and any crib $or% 4 beams or other s!pporting str!ct!re in s!ch a manner that there $ill not be

Each pile for initial test shall be constr!cted in a manner similar to that to be !sed for
constr!ction of the $or%ing piles 4 and by the !se of similar e<!ipments and materials0 ,ny
"ariation $ill only be permitted $ith prior appro"al0
)or each pile $hich is to be tested for initial test a detailed record of the soil enco!ntered
d!ring boring or of the progress d!ring dri"ing shall be made and s!bmitted to the EngineerBinB

6here EngineerBinBcharge re<!ires soil sample to be ta%en or in sit! tests to be made in
bored piles4 the contractor shall gi"e the res!lts of s!ch tests to the EngineerBinBcharge $itho!t

#he pile shall terminate at the normal c!t off le"el or at a le"el re<!ired by the EngineerB

'n the e"ent of any disp!te bet$een contractor and persons engaged by contractor at site4
contractor shall amicably resol"e s!ch disp!tes in s!ch a $ay that $or% can be proceed
pretedly 0 'n the e"ent of s!ch disp!tes $hich are not sol"ed in the abo"e said manner4
contractor shall immediately notify EngrBinBcharge of the e;istence of s!ch a disp!te and the
nat!re thereof b!t contractor shall himself be responsible to ta%e any s!ch meas!res necessary
and permissible to ha"e sit!ation resol"ed0
SETTLE'ENT OF DIS"$TES
#his tender=contract shall be the s!b?ect to and in all respects be go"erned by 'ndian Disp!tes
or differences connected $ith or arising o!t of this contract shall be referred to the +eneral
manager of the company $ho shall himself or thro!gh one of his not representati"e not directly
related to the contract4 arri"e at a decision on the matter4 $hich $ill be binding on the parties

S$S"ENSION & TER'IN%TION
'n the e"ent that the contractor is !nable or !n$illing to complete or is compelled to
Postpone his acti"ities relating to $or% at any stage d!ring the pendancy of contract4 9'L may
either s!spend or terminate contract by gi"ing contractor thirty days notice0
'f contractor shall fail or neglect to e;ec!te $or% $ith all d!e diligence and e;pedition or shall
ref!se or neglect to comply $ith any reasonable orders gi"en to him in $riting by EngrBin
Charge in connection $ith $or% or shall other $ise commit breach of any of the pro"isions of
contract4EngrBin Charge may gi"e contractor notice in $riting re<!iring to ma%e good s!ch
fail!re neglect or breach0 Sho!ld contractor fail to comply $ith the notice $ithin the time
specified therein4 then EngrBin charge shall4 $itho!t pre?!dice to his other rights !nder contract4
be at liberty to ha"e s!ch $or% or portion of $or% as contractor has failed or neglected to
e;ec!te4 e;ec!ted directly or thro!gh any other agency $hich he deems fit at the ris% and cost
of the contractor and EngrBin charge shall ha"e the free !se of all of contractorJs e<!ipment4
materials and other things for the time being a"ailable at site for getting the $or% completed in
the abo"eBsaid manner to the e;cl!sion of any right of contractor for fair $ear and tear

thereof 0EngrBin charge shall f!rther be entitled to apply the proceeds of s!ch e<!ipment and
!n!sed materials of contractor and any balance amo!nt that may be d!e to contractor for $or%

fail!re4 neglect4 ref!sal4 or contra"ention by contractor and =or to$ards any e;pense that EngrB
in charge might ha"e inc!rred in getting the $or% completed in the abo"e said manner0
'f contractor shall become ban%r!pt or insol"ent or ha"e a recei"ing order made against him or
shall compo!nd $ith his creditors or shall commence to be $o!nd !p other$ise than for the
p!rpose of reconstr!ction or carry on its b!siness !nder a recei"er for the benefit of its
creditors4 company may at its sole discretion either

'n the e"ent of s!spension of contract "ide abo"e4 immediately on receipt of notice therefore
from EngrBinBcharge4 contractor shall s!spend all acti"ities at site e;cept those essentially to be
carried for o!t the time being in progress in a safe manner $itho!t $astage of materials and
temporarily disband or reBassign contractorJs $or%men e;cept those essentially re<!ired at site
s!ch as for sec!rity of contractorJs e<!ipments and materials0 Contractor shall reBmobilise his
$or%men and reBcommence $or% $ithin fifteen (1>) days of receipt of notice from EngrBinB
charge re<!iring contractor to do so0
'n the e"ent of termination of contract immediately on receipt of notice therefore from EngrBinB
charge4 contractor shall ta%e all steps for $inding !p $or% s!ch as cancellation of any pending
orders and termination of any s!bcontractors that contractor might ha"e entered to $ith others
in connection $ith $or%4 safe g!arding and sec!ring of any $or% in progress in a safe manner4
disbanding of $or%men4 remo"al of temporary constr!ction made by contractor at site and
ret!rn of all e<!ipment 4special tools !nB!sed materials and doc!ments that EngrBinBcharge
has s!pplied to contractor0
8pon termination of contract for any reason4 obligation of the parties hereto shall cease e;cept
for the liabilities for either party to other in respect of obligation that $as ac<!ired prior to the
date of s!ch termination0
RECO0ER1 OF D$ES FRO' CONTR%CTOR
9'L shall ha"e reco!rse to contractor for any costs4 claim4 demands4 proceedings4 damages
and e;penses $hate"er arising o!t of or in connection $ith any fail!re of contractor to perform
