In the beginning of the 79
th
meeting of SEAC, which was held on 28.12.2013 at 11:30 hrs at the
Conference Room, Paribesh Bhawan, Bidhan Nagar, the Secretary, SEAC welcome all the members. After
introductory session, five cases were discussed under 'Miscellaneous' section. Seventeen cases were placed
for reconsideration. Four applicants were requested to make their presentation before the committee. Three
out of four applicants appeared before the SEAC for technical presentation on their respective project
proposal, while M/s. Emami Cement Ltd. remain absent.

SESSI ON I

A. Miscellaneous
Discussion on EIA notification, 2006 and several circulars/guidelines issued by MoEF time to time
regarding Environmental Clearance.
The committee members took note of EIA Notification dated 14/09/2006 and its amendments thereafter.
The committee also took note of important office memorandums, circulars and guidelines issued by
MoEF, GoI which have been published time to time.

1. Proposed Township URBANA by M/s. Bengal NRI Complex Limited at 782 & 783,
Anandapur, P.O EKTP, Kolkata 700 107.

Activity:
This was initially a proposal for development of a Township consisting of Residential and Commercial
Complexes. The Residential complex shall comprise of 912 dwelling units in 2 Apartment Towers (5
nos. G+45 & 2 nos. G+40 storied buildings) and 48 bungalows. The Commercial Complex shall
comprise of 2 office towers (2B+G+6 podium +34 storied building & 2B+G+6 podium +26 storied
building).
Chronology:
SEAC has issued PEC for the proposed project on 13.02.2009. The PP has modified the proposal
which has been considered during 59
th
SEAC meeting held on 20.09.2011 and SEAC asked the PP to
deliver a detailed power point presentation on the revised proposal.
During presentation in the 60
th
meeting held on 24.10.2011 the committee has noted that the
construction has started and the matter was communicated to the project proponent vide letter No.
715-2N-82/2008(E) dated 11.11.2011 along with submission of additional information.
The SEAC has recommended Environmental Clearance for the proposed project (Phase-I) during 61

meeting held on 29.11.2011.

SEIAA issued a letter to SEAC informing that the built up area of Phase-I of the project is 217811.55
sq.m which as per schedule is treated as 8(b) category. As per S.O 695(E) dated 4
th
April, 2011 and
also the fact that the project is coming up in an environmentally sensitive area, SEIAA feels that
EIA/EMP should be carried out for this project.
The SEAC has scrutinized the issue in the 65
th
SEAC meeting held on 20.03.2012 and recommended
that EIA study to be undertaken for the proposed project. The SEAC, therefore, requested the
proponent to submit the proposed Terms of Reference for EIA studies of the project. Further, the
committee has recommended that since the project is proposed to be located in the fringes of the East
Kolkata Wetlands and the project proponent will be extracting ground water for the above mentioned
project, the expert comments / opinion of East Kolkata Wetlands Management Authority on the above
to be obtained.
Accordingly letter was issued to Chief Technical Officer, East Kolkata Wetlands Management
Authority seeking expert opinion and has received observations of EKWA vide letter dated
03.07.2012.
The case was considered in the 66
th
SEAC meeting held on 25.04.2012. The committee has
recommended that the proponent should submit necessary information in view of the Office
Memorandum (Guidelines for high rise buildings) issued by MoEF vide no. 21-270/2008-IA-III dated
07.02.2012. The project proponent submitted their reply in this regard on 21.05.2012
The PP was requested to present their case and the Terms of Reference (ToR) for EIA EMP study
during 68
th
SEAC meeting held on 14.06.2012. During the said presentation the SEAC discussed and
finalised the ToR for preparation of EIA report and EMP in respect of the said project.
The PP submitted the EIA report and other documents on 21.02.2013. The PP submitted the Executive
Summary of the EIA report of the entire project on 27.02.2013. The PP has obtained permission for
abstraction of groundwater from SWID of 1340 m

/day.
The PP has mentioned in the EIA report that a Writ Petition No. E.P.27900 (W) of 2012 has been filed
by the project proponent. As per decision of the Honble Supreme Court in the case of Bhopal Gas
Peedith Mahila Udyog Sangathan & Ors. Vs. U.O.I. decided on 19
th
August, 2012 [Writ Petition (C)
No. 50/1998 with IA Nos. 62-63 of 2011 in Civil Appeal Nos. 3187-3188 of 1988], Registry is
directed to transmit the record to the National Green Tribunal, New Delhi, forthwith.
The State Level Expert Appraisal Committee (SEAC) has reviewed the letters submitted by PP on
21.02.2013, 27.02.2013, 21.03.2013 and 25.03.2013 in the 77
th
meeting held on 26.03.2013. The
SEAC noted that a Writ Petition vide No. 17900 (W) of 2012 was filed by the project proponent in the
Honble High Court, Kolkata. The SEAC is of the opinion that matter is subjudice, however, no
communication was made to project proponent in this regard.
The PP submitted a letter on 26.04.2013 mentioning that they had undertaken EIA study based on
prescribed ToR issued by SEAC and submitted the EIA report for the said study vide their letter dated
20.02.2013 and subsequently PP submitted necessary clarifications with respect to their project
proposal. Further vide the above letter the PP has requested for issuance of Environmental Clearance at
the earliest.
The issue has been discussed in the 78
th
SEAC meeting held on 08.05.2013 and SEAC opined that
since the matter is referred to the NGT, SEAC will wait for necessary directives.
As per Order No. 7 dtd. 24
th
July, 2013 passed by Honble NGT, Principle Bench, New Delhi it has
been mentioned that if the process has already been commenced for the purpose of reappraisal with
SEAC the same shall be expedited because it has been informed that the same was kept in abeyance
due to pendency of the appeal. The appeal is accordingly disposed of with no order as to costs.
The PP has submitted revised salient features of the Phase I & Phase II of the proposed project on

SEAC also taken note of S.O 2559(E) dated 22.08.2013 issued by MoEF.

The case was put up for reconsideration. The SEAC reviewed the case and after detailed discussion, SEAC
opined that since Phase I of the project has already been recommended with a note that construction
activity had already been started and also submitted draft EIA report as per ToR issued by SEAC, the case
may be forwarded to SEIAA for information and opinion.


2. Proposed expansion of Residential Complex 'Vivek Bihar' by M/s. Howrah Mills Company Pvt
Ltd. at premises no. 493/C/A & 493/C/B, G.T Road, P.O+P.S-Shibpur, Ward no.-36, Howrah
Municipal Corporation, Howrah 711 102.

Activity:
This is a proposal for expansion of residential complex having 600 nos. of flats (Phase IV-6 Blocks of
G+V storied building, Phase V-22 Blocks of G+V storied building).

Chronology:
The SEAC recommended the project to delist as per MoEF Guidelines in 78
th
meeting held on
08.05.2013. Meanwhile SEAC has received a letter from pp along with revised FORM I, IA and
project report on 30.05.2013.

The case was put up for reconsideration. During the meeting SEAC scrutinized the submission and
recommended to forward the submission made by the project proponent to the SEIAA for opinion and
necessary action.

3. Proposed expansion of the Residential Complex by Army Welfare Housing Organisation
(AWHO) at Holding No. RGM.AS/534/04, Teghoria VIP Road, Jl. No. 9, Mouza Teghoria,
Jl. No. 5, Mouza Kaikhali, Rajarhat Gopalpur Municipality Ward No. 10 & 11, PO
Airport, PS - Rajarhat, Dist. 24 Parganas (North), Kolkata 700052, West Bengal.

Activity:
This is a proposal for expansion of the Residential Complex of AWHO. The PHASE I of the
residential complex has been sanctioned by Rajarhat Gopalpur Municipality on 23.04.1997 and already

constructed. The PHASE I consists of 234 flats in 16 Residential blocks, Site Office and Security
Room having total built up area 26838.808 sqm. The proposed PHASE II shall consist of 180 flats in 9
Residential blocks and Club having total built up area 30042.77 sqm. The total no. of flats will be 414
and total built up area including both phases will be 56881.58 sqm.

The municipality should possess a valid
Municipal Solid Waste Authorization
Certificate.
The proponent has submitted the
concurrence letter issued by the Rajarhat-
Gopalpur Municipality for supply of water,
discharge of treated wastewater and
collection of solid waste.

The case was put up for reconsideration. The SEAC, after scrutinising the documents submitted by the
project proponent and detailed discussion has decided to forward the same to the SEIAA for the opinion
and necessary action.

4. Proposed Residential Complex TEEN KANYA by M/s. Bengal Shelter Housing Development
Ltd. at Plot No. AA/II-B/BLK/4, Action Area II, New Town, Rajarhat, Dist 24 Parganas
(North), PIN 700136, West Bengal.

Activity:
This is a proposal for construction of a Residential Complex (3 blocks of B+G+16 storied buildings, 3
blocks of B+G+13 storied buildings, 2 blocks of G+4 storied buildings) having 387 apartments
alongwith Commercial block (G+2 storied).
Chronology:
During presentation / interaction in the 51
st
SEAC meeting held on 03.02.2011, the committee
realized that the construction work in this project has started without prior permission under the
Environmental Acts. The SEAC forwarded this case to SEIAA for necessary action for violation of
environmental rules and regulations.
The proponent mentioned vide letter dated 17.11.2011, that they have already submitted Rs. 1 lakh as
per the direction of Dept. of Environment, GoWB.
The unit again presented their proposal before SEAC on 61
st
SEAC meeting held on 29.11.2011. The
State Level Expert Appraisal Committee (SEAC), West Bengal, made the following recommendations
in the 61
st
SEAC meeting and subsequent response submitted on 27.12.2012 from the unit is given
below :-

by NKDA with drainage connectivity to
the project.

depth 90m and 150 mm dia.
3) A correct and revised area statement should be
submitted. Gridded Master plan of the proposed
project with detailed landuse classification,
infrastructural services etc. and proper area
statement (clearly mentioning Ground
Coverage, Paved Area, Green Area, Waterbody
etc.) should be submitted in larger format.
Existing structures, trees and waterbody, if any,
should be clearly shown in the proposed Master
Plan. The plantation area should be clearly
specified. The total paved area should not
exceed 25% of land area.
c) Gridded Master plan submitted.

Estate Phase I, Block D, Dist. Nadia, Pin 741235, West Bengal.

Activity:
This is an expansion proposal for enhancement of production capacity of Unsaturated Polyester Resins
(UPR) by 690 TPA. The proposed plant will be located adjacent to the existing plant at Kalyani
Industrial Estate. During the 52
nd
SEAC meeting it has been understood by SEAC that the proposed
expansion work has been started before obtaining environmental clearance. The PP has given an
undertaking that they will not continue any work for expansion project before getting all statutory
clearances to SEAC on 13.10.11

Chronology:
The case was recommended by SEAC in the 60
th
SEAC meeting held on 24.10.2011 with condition
that the effluent as well as kettle wash water should be suitably treated in ETP to meet environmental
standards. The effluent should be reused within the plant as much as possible and only the excess flow
is to be discharged after compliance with the environmental standards. Effluent treatment plant should
be monitored on a regular basis.
The Member Secretary, SEIAA noted that there is a lack of clarity regarding effluent treatment unit
(both existing as well as proposed unit) and returned the case to SEAC with a request to get the
clarification on effluent treatment from the project proponent.

The case was placed in the 63
rd
SEAC meeting held on 31.01.2012 and the committee has sought
observation from WBPCB regarding the present status of effluent treatment plant.
The unit was inspected by Board officials on 02.04.2012 and it was observed that the process does not
require any water. Water is by-product generated due to polymerization process which is collected in a
container for pH correction by caustic soda and then evaporated in an evaporator and released through
a stack of ht. 24 m from ground level.
The unit has submitted a letter dated 03.05.2012 mentioning that earlier the unit had biological effluent
treatment plant for treatment of water generated from the process. However, the unit has failed to
maintain the anaerobic bacteria, in most cases it died and instead controlling the oxygen deficiencies it
was actually increasing the BOD and COD level. Therefore, the unit has installed evaporator by
discarding the ETP.
The unit has also proposed to install higher capacity evaporator for the expansion project and
mentioned that as the polymerization reaction is hydrophobic in nature, no water is used to clean the
reactor. Styrene Monomer which is used as raw material and is also a solvent for the product is used
for cleaning.
The solid waste remaining after evaporation is sent to WBWML, Haldia and unit has obtained
hazardous waste authorization from WBPCB for existing plant.
The SEAC has reviewed the letter of the pp submitted on 07.05.2012 in the 67
th
meeting held on
25.04.2012 and made the following recommendations. Subsequent response dated 28.02.2013 from the

from the reaction chamber is slightly acidic in nature.
Such acidic effluent is initially neutralized using

vapour from the evaporator is released to the
atmosphere through a piping system (comprising of SS
and FRP pipes). Wastewater treatment flow sheet
submitted in this regard.
ii. Analysis report of stack gas
emitted from the evaporator
especially with respect to
composition of volatile
substances for the existing plant.
2. The unit has submitted Chromatogram Plot of organic
compounds present in flue gas. The unit has also
submitted list of organic compounds identified by
GC/MS analysis.
The proponent mentioned that Sludge generated in the
evaporator is hazardous in nature. Such sludge is being
handed over to West Bengal Waste Management Ltd.
for ultimate disposal which is accomplished by
incineration at WBWMLs own facility. The unit has
also submitted application for renewal of Hazardous
Waste Authorization to WBPCB, Authorization was
valid upto 30.04.2012.

on 14.05.2013. The proposed ETP shall comprise of the following: Reaction Chamber, Settling
Chamber, Sand Filter Bed, Collection pit, Carbon Bed, Biological Chamber followed by another
Carbon Bed.

The case was put up for consideration. SEAC after reviewing the letter submitted by the proponent,
recommended that project proponent should submit waste water characteristics and schematic of the
proposed wastewater treatment system with influent and effluent data and the case was recommended to
SEIAA for taking further necessary action since the proposed expansion of the project has already been
started without obtaining prior environmental clearance.

site with respect to East Kolkata Wetland.
The unit has submitted their reply on 03.10.2012 along with the permission for ground water
abstraction for 168 KLD. The SEAC has received a opinion of CEO, EKWMA on 24.09.2012.
The PP has again submitted a letter on 26.11.12 mentioning that due to installation of highly water
efficient fixtures and faucets, fresh water consumption will be reduced and will become 267 KLD.
Moreover, as the project is solely institutional in nature and operates generally 8 hrs in a day for 5
days/ week. Thus during weekend days (2 days) total vol. of water abstracted (168x2= 336 KLD) will
be distributed for next 5 days. Therefore daily avg. water availability for 5 days is =168+336/5 = 235
KL approx. Balance water requirement of 267-235=32 KLD which are expecting to be available from
K.M.C supply very soon.

does not fall under EKW area.
2. East Kolkata Wetland is an extremely
important wetlands from ecological and
bio-diversity point of view. Construction
of such tall building is like to have
adverse effects on migration of bird
species. Detail study regarding impact of
the proposed project on the migration of
bird species, fauna to be carried out by an
institute of repute like Wildlife Institute
of India (WII), Bombay Natural History
Society and report to be submitted before
the SEAC.
2) The PP mentioned that there are existing tower
of 7 stories adjacent to the proposed building in
the same campus. The unit requesting to waive
off the report on migratory birds as they
already have existing building of the same
height adjacent to the proposed one.
3. It is noted that there is shortfall in fresh
water supply compared to actual demand.
Project Proponent is requested to provide
specific clarifications to meet up the
shortfall.
3) The PP has obtained permission from SWID
for abstraction of ground water @ 222 m

/day.
Though fresh water requirement 382 KLD, pp
will install high water efficient fixtures to

The PP has submitted rainwater harvesting proposal as per SEAC guidelines. The reply submitted on
28.05.2012 and 05.07.2012 was considered in the 69

SEAC meeting held on 25.07.2012 and the
committee recommended that the source of fresh water required for the project should be specified.
And since the project is located very close to EKW, the opinion of the EKWMA in respect of impact
of the project of the East Kolkata Wetlands to be obtained.

The unit submitted their reply on 05.11.2012 enclosing a permit for sinking of new deep tube
well.SEAC also received observations of CEO,EKWA on 21.09.2012 which are as follows: -
The PP has submitted a letter on 20.05.2013 stating that few large projects in the vicinity have
conducted such study from reputed institutions and have already submitted reports to SEAC and the
proposed project is within 2 KM areal distance of the said large projects and smaller in height
compared to these large projects and hereby requesting not to insist to carry out such studies.

This was a proposal for construction of Commercial Complex (3B+G+5 storied) along with MLCP
(4B+G+6 storied) with total Built up area 66142.64 sqm. and obtained EC from SEIAA on 12.08.2008.
SEAC received a letter issued vide memo no. EN/3410/T-II-1/007/2008 dated 13.12.2010 from Sr.
Environment Officer, Department of Environment, GoWB regarding deviation of the project from
approved EC.
Now the unit has applied for modification of above EC with proposal for Commercial Complex
comprising of 1 Block of 2B+G+5 storied shopping mall consisting about 140 retail units, 3 nos. mall

proponent has mentioned that M/s. M. L. Dalmiya & Co. Ltd. has already given permission vide
letter under Ref. No. L/40/IT-Park/67 dated 03.08.2011.
During the 71

meeting held on 24.09.2012, the SEAC had noted that source and availability of
fresh water as sought earlier is yet to be submitted. The SEAC had also recommended that specific
proposal regarding management of solid waste to be submitted.
During the 73

meeting held on 30.11.2012, the reply of the unit dated 10.010.2012 and
17.10.2012 was considered and SEAC noted that no specific information regarding source and
availability of fresh water as sought by the committee has been provided. Regarding management
of solid wastes, the PP has mentioned that segregation of waste will be done at source and stored in
separate bins. The PP had undertaken to dispose the MSW generated through agency having valid
authorization from WBPCB. E wastes will be handled as per E waste (Management and Handling)
Rules, 2011.

be requested to provide the opinion on the status of water availability based on latest water census
in the concerned area. However, no such response received.

The above two cases were considered in the 77

SEAC meeting held on 26.03.2013 and the
committee has issued a reminder letter to the SWID for providing opinion as per latest water
census of the area and these two cases have been kept pending due to non-availability of opinion
of SWID.

Further the SEAC has received a letter dated 25.04.2013 issued by the Director, State Water
Investigation Directorate regarding EC in respect to applicants namely M/s Phoenix Software Ltd.,
M/s Dhunseri Petrochem and Tea Ltd., and M/s Cognizant Technology Solutions India (P) Ltd. to
be located at KITP Bantala. The letter mentions that
a) M/s. Dalmiya & Co. has already been entrusted to cater the total water requirement at Kolkata
Leather Complex, Bantala and SWID has already allotted them 26 no. of DTW particularly for
the tannery units of Kolkata Leather Complex.

Leather Complex to augment the water supply arrangement by M/s. Dalmiya & Co.
d) This tubewell is allocated in addition to 26 nos. of proposed tubewell at Kolkata Leather
Complex.
e) The tubewell may be installed of same size i.e. 300x200 mm with the depth of approx. 200 mt.
bgl.
f) However, M/s. Dalmiya & Co. will be informed by SWID to accommodate the additional
tubewell in their water supply network.
g) M/s. Dalmiya & Co. should apply in Form I at the office of the Geologist & Member
Secretary, DLA of South 24 Parganas & necessary permission in this regard will be provided
by DLA, South 24 parganas as per provisions under GW-Act duly approved by SLA and
Technical Sub-committee.
M/s. Dhunseri Petrochem & Tea Ltd. have submitted a letter to the Member Secretary, WBPCB
on 03.10.2013 informing that M/s M L Dalmiya has already applied to SWID for installation of an
additional tubewell as recommended by SWID. Letter of M/s ML Dalmiya dated 11.09.2013
addressed to the PP in this regard has been enclosed. Copy of TR Form 7 regarding deposit of
requisite fees has been also enclosed.
The case was placed for reconsideration. The SEAC considered the submission by the proponent and
remarks of the SWID. The SEAC recommended and sent the reply of SWID to SEIAA for their

Chronology:
During the presentation in the 59
th
meeting held on 20.09.2011, the SEAC has observed that this
housing project has been proposed in a site which is likely to be contaminated due to past industrial
activity. The SEAC directed vide letter dated 10.10.2011 that the project proponent should first assess
the level and type of remediation required, prepare specific site remediation plan and get the site
remediated properly. The project proponent should also obtain necessary approval from West Bengal
Pollution Control Board after remediation. The SEAC decided that this case would be considered only
after the above actions are satisfactorily executed.
The proponent submitted their reply on 21.11.2011. The proponent has submitted the test results
conducted by National Test House for nickel content only. The project proponent has mentioned that
since the nickel content at site is 10 times lower than the threshold limit, no remediation is necessary.
The State Level Expert Appraisal Committee (SEAC) has considered the submission of the pp dated
21.11.2011 in the 61
st
meeting held on 29.11.2011. The committee requested the pp to assess the level
of contamination in the proposed site by a competent agency like NEERI and address all the issues
raised in the previous letter dated 10.10.2011.
The pp again submitted a reply on 30.01.2012 mentioning that they have obtained test result through
National Test House, a Govt. of India organisation, it is observed from their report that nickel content
was determined to be 0.05% by mass. The threshold limit for nickel as per Hazardous Waste
(Management & Handling) Rules is 5000 mg/kg which is equivalent to 0.5% by mass. As the nickel
content is 10 times lower than the threshold limit no remediation measures are deemed necessary.

The pp has submitted a reply along with the test report of NEERI on 21.03.2013. They also mentioned
that the nickel content in soil at the abovementioned site is 68.12 mg/kg. by mass. The threshold limit
of nickel as per the Soil Guideline Values (Environment Agency 2009b) for land use for residential
use is 130 mg/kg and the Soil guideline Values for Nickel as per India Standards is 75-150 mg/kg.
Therefore, the nickel content at their proposed site is 55% lower than the threshold limit, hence there
will be no harmful effect.
During the 78
th
meeting held on 08.05.2013 SEAC opined that opinion of Waste Management Cell,
WBPCB to be obtained on the report provided by the pp.
Remarks of WMC of WBPCB on the final report submitted by NEERI for the proposed residential
complex is enclosed in Annexure I.
The name of the Environmental Consultant is M/s. Ghosh Bose & Associates Pvt. Ltd. The case is
placed for reconsideration. The SEAC considered the submission by the proponent and remarks of the
WMC, WBPCB and recommended that the project proponent should submit the report after incorporating
necessary modifications as suggested by the WMC, WBPCB.
It has been decided that the case shall be further considered only after submission of the necessary
clarification.

exceed 50 mg/Nm

will involve grinding of Cement Clinker with fly ash and Gypsum.

The project proponent was absent during the meeting. The SEAC recommended that the proposal may be
placed before SEAC on receiving request from the project proponent.
