INTRODUCTION TO LAW

CRIME AGAINST PERSONS


In every problem there is an answer, and in every issue there is a solution. In
this written paper or a simple written comment about the particular issue that is
really particular to us, I hope to make a clear view about this topic and try to make
it possible to be easily perceivable to the reader. A crime, especially those crimes
that are created more pain, stress, distress, hatred, and death to the victim are really
shocking to the conscience.
I try to answer some of the questions that are related to this topic, these
questions are not come from to the other person or persons, I asked myself these
questions only to create a comment and also to answer thereof. And also, I
included the definition of crime, the possible reason why they are did that, and the
possible solution and laws that are connected to this topic.
Firstly, what is crime against person? In criminal law, usually refers to a
crime which is committed by direct physical harm or force being applied to another
person. They are usually analyzed by division into the following categories: Fatal
offences; Sexual offences; Non-fatal non-sexual offences. They can be further
analyzed by division into: Assaults and Injuries. In our Revised Penal Code we
have parricide, murder, homicide, infanticide and abortion, duel, physical injuries,
and rape.
Murder is the unlawful killing, with malice aforethought, of another human,
and generally this premeditated state of mind distinguishes murder from other
forms of unlawful homicide. Criminal homicide takes several forms and includes
certain unintentional killings. The crime committed in a criminal homicide is
determined by the state of mind of the defendant and statutes defining the crime.
Infanticide is the intentional killing of infants. A duel is an arranged engagement
in combat between two individuals, with matched weapons in accordance with
agreed-upon rules. Mutilation is an act of physical injury that degrades
the appearance or function of any living body, sometimes causing death. Rape is a
type of sexual assault usually involving sexual intercourse, which is initiated by
one or more persons against another person without that person's consent. The act
may be carried out by physical force, coercion, abuse of authority or against a
person who is incapable of valid consent, such as one who is unconscious,
incapacitated, or below the legal age of consent.

Secondly, why people commit crime? Criminal behavior has always been a
focus for psychologist due to the age old debate between nature and nurture.
Research was conducted regarding this which resulted in a conclusion that genes,
environment, and society do play a role in the criminality of individuals. There are
various reasons why criminal choose to do criminal acts. One reason why people
commit crime is because they want to. This can be classified as an individual
making a poor choice in life. It also can be the result of the environment he or she
surrounds their self with. The old saying is you are who you hang around.
Which are very true criminals tend to hang around other criminals.
Another reason is society, many criminal choose to commit criminal acts.
Some crimes are caused by poverty and inequality. Both rich and poor people
commit crimes, but crime rates tend to be higher in poorer communities, especially
those located in inner cities. Some commit a crime because of hatred, vengeance
and resentment. People who had been committed crimes still have in their mind
that someday it maybe happen to them? And to the people who had been took a
vengeance they could still not imagine that it may cause a chain of hatred? We can
relate this in what is happening now in the Philippines.
Philippines is marked by a wide range of spiritual beliefs, including
Catholics, Iglesia ni Cristo, Aglipayans, Protestants, and Muslims, But what
happened to the people of the Philippines, they always part also of the wide range
criminals. Rebellion, corruption, harassment and other acts of criminals are what
we always have and these are not far enough from the definition of crimes against
persons.
As I think, almost of the violation is a crime against person, why? Because
if we referred this in a simple products of goods who are the end user? We are the
end user and we are the very affected organism in this world not only physically
but also morally and spiritually affected. Criminals also changes us to be like of
them, every time we heard a news in radio, television we can create a little detest
feelings to those persons who committed a crimes.
Thirdly, how we can find a solution for this problem? We live in a world of
war and poverty, where crime creeps around alleyways and crevices of
neighborhoods, and where our children live in fear of life. The world is already
dark and if we as one people do not do something fast, the world will become
much darker. The first step in preventing crime is to start with the youngest
generation. Let's face it, children are inquisitive creatures, and if they are not
taught right from wrong early in life, you may see them in handcuffs before you
see them win a Nobel Prize. Creation of education programs in schools would be a
great way for children to learn about the dangers of crime, and how easy it could
be to become involved with the wrong crowd. Parents also need to get involved as
much as possible. Guardians are as much as responsible for their children's
behaviors as the children themselves. You would be surprised how effective just
talking to your kids can be. Give them facts; true stories, and possible
consequences for various crimes, and most importantly, listen. Watch for signs
that your children may need assistance, such as fatigue, quietness, loss of appetite,
or excessive aggressiveness. If they do not listen to you, don't push it, but instead
suggest alternative ways of releasing built-up pressure, such as writing in a journal,
or talking to a professional.
Another good offensive in prevention is to report crime to the proper
authorities. If ever anyone witnesses or hears about a possible crime, then these
people need to contact a police officer or a local sheriff's office to look into that
select situation. Do not take the law into your own hand, though, since doing so
can create legal problems or worse. And another is to implement thoroughly those
laws which are applicable in preventing crimes against persons; in the Philippines
we have Revised Penal Code, some provision in Civil Code which protect the
rights of every person, and also in our Constitution. Apart from the crimes
penalized in the Revised Penal Code, several other pieces of criminal legislation
have been passed, penalizing acts such as illegal possession and trafficking of
dangerous drugs, money laundering, and illegal possession of firearms. These laws
are called Special Penal Laws and they form part of Philippine Criminal Laws.
Finally, the best solution to the every problem is within us. We are the one
who can control what really we want to be, and most of that we need God. I dont
really know what people can do if God is not within their life. Most of the high
profile criminals are same alike of us too, same figure as human being but why do
you think they can able to do a crime? We need a self control in every
circumstance that we are facing every single day of our life, we have only one life
and we need to take care of it, I cant really suggest if I really want to have a death
penalty, but people are only afraid to death. But there are also people who not
afraid to kill and die for the person whom they love.
