Gurdev Nagar Ludhiana-141001 (Only Blood relation and Wife) as a Co-Applicant in the said
registration/allotment/flat/plot Agreement as per the terms and conditions set out therein.

INDEMNITY CUM UNDERTAKING


THIS Indemnity Bond is made on this 6th day of January, 2015 by Gurpreet Singh Sandhu S/o T.S
Sandhu aged about 49 years R/o 765 Gurdev Nagar Ludhiana-141001 hereinafter referred to as the
Indemnifier which includes his/her heirs, successors, executors, representative, assignees and
administrators on the ONE PART.
In favour of
M/s Emaar MGF Land limited a company incorporated under the Companies Act, 1956 having
its registered office at ECE House, 28, K.G.Marg, First Floor, New Delhi-110001 hereinafter referred
to as the Beneficiary which includes its Assigns, Nominees, Successors, etc. of the OTHER PART.
AND WHEREAS the Indemnifier had applied for registration/allotment/flat/plot no
in the
Residential project at Palm Terraces Select, Gurgaon, of the Beneficiary in lieu of which a
registration receipt dated _______ bearing No. _________ was issued to the Indemnifier allotting
him a Customer Code No. 81155 against payment of booking amount of Rs. 10,00,000/- (Rupees
Ten Lakhs only) vide cheque No. 815013 dated 18.07.10 drawn on HDFC BANK,KALKAJI Bank for
the registration/allotment/flat/plot Agreement of Apartment admeasuring approximately 2410 sq.
ft. The Indemnifier had executed a Property Buyers Agreement No. _______ dated 01.11.2010
with the Beneficiary / yet to execute a property Buyers agreement
AND WHEREAS the Indemnifier has till date paid an amount of Rs. 1,71,00,838/- (Rupees One
Crore Seventy Lakhs eight hundred and thirty eight only) as per the details of the receipts

AND WHEREAS the Indemnifier now declares that the money deposited by the Indemnifier is self
acquired out of his/her own sources and no one else has a right over it. The Indemnifier now wishes
to add the name of Ms. Amritah Sandhu D/o, Gurpreet Singh Sandhu R/o 765 Gurdev Nagar
Ludhiana-141001 (hereinafter referred to as the Co-applicant) as the Second Applicant in the
aforesaid registration/allotment/flat/plot Agreement without having received any consideration from
the Co-applicant, purely on account of natural love and affection.
AND WHEREAS the Indemnifier is making the addition of the name of the Co-Applicant in the
registration/allotment/flat/plot Agreement voluntarily and out of his own free will without any
coercion from any one.
NOW THIS INDEMNITY CUM UNDERTAKING WITNESSES AS UNDER:

1.

That I had applied for registration Agreement of a flat in the Residential project at Palm
Terraces Select, Gurgaon of the Beneficiary and had paid an amount of Rs. 1,71,00,838/- till
date. That the Indemnifier undertakes and declares that the amounts paid for the aforesaid
registration/allotment/flat/plot Agreement are from his/her self acquired income and is not
ancestral and no one else has a right or claim over it.

2.

That on account of natural love and affection the Indemnifier wishes to add the name of the
Co-Applicant in the said registration/allotment/flat/plot Agreement. That the Indemnifier has
not received any consideration or gain from the Co-Applicant for the addition of the name of
the Co-Applicant in the registration/allotment/flat/plot Agreement and has made the
same voluntarily out of his own free will without any coercion from any one.

3.

That the Indemnifier along with the Co-Applicant shall have joint and equal rights, title,
claim or interest whatsoever in the said registration/allotment/flat/plot Agreement and any
amounts paid for the aforesaid purpose to the Beneficiary.

4.

Further that the Indemnifier undertakes to keep the Beneficiary, harmless and indemnified
against any claims, losses, damages, costs including litigation costs, etc. of all kinds
whatsoever suffered or incurred directly or indirectly or in any manner whatsoever while
acting on the representations of the Indemnifier by the Beneficiary in respect of the
aforesaid registration/allotment/flat/plot Agreement on account of any claim by any of the
legal heirs or any person claiming through him for addition of the name of the Co-applicant
in registration/allotment/flat/plot Agreement or from any legal and financial consequences
arising from any acts committed by the Indemnifier.

5.

Further the Indemnifier undertakes and agrees to indemnify the Beneficiary against any
claims, losses, damage, costs etc. which may be caused due to any claims made by the
Indemnifier or Co-Applicant or any person claiming under them on the basis of the original
receipts issued by the Beneficiary against the registration/allotment/flat/plot Buyers
Agreement.

6.

Incase due to such alteration in the name of the allottees, any liability whatsoever accrues
against the Beneficiary, in lieu of any statutory or other payments including but not limited
to stamp duty, taxes, cesses, etc., by whatever name called, the Indemnifier agrees and
undertakes to indemnify the Beneficiary from such liability without any protest, demur or
dispute.

7.

Further the Indemnifier undertakes and agrees that he/she along with the Co-Applicant
comply with all the rules and regulations laid down by the Beneficiary for
registration/allotment/flat/plot Agreement for the addition of his name along with
Indemnifier and shall execute all the necessary documents as may be required by
Beneficiary including terms and conditions of standard Flat/Plot Buyers Agreement.

I, Shri Gurpreet Singh Sandhu of Shri T.S Sandhu aged about 49 years R/o 765 Gurdev
Nagar Ludhiana-141001 do hereby solemnly affirm and declare as under:

That the Deponent had applied for registration/allotment/flat/plot no


PTS-07-0301 Buyers Agreement of a flat/plot/villa in the Residential project at
Palm Terraces Select, Gurgaon, of M/s Emaar-MGF Land Limited and has till date
paid an amount of Rs. 1,71,00,838/- (Rupees One Crore Seventy Lakhs eight
hundred and thirty eight only).

2.

That I on account of natural love and affection without any coercion from any
person outside, wish to add the name of Ms Amritah Sandhu D/o Gurpreet Singh
Sandhu R/o 765 Gurdev Nagar Ludhiana-141001 (Only Blood relation and
Wife) as a Co-Applicant in the aforesaid registration/allotment/flat/plot Buyers
Agreement. My relationship with the Original Applicant is father and daughter.

That I have not received any amount whatsoever for the aforesaid addition of the
name of the Co-Applicant in the registration/allotment/flat/plot Buyers
Agreement.

4.

That I have read and understood and agree and undertake to abide by all the
rules, regulations and terms and conditions as laid down by the Company for the
registration/allotment/flat/plot Buyers Agreement and also agree to execute
jointly with the Co-Applicant all other documents as may be required by the
Company including the standard Flat/Plot Buyers Agreement, as a co-Applicant.

5.

That I assure the Company and undertake to indemnify the Company to the
extent the Company suffers in case it is made to part with the sale price in whole
or in part and to this effect I am furnishing an Indemnity-cum-Undertaking in
favour of the Company.

Crore Seventy Lakhs eight hundred and thirty eight only).

That my relationship with the Original Applicant is father and daughter and he
has now made me the Co-Applicant on my request. That the Original Applicant

added
me
as
the
Co-Applicants
in
the
said
registration/allotment/flat/plot no Buyers Agreement vide their letter dated
01.11.submitted to the Company and I have no objection to the same.

That I have not paid any amount whatsoever for the aforesaid addition of my
name in the registration/allotment/flat/plot Buyers Agreement.

4.

That the Original Applicant has added my name as the Co-Applicant voluntarily
and out of his own free will without and coercion from any person outside and
out of natural love and affection.

5.

That I have read and understood and agree and undertake to abide by all the
rules, regulations and terms and conditions as laid down by the Company for the
registration/allotment/flat/plot Buyers Agreement and also agree to execute all
other documents as may be required by the Company including the standard
Flat/Plot Buyers Agreement, as a co-Applicant.
