MUNICIPAL ORDINANCE NO. 05-2012

AMENDING SOME SECTIONS OF ORDINANCE NO. 01-2001, AS AMENDED
OTHERWISE KNOWN AS THE TOWN FIESTA ORDINANCE OF GUINOBATAN,
ALBAY.

BE IT ORDAINED, by the Sangguniang Bayan of Guinobatan, Albay in session assembled

that:
SECTION 1. Amendatory Provisions.
(a) Section 2 of Municipal Ordinance No. 01-2011, as amended, is hereby further
amended to read as follows, to wit:

SECTION 2. Municipal Roads/Streets to be closed. The

following municipal roads and/or streets are hereby lifted
from public servitude or closed temporarily from July 20
August 20, to be utilized by transient vendors and as
area/space for feria, rides and parlor games every fiesta
celebration of the munipality x x x
(b) Section 3 of Municipal Ordinance No. 01-2001, as amended, is hereby further
amended to include the following provision which shall be designated as paragraph (f):

f. The following fees shall be imposed/charged in

connection with the provision of electrification in the
places/premises to be utilized by transmit vendors during
Fiesta Season, to wit:
(1) An Application Fee in the amount of PhP 500.00, which
shall be non-refundable, shall be imposed/charged upon
all entity/person desiring to provide such electrification;
and

(2) A privilege Fee with a floor price of PhP 6,400.00 shall

be imposed/charged upon the winning entity/person in
the bidding conducted for the purpose, who shall be
given/granted a Certificate of Award only upon payment
of the same.
Provided, however, that no operator/owner of such entity
shall be granted the privilege of providing such necessary
electrification without processing the following qualification,
to wit:
a. A bonafide resident of the Municipality of Guinobatan;
and,
b. A duly licensed/registered Electrification Engineer or duly
authorized by the Albay Electric Cooperative (ALECO)
Provided further, that in case there had been a failure to
bid, or if no person/entity applied for the same, the LGUGuinobatan shall provide for the necessary electrification
within such place/premise utilized by transient vendors
during the duration of the Fiesta Season.
(c) Section 4(c) of Municipal Ordinance No. 01-2001, as amended, is hereby amended to
read as follows:

c. All vendors for dry goods, plastic & glass wares and
similar items shall be allowed to apply for a maximum of
five (5) stalls only x x x.
SECTION 2. Separability Clause. If, for any reason or reasons, any part or provision of this
Ordinance shall be held to be unconstitutional or invalid, other parts or provisions
hereof which are not affected thereby shall continue to be in full force and effect.
SECTION 3. Repealing Clause. Municipal Ordinance No. 01-2001 and any other ordinances
or part or parts thereof which are inconsistent with any of the provisions of this
Ordinance are hereby amended or modified accordingly.

SECTION 4.Effectivity. This ordinance shall take effect upon review and approval of
the Sangguniang Panlalawigan and completion of the required publication
and upon approval of the Municipal Mayor.
