IcurrentlyhavemultipleDenialofAccesscomplaintspendingagainstthe
WoodbineBoardofEducationRecordsCustodian,AllenParmelee.Ihavelearned
viaanOPRArequestfiledwiththeBoroughofWoodbinethatDistrict
SuperintendentLyndaAndersonTownssentanemailtoGRCcasemanager
RobertSharkeyonMarch15,2014inapparentattempttoinfluencethecouncil
outsideofproceduraldueprocess.Iamsubmittingthisformalobjectionin
response.TheWoodbineBoardofEducationifaffordedanopportunitytogivea
defenseintheirStatementofInformation.

TotheextentMs.Townsundueinfluencemayhavealreadytaintedafairprocess,I
respectfullysubmitthefollowingrebuttal.

Ms.TownsaccusationsinherdisingenuousemailtoMr.Sharkeyaresimplynot
true.

OneofMs.TownsaccusationsisthatIfileallmostdailyOPRArequests.For
therecord,since2013Ihavefiled24submissions.Iamattachingaspreadsheet
withthedatesofthoserequests.

Ms.TownsalsoassertsthatsheandMr.Parmeleehaveexertedeveryeffortto
respondtoamultitudeofOPRArequests.Thisagainisuntrue.Initiatinglitigation
againstaCustodianisverytimeconsumingwhetherIdosomyselforhavecounsel
representme.WhenaCustodianviolatesOPRAasacourtesyIgivethecustodian
achancetocorrecttheirviolation.WhenIattempttocommunicatewithMr.
Parmeleeheignoresme.IneachofmyDOAcomplaintsyoucanseeexhibits
showingthecustodiangoingunresponsive.AtthatpointIhavenootheralternative
thantofileforanorder.

RegardingmycommentsaboutOPRAbeingagame,OPRAabsolutelyisagame.
Andthegovernmenthasmadeitthatway.Asourfoundingfatherswarnedusthe
governmentcantbetrusted.Thegovernmentliestothepeopleandhidesthetruth
fromthepeopleeveryday.OPRAislikeachessgamerequiringyoutothink
severalmovesahead.

Forexample,in2013HamiltonTownshipdeniedPressofAtlanticCityreporter
DerekHarperapubliclyfundedengineeringreportonthesafetyoftheMays
Landingdam.ThePressfiledanotherOPRArequestwiththeCountywhich
partiallyfundedthestudyonlytobedeniedthereportagain.LastlythePressfiled
thesamerequestathirdtimewiththeStateDepartmentofEnvironmental
Protection.TheDEPreleasedthereportwhichcalledthedamunsafewiththe
possibilitythatthedamcouldhaveacatastrophicstructuralfailureresultinginloss
oflife.HadMr.Harpernotplayedthegamethepublicwouldhaveneverknown
theembarrassingtruththeTownshipandtheCountywereattemptingtohide.(See
November16,2013reportWatchdogReport:'Unsafe'LakeLenapedamadds
floodrisktofourtowns)

In2014BoroughCouncilmanClarenceRyaninformedmethattheschooldistrict
filedtruancychargesagainsthimafterhisdaughter'sdebilitatingillnesscauseda
lengthyabsence.Theabsencewasexcusedbyherpediatrician.Mr.Parmelee
deniedthechargeswerefiledandthereforenosuchrecordexisted.NotuntilI
remindedMr.Parmeleethatthesewerecourtrecordswhichwereassessabletothe
publicatthecourthousedidhefinallyreleaseacopyofthecomplaint.HadInot
playedthegametherecordswouldneverbereleased.(SeeGRC201459)(Also
seenewlyfiledcomplaintScheelervWoodbineBOE2/19)

Icurrentlyhaveapendinglawsuitagainsttheschooldistrictfiledonbehalfofmy
12yearoldson.MostofmyOPRArequestswerefiledfordocumentswhichIfelt
couldbehelpfulinmycase.Otherrequestswerefiledregardingtheneedforthe
districttohaveastatemonitor.Alloftherecordsrequestedhadanexplicitpurpose
whichIhadeveryrighttorequest.ThetruthisthattheBoardofEducationdoes
nothavetheabilitytofaithfullycomplywithitsobligationtothecommunityunder
OPRA.Mr.Parmeleedoesn'tappeartobequalifiedtobetherecordscustodian
duetolackoftraining.Since2012IestimatetheBoardhasspentwellover$5,000
havingtheirsolicitorassistthecustodianindoinghisjob.
