Medical disciplinary. According to thefreedictionary.com, medical means of or relating to

the study or practice of medicine, while disciplinary means of or relating to or used for
discipline. Another definition from Merriam Webster online dictionary, disciplinary means
intended to correct or punish bad behavior, while medical means of or relating to the treatment of
diseases and injuries. So overall, medical disciplinary means how medical practiotioners, doctors
and dentists, are supposed to act in a particular situation or respond to a particular situation.
In other countries like USA, Ireland, Uganda, and many more, laws about medical
disciplinary are found and written in Medical Practitioners Act, while in Indonesia it is found and
written in Himpunan Peraturan tentang Majelis Kehormatan Disiplin Kedokteran Indonesia,
MKDKI for short. A council is established and is known as the Medical and Dental Practitioners
Council which has the right to sue or be sued in its corporate name and, subject to this Act, may
suffer all other thing and acts as bodies corporate may lawfully do or suffer. In Indonesia this
council is known as Majelis Kehormatan Disiplin Kedokteran Indonesia.
MKDKI is an autonomous agency of the Indonesian Medical Council (KKI) which is
independent in carrying out their duties. They are competent authorities which are able to: (1)
Determine the presence or absence of mistakes made by doctors and dentists in the discipline of
medicine and dentistry. (2) Disciplinary sanctions. It is for doctors and dentist. There function is
to uphold doctor and dentists discipline while practicing.
According to MKDKI, the purposes of disciplinary are as the followings:
a) Provide protection to the patient.
b) Maintaining the quality of the doctor / dentist.
c) Maintain professional honor medical / dental.
According to The Medical and Dental Practitioners Act, the council has functions as
following:
a) to monitor and exercise general supervision and control over and maintenance of
professional medical and dental educational standards, including continuing education
b) to promote the maintenance and enforcement of professional medical and dental ethics;
c) to exercise general supervision of medical and dental practice at all levels;
d) to exercise disciplinary control over medical and dental practitioners;
e) to protect society from abuse of medical and dental care and research on human beings;
f) to advise and make recommendations to the Government on matters relating to the
medical and dental professions;
g) to exercise any power and perform any duty authorized or required by this Act or any
other law;
h) to disseminate to the medical and dental practitioners and the public, ethics relating to
doctor-patient rights and obligations; and
i) for the purposes of discharging its functions under this Act, to perform any other function
or act relating to medical or dental practice as the Minister may direct.

There are two types of MKDKI if classified by their location: MKDKI and MKDKI-P.
MKDKI is located at the capital city of Indonesia, and MKDKI-P is located at a province.
MKDKI is an institution that has the authority to determine whether there was an error made by
a doctor or a dentist in medical disciplinary application and determine sanctions against them.
While MKDKI-P is an institution that has the authority to determine whether there was an error
made by a doctor or a dentist at a particular province, in medical disciplinary application and
determine sanctions against them.
MKDKIs job is to concede a complaint, investigate and determine the case that has been
submitted, and construct guidelines and procedures in handling the case. MKDKI-Ps job is to

MKDKI, in carrying out the tasks have the authority to:

receive complaints of violations of physicians and dentists discipline;

specifies the type of complaints of violations of discipline or ethics violations or not both;
examine complaints of violations of discipline physicians and dentists;
decide whether there is breach of discipline physicians and dentists;
determine disciplinary sanctions against doctors and dentists;
MKDKI implementing decisions;
formulate procedures for handling disciplinary cases doctors and physicians teeth;
preparing manuals and MKDKI MKDKI-P;
develop, coordinate and oversee the implementation of the tasks MKDKI-P;
make proposals and give consideration MKDKI-P formation the Indonesian Medical
Council, and
k) the socialization, education, and dissemination of MKDKI and and MKDKI-P notes and
documenting the complaint, investigation process, and MKDKI decision.
According to The Medical and Dental Practitioners Act, the council are to take offences to
consideration if any person who are:
a) willfully and falsely uses any name or title implying a qualification to practise medicine,
surgery, dentistry;
b) not being registered or authorised under this Act practices whether openly or impliedly as
a medical or dental practitioner;
c) willfully procures or attempts to procure himself or herself to be registered under this Act
by false or fraudulent representation either verbally or in writing;
d) having been summoned by the council fails
to attend as a witness;
to produce any books or documents which he or she is required to produce
without reasonable cause;
e) refuses, without lawful excuse, to answer any question put to him or her in the course of
the proceedings of the council; or

f) Contravenes any other provision of this Act, commits an offence and is liable on
conviction to a fine of not less than three hundred thousand shillings and not more than
three million shillings or to imprisonment for not less than three months and not more
than one year or to both.
MKDKI leadership consists of a chairman, a vice chairman, and a secretary. MKDKI are
selected and determined by leadership of the plenary meeting and members are set by the
Chairman of the Indonesian Medical Council (KKI). MKDKI membership consists of 3 (three)
doctors and 3 (three) persons dentists of society together each profession, a physician and dentist
represent hospital associations, and 3 (three) law degree.
