I, Bandaru Peda Venkata Narasimham S/o Late Kondaiah, aged 74 years,
Chagollu Village, Ulavapadu Mandal, now residing at Gaddalagunta, Ongole,
Prakasam District, do hereby solemnly affirm and sincerely state as follows:I am the deponent herein and 4th petitioner in the main O.P.

The O.P. is

filed for compensation for the death of my son, who died in a motor accident.
Later the matter was decreed for an amount of Rs.10,04,400/- with interest and
costs on 15-12-2010. The 3rd respondent deposited an amount of Rs.25,000/- in
to the Honble Court and preferred an Appeal before the Honble High Court of
A.P., in M.A.C.M.A.M.P.No.3646/2011 in S.R.No.33168/2011, dt.06-09-2011
for stay the execution of decree and judgment passed in M.V.O.P.379/2008 and
after hearing, the Honble High Court passed order that There shall be
interim stay as prayed for, subject to the condition of the petitionerappellant depositing 50% of the amount awarded by the Tribunal, within a
period of six weeks from today. In default, the stay stands vacated without
further reference to the court. On such deposit, the respondent-claimants
are permitted to withdraw the amounts as ordered by the Tribunal.

On

10-10-2011 the 3rd respondent deposited an amount of Rs.6,49,625/- into the


Court and in total amount of Rs.6,74,625/-.

This Honble Court awarded an

amount of Rs.1,00,000/- with interest and costs towards my share of


compensation amount as per decree direction. I am entitled to withdraw entire
compensation on the deposited amount towards my share of compensation is
Rs.67,167/-. I am entitled to withdraw an amount of Rs.67,167/- only as per
decree direction. We filed an Appeal before the Honble High Court of A.P. in
C.M.A.753/2011 for enhancement on the compensation amount and the same
was pending. I am entitled to withdraw the same and there are no Attachments
or Stay or Appeal on the said amount. I, under take that if the Honble Court

directs me to re-deposit the amount, I will deposit the same. I am herewith


filing my Bank Pass-Book.
Hence I pray that this Honble Court may be pleased to issue a cheque for
Rs.67,167/- (Rupees Sixty seven thousand and one hundred sixty seven Only)
in favour of the Branch Manager, State Bank of India, Chakicherla Branch,
Prakasam District, and he may be directed her to credit the same to the S.B.A/c
No.31998772981of the petitioner in the interests of justice.

DEPONENT
Solemnly affirmed and affixed his L.T.I. before me the contents of the affidavit
is read over and explained in Telugu to the deponent and admitted him to be
correct on this the day of November, 2011.
