Jubilee Government Delegation unsubstantiated Claims at 24th AU Summit on ICC


Nairobi, Kenya Friday, January 30, 2015/Jubilee Government policy, both locally and
internationally, fail to embrace culture of accountability that stigmatizes impunity. It articulates
and acts no concrete sensible steps tackling endemic impunity legacy. Jubilee Government has
never outlined, in detail, its policy on respect for human rights and commitment to ending longstanding culture of impunity in the Kenya. The level of impunity enjoyed by top government
and political leaders is horrifying.
For Jubilee Government to make claims that International Criminal Court supports and funds
terrorists is outrageous and outlandish. In the 24th African Union Summit, Jubilee government
and its one-sided yes-sayer delegation, appalling, continues to support and defend impunity for
perpetrators of serious atrocious rather than strengthening credible mechanisms that stem a
worrying tide of impunity.
It is very encouraging that majority of African Countries have known the truth behind the
mischievous, dirt and shameful campaign against International Criminal Court being
spearheaded by Jubilee government and they have decided to stand with the Court. They have
asserted their support to the Court. This campaign is personal interest driven and not
beneficial to the long-term interest of people of Kenya.
Government of Kenya has had very opportunity accorded to it to present its case both at
Assembly of States Parties and in the court with dismal convincing. If it is genuine in claims of
supporting credible criminal accountability why has it failed to set an impartial, credible and
effective local tribunal to prosecute perpetrators of heinous 2007/8 crimes? Propaganda is
short-lived. People of Kenya have systematically, ruthlessly and adversely been affected by
corrosive culture of impunity prevailing in the country because perpetrators are in full certain
knowledge that there will be no consequences.
For a government expecting to be taken seriously globally, to make unsubstantiated claims that
ICC is working and funding terrorists in Kenya, smack of desperation to attract international
sympathy, and significantly destroy reputation and image of Kenya internationally. This
disastrous claim is consistent with Jubilee government policy of linking political opposition and
human rights groups that stand firmly for accountability and justice to supporting with
terrorism in an attempt to silence criticism to government policies and curtail constitutional
guaranteed civil liberties. Government has never provided any evidence to support its
horrendous claims.
In the domestic front, Jubilee Government does not eschew violations of basic freedoms. It is
determined to protect unsustainable, unjust kleptocratic political and economic system. Jubilee
government is lethargic to accountability, fosters intolerance, entrench impunity and disdain
building of inclusive democratic culture.

Finally, it is appalling that the vast majority of survivors never receive justice, support or
recognition despite years of waiting, and that it is victims, not the perpetrators, who still bear
the shame and stigma. Kenya is trapped in unresolved grievances that pose potential of fueling
further cycles of violence and conflict in the future. Where there is no justice or dignity the
seeds of future violence are sown. People of Kenya (Jubilee Government not interested) can
grasp the opportunity to shatter the culture of impunity once and for all.
