UNDUE ADVANTAGE
The information enabled Aon
to quote as its bid price, the precise amount constituting the annual
teachers medical allowance. The budget for the financial year was approximately Sh5.6 billion while their bid
price was Sh5.59 billion, TSC said.
This information was not available
to the other bidders and it gaveAon
undue advantage, the commission
added.
The insurance firm, however, argued that any issues of conflict of interest ought to have been raised and
determined during the tender evaluation process, not after the award and
acceptance.
The applicants (Aon) bid complied with each and all the requirements set out in section 43 of the
Act (PPDA), Aons document partly reads.
TSC also claimed that Aon varied specifications of maternity, optical and dental components from
free-for-service to capitation. The
commission argued that changing
the model would amount to varying
tender specifications contrary to the
procurement Act.

of the medical scheme to the two

the teachers unions were briefed and

saying the capitation model for outpatient cover and theexecution of the
contract were approved.
But the teachers employer said
Aon did not demonstrate and provide a biometric infrastructure with
a member identification solution that
identifies members through finger
capture as required.
Maintenance Levy
The lawyer pointed out

Levy Fund Act which came into force in 1993, provides for
the imposition of levies on petroleum fuels including diesel
and is payable by motorists as
part of their fuel costs.

to digital television broadcasting has
become a do-or-die affair for Kenya.
Contrary to claims by the Government, it was the industry regulator that sent technicians to switch off
the analogue transmitters belonging
to the countrys independent television stations KTN, NTV and Citizen
TV. The three have been off air since
Saturday.
The stations have steadfastly resisted attempts to force them, in defiance of copyright laws, to hand over
content that they generate at great
cost to foreign-owned television firms
for free, who would then have charged
the public a fee to watch the same.
The three stations had asked the
regulator for more time to import
their transmitters and digital set-top
boxes in line with the self provisioning licence granted to them.
The media owners representatives
are to appear before the committee to
explain their concerns with the regulator.
We will see if we can have a tripartite meeting to deliberate on this
matter so that we can get a way forward, said the Committee chairman
Jamleck Kamau, MP for Kigumo.
The matter also featured in the
Senate, where Siaya Senator James
Orengo gave notice for adjournment
of House business to discuss the digital migration row.
But while Opposition senators
rose to support the adjournment, on
the Government side, only Senator
Steven ole Ntutu (Narok) rose to back
the motion.
Speaker Ekwee Ethuro ruled that
the House adjourn at 5.30pm to discuss the matter, after dispensing with
other pending bills.
After 5pm, Senator Kipchumba
Murkomen (Elgeyo/Marakwet) said
there wasnt adequate time to discuss
the motion yet it had attracted immense interest. The Senate will therefore debate the motion today.
Earlier in Parliament, Kamau
asked the Government officials why
it was difficult to grant the three media houses an extension to prepare for
the switchover considering the international deadline is in June.

POOR SIGNALS
While some grappled with poor
signals, others said they had no
clue what kind of set-top boxes they
should buy.
Some residents who had purchased decoders from a pay television operator said they had problems
receiving digital signals due to either
poor equipment or poor signal distri-
bution.
Some of the decoders in the market include Zuku, Multichoice and
StarTimes, the least costing Sh4,000
besides the monthly viewing charges, which range from Sh500 to Sh850.

either very poor or not available.

Lands Cabinet Secretary Charity Ngilu has explained why she disowned a report prepared by a joint
committee of the ministry and the
National Lands Commission (NLC)
designed to end persistent wrangles
between the two parties.
MsNgilu yesterday told the National Assemblys Constitution Implementation Oversight Committee that
she could not accept the report because the officers, who are purported
to have represented the ministry, did
not have her blessings and mandate.
The report was to ensure that recommendations contained in an accord signed by Ngilu and NLC Chairman Muhammad Swazuri, in the
presence of President Uhuru Kenyatta, were implemented to end the
stalemate.

when she insisted that she could not
honour the report, despite admission
by her Principal Secretary Mariam El
Maawy that she is the one who nominated the three officers who sat in the
joint committee that prepared the report. El Maawy said only officers appointed by Ngilu could have represented the ministry because she was
the one who signed the accord.

The National Treasury has
ordered all Cabinet secretaries
to give an audit of their spending so far in order to free all the
money that is unlikely to be
spent in the next four months
and divert it to urgent projects.
The order came even as
Treasury revealed that it had
rejected a Sh60 billion additional funds request from ministries.
Treasury Cabinet Secretary
Henry Rotich told a parliamentary committee that the memo
to the ministries targeted projects that were yet to begin but
whose ground-breaking was
expected in the current financial year.
They have to give us the
status of the expenditure so
we can see what to rationalise.
Clearly, there are some projects that have not taken off,
said Mr Rotich at a meeting
with the Budget and Appropriations Committee in Nairobis
County Hall yesterday.
The deadline for the ministries is end of this month so
the National Treasury can prepare the Supplementary Appropriations Act to legalise the
planned re-allocations.
Rotich said the ministries
had asked for a total of Sh118
billion in the supplementary budget, but he had rejected
the requests that appeared to
be impulsive.

which was expected to lower the cost of electricity by 40 per cent towards the end of 2014.
However, there has been little or no change
in power bills and the fuel levy has remained
constant despite the significant drop in fuel
prices.
These costs are usually passed on to the
consumer who often has no recourse for help.
The only reduction that has benefited the
common man is the lowering of the price of
kerosene which shed off almost Sh14 per litre.
While the drop is welcome, extensive use of
paraffin contributes greatly to greenhouse
emissions that impact negatively on the climate. So one gain is offset by another.
The unfortunate thing is that most households in Kenya cannot afford to use gas hence
the heavy reliance on paraffin and wanton felling of trees. The cost of living remains high.
The prices of essential commodities like
flour, milk, bread and sugar remain high despite industries operating on a lower budget in
terms of energy usage.
Of great concern, however, is the fact that
the area in which the ordinary Kenyan expected relief was in the lowering of fares by public
service vehicle operators. This has not happened.
In the past, whenever fuel prices went up,
fares would shoot up almost immediately. It is
worth noting that despite four consecutive
drops; fares have remained the same.
Industry operators have been reluctant to
let citizens enjoy the drop in fuel prices.

involving the Government.
No Government lawyer wants
to be told that a lost case is over
and will not be appealed, so the
Solicitor-Generals decisions not
to go forward may leave disgruntled feelings in other legal offices.
Resignation of a Solicitor General is only possible by way of a
letter addressed to the President.
The President may however,
remove from office the Solicitor
General on ground of serious violation of the Constitution or any
other law, gross misconduct, incompetency, physical incapacitation or bankruptcy.
In the event of the Attorney
General becoming incapacitated
or otherwise unable to perform
his constitutional duties, for
whatever reason, can the Solicitor
General take over?
The answer to that question is
a moot point. In Kenya the roles
of the Solicitor Generals office,
which is presently occupied by
Njee Muturi and his Deputy Muthoni Kimani, are vital in assisting
the State legal agencies.
In times to come the contribution of Solicitor Generals will undoubtedly manifest positively and
hopefully legal services in their
docket will improve for the better.

point I agree. But as much as I
agree with him, there are some
painful realities that we must accept as Kenyans.
First, no one ever held a gun at
someones head to listen to a particular station or read a particular
webpage or news report.
There is always the element of
choice enabled through consumer agency: the dial button on radio or the remote control on TV.
The choice of what to read and
what not to read are all within the
readers discretion, it is never coerced.
Second, just as a people deserve their leaders however myopic or infantile their manners are,
a people too deserve their media.
Our media reflects our sensibilities and our identities.
Our media is truly us, a mirror
of ourselves, our values, fears and
aspirations. That is the truth.

For the few months the country
has gone without rains, the drainage

Concerned authorities should realise that long rains could start any
time and therefore there is urgent
need to unblock drainage systems.
We should not wait for the rains
to wreak havoc before swinging into action.
Those who have encroached on
road reserves and any public land
should also be evicted and prosecuted.
Farmers should also use this time
to dig terraces to control soil erosion.

George Muchai and his three aides.
At the burial of the last aide,Stephen Wambugu, who was Muchais
driver, four legislators - Kiambu Senator Kimani Wamatangi and MPs
Paul Koinange (Kiambu), John Kiragu
(Limuru) and Kabando wa Kabando
(Mukurweini), asked Kenyans to let
police and the courts handle the matter without undue speculation.
The ball was set rolling by Kihara
Warui, the late MPs personal assistant, when he asked people to stop
speculating about the deaths following confessions by suspects in custody that they killed the MP and his
aides to avoid being shot by the bodyguards after a normal carjacking.

Mr Warui, who said he was usually the fifth passenger in the MPs
car, said he parted company with the
ill-fated party at 4pm, at the end of
their workday, only for the MP to die
12 hours later.
MPs Kabando and Koinange also
cautioned against speculation, with

investigations into the incident.
What we want to say is that if
anyone paid for the MPs elimination, God would punish him even if

The Kenya Medical Supplies Agency (Kemsa) has entered in a partnership with county governments to
manage medical supplies in county
hospitals.
Governor Kinuthia Mbugua lauded the agency for embracing devolution and adopting a new business
model that partners with the counties.
Mr Mbugua said achieving integrated healthcare services is a key
objective of devolved governance and
will fill gaps that existed in the previous centralised system.
The Kemsa supermarket model has proved very useful in availing
quality and affordable medical supplies to the counties of which all Rift
Valley counties are beneficiaries, he
said.

The recognition of JKIA comes after the opening of the new Terminal 1A. The terminal, which
has three floors and includes duty free shops,
a food court, customer lounges, a mini market
among other facilities, has a capacity to handle
one-way peak hour traffic of 1,500 passengers.
The terminal has improved customer experience at JKIA, besides guaranteeing operational
efficiency, boosting security and improved quality of service to airport users.
On-going works at the airport include construction of Terminal 2, expected to be opened
at the end of this month. The new prefab terminal has a capacity to handle 2.5 million passengers annually and will cater for both international and domestic departures and arrivals.
The capacity injected by the new terminal
brings the capacity of JKIA to 7.5 million passengers annually. At the moment it handles an
estimated 6.5 million passengers annually.

Opposition outrage roils
South African parliament
The South African parliament
is supposed to be a sanctuary for
decorum. These days, it is anything
but. Yesterday, an opposition party
complained in parliament that their
chief had been called a cockroach
by the assembly speaker. A top
member of another opposition group
described President Jacob Zuma, who
was in the chamber at the time, as
a broken man who will eventually
be swept from power. Last week,
security guards entered parliament
to remove opposition lawmakers who
disrupted an annual address by Zuma
to demand that he answer questions
about a scandal. The ruling party has
dominated politics since 1994.

Taliban kill 28 in attacks on security forces
Four suicide attackers yesterday stormed a provincial
police headquarters in eastern Afghanistan, killing 22 police,
an official said. Taliban insurgents immediately claimed
responsibility. The attack in Logar province outside the capital,
Kabul, was the latest to target Afghan security forces following
the withdrawal of most foreign combat troops at the end of
last year. In neighbouring Pakistan, another Taliban suicide
attack on a provincial police headquarters killed at least seven
people in the eastern city of Lahore, in what militants called
a revenge bid for the recent hangings of their colleagues.
The Afghan and Pakistani Taliban are separate groups that
share the goal of establishing hard-line Islamic rule. In the
Afghan assault, the four attackers rushed to the gates of the
police compound in early afternoon, with one detonating
his explosives-filled vest at the main gate and killing one
policeman, a state official said.

Russia coach promoted
Russia has reappointed a scandalhit athletics coach to a senior
position less than a month after
he resigned amid several doping
scandals. Valentin Maslakov served
as head coach of the Russian
national team from 2007 until
last month, when he stepped
down shortly after doping bans
were handed to three Russian
Olympic champion race-walkers.
The Russian athletics federation
said Maslakov has now been
named the senior coach for
sprinting. Valentin Balakhnichev
said he would resign as athletics

Cabinet Secretary must unlock legal
complications to act on FKF and KPL

The Football Kenya Federation (FKF) and Kenyan
Premier League (KPL) factions meet today to end the
impasse of running the 2015 top tier league, as ordered
by Sports Cabinet Secretary Hassan Wario on Monday.
But even so, authorities, who include the Cabinet
Secretary himself, face a legal conundrum which must
be unlocked and interpreted soberly to find a way of
dealing with the matter effectively.
FKF has not applied for registration as required under the Sports Act 2013. Article 49 (3) says: An existing
sports organisation that does not apply for registration
within the time prescribed in subsection (1), shall not
be recognised as a sports organisation for the purposes of this Act.
KPL has already applied to be registered under the
Act, but FKF insists on remaining under the Societies
Act, according to what the Vice President Robert Asembo said in a recent interview with The Standard.
This could force the Sports Registrar under article
49 (1) to withdraw recognition of FKF as a sports organisation.
KPL, on the other hand, could easily fall under the
Act, if section 3 of Article 49 is applied: Provided that
an existing sports organisation in respect of which
(a) an application for registration has been made by it
under subsection (1) and has not been rejected; or (b)
an appeal has been lawfully made under this Act and
remains undetermined, shall continue to be recognised as a sports organisation for the purposes of
this Act.
If the Cabinet Secretary wants to act on FKF and
KPL if they fail to agree on the way forward, as is widely speculated, he will first of all want to deal with this
matter of registration. Does FKF fall under his jurisdiction to enable him to deal with it?
RETAINING 16 CLUBS
Among the sticky issues in this impasse is the composition of the KPL, with FKF preferring 18 teams and
their nemesis insisting on retaining 16 clubs as recommended by a Fifa expert consultant.
The other issues causing differences between the
FKF and KPL are extension of contract with SuperSport
for five years and promotion of three teams - Shabana,
Homeboyz and Nakumatt - to the top league.
Article 54 (1) of the Act will also cause problems for
Wario. It says he can only intervene where a sports associations fails to comply with the recommendations
of an inspection.

Sports Secretary Japhter Rugut
was yesterday appointed to lead mediation between Kenya Rugby Union
(KRU) factions.
Some 30 clubs met last week
(Tuesday) and resolved to send the
entire KRU board packing, and have
a former vice chairman, Sasha Mutai, named to lead an interim committee to run the sport for a year and
organise elections.
But the Government took charge
of the sport yesterday and appointed Rugut to spearhead mediation
between Mutais side and the one
led by acting chairman Gabriel
Ouko.
Yes we met both boards today - the KRU board and the one
which purportedly came into office. A decision was made that we
should set a date next week to try
and bring them together, Rugut told
FeverPitch.
I was appointed to lead the mediation process and we hope for the
best. The decision to agree on the
way forward will have to come from
them, he said. The meeting was
chaired by Sports Cabinet Secretary
Hassan Wario.

Vetting delayed the Athletics Kenya team
selections for the 12th African Junior Athletics
Championships at the Nyayo National Stadium yesterday.
Officials spent the better part of the morning and afternoon verifying athletes birth certificates for the biennial showpiece, which is restricted to boys and girls aged 18 and 19 years.
Athletics Kenya will use the two-day showpiece to pick a team to the 12th African Junior
Athletics Championships that runs in Addis
Ababa, Ethiopia, from March 3-8.
The spectacle, which started at 4pm, lived

enyas push for universal family planning services to women and girls appear to be
bearing fruits. The uptake of
modern contraceptive by women in
the country is on the rise, with Nairobis rate climbing to 53 per cent
from 44 per cent.
Regions like Kisumu have already
hit the targeted 56 per cent in line
with the Governments 2012-2016
National Family Planning Implementation Plan.
Among other objectives, the plan
outlines the countrys strategy for increasing modern contraceptive from
46 per cent to 56 per cent by end of
this year.
A report released early November
by a global partnership known as
Family Planning 2020 (FP2020) has
shown that Kenya has made significant gains in access to family planning services and information.
According to the report, the country has added 290,000 new family
planning users since 2012. It also
shows that the use of modern contraceptives helped avert more than
one million unintended pregnancies and nearly 3,600 maternal
deaths in Kenya.
All this goes to show that Kenya is
on the right track in improving the
life of the woman. At least this is the
impression one gets from a distance.
But, it is only when one zooms in to
take a close-up look at what this really means, especially for communities that appear to have been left behind or forgotten in this effort, does
one begin to get a clearer picture.
A case in point is the isolated
community found in the Internally
Displaced Persons (IDPs) camps of
Majani Mingi, Lomolo A and Lomolo B, located in Rongai constituency,
Makongeni sub-location of Nakuru
County.

Everyone experiences spells of worry
and dread at some time or another. But
when anxiety is chronic, it becomes a
medical problem and a doctor should be
consulted. Though it is a psychological
state, anxiety manifests itself in physical
symptoms, and a growing body of
medical opinion argues that diet can help
to ease, and may even eliminate some of
it.
Physical symptoms include a dry
mouth, sweating, breathlessness, a
thudding heart, dizziness, chest pains, diarrhoea and fatigue. Anxiety may also
undermine the immune system.
A loss of appetite may disrupt normal
eating patterns. As a result, low food
intake can lead to loss of weight as well
as inadequate nutrition.
There is evidence that lack of
magnesium and vitamin B6 is associated
with anxiety and, when under stress, the
body rapidly uses up reserves of vitamin
C; those suffering from chronic anxiety
will often benefit from increased intake.
Avoiding food can lead not only to
increased anxiety, but to the risk of other
problems developing such as heartburn.
Caffeine - found in coffee, tea and
some cola drinks, as well as in plain dark
chocolate - is a stimulant. In small doses,
it can enhance both mental and physical
performance, but in larger amounts, it
can lead to agitation, particularly among
people who are sensitive to caffeine.

reach for a drink, but this is likely to
make them feel worse, not better. During

Many are incredibly cheerful, and
talk of their future with boundless
hope and anticipation. They are eager to acquire education. They talk of
the various careers they want to pursue.
Barely a year since the school was
established, its population has shot
up to 7,433 pupils who learn in 25
crowded classrooms.
The walls and roofs are made of
iron sheets. The learners squeeze
themselves in with up to six sharing
a desk meant for three.
Many of the younger pupils share
desks, while others are forced to sit
on the floor.
A standard classroom is supposed
to have 45 pupils, but most classrooms here have more than 150.
When the school was started in
February last year with only 100 pupils, it was housed in tents for five
months.
Later, the tents were replaced
with iron sheet structures. The institution is situated a few metres from
Kakuma refugee camp, in Turkana
County.
The school has refugees from five
nations, but over 70 per cent of them
are South Sudanese who have escaped civil war in their country that
has claimed close to 10,000 lives in

job market is flooded, the political
arena is flooded, the business market
is flooded and one can only make it
if they have an outstanding idea or
know the right people.
It is as a result of this competition
that most parents take their children
to boarding primary schools.
Apart from the fact that they are
busy and hardly have time to be at
home with their children, the main
reason is that the children will perform better when they are in a boarding environment.

can only do so much. When I was a
teacher, I witnessed situations where
parents would request me to speak to
their daughters, who were my students,
since they had become difficult at home
and would never listen to their parents.
I always wondered why a child would revolt against their parents.
Your child is your responsibility.
Spend quality time with them in their
childhood before you release them to the
world. You will be proud of what you did
because your child will make you proud.
