Administrative Order

Iowa Court Rule 16.102 authorizes a chief judge to order the conversion of paper court files to an
electronic file of any case not subject to the Rules Pertaining to the Use of the Electronic Document
Management System (EDMS). It is in the best interest of all for the Court to have access via EDMS to pending
files that exist at the time a county clerk of court office implements EDMS. Accordingly:

It is so Ordered that:

1. Each Clerk of Court may take action to convert paper case files that are pending and will likely
appear on a future court schedule as soon as implementation of EDMS begins in their respective
counties.
2. The Clerk shall work with the local Court to identify specific documents that are to be scanned in
each case type. Upon implementation of electronic filing in the County, the security level of
these electronic records shall be as identified by the EDMS Business Advisory Committee.
3. The Clerk shall send the Notice Regarding Electronic Filing to the attorneys and parties
appearing pro se.
4. Once notified, counsel of record or parties appearing pro se shall apply the rules pertaining to
protection of personal privacy (Iowa Ct.R.16.602 through 16.607) to all future filings in that
case.
5. After being notified of commencement of the electronic filing in that County, attorneys, parties
appearing pro se and all other shall file all future filings on that case electronically.

COMES NOW the State of Iowa and for its Application to Revoke Defendants
Deferred Judgment and Impose Sentence states the following:
1. On or about March 26, 2013, defendant pleaded guilty to theft in the
second degree, but received a deferred judgment and was placed on probation
for two years.
2. On February 11, 2014, defendant was charged with disturbing the peace
Clay County Case No. SPSMSM011207.
3. The defendant has not complied with his plan of payment for court-
ordered victim restitution.
WHEREFORE, the State respectfully requests the Court set a hearing on this
Application and revoke Defendants probation / deferred judgment and, after the
State establishes Defendants violations by a preponderance of the evidence,
impose sentence pursuant to Iowa Rule of Criminal Procedure 2.24(3)(d).

STIPULATION FOR PURGE
CONTEMPT
The parties hereby stipulate and agree to the averments, and terms and
conditions set forth below, and submit the same to the Court for approval. The
defendant is represented by his attorney, Peter Goldsmith. The State of Iowa is
represented by Sac County Attorney Ben Smith. The undersigned represents
that the parties reached this agreement during a phone conversation on March
31, 2014, while defendant was personally present in Attorney Goldsmiths office.
1. On March 26, 2013, defendant pleaded guilty to THEFT IN THE
SECOND DEGREE, but received a deferred judgment and was placed on
probation for two (2) years.
2. On February 11, 2014, defendant was charged by the Spencer, Iowa,
Police Department with disturbing the peace (Clay County Case No.
SPSMSM011207).
3. On February 27, 2014, the State of Iowa filed an application to revoke
defendants deferred judgment and impose sentence.
4. The hearing on the States application is scheduled for April 16, 2014.
5. The parties stipulate that defendant violated the terms and the conditions
of his probation and, by doing so, disobeyed the Courts Order filed herein on
March 26, 2013.
6. The parties further stipulate that defendant should be found in contempt
of court and should be ordered sentenced to ten (10) days in the Sac County Jail.
7. The parties further stipulate that defendant shall be sentenced to thirty
(30) days in the Sac County Jail for willful contempt of Court.
8. The parties further stipulate that the mittimus ordering defendants
confinement shall be withheld at this time. The parties agree that should mittimus
issue the defendant shall serve the sentences consecutively, and not
concurrently, with any other jail sentence in any other matter.
9. The parties further stipulate that the defendant may purge the contempt
by doing the following:

a. Becoming gainfully employed on a full-time basis within two (2)
months following the entry of this Order.
b. Making a payment of at least $125 per month towards restitution
herein, on or before May 1, 2014, and on or before the first day
of each month thereafter.
c. Having no further violations of the law.
10. The defendant agrees to personally appear before this Court at 9:00
a.m. on September 3, 2014, for review of compliance with the terms of this
stipulation. The defendant is aware that if defendant fails to appear before this
court as ordered by the Court, a bench warrant may be issued for defendants
arrest, and defendant may be subject to separate charges of contempt for failure
to appear. The defendant is also aware that absent an unanticipated change of
circumstances, the jail sentence shall be imposed if the defendant fails to
completely meet the above conditions for purge of contempt.
WHEREFORE, the parties respectfully request that the Court enter an order
consistent with the parties stipulation and any other relief the Court deems just
and equitable in the premises.

COMES NOW the State of Iowa and for its Application to Revoke Defendants
Deferred Judgment and Impose Sentence states the following:
1. On March 26, 2013, defendant pleaded guilty to THEFT IN THE SECOND
DEGREE, but received a deferred judgment and was placed on probation for two (2)
years.
2. On February 11, 2014, defendant was charged by the Spencer, Iowa,
Police Department with disturbing the peace (Clay County Case No.
SPSMSM011207). Accordingly, on February 27, 2014, the State of Iowa filed an
application to revoke defendants deferred judgment.
3. On or around April 11, 2014, the parties stipulated that defendant was in
contempt of court. The parties further stipulated defendant should serve thirty days
in jail, but be allowed to purge said mittimus by following / completing certain terms
and conditions, one of which required defendant to have no further violations of the
law.
4. On or around May 11, 2014, defendant was arrested for THIRD DEGREE
BURGLARY (Woodbury County Case No. FECR088456, see attached Criminal
Complaint and Trial Information)
5. Additionally, defendant has failed to report to his probation officers, and has
failed to comply with various other terms and conditions of his probation (see
attached Report of Violation)
6. By the very nature of defendants new charges, defendant has violated the
terms and conditions of his probation.
WHEREFORE, the State respectfully requests the Court issue a warrant for
defendants arrest, set a hearing on this Application and revoke Defendants probation /
deferred judgment and, after the State establishes Defendants violations by a

preponderance of the evidence, impose sentence pursuant to Iowa Rule of Criminal
