O R D E R

This matter is before the court to establish the protocol to be followed for the oral
arguments scheduled for 1:00 p.m. Wednesday August 6, 2014 at the Potter Stewart Courthouse.
The proceedings will commence promptly at 1:00 p.m. Admission to the courtroom will be
closed at 12:55 p.m.
Courtroom Location, Seating and Access
The Courtroom will open at 12:00 p.m. Seating will be reserved for the litigants

; sixteen
places will be reserved for members of the press, in the manner described below; the remainder
of seating in the courtroom will be available on a first-come first-served basis. Additional
overflow seating will be available in the two other Court of Appeals Courtrooms. No more than
215 spectators will be admitted to the courthouse for the arguments. Audio recordings of the
arguments will be made available shortly after the conclusion of all arguments via a link on the
courts website.

Press Access and Seating
Up to sixteen seats will be reserved for members of the press; no more than one
representative from each media organization or entity will be allowed to sit in these reserved
spaces. Efforts will be made to fairly distribute media seating amongst the various states from
which the cases being argued arise. Access will be by credentials issued by the court. The
process for obtaining credentials will be posted on the courts website.
Security Screening and Identification
Security screening, including the presentation of valid government-issued picture
identification, will be required for entry to the courthouse. No one will be admitted to the
courthouse without proper identification. Security screening will be at the direction of the
United States Marshal and his designees.
Prohibition on Broadcasting, Recording and Photography
Audio and/or video recording, broadcasting, and photography anywhere in the courthouse
during the oral arguments are explicitly forbidden. This prohibition includes blogging, tweeting,
emailing, use of cell phones or any other recording mechanism, any broadcast mechanism or
wireless communication. Anyone violating this prohibition will be removed from the
courthouse.
Use of Electronic Equipment in the Courtrooms Prohibited
The use of laptops, cell phones, tablets or other devices by anyone other than counsel
presenting oral argument is prohibited during argument. All cell phones must be turned off
during argument.
Overflow and Audio Feed Access
Two additional courtrooms will be open to the public with a live audio feed of the
proceedings. Seating will be on a first-come first-served basis.

Decorum
Once argument has commenced, spectators may exit the courtroom only between
arguments. No one who exits the courtroom, for whatever reason, will be readmitted. No
interviews will take place inside the courtroom, nor will media be permitted to broadcast from or
conduct interviews on the steps to the courthouse. For safety and security, all outside stairways,
entries to and exits from the courthouse must be kept clear at all times. Spectators will not be
allowed to congregate in the courthouse hallways, or otherwise impede the orderly conduct of
business within the courthouse.
Digital Recordings Available On the Court Website
Audio recordings of the arguments will be made available on the courts public website
as soon as practical after the conclusion of the hearing on August 6. The recordings may be
downloaded free of charge.
Members of the public, the media, and counsel are urged to consult the courts website
for further logistical information and instructions.
