Sec.6.(a)Thepostsecondaryproprietaryeducationalinstitutionshallpayarefundtothestudentintheamountcalculatedundertherefundpolicy
specifiedinthissectionorasotherwiseapprovedbythecommission.Theinstitutionmustmaketheproperrefundnolaterthanthirtyone(31)daysof
thestudent'srequestforcancellationorwithdrawal.
(b)Thefollowingrefundpolicyappliestoeachresidentpostsecondaryproprietaryeducationalinstitution,exceptasnotedinsection4.5ofthisrule:
(1)Astudentisentitledtoafullrefundifone(1)ormoreofthefollowingcriteriaaremet:
(A)Thestudentcancelstheenrollmentagreementorenrollmentapplicationwithinsix(6)businessdaysaftersigning.
(B)Thestudentdoesnotmeetthepostsecondaryproprietaryeducationalinstitution'sminimumadmission
requirements.
(C)Thestudent'senrollmentwasprocuredasaresultofamisrepresentationinthewrittenmaterialsutilizedbythe
postsecondaryproprietaryeducationalinstitution.
(D)Ifthestudenthasnotvisitedthepostsecondaryeducationalinstitutionpriortoenrollment,and,upontouringthe
institutionorattendingtheregularlyscheduledorientation/classes,thestudentwithdrewfromtheprogramwithin
three(3)days.
(2)Astudentwithdrawingfromaninstructionalprogram,afterstartingtheinstructionalprogramatapostsecondary
proprietaryinstitutionandattendingone(1)weekorless,isentitledtoarefundofninetypercent(90%)ofthecostofthefinancialobligation,lessan
application/enrollmentfeeoftenpercent(10%)ofthetotaltuition,nottoexceedonehundreddollars($100).
(3)Astudentwithdrawingfromaninstructionalprogram,afterattendingmorethanone(1)weekbutequaltoorlessthantwentyfivepercent(25%)of
thedurationoftheinstructionalprogram,isentitledtoarefundofseventyfivepercent(75%)ofthecostofthefinancialobligation,lessan
application/enrollmentfeeoftenpercent(10%)ofthetotaltuition,nottoexceedonehundreddollars($100).
(4)Astudentwithdrawingfromaninstructionalprogram,afterattendingmorethantwentyfivepercent(25%)butequaltoorlessthanfiftypercent
(50%)ofthedurationoftheinstructionalprogram,isentitledtoarefundoffiftypercent(50%)ofthecostofthefinancialobligation,lessan
application/enrollmentfeeoftenpercent(10%)ofthetotaltuition,nottoexceedonehundreddollars($100).
(5)Astudentwithdrawingfromaninstructionalprogram,afterattendingmorethanfiftypercent(50%)butequaltoorlessthansixtypercent(60%)of
thedurationoftheinstructionalprogram,isentitledtoarefundoffortypercent(40%)ofthecostofthefinancialobligation,lessan
application/enrollmentfeeoftenpercent(10%)ofthetotaltuition,nottoexceedonehundreddollars($100).
(6)Astudentwithdrawingfromaninstitutionalprogram,afterattendingmorethansixtypercent(60%)ofthedurationoftheinstructionalprogram,is

thecourseasrequiredbyVeteranAdministrationregulation.Therefundwillbewithin10%(percent)ofanexactproratarefund.Nomorethan$10.00
oftheestablishedregistrationfeewillberetainedifaveteranoreligiblepersonfailstoenterandcompletethecourse.
Thecodestatesthattheexactprorationwillbedeterminedontheratioofthenumberofdaysofinstructioncompletedbythestudenttothetotal
