trademarks and Copyrights
/ou agree not to use +racle trademarks (including <+1.C"4=) or potentially confusing
variations (including <+1.=) as a part of your product name(s), service name(s), company name,
or domain name(s)' In marketing, promoting, or distributing the programs, you agree to make it
clear that +racle is the source of the programs' /ou shall include on all copies of the programs
used or distributed by you:

? assign this .greement or give or transfer the programs to another individual or entity

? cause or permit reverse engineering or decompilation of the programs2
? disclose results of any program benchmark tests without our prior consent2 or,
? use any +racle name, trademark or logo, e&cept as specified in this agreement'

to you for the programs licensed under this agreement'
4nd of .greement
/ou may terminate this .greement by destroying all copies of the programs' -e have the right
to terminate your right to use the programs if you fail to comply with any of the terms of this
.greement, in which case you shall destroy all copies of the programs'
1elationship :etween the )arties
The relationship between you and us is that of licensee3licensor' #either party will represent that
it has any authority to assume or create any obligation, e&press or implied, on behalf of the other
party, nor to represent the other party as agent, employee, franchisee, or in any other capacity'
#othing in this .greement shall be construed to limit either partyGs right to independently
develop or distribute software that is functionally similar to the other partyGs products, so long as
proprietary information of the other party is not included in such software'

software freely available in source code form' If you use +pen ource software in con0unction
with the programs, you must ensure that your use does not: (i) create, or purport to create,
obligations of us with respect to the +racle programs2 or (ii) grant, or purport to grant, to any
third party any rights to or immunities under our intellectual property or proprietary rights in the
+racle programs' Bor e&ample, you may not develop a software program using an +racle
program and an +pen ource program where such use results in a program file(s) that contains
code from both the +racle program and the +pen ource program (including without limitation
libraries) if the +pen ource program is licensed under a license that re!uires any

/ou agree that this .greement is the complete .greement for the programs and licenses, and this
.greement supersedes all prior or contemporaneous .greements or representations' If any term
of this .greement is found to be invalid or unenforceable, the remaining provisions will remain
effective'
