Cyber (e!)rity Poli!y& The -ational Cyber (e!)rity Poli!y of India 2013 (-C(P 2013
was drafted 'eepin$ this re.)irement in mind& It is a $ood Poli!y on many !o)nts b)t it
also failed to address many !r)!ial aspe!ts as well& For instan!e+ the Poli!y has failed to
prote!t Priva!y /i$hts in India& -evertheless+ this is a $ood step in the ri$ht dire!tion and
it m)st be )pdated and improved as the time passes
(2) National Security olicy "# India! -ational (e!)rity of India is fa!in$ many
!hallen$es these days that are mainly attrib)table to the )se and ab)se of Information and
Comm)ni!ation Te!hnolo$y (ICT& 0 -ational (e!)rity Poli!y of India is )r$ently
needed that m)st have the Cyber (e!)rity Poli!y as an essential element& Presently this is
not the !ase b)t we hope the same wo)ld be a!hieved very soon by the Indian
,overnment&
(3) National Telecom Security olicy "# India! There is no implementable -ational
Tele!om (e!)rity Poli!y of India as on date& *owever+ it may be drafted very soon by the
Indian ,overnment& 0s of now the Tele!om (ervi!e Providers of India are openly
flo)tin$ the Laws of India& They are not followin$ the Cyber Law D)e Dili$en!e in India&
For instan!e+ 0irtel and Tata Teleservi!es Limited are violatin$ Cyber Law of India in
$eneral and Internet Intermediary /)les of India in parti!)lar& These violations m)st be
p)nished by Department of Tele!omm)ni!ation (DoT and Tele!om /e$)latory
0)thority of India (T/0I& 1ven the Defen!e /esear!h and Development 2r$anisation
(D/D2 has !omm)ni!ated to the DoT that the proposed -ational Tele!om (e!)rity
Poli!y sho)ld have a framewor' to penalise Tele!om (ervi!e Providers if they fail to
abide by the norms&
($) Imported So#t%are And Telecom &'uipments Security! Cyber (e!)rity of imported
(oftware and Tele!om Prod)!ts was a ma3or !a)se of !on!ern for India& For instan!e+
*)awei and 4T1 have already fa!ed Tele!om (e!)rity Iss)es in India& (imilarly+ India is
also !onsiderin$ ma'in$ the -orms for import of Tele!om 1.)ipments in India more
strin$ent& The (e!)rity 0$en!ies of India have $one to the e5tent of even s)$$estin$ for
the developin$ indi$eno)sly man)fa!t)red Cyber (e!)rity (oftware& 0ltho)$h the testin$
of Imported (oftware and *ardware for embedded 6alware has been postponed till 1st
0pril 201" by India yet this iss)e wo)ld res)rfa!e in the year 201"& 1ven a Tele!om
(e!)rity Dire!torate of India has been proposed by Indian ,overnment&
