A probe is monitoring both infrastructure and
hardware, the designer would like the samplers to
appear in different logical entities, rather than
combined
A designer has 5 SQL toolkits that monitor a
process, 3 are dev and 2 are prod, entities are used
to spilt them up

Licence Agreement
The copyright and other intellectual property rights in these training course guides (the Guides) and its ancillary documentation (if any) are owned
by ITRS Group plc (the Owner). By using these Guides you (an individual or legal entity) agree with the Owner to be bound by the terms of this
Agreement which will govern your use of the Guides. If you do not accept these terms you may within 14 days of receipt return the Guides and
ancillary documentation (if any) unused to the Owner.
Licence
You are permitted to:
(1) load the Guide into and use it on 1 Central Processing Unit which is under your control;
(2) use the Guides for instruction and guidance relating to the use and configuration of the Geneos software and application environment;
(3) make 1 copy of the Guides for back-up purposes only in support of the permitted use. The copy must reproduce and include the Owner's copyright
notice. Such copy and the media on which it is stored shall be the property of the Owner and this Agreement shall apply to the copy as it applies to the
Guides;
You are not permitted:
(4) to load the Guides on to a network server for the purposes of distribution to one or more other computer(s) on that network or to effect such
distribution (such use requiring a separate licence);
(5) except as expressly permitted by this Agreement and save to the extent and in the circumstances expressly permitted by law, to rent, lease, sublicense, loan, copy, modify, adapt, merge, translate, reverse engineer, decompile, disassemble or create derivative works based on the whole or any
part of the Guides or its associated documentation or use, reproduce or deal in the Guides or any part thereof in any way.
Term
This Agreement is effective until you terminate it by destroying the Guides and its documentation together with all copies. It will also terminate if you
fail to abide by its terms. Upon termination you agree to destroy all copies of the Guides and its documentation including any Guides stored on the
hard disk of any computer under your control. The media on which such copies resided will after destruction of the copies residing on them revert to
you.
Ownership
You own only the physical media (or authorised replacement) on which the Guides are recorded (if any). You may retain the physical media on
termination of this Agreement provided the Guides have been erased. The Owner shall at all times retain ownership of the Guides as recorded on the
original physical media on which it was supplied and all subsequent copies thereof regardless of form. This Agreement applies to the grant of Slide

licence contained herein only and not to the contract of sale of the physical media.

Warranties
(1) The express terms of this Agreement are in lieu of all warranties, conditions, undertakings, terms and obligations implied by statute, common law,
trade usage, course of dealing or otherwise all of which are hereby excluded to the fullest extent permitted by law.
(2) The Owner does not warrant that the Guides will meet your requirements or that the operation of the Guides will be uninterrupted or error-free or
that defects in the Guides will be corrected. In no event will the Owner be liable to you for any indirect or special loss or damage of any kind (except
personal injury or death resulting from the Owner's negligence or breach of this Agreement), nor for any form of lost profits economic or
consequential loss arising from your use of or inability to use the Guides or from errors or deficiencies in it whether caused by negligence or
otherwise. In respect of any other claim, in no event shall the Owner's liability exceed such amount (if any) paid by you for the Guides.
Data Protection
You warrant and undertake to the Owner that you will observe all obligations under the Data Protection Act 1998 relating to personal data and
indemnify the Owner against all breaches of the Act or any Statute or Regulation analogous to the Act in any jurisdiction where the Guides are used.
Waiver of remedies
No delay by either party in enforcing the provisions of this Agreement shall prejudice their rights nor shall any waiver of their rights operate as a
waiver of any subsequent breach and no right, power or remedy of either party is exclusive of any other right, power or remedy available.
Third parties
No person who is not a party to this agreement shall have any right to enforce it pursuant to the Contracts (Rights of Third Parties) Act 1999.
Confidentiality
You agree to keep the existence and nature of this Agreement confidential and not to use the same in any publicity, advertisement or other disclosure
with regard to this Agreement without the prior written consent of the Owner.
Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
