3. Occupancy: Seating capacity shall be limited to 150 persons. Additional capacity as determined by the City of Chicago. Licensee shall track the number of occupants in the premises at any one time. Licensee shall present said number to the City upon request.
4. Package Sales: Alcoholic items to be sold for off-premises consumption shall be limited to Forbidden Root products or products labeled as produced in cooperation with Forbidden Root. .
5. Amusements: No electronic dance concerts shall be held at the premises of the Licensee. The Licensee shall not install any DJ equipment on the premises. No Public Place of Amusement license shall be sought or secured which allows an admission fee, minimum purchase requirement, membership fee or other fee or charge to be imposed for the privilege of entering the premises or the portion of the premises where the music, dancing, or other amusement is to be provided or permitted. The Licensee agrees to monitor the noise levels emanating from the premises to ensure compliance with the Chicago Noise Ordinance, and to take immediate steps to alleviate any violation, including but not limited to:
a. The Licensee will comply with, and advise all supervisory personnel of, all applicable provisions of the Chicago Noise and Vibration Control Ordinance, Chapter 8-32 of the Municipal Code including, but not limited to, not permitting any other amplified sound to generate a sound louder than average conversational level at a distance of l00 feet from the property line.
b. The Licensee will regularly monitor sound levels along its exterior perimeter to ensure compliance with applicable standards and regulations.
c. Sound absorption device and other prevention methods, including soft furnishing, sound absorption panels, additional tuck-pointing and insulation of exterior walls or other materials shall be installed as necessary to reduce sound levels.
6. Noise
a. Signs shall be posted near the exits reminding patrons to respect the neighbors, not to loiter and to leave quietly.
b. Loading and unloading activities (excluding trash) will occur during limited hours: (i) loading will be prohibited before 7:00a.m. every day and after 8:00p.m. Sunday - Thursday and after 10:00 p.m. Friday and Saturday.
c. No trash will be placed in any exterior dumpster between the hours of 1:00am and 8:00am Sunday through Saturday.
d. Licensee agrees to close all windows by 9:00pm.
e. A direct telephone number and email will be made available to residents in order to contact the manager on duty.
7. Loading Activity:
a. Licensee agrees to encourage its vendors to use vehicles in the alley that do not exceed 26 feet. Licensees vehicles using the alley will be limited to 26 ft. maximum length or smaller.
b. Delivery/pick-up hours limited as described in 6.b, above.
c. Delivery and pick-up personnel shall be directed to access the rear of the building from Chicago Avenue by traveling north on Hermitage, west in the alley, and south on Wood.
8. Parking: No parking will be provided on-site; valet service to be employed as necessary. If valet service is employed, Licensee shall maintain a copy of the deed, lease or other contract showing that the valet parking operator has a contractual right to place a vehicle in legal off-street parking consistent with City of Chicago Municipal Code 4-232-070 (issuance conditions for valet parking) at the premises of the Licensee and a copy, with financial information redacted, shall be made available to the East Village Association for inspection at Licensees office within 3 days of a written request by the East Village Association. .
9. Safety
a. The establishments personnel, during its hours of operation and for one hour prior to opening and one hour after closing, shall monitor the establishments perimeter for any criminal activity as defined by federal and state law, including offenses against persons, offenses against property, and offenses against the public.
b. All criminal activity shall be immediately reported to the Chicago Police Department. All such reports shall be made as soon as practicable after Licensee personnel first observed evidence of criminal activity.
c. The establishments supervisory personnel shall cooperate with all law enforcement personnel involved with investigations and prosecutions of all criminal activity reported under paragraph 8.b, above. Licensee shall attend CAPS meetings as necessary, to assist in crime prevention.
d. A logbook shall be maintained of all criminal activity reported under paragraph 8.b, above. The logbook shall be maintained at the premises of the Licensee and shall be made available for inspection and copying at the request of law enforcement officials or the City of Chicago Local Liquor Control Commission. .
e. The establishment will install outdoor lights and 24-hour security cameras with at least a 30-day recording capability along its front and rear perimeter. Security camera footage shall be available for inspection and copying at the request of law enforcement officials or the City of Chicago Local Liquor Control Commission. Tampering with security cameras shall be a violation of this Plan of Operation and is prohibited.
10. Waste Disposal and Litter Control
a. Spent grain and hops will be stored indoors in unvented closed containers and will be disposed of within forty-eight hours.
b. The Licensee shall maintain sufficient trash containers to accommodate all the waste generated.
c. The containers shall be locked.
d. Trash pick-up shall occur sufficiently frequently to avoid accumulation of waste beyond container capacity.
e. The exterior of the facility shall be monitored throughout the hours of operation and for one hour prior to opening and one hour after closing. Any trash found along the exterior of the establishment, including on the adjacent public right-of-ways shall be picked-up and disposed of in the establishments trash containers.
f. The Licensee shall sign the Brewers for clean water pledge with the NRDC and shall comply with all applicable environmental regulations.
11. Signage:
a. Signs shall be posted on the rear of the building indicating that travel speed along the alley is limited by City Ordinance to 15 MPH and that idling time is limited by City Ordinance to a maximum of 3 minutes.
b. Signs shall be posted reminding pet owners to not leave their pets unattended.
c. No changing-image, digital display or electronic signage boards shall be installed on the exterior of the building (including the roof of the building) or in such as a way as to be visible from the exterior of the building (including the roof of the building).
12. Pet-Friendly Salt: Only pet-friendly salt shall be used from the purpose of melting snow and ice along the public way.
13. Environmental Guidelines: Licensee shall comply with the World Bank Group/International Finance Corporation (WBG/IFC) Environmental, Health, and Safety Guidelines for Breweries to the extent practicable.
14. Additional licenses: The Licensee agrees it will not apply for a Late Hour Liquor License, or an Outdoor Patio Liquor License. Licensee agrees it will not apply for an non-incidental Package Goods Liquor License prior to March 1, 2015,. The Licensee further agrees that this Plan of Operation would apply to any Package Goods Liquor License issued at this location.
15. Licensee agrees that any new operational concept to be implemented at the establishment shall not include, adult entertainment facility, cabaret or those prohibited uses described in Paragraph 5 above (Prohibited Uses). The operation of one or more Prohibited Uses shall be deemed a violation of this Agreement.
The conditions of this license are legally binding and may be enforced by City of Chicago enforcement authorities. Violation of the above stated agreed conditions may result in the imposition of a fine and/or suspension or revocation of all business licenses issued to the Licensee. Violations of the above stated agreed conditions may also result in the issuance of cease and desist orders prohibiting the activity which violates the conditions of the liquor license.
The conditions of the liquor license shall apply to the business address and Licensee and to all officers, managers, members, partners and direct or indirect owners of the entity of which is licensed. The sale of the business to other persons purchasing the stock or membership units of the licensed entity shall be subject to the same agreed conditions set forth in this plan of operation.
It shall be the duty of every person conducting, engaging in, operating, carrying on or managing the above-mentioned business entity to post this liquor license plan of operation next to the liquor license certificate in a conspicuous place at the business address and to advise and train all employees to comply with the plan of operation.
