Pharmacy Location.
Under the National Health Act 1953, the Commonealth !overnment o"
A#stralia im$oses strict controls on a$$rovin% ne $harmacies and on
relocatin% e&istin% $harmacies "or Pharmarce#tical 'ene(ts )cheme *P')+
dis$ensary $#r$oses. ,hese location-based controls hel$ to %ive e.ect to the
A#stralian Comm#nity Pharmacy A%reement beteen the Commonealth
and the Pharmacy !#ild o" A#stralia.
Pharmacy Ownership.
Allowing for some variations in each State Act, and the specified exceptions of friendly societies and
some grandparented proprietors (that is, for profit non-pharmacist proprietors whose holdings predate
existing restrictions), by and large only registered pharmacists may own pharmacies (ational
!ompetition "eview of Pharamcy #$$$). Pharmacists m#st be re%istered in the )tate
or ,erritory in hich they are $ractisin% and $ractise in a$$roved $remises.
%ith o&tlying areas disadvantaged, the government offers a r&ral allowance to pharmacies that
cond&ct their b&siness in o&tbac' towns. (owever, gone are the days of a free license. )oday, a license
m&st be p&rchased.
)he *&eensland legislation re+&ires pharmacy ownership to comply with proprietary interest
Limitation on number of Pharmacies owned: 5 for Pharmacist owners.6 for Friendly Societies

Pharmacy Re%istration.
,o obtain re%istration, the all 2#risdictions re3#ire a $harmacist to have a
reco%nised 3#ali(cation "rom a tertiary instit#tion in A#stralia or overseas,
and to com$lete a $eriod o" $re-re%istration trainin%. ,he )tate and ,erritory
Pharmacy Acts reserve the $rivile%e o" $ractisin% $harmacy to re%istered
$harmacists. ,he s#$$ly o" dr#%s and $oisons is only $ermitted by non-
$harmacists in very limited circ#mstances. 4n addition, most 2#risdictions
$rotect the la"#l #se o" the term 5$harmacist6, $harmace#tical chemist6 and
similar titles and descri$tions by restrictin% these to re%istered $harmacists.
Acts and re%#lations also im$ose restrictions on the $ro"essional cond#ct o"
$harmacists incl#din%7 $rescribed ethical and $ro"essional standards and
related disci$linary sanctions8 and limitations on advertising such as the
Queensland prohibition of advertising leading to invidious
comparison with other pharmacists (Queensland Pharmacy
Regulations 1997+.

Certain dr#%s may be dis$ensed itho#t a $rescri$tion only i" the
$harmacist ens#res the e&istence o" a thera$e#tic need "or the medicine.
,he $harmacist is also o"ten re3#ired to $ersonally hand the medicine to
the cons#mer and co#nsel the cons#mer on a$$ro$riate #se.
Prescri$tion-only medicines may be dis$ensed only on $resentation o" an
ori%inal $hysical $rescri$tion si%ned by hand by a doctor holdin% an
A#stralian $rovider n#mber. 0nline $harmacies have attem$ted to deal
ith this by re3#irin% the $rescri$tion to be $osted to the $harmacy or
handed to the co#rier in ret#rn "or the medicine.

be eli%ible to distrib#te $rod#cts that are s#bsidised by the
Pharmace#tical 'ene(ts )cheme *P')+.
