BeItEnactedbytheLegislatureoftheStateof(STATE):
SECTION1.SHORTTITLE.
Thisactshallbeknownandmaybecitedasthe"(STATE)2ndAmendmentPreservationAct."
SECTION2.FINDINGS
TheLegislatureoftheStateof(STATE)finds:
(1)thattherighttokeepandbeararmsisafundamentalindividualrightthatshallnotbe
infringed
(2)thatitistheintentoftheLegislatureinenactingthisacttoprotect(STATE)
employees,includinglawenforcementofficers,frombeingdirected,throughfederal
executiveorders,agencyorders,statutes,laws,rules,orregulationsenactedor
promulgatedonoraftertheeffectivedateofthisact,toviolatetheiroathofofficeand
individualrightsaffirmedunderthe2ndAmendmenttotheConstitutionfortheUnited
Statesand(SECTIONANDARTICLE)oftheConstitutionoftheStateof(STATE)
(3)thatpursuanttoandinfurtheranceoftheprinciplesoffederalismenshrinedinthe
ConstitutionoftheUnitedStates,thefederalgovernmentmaynotcommandeerthis
Statesofficers,agents,oremployeestoparticipateintheenforcementorfacilitationof
anyfederalprogramnotexpresslyrequiredbytheConstitutionoftheUnitedStates
(4)thatthisrighttobefreefromthecommandeeringhandofthefederalgovernmenthas
beenmostnotablyrecognizedbytheUnitedStatesSupremeCourtinPrintzv.United
StateswhentheCourtheld:TheFederalGovernmentmayneitherissuedirectives
requiringtheStatestoaddressparticularproblems,norcommandtheStatesofficers,or
thoseoftheirpoliticalsubdivisions,toadministerorenforceafederalregulatoryprogram
and
(5)thattheanticommandeeringprinciplesrecognizedbytheU.S.SupremeCourtin
Printzv.UnitedStatesarepredicatedupontheadviceofJamesMadison,whoin
Federalist#46advisedarefusaltocooperatewithofficersoftheUnioninresponseto
eitherunconstitutionalfederalmeasuresorconstitutionalbutunpopularfederal
measures.
SECTION3.PROHIBITIONS
A.Otherthancompliancewithanorderofthecourt,notwithstandinganylaw,regulation,ruleor
ordertothecontrary,noagencyofthisstate,politicalsubdivisionofthisstate,oremployeeofan
agencyorpoliticalsubdivisionofthisstateactinginhisorherofficialcapacityshall:
(1)Knowinglyandwillinglyparticipateinanywayintheenforcementofanyfederalact,
law,order,rule,orregulationissued,enactedorpromulgatedonoraftertheeffective
dateofthisactregardingapersonalfirearm,firearmaccessory,orammunition.
(2)Utilizeanyassets,statefunds,orfundsallocatedbythestatetolocalentitiesonor
aftertheeffectivedateofthisact,inwholeorinpart,toengageinanyactivitythataidsa
federalagency,federalagent,orcorporationprovidingservicestothefederalgovernment
intheenforcementoranyinvestigationpursuanttotheenforcementofanyfederalact,
law,order,rule,orregulationissued,enactedorpromulgatedonoraftertheeffective
dateofthisactregardingapersonalfirearm,firearmaccessory,orammunition.
SECTION4.PENALTIES
A.Anyagentoremployeeofthisstate,orofanypoliticalsubdivisionofthisstatewhoknowingly
violatestheprohibitionsinSection3ofthisactshall,onafirstviolation,beliableforacivilpenalty
nottoexceedthreethousanddollars($3,000)whichshallbepaidintothegeneralfundofthe
state,andonasecondorsubsequentviolationshallbeguiltyofamisdemeanor.
B.Apoliticalsubdivisionofthisstatemaynotreceivestategrantfundsifthepoliticalsubdivision
adoptsarule,order,ordinance,orpolicyunderwhichthepoliticalsubdivisionviolatesSection3
ofthisAct.Stategrantfundsforthepoliticalsubdivisionshallbedeniedforthefiscalyear
followingtheyearinwhichafinaljudicialdeterminationinanactionbroughtunderthissectionis
madethatthepoliticalsubdivisionhasintentionallyrequiredactionswhichviolatetheprohibitions
inSection3ofthisAct.
SECTION5.SEVERABILITY
Theprovisionsofthisactareherebydeclaredtobeseverableandifanyprovisionofthisactor
theapplicationofsuchprovisiontoanypersonorcircumstanceisdeclaredinvalidforany
reason,suchdeclarationshallnotaffectthevalidityoftheremainingportionsofthisact.
SECTION6.EFFECTIVEDATE
ThisacttakeseffectuponapprovalbytheGovernor.
