I hereby declare as follows:
I am aware that Phoenix Sea Services Pvt. Ltd. conducts maritime courses through various reputed
Indian & Foreign training colleges/ Universities providing Maritime Education and Training which is approved
by DG Shipping, Government Of India as well as approved by reputed foreign colleges /
Universities. As I am interested in pursuing career in Merchant Navy, I approached Phoenix Sea
Services Pvt. Ltd. along with my father/Guardian and expressed my interest in undergoing the training
course.

I aware of the fact that Phoenix Sea Services Pvt Ltd agreed to admit me on the basis of my
application and the certificates submitted by me and on the basis of my following declaration & after
fulfilment / comply with following terms & condition.

1. I solemnly declare that I had been well informed about Phoenix Sea Services Pvt. Ltd. and the
course by the counsellor from my native place and I have chosen to join the course on my own
will and with full permission from my Parent/Guardian/Guarantor after clearly understanding
the scope of training, nature of job and job opportunities available in Maritime Industry for this
course.

2. I am fully aware that if I pay program cost by way of bank loan, I will be personally responsible for
the sanction of bank loan, if I fails, Phoenix Sea Services Pvt. Ltd Will not be responsible for delay
or cancelled selection for said program & amount deposited (full or part of fees) is non-refundable
& non-transferable in any case & will not be entitled for any indemnity.

3. I am fully aware that selection will only take effect after qualifying B.E. / Diploma/ 10+2 / 10th
examination with required marks & I have also to qualify in the CET test conducted by
competent authority, if needed. If I fails to secure required marks then my selection will be
cancelled & amount deposited (full or part of fees) is non-refundable & non-transferable & will
not be entitled for any indemnity.

4. I am fully aware that part-payment of fees will not be entertained & I will not be admitted to
the program without full payment of fees as per schedule of program. In case of delayed
payment I lose my priority for selected program & will not be entitled for any indemnity.

5. I am fully aware that Phoenix Sea Services Pvt. Ltd. ,which is Ship Management Company
incorporated under the Company Act 1956 ( No. 1 of 1956) & the company is private limited.
Reserves its right to reject me at any stage of selection without disclosing any reasons. In case
Phoenix Sea Services Pvt. Ltd. Reject me before starting training program amount deposited
by me is partially refundable after deducing expenses bared by Phoenix Sea Services Pvt. Ltd.

6. I am fully aware that after completing my admission procedure in training program. Phoenix
Sea Services Pvt. Ltd. Reserves its rights to decide institute & course module as per availability
of seats ( Subject to change without prior notice. & after paying the fees, if I decided to
withdraw from program for any reasons or my parents / guardian wish to withdraw from
training program or If I found unfit to continue, including medical grounds, or whatsoever
reason, amount paid by me is not refundable & non-transferable for any reason under any
circumstances

7. I am fully aware of the fact that if I will be detained or found medically unfit from institute
before / during or after period of training program or If the behavior of me is found detrimental
to the smooth functioning of the institute, hostel or Phoenix Sea Services Pvt. Ltd. (company)
, I will be dismissed / removed from the institute & will not be re-admitted & Phoenix Sea
Services Pvt. Ltd. Will not be responsible for future training program & recruitment & fees paid
by me is not refundable & non-transferable.

8. Institute & Phoenix Sea Services Pvt. Ltd.is not responsible for any kind of Accident / Death /
Physical injuries when I am doing any practical in the institute or any other place of training
outside the institute such as swimming pool, Boating etc. & Institute, Instructors Management,
Phoenix Sea Services Pvt. Ltd. Is not responsible for any compensation for any incident / Refund
of any training fees.

9. I am fully aware of the risks involved in the job as it is in the ships sailing in the high seas.

10. I declare that I have not been neither lured nor coerced, coaxed into joining the training.

11. I confirm that I have been very lucidly explained and counseled on the scope of training and
that I will have to undergo mandatory on-board training at my cost.

12. I confirm that I am aware and I had been informed that college only facilitates and helps me
to apply for Seaman's book (CDC) and mandatory on-board training.

13.1 I know and agree that I have to pay for all costs related to the application of Seaman's book
and course fee/deposit for on-board training.

13.2 I and my father/mother/Guarantor/Guardian jointly agree that we have been properly
explained and we have understood clearly the Fees Structure. We know and agree that the fee
payable to Training Institute is ................................................................... (In Words

payable are: Caution deposit, Insurance & any Other charges required for my Institute & On-
board Training time to time.

13.2 I agree to pay the fee, Insurance, Caution deposit and other charges on/or before joining the
course and other charges as and when advised.

13.3 I know that the course is totally residential and the fee includes hostel Accommodation and
boarding charges.

13.4 I agree that I will strictly abide by the rules and regulations of the college.

13.5 I confirm to have received the copy of the same and read and understood the same & during
training program I maintain strict discipline in the Institute / Hostel Campus / Outside during
training program. I aware that Use of alcohol, tobacco & other illegal drugs are strictly
prohibited & Use of mobile phone is strictly prohibited, any violation will be dismissed from the
institute.

13.6 I agree that failure to pay the fees, government and other charges, taxes as stipulated will
forfeit admission.

14 I and my Father/Guarantor/Guardian confirm that the certificates produced are Genuine.
Phoenix Sea Services Pvt. Ltd and the Training Institute is no way responsible for obtaining any
of the certificates. I, further, indemnify the college against any damage in future caused if any
of my certificates is found to be fake.

15. I confirm that I am not suffering from any chronic disease Epilepsy, Migraine or any mental or
physical disorders which cannot be detected otherwise by normal medical examination. Further
confirm that I or my Parents/Guarantor/Guardian will not hold Phoenix Sea Services Pvt. Ltd
responsible if the trainee is found to have any disorder and rejected from any of his future
assignments.

16. I confirm that I have obtained the medical certificate that I have submitted now, briefly
explaining the history of past illness, any accidents, any operations, blood group detail, and
detail drug allergies at the time of admission.

17. I agree that Personal insurance is compulsory. I, my parents, guarantor, guardian agree that
Phoenix Sea Services Pvt. Ltd is not responsible to pay any compensation what so ever other
than the Insurance payable by the Insurance companies in the event of any type of injuries to
me due to any accident during the course duration in the institute. Payment of Insurance is the
discretion of the Insurance Company as per their rules and regulations.

18. I agree that any other course or training adding value to the trainee shall be at my cost.

19. I agree that I will obtain Foreign CDC as per program module & schedule & I have to clear
required examination for obtaining CDC ,If needed for my on-board training program & I will
be personally responsible for PASSPORT before joining for on-board training program
(Placement) & cost is only borne by me . I am completely aware that my On-board / Off-
board training program is subject to submission of my passport.

20. I am also aware that after completion of my course at least 120 days are required to obtain
my foreign CDC (whichever will be applied). In case any delay will take place on the part of
the Issuing Authority, I will wait patiently and will not ask for any financial penalty from
Phoenix Sea Services Pvt. Ltd.

21. I clearly understand that CDC is basically issued by the competent authority and hence if due
to any technical problem if the CDC will be delayed then I can't Pressurize Phoenix Sea
Services Pvt. Ltd.

22. I am also aware that after obtaining my CDC I will have to wait patiently for my On-board
training. I am also aware that on-board training( Placement) decided by Phoenix Sea Services
Pvt. Ltd. depending on the market situation, condition & variation I may have to wait for
maximum 120-180 days for placement & its combined responsibility of the academy and
Phoenix Sea Services Pvt Ltd, and only entities for one placement. & I declare that in future,
I should not publish, speak or write any false, baseless and highly defamatory material with
the intention to defame the name of Phoenix Sea Services Pvt. Ltd and or the Academy in
print, satellite and Internet Based Media In case of delay for on-board training purpose. I am
completely aware that I will be only entitled for on-board training If I want to join another
training program for COC or any other value added courses or want to join for another or next
placement I am ready to bare additional charges for it.

23. I am fully aware that, If I unable to continue for on-board/off-board training program after
completing of my academic session, for whatever reason or circumstances I will only entitled
for on-board charges after deducting all of my expenses, taxes & academic fees as per refund
policy of the Phoenix Sea Services Pvt. Ltd., Nagpur & bound to my parent, legal hairs, successors & legal
representatives.

24. I understand that fees claim will not be entertained under any circumstances. (Not even part
fee).

25. I assured that I should not join any other Training Institute, Company, Consultant for the
purpose of training, recruitment etc. without written permission of Phoenix Sea Services Pvt.
Ltd.

26. I finally, admit that I have no grievance, and I will neither take any legal action in future nor
claim for indemnity or take any legal (Civil or Criminal) action in the judicial or quasi-judicial
27. authority or claim through Arbitration, Mediation, Consumer Court and or Forum against
Phoenix Sea Services Pvt Ltd ad or the Academy

28. For all matters, disputes subject Jurisdiction is confined to Nagpur city (Maharashtra) only,
where the registered office of Phoenix Sea Services Pvt. Ltd. Is situated.

DECLARATION : I finally agreed the terms & condition mentioned in above declaration. I
further declare that all above information stands true & so I hereby agree to sign this
