PETITION FOR ANNULMENT OF A MARRIAGE
COMES NOW, the plaintiff, by undersigned counsel, to this honorable court, respectfully
states that:
1.

Herein Petitioner, GREGORIO A. MARASIGAN, is 25 years of age, born on

February 27, 1989, and a resident of 123 Scout Borromeo St., Brgy. West Triangle, Quezon City, whose
address is also the conjugal abode.
2.

Herein Respondent, THERESA G. CARAMAT-MARASIGAN, is 24 years of

age, born on March 22, 1988, and presently a resident of Unit C, 45 Scout Albano St., Brgy. East
Triangle, Quezon City.

3.

Petitioner and Respondent got married on May 17, 2012 at the Manila Cathedral

with address at Cabildo cor. Beaterio Sts., Intramuros, Manila.

The marriage was solemnized by Fr. Miguel F. Ramolete. Attached as Annex A

hereof is a Certification issued by Archbishop Gaudencio Rosales that Fr. Ramolete is authorized by the
Catholic Church to solemnize marriages.

The aforesaid marriage of Petitioner and Respondent was conducted under the

legal authority embodied in the Marriage License with Register No. 91, series of 2012, issued by the Civil
Register of Manila on April 26, 2012, attached hereto as Annex B.

The aforesaid marriage of Petitioner and Respondent was legally consummated

as shown in the Marriage Contract attached hereto as Annex C, with Register No. 122, series of 2012,
signed by the parties on the date of the marriage, which is May 17, 2012, and by a Certificate of Marriage
attached hereto as Annex D, issued by the Civil Register of Manila on March 31, 2014.

At 4:00 PM on February 14, 2013, Valentines day, Petitioner went home earlier

to give Respondent a pair of earrings valued at PHP 15,000.00 as a gift apt for the occasion. To his
surprise, he found Respondent in the middle of a sexual intercourse with a woman. The Affidavit of the
Petitioner on the above-mentioned incident is attached hereto as Annex E.

Two weeks passed after the unfortunate incident of February 14, 2013 and their

relationship grew sour, until finally on February 28, 2013, a verbal altercation erupted between the
Petitioner and Respondent, prompting Respondent to pack her clothes and leave the conjugal abode. Said
altercation was heard by witness Marie Fe B. Sangalang whose address is 124-A Scout Borromeo St.,
Brgy. West Triangle, Quezon City. The Affidavit of Ms. Sangalang attesting to the fact that the altercation
happened on February 28, 2014 is attached hereto as Annex F.

After Respondent left the conjugal abode, Petitioner asked her friends on the

matter of her sexual orientation and preference by sending personal e-mails, on multiple occasions
ranging from March 2013 to November 2013, to a few of her friends in social networking site by the
name of Facebook. Only one of her friends replied to his e-mail on January 14, 2014, a person by the
name of Josephine L. Villalon, whose address is 52 Matalahib St., Brgy. Santo Domingo, Quezon City.
She divulged, in the e-mail, that Respondent have had numerous lesbian relationships in the past and even
gave him the number of a former girlfriend, 0919-911-9191, and whom she identified as Madeleine N.
Estrella. A printed screenshot of the e-mail is attached hereto as Annex G, and the Affidavit of Ms.

Villalon attesting to the fact that Respondent had numerous lesbian relationships is attached hereto as
Annex H.

On January 15, 2014, as he was going through the effects of his wife, herein

Respondent, he saw a photograph of her in intimate proximity with a beautiful woman. In the photograph,
it was very clear that his wife, herein Respondent, was holding hands in amorous intimacy with a person
that belongs to the same sex as her. The woman was the same woman that he saw when he surprised
Responded in that incident of February 14, 2013. The photograph is attached hereto as Annex I.

On February 2, 2014, he received a text message from a colleague of

Respondent, Lilibeth S. Hernandez, informing him that the woman with whom Respondent was having
sexual intercourse was Winona T. Quilang. Petitioner made arrangements with the colleagues of
Respondent, through Ms. Hernandez, to inquire on the identities of Estrella and Quilang. The meeting
happened on February 8, 2014 at the McDonalds Fast Food Restaurant along Kalayaan Avenue, and there
were three attendees: witness Braulio P. Lopez, whose address is at 19 New York Avenue, Cubao, Quezon
City; witness Crystal Claire K. Quigaman, whose address is at 27 Kamias St., Quezon City; and Lilibeth
S. Hernandez, who declined the request to testify for Petitioner. Mr. Lopez related that the relationship of
Respondent and Estrella were more intimate than that of best friends and even showed an electronic
photograph on his Smart Phone dating from their graduation in 2011 where two women, whom he
identified as Respondent and Estrella, were intimately kissing in what appears to be a post-graduation
party, with Respondents left hand holding Estrellas breast. The Affidavit of Mr. Lopez is attached hereto
as Annex J-1 and a printed copy of the electronic photograph attached hereto as Annex J-2.

During the same meeting, he showed the photograph marked herein as Annex I

to the group. Mrs. Quigaman identified the woman as Winona T. Quilang, whose address is Unit C, 45
Scout Albano St., Brgy. East Triangle, Quezon City. She divulged that Respondent had been living with
her since summer of 2013. The Affidavit of Mrs. Quigaman is attached hereto as Annex K.

WHEREFORE, the Petitioner prays that the Honorable Regional Trial Court issues an
Order declaring the Annulment of Petitioners marriage with Respondent and such other reliefs as may be
allowed under the law.

I, GREGORIO A. MARASIGAN, of legal age, after having been duly sworn in
accordance with law, hereby depose and say:

that I am the Petitioner in the foregoing Petition for Annulment of a Marriage.

that I have caused the above Petition to be prepared and have read the contents
thereof. The allegations therein are true and correct to the best of my knowledge
and based on the records at hand. I attest to the authenticity of the annexes
thereto.

3.

that I certify that:


a. I have not heretofore commenced any action or claim pending involving the
same issues in any court, tribunal or quasi-judicial agency;
b. To the best of my knowledge, no other action or claim is pending; and
c. If I should thereafter learn that a similar action or claim had been filed or is
pending, I shall report the fact within five (5) days therefrom to the
Honorable Court
