Who can attend?


The Course is designed for professionals, scholars, teachers and practitioners
who are familiar with legal reasoning and concepts of Alternative Dispute
Resolution. Those interested in gaining knowledge, skill and expertise in
arbitration must attend. Attendance is compulsory. On Completion of the
course, the participant will be awarded with a Certificate from NLSIU. No
accommodation shall be provided by NLSIU.

Arbitration has much scope in reso lving outstanding disputes legally and formally, as it is a
legal, for mal, private binding process t hrough which disputes can b e resolv ed by an awar d
made by an indep endent A rbitral or P anel, w hich gets c onstituted after cons ultations, an d
with to tal agreement of both th e disputing parties. For a country like India, w ith its
burgeoning cases waiting to be disposed and li mited ju dicial r each, arbitr ation can be
valuable.
Objective
The objective of this cou rse is to equip the participants with the knowledge, scope and reach
of Arb itration l aw and practice. Th e course wi ll study the legal pr inciples applicable to the
widely accepted us e of arbitration as a means of r esolving disputes arising under public and
private sector collective.
The course w ill cov er all for ms o f Arbitration, including G overnment Arbitration,
Commercial Arbitration , Invest ment and non commercial arbitr ation. Participants will be
treated to d rafting arbitra tion clauses in Cont racts, A ppointment of arbitration, Ad hoc
arbitration and Institutional arbitration, Venue and seat of arbitration, procedure of arbitration,
award of arbitration, Judicial review toward s arbit ral awards and the scop e o f foreign
arbitration. Apart from the comprehensive theoretical aspects, this c ourse will al so cover
practical and proce dural a spects of the arbitration proce ss with c ase studies a nd m ock
arbitration proceedings.

This course has two d istinct bu t related go als. F irst, it i s an in -depth s tudy o f the law
governing Arbitration in India . Second, it is de signed to te ach th e ski lls n ecessary for
practitioners in the practice of arbitration. In that respect, it is like a skills-training course.

Day 1: Introduction to Arbitration, History, background of the Arbitration law in India scope
and limitation and treatment in other legal systems
Drafting A rbitration clauses i n Contracts, Arb itration agree ments A ppointment
process
Arbitration and Government: Various forms and procedures.
Day 2: term s of re ference, Arbitral award, Venu e a nd seat of a rbitration, choice of law,
jurisdiction, confli ct o f interes t, pre hear ing process, dealing with factual, opin ion
and documentary evidences.
Day 3: Role of National Courts, Cost a nd remedies, Confidentiality, international arbitration
treaties, enf orcement of fore ign arbitral award and the arbitral rules of leading
international arbitration institutions, Investment arbitration
